An editorial in the Washington Post published hours before the 9/11 attacks reads, “When it comes to foreign policy, we have a tongue-tied administration. After almost eight months in office, neither President Bush nor Secretary of State Colin Powell has made any comprehensive statement on foreign policy. It is hard to think of another administration that has done so little to explain what it wants to do in foreign policy.” (Abramowitz 9/11/2001) Two months before Bush’s election, many key members of Bush’s future administration signed a Project for the New American Century report that advocates a very aggressive US foreign policy. One British Member of Parliament will later call it a “blueprint for US world domination”(see September 2000). Yet there has been little sign of the foreign policy goals advocated in this report in the eight months before 9/11.

Exercise Includes Simulated Attack on the US - Vigilant Guardian is described as “an exercise that would pose an imaginary crisis to North American Air Defense outposts nationwide”; as a “simulated air war”; and as “an air defense exercise simulating an attack on the United States.” According to the 9/11 Commission, it “postulated a bomber attack from the former Soviet Union.” (Seely 1/25/2002; Filson 2003, pp. 55 and 122; 9/11 Commission 7/24/2004, pp. 458) Vigilant Guardian is described as being held annually, and is one of NORAD’s four major annual exercises. (Filson 2003, pp. 41; Arkin 2005, pp. 545; GlobalSecurity (.org) 4/27/2005) However, one report says it takes place semi-annually. (Scott 6/3/2002) Accounts by participants vary on whether 9/11 is the second, third, or fourth day of the exercise. (Code One Magazine 1/2002; Seely 1/25/2002; Kampouris 9/11/2002) Vigilant Guardian is a command post exercise (CPX), and in at least some previous years was conducted in conjunction with Stratcom’s Global Guardian exercise and a US Space Command exercise called Apollo Guardian. (US Congress n.d.; Arkin 2005, pp. 545; GlobalSecurity (.org) 4/27/2005) All of NORAD is participating in Vigilant Guardian on 9/11. (Scott 6/3/2002)
Exercise Includes Simulated Hijacking - Vanity Fair reports that the “day’s exercise” (presumably Vigilant Guardian) is “designed to run a range of scenarios, including a ‘traditional’ simulated hijack in which politically motivated perpetrators commandeer an aircraft, land on a Cuba-like island, and seek asylum.” (Bronner 8/1/2006) However, at NEADS, most of the dozen or so staff on the operations floor have no idea what the exercise is going to entail and are ready for anything. (Cooper 8/5/2004)
NORAD Fully Staffed and Alert - NORAD is currently running a real-world operation named Operation Northern Vigilance (see September 9, 2001). It may also be conducting a field training exercise calling Amalgam Warrior on this morning (see 9:28 a.m. September 11, 2001). NORAD is thus fully staffed and alert, and senior officers are manning stations throughout the US. The entire chain of command will be in place and ready when the first hijacking is reported. An article later says, “In retrospect, the exercise would prove to be a serendipitous enabler of a rapid military response to terrorist attacks on September 11.” (Scott 6/3/2002; Kelly 12/5/2003) Colonel Robert Marr, in charge of NEADS, will say: “We had the fighters with a little more gas on board. A few more weapons on board.” (ABC News 9/11/2002) However, Deskins and other NORAD officials later are initially confused about whether the 9/11 attacks are real or part of the exercise (see (8:38 a.m.-8:43 a.m.) September 11, 2001).

Mahmood Ahmed is at a breakfast meeting at the Capitol with the chairmen of the House and Senate Intelligence Committees, Senator Bob Graham (D-FL) and Representative Porter Goss (R-FL), a 10-year veteran of the CIA’s clandestine operations wing. Also present at the meeting are Senator Jon Kyl (R-AZ) and the Pakistani ambassador to the US, Maleeha Lodhi, as well as other officials and aides. (Goss, Kyl, and Graham had just met with Pakistani President Pervez Mushrraf in Pakistan two weeks earlier (see August 28-30, 2001)). (Tapper 9/14/2001; Leiby 5/18/2002) Graham and Goss will later co-head the joint House-Senate investigation into the 9/11 attacks, which will focus on Saudi government involvement in the 9/11 attacks, but will say almost nothing about possible Pakistani government connections to al-Qaeda and the 9/11 attacks (see August 1-3, 2003 and December 11, 2002). (Priest and Eilperin 7/11/2002) Note that Senator Graham should have been aware of a report made to his staff the previous month (see Early August 2001) that one of Mahmood’s subordinates had told a US undercover agent that the WTC would be destroyed. Some evidence suggests that Mahmood ordered that $100,000 be sent to hijacker Mohamed Atta (see October 7, 2001).
Pakistan's Demands - Graham will later say of the meeting: “We were talking about terrorism, specifically terrorism generated from Afghanistan.” The New York Times will report that bin Laden is specifically discussed. (Sergent 9/12/2001; Tapper 9/14/2001; Risen 6/3/2002) The US wants more support from Pakistan in its efforts to capture bin Laden. However, Mahmood says that unless the US lifts economic sanctions imposed on Pakistan and improves relations, Pakistan will not oppose the Taliban nor provide intelligence and military support to get bin Laden. He says, “If you need our help, you need to address our problems and lift US sanctions.” He also encourages the US to engage the Taliban diplomatically to get them to change, instead of isolating them. Pakistani journalist Ahmed Rashid will later comment, “It was absurd for Mahmood to insist now that the Americans engage with the Taliban, when [Pakistan’s] own influence over them was declining and al-Qaeda’s increasing.”
Meeting Interrupted by 9/11 Attacks - Zamir Akram, an accompanying Pakistani diplomat, leaves the room for a break. While outside, he sees a group of Congressional aides gathered around a television set. As Akram walks up to the TV, he sees the second plane crashing into the World Trade Center. He immediately runs back to the meeting to the tell the others. But even as he gets there, a congressional aide comes in to say that Capitol Hill is being evacuated. The aide says, “There is a plane headed this way.” Mahmood and the rest of the Pakistani delegation immediately leave and attempt to return to the Pakistani embassy. But they are stuck in traffic for three hours before they get there. (Rashid 2008, pp. 26-27)

Major General Larry Arnold, the commander of the Continental United States NORAD Region (CONR), learns of the possible hijacking of Flight 11 after leaving a video teleconference, but initially thinks the reported hijacking is part of a NORAD training exercise. (Filson 2002; Code One Magazine 1/2002) Arnold, who is at CONR headquarters, at Tyndall Air Force Base, Florida, has been in the video teleconferencing room, participating in a teleconference with other senior NORAD officials (see (8:30 a.m.-8:40 a.m.) September 11, 2001). (9/11 Commission 2/2/2004 pdf file; Spencer 2008, pp. 31) Colonel Robert Marr, the battle commander at NORAD’s Northeast Air Defense Sector (NEADS), recently tried phoning Arnold to get authorization to scramble fighter jets in response to the hijacked Flight 11, but no one at CONR interrupted the teleconference to fetch Arnold, and so Marr left an urgent message for the CONR commander (see (8:38 a.m.) September 11, 2001). Note Informs Arnold of Hijacking - Arnold is now in the video teleconferencing room with Robert Del Toro, an intelligence officer with the 1st Air Force, discussing the just-concluded teleconference, when his executive officer, Kelley Duckett, hands him a note with Marr’s message on it. The note says the FAA’s Boston Center is reporting a hijacking and requesting assistance with it, and asks that Arnold phone Marr back immediately. Arnold Thinks Hijacking Is 'Part of the Exercise' - NORAD is currently in the middle of a major training exercise called Vigilant Guardian. (Code One Magazine 1/2002; Arkin 2005, pp. 545) Arnold will later say that, as a result, when he learns of the possible hijacking: “The first thing that went through my mind was: ‘Is this part of the exercise? Is this some kind of a screw-up?’” (ABC News 9/11/2002) According to author Lynn Spencer, “Even as NORAD’s commander for the continental United States, Arnold is not privy to everything concerning the exercise.” The exercise “is meant to test commanders also, to make sure that their war machine is operating as it should.”
Arnold Told Hijacking Is 'Real-World' - Since a simulated hijacking is scheduled as part of the day’s exercise (see (9:40 a.m.) September 11, 2001), Arnold asks Duckett, “Is this part of the exercise?” Duckett replies that the hijacking is real-world. (Spencer 2008, pp. 38) Arnold will say that “understanding this is real-world is obviously important, so I rushed downstairs to our battle staff position.” (Filson 2002) It occurs to Arnold that it has been many years since NORAD handled a hijacking (see February 11, 1993). He is relieved that, “because we were in the middle of an exercise,” he recently reviewed the protocol for what to do in response to a hijacking, and so “we were pretty well familiar with those procedures.” (9/11 Commission 5/23/2003; Spencer 2008, pp. 38) Arnold will promptly phone Marr and instruct him to go ahead and scramble fighters in response to the hijacking (see (8:42 a.m.) September 11, 2001). They are there for a real-world maneuver called Operation Northern Vigilance, tasked with monitoring a Russian air force exercise being conducted in the Russian Arctic all this week (see September 9, 2001). (North American Aerospace Defense Command 9/9/2001) At its operations center deep inside Cheyenne Mountain, Colorado, NORAD is also reportedly at “full ‘battle staff’ levels for a major annual exercise that tests every facet of the organization.” The operations center is now contacted by NORAD’s Northeast Air Defense Sector (NEADS), based in Rome, New York. NEADS says the FAA believes there is a hijacking in progress and is asking NORAD for support; this is not part of the exercise. As the Toronto Star will later report: “In a flash, Operation Northern Vigilance is called off. Any simulated information, what’s known as an ‘inject,’ is purged from the screens.” (Simmie 12/9/2001) NORAD has the capacity to inject simulated material, including mass attacks, during exercises, “as though it was being sensed for the first time by a radar site.” (US Department of Defense 1/15/1999) However, Northern Vigilance is a military operation, not a training exercise. (North American Aerospace Defense Command 9/9/2001; US Congress 3/11/2005) So presumably the “simulated information” is part of a NORAD exercise currently taking place, such as Vigilant Guardian (see (6:30 a.m.) September 11, 2001). Therefore, many minutes into the real 9/11 attacks, there may be false radar blips appearing on the screens of NORAD personnel. Additional details, such as whose radar screens have false blips and over what duration, are unclear. However, while the Toronto Star will indicate that the simulated material is removed from NORAD radar screens shortly before 9:03 a.m., when the second attack on the World Trade Center takes place, at 10:12 a.m. an officer at the operations center will call NEADS and ask it to “terminate all exercise inputs coming into Cheyenne Mountain” (see 10:12 a.m. September 11, 2001). (North American Aerospace Defense Command 9/11/2001; Simmie 12/9/2001) This would indicate that the NORAD operations center continues receiving simulated radar information for over an hour more, until after Flight 93 has crashed (see (10:06 a.m.) September 11, 2001) and the terrorist attacks have ended. The Russians, after seeing the attacks on New York and Washington on television, will quickly communicate that they are canceling their Russian Arctic exercise. NORAD’s Northeast Air Defense Sector (NEADS) in Rome, NY, has just received a phone call informing it of the hijacking of Flight 175 (see (9:03 a.m.) September 11, 2001), and several personnel have witnessed the plane crashing into the second World Trade Center tower live on CNN. There is considerable confusion on the operations floor over whether the plane seen on TV is the hijacking they have just been informed of. Tape recordings capture NEADS personnel in the background trying to make sense of things: “Is this explosion part of that that we’re lookin’ at now on TV?“… “And there’s a possible second hijack also—a United Airlines“… “Two planes?” Someone comments, “I think this is a damn input, to be honest.” (Bronner 8/1/2006) Another person replies, “Then this is a damned messed-up input!” (Spencer 2008, pp. 84) “Input” refers to a simulations input, as part of a training exercise. (Bronner 8/1/2006) NORAD has the capacity to inject simulated material, including mass attacks, during exercises, “as though it was being sensed for the first time by a radar site.” (US Department of Defense 1/15/1999) At least one military exercise this morning is reported to include simulated information injected onto radar screens (see (9:00 a.m.) September 11, 2001). (Simmie 12/9/2001) At the current time, despite the earlier crash of Flight 11, NORAD has yet to cancel a major exercise it is in the middle of (see (Shortly After 9:03 a.m.) September 11, 2001). Staffer Complained, 'Let's Get Rid of This Goddamn Sim' - A few minutes earlier, at 9:30 a.m., a member of staff on the operations floor complained about simulated information—presumably false tracks—appearing on NEADS radar screens. He said: “You know what, let’s get rid of this godd_mn sim. Turn your sim switches off. Let’s get rid of that crap.” (North American Aerospace Defense Command 9/11/2001; North American Aerospace Defense Command 9/11/2001) (A “sim switch” presumably allows simulated material on radar scopes to be turned on or off.)
Technician Instructs, 'Turn Off Your Sim Switches' - Now a member of NEADS staff, who according to a 9/11 Commission document is Technical Sergeant Jeffrey Richmond, gives an instruction to the NEADS surveillance technicians, “All surveillance, turn off your sim switches.” Seconds later, apparently in response to this instruction, someone on the operations floor tells a colleague, “You got your sim switches down.” (North American Aerospace Defense Command 9/11/2001; 9/11 Commission 2004)
Sim Switches Turned On for Day's Exercise - Simulated material (“sim”) is apparently appearing on NEADS radar screens because of the NORAD training exercise, Vigilant Guardian, that was being conducted this morning (see (6:30 a.m.) September 11, 2001). Former Deputy Secretary of Defense John Hamre has revealed that NORAD has the capacity to inject simulated material into the system, “as though it was being sensed for the first time by a radar site.” In a training exercise in December 1998, for example, NORAD ran “30 different simulations, some of them being mass attacks, some of them being single missiles.” An information page on the current exercise stated, “All of NEADS, operations personnel are to have their sim switches turned ‘on’ starting at 1400Z 6 Sept. 01 till endex [the end date of the exercise].” Since Vigilant Guardian was originally scheduled to continue until September 13, this would mean NEADS personnel had their sim switches turned on this morning. Radar Equipment Set to Display 'Sim Tracks' - A memo outlining special instructions for Vigilant Guardian participants further detailed how NORAD equipment needed to be set to display simulated material during the exercise. It stated: “The exercise will be conducted sim over live on the air sovereignty string. The Q-93 must be placed in the mixed mode to allow the telling [i.e. the communicating of information between facilities] of sim tracks.” (Northeast Air Defense Sector 8/23/2001) The Q-93 is a piece of equipment used by NORAD, which is described as “a suite of computers and peripheral equipment configured to receive plot data from ground radar systems,” and which “performs track processing.” (General Accounting Office 12/24/1992 pdf file; Federation of American Scientists 4/23/2000) The Q-93 also “receives flight plans from the FAA, and has bi-directional communications with NORAD headquarters and a real-time link to AWACS [Airborne Warning and Control System planes].” (Satterthwaite, Corman, and Herm 6/2002)
Exercise Supposedly Canceled Earlier On - While NEADS radar scopes are still displaying simulated material as late as 9:34 a.m., some accounts will claim the Vigilant Guardian exercise was canceled shortly after 9:03 a.m., when the second World Trade Center tower was hit (see (Shortly After 9:03 a.m.) September 11, 2001). (Tudor 3/2002; Filson 2003, pp. 59) And according to a report in the Toronto Star, “Any simulated information” for the exercise was “purged from the [radar] screens” at NORAD’s operations center in Cheyenne Mountain, Colorado, shortly before the second WTC tower was hit (see (9:00 a.m.) September 11, 2001). (Simmie 12/9/2001) However, NEADS will receive a phone call from the operations center at 10:12 a.m. in which the caller asks it to “terminate all exercise inputs coming into Cheyenne Mountain” (see 10:12 a.m. September 11, 2001). (North American Aerospace Defense Command 9/11/2001)

As part of a NORAD training exercise, a simulated plane hijacking was scheduled to occur around this time. It was to have been based around politically motivated perpetrators taking command of an aircraft, landing it on a Cuba-like island, and seeking asylum there. The hijacking was one of several simulated scenarios prepared for the day. Details of the other scenarios are unknown. Major Kevin Nasypany, the mission crew commander at NORAD’s Northeast Air Defense Sector (NEADS) who’d helped designed the exercise, initially thought the reports of Flight 11 being hijacked were because “Somebody started the exercise early.” (Bronner 8/1/2006) The exercise was canceled after the second plane hit the World Trade Center (see (Shortly After 9:03 a.m.) September 11, 2001).

(Thomas 12/31/2001) Cheney will later say that the WTC coming down “was a shock to everybody—it certainly was to me.” (PBS 9/9/2002) However, if he is indeed shocked, this is not how Cheney appears to others in the room. One witness who is present will later recall that, as the South Tower collapses, there is “a groan in the room that I won’t forget, ever. It seemed like one groan from everyone.” However, Cheney makes no sound, but closes his eyes for a long, slow blink. The witness says, “I remember turning my head and looking at the vice president, and his expression never changed.” (Gellman and Becker 6/24/2007) According to Mary Matalin, a counselor to the vice president, Cheney says nothing in response to the collapse, but “he emoted in a way that he emotes, which was to stop.” (CNN 9/11/2002; CNN 9/11/2002) When he is told that a casualty estimate ranges well into the thousands, the vice president reportedly just nods grimly. (Thomas 12/31/2001) According to the Washington Post, three people who are present say they see no sign now or later “of the profound psychological transformation that has often been imputed to Cheney.” What they see is “extraordinary self-containment and a rapid shift of focus to the machinery of power. While others assessed casualties and the work of ‘first responders,’ Cheney began planning for a conflict that would call upon lawyers as often as soldiers and spies.” He will promptly begin assembling the legal team that subsequently assists him in expanding presidential power (see (After 10:00 a.m.) September 11, 2001). [Source: David Bohrer / White House]According to an in-depth examination by the Washington Post, within hours of the 9/11 attacks, Vice President Dick Cheney begins working to secure additional powers for the White House. Cheney had plans in place to begin acquiring these powers for the executive branch before the attacks, but had not begun to execute them.
Gathering the Team - David Addington, Cheney’s general counsel and legal adviser, had been walking home after having to leave the now-evacuated Eisenhower Executive Office Building. He receives a message from the White House telling him to turn around, because the vice president needs him. After Addington joins Cheney in the Presidential Emergency Operations Center (PEOC) below the East Wing of the White House, the pair reportedly begin “contemplating the founding question of the legal revolution to come: What extraordinary powers will the president need for his response?” Later in the day, Addington connects by secure video with Timothy Flanigan, the deputy White House counsel, who is in the White House Situation Room. John Yoo, the deputy chief of the Office of Legal Counsel, is also patched in from the Justice Department’s command center. White House counsel Alberto Gonzales joins them later. This forms the core legal team that Cheney will oversee after the terrorist attacks. Associate White House counsel Bradford Berenson will later recall: “Addington, Flanigan and Gonzales were really a triumvirate. [Yoo] was a supporting player.” Addington dominates the group. Gonzales is there primarily because of his relationship with President Bush. He is not, Yoo will later recall, “a law-of-war expert and [doesn’t] have very developed views.” Along with these allies, Cheney will provide what the Washington Post calls “the rationale and political muscle to drive far-reaching legal changes through the White House, the Justice Department, and the Pentagon,” which will free the president to fight the war on terror, “as he saw fit.”
Drafting the AUMF - The team begins drafting the document that will become the Authorization to Use Military Force (AUMF—see October 10, 2002) passed by Congress for the assault on Afghanistan. In the words of the group, the president is authorized “to use all necessary and appropriate force against those nations, organizations, or persons he determines planned, authorized, committed, or aided the terrorist attacks that occurred on September 11, 2001, or harbored such organizations or persons, in order to prevent any future acts of international terrorism against the United States.”
Extraordinarily Broad Language - The language is extraordinarily broad; Yoo will later explain that they chose such sweeping language because “this war was so different, you can’t predict what might come up.” The AUMF draft is the first of numerous attempts to secure broad powers for the presidency, most justified by the 9/11 attacks. The Washington Post will later report, “In fact, the triumvirate knew very well what would come next: the interception—without a warrant—of communications to and from the United States” (see September 25, 2001). Presumably, hijackers Ziad Jarrah, Ahmed Alhaznawi, Ahmed Alnami, Saeed Alghamdi, and all the plane’s passengers are killed instantly. (CNN 9/12/2001; North American Aerospace Defense Command 9/18/2001; Ellison 10/17/2001; Hillston 10/28/2001; Levin, Adams, and Morrison 8/12/2002; Associated Press 8/21/2002; MSNBC 9/3/2002) The point of impact is a reclaimed coal mine, known locally as the Diamond T Mine, that was reportedly abandoned in 1996. (Pittsburgh Tribune-Review 9/12/2001; Zapinski 9/12/2001; Frederick 9/11/2002) Being “reclaimed” means the earth had been excavated down to the coal seam, the coal removed, and then the earth replaced and planted over. (Kashurba 2002, pp. 121) A US Army authorized seismic study times the crash at five seconds after 10:06 a.m. (Kim and Baum 2002 pdf file; Perlman 12/9/2002) As mentioned previously, the timing of this crash is disputed and it may well occur at 10:03 a.m., 10:07 a.m., or 10:10 a.m.

An officer at NORAD’s operations center in Cheyenne Mountain, Colorado, calls NORAD’s Northeast Air Defense Sector (NEADS) and asks it to stop “exercise inputs” being sent to the operations center.
NORAD Calls Chief of Exercises at NEADS - The NORAD officer, a “Captain Taylor,” calls NEADS, where the phone is answered by Captain Brian Nagel. (North American Aerospace Defense Command 9/11/2001) Nagel is chief of NEADS live exercises. (Filson 2003, pp. 74) After introducing himself, Taylor says, “What we need you to do right now is to terminate all exercise inputs coming into Cheyenne Mountain.” Nagel gives Taylor an extension number and suggests that he call it to get the exercise inputs stopped. Taylor replies, “I’ll do that.” (North American Aerospace Defense Command 9/11/2001) According to an article in Vanity Fair, “inputs” are simulated scenarios that are put into play for training exercises. (Bronner 8/1/2006) NORAD has been conducting a major exercise this morning called Vigilant Guardian (see (6:30 a.m.) September 11, 2001). (Arkin 2005, pp. 545)
Exercise Includes Simulated Radar Information - Taylor is presumably referring specifically to false tracks that have been transmitted onto NORAD radar screens for the exercise. NORAD has the capability to inject simulated material, including mass attacks, into the system during exercises, “as though it was being sensed for the first time by a radar site.” (US Department of Defense 1/15/1999) All of the operations personnel at NEADS have been instructed to “have their sim switches turned ‘on’” (presumably to allow simulated information to appear on their radar screens) from September 6 until the end of Vigilant Guardian, on September 13. An information page on the exercise stated that a “sim test track will be in place and forward told [i.e. transferred to a higher level of command] to both NORAD and CONR,” NORAD’s Continental United States Region. (Northeast Air Defense Sector 8/23/2001)
Exercise Supposedly Called Off Earlier - More than 50 members of the battle staff at the NORAD operations center have been participating in Vigilant Guardian this morning. (Tudor 3/2002; 9/11 Commission 3/1/2004 pdf file) Some accounts will claim this exercise was canceled shortly after 9:03 a.m., when the second World Trade Center tower was hit (see (Shortly After 9:03 a.m.) September 11, 2001). (Tudor 3/2002; Filson 2003, pp. 59) And a report in the Toronto Star will state, “Any simulated information” for the exercise was “purged from the [radar] screens” at the operations center shortly before the second tower was hit (see (9:00 a.m.) September 11, 2001). (Simmie 12/9/2001) But a member of staff at NEADS complained at 9:30 a.m. about simulated material still appearing on radar screens there, and at 9:34 a.m. the NEADS surveillance technicians were instructed to turn off their “sim switches” (see 9:34 a.m. September 11, 2001). During a phone call with Christopher Meyer, the British ambassador to the United States, National Security Adviser Condoleezza Rice suggests the possibility of Iraqi complicity in the attacks on New York and Washington. Following the strike on the Pentagon, Meyer held an emergency meeting of his staff at the British Embassy. He then calls Rice to offer condolences and support. He asks her who does she think was responsible for the attacks? In his 2005 memoirs, Meyer will recall: “The names al-Qaeda and Osama bin Laden were already in circulation. She said that the early evidence suggested that it was them. But there could also be a connection with Iraq. That would need investigating.” (Meyer 2002 pdf file; Meyer 2005, pp. 188 and 190) However, in a 2007 interview, he will suggest Rice might have made this reference to possible Iraqi complicity in a later call, saying, “I think it was in the same conversation [I had with Rice on the morning of September 11], or it may have been the next one we had very soon after, she said, ‘Well, one thing we need to look into is to see whether Iraq’s had anything to do with this.’” (Meyer 12/20/2007)

[Source: FBI]Within an hour of the 9/11 attacks, the Minnesota FBI uses a memo written to FBI headquarters shortly after Zacarias Moussaoui’s arrest to ask permission from a judge for the search warrant they have been desperately seeking. After the World Trade Center is hit for the first time at 8:46 a.m., Mike Maltbie of the Radical Fundamentalist Unit (RFU) at FBI headquarters calls the Minneapolis field office and talks to FBI agent Coleen Rowley. When Rowley says it is essential they get a warrant to search Moussaoui’s belongings, Maltbie instructs her to take no action, because it could have an impact on matters of which she is not aware. Rowley replies that it would have to be the “hugest coincidence” if Moussaoui were not related to the attack. She will recall that Maltbie replies that coincidence is the right word. Maltbie will later say he does not recall using the word “coincidence” in the conversation. Maltbie then consults Tom Ainora, an attorney at the FBI’s national security law unit, who says Minneapolis should seek the warrant. While Rowley is waiting for Maltbie to call back, one of her colleagues, Chris Briese, talks to RFU chief Dave Frasca. According to Briese, Frasca initially says there is not enough evidence for a criminal warrant, but when they find out the Pentagon has been hit Frasca consents. Frasca will say that he consents immediately. (Time 5/21/2002; US Department of Justice 11/2004, pp. 178-9 pdf file) Briese later tells Samit that Frasca also initially claims it is just “a coincidence.” (Gordon 6/4/2006) A federal judge approves a criminal search warrant this afternoon. (Hersh 9/30/2002; US District Court for the Eastern District of Virginia, Alexandria Division 3/9/2006) The Radical Fundamentalist Unit at FBI headquarters had previously blocked requests for criminal and intelligence search warrants (see August 21, 2001 and August 28, 2001). Rowley will note that this very memo was previously deemed insufficient by FBI headquarters to get a search warrant, and the fact that they are immediately granted one when finally allowed to ask shows “the missing piece of probable cause was only the [FBI headquarters’] failure to appreciate that such an event could occur.” (Time 5/21/2002) After the warrant is granted, Moussaoui’s belongings are then rushed to an evidence response team, which discovers documents linking Moussaoui to 11 of the hijackers (see August 16, 2001). Rowley later suggests that if they had received the search warrant sooner, “There is at least some chance that… may have limited the September 11th attacks and resulting loss of life.” (Ratnesar and Weisskopf 5/27/2002)

At around 8:00 p.m., Afghanistan time (11:30 a.m., New York time), Taliban leader Mullah Omar allegedly says, “Things have gone much further than expected.” This is according to what the New Yorker will describe as “Afghan intelligence sources” who monitor the call. (It is unclear what “Afghan intelligence sources” means, since the Taliban control nearly all of Afghanistan at this time, but it could be a reference to Northern Alliance forces; the CIA gave them equipment to monitor the Taliban (see Winter 1999-March 2000).) Omar’s comment takes place over an hour after one of the World Trade Center towers collapsed, which means thousands have been killed in the attacks, not hundreds (see 9:59 a.m. September 11, 2001). An Afghan intelligence official will later say: “They were expecting a reaction. But they thought it would be a Clinton-type reaction. They didn’t anticipate the kind of revenge that occurred.” (Anderson 6/10/2002) The “Clinton-type reaction” presumably is a reference to the August 1998 missile strikes on Sudan and Afghanistan during the Clinton administration (see August 20, 1998).

These notes will be leaked to the media nearly a year later. According to the notes, although Rumsfeld has already been given information indicating the 9/11 attacks were done by al-Qaeda (see 12:05 p.m. September 11, 2001) and he has been given no evidence so far indicating any Iraqi involvement, he is more interested in blaming the attacks on Iraq. According to his aide’s notes, Rumsfeld wants the “best info fast. Judge whether good enough hit S.H. [Saddam Hussein] at same time. Not only UBL [Osama bin Laden].… Need to move swiftly.… Go massive. Sweep it all up. Things related and not.” (Roberts 9/4/2002; Bamford 2004, pp. 285) In a 2004 book, author James Moore will write, “Unless Rumsfeld had an inspired moment while the rest of the nation was in shock, the notes are irrefutable proof that the Bush administration had designs on Iraq and Hussein well before the president raised his hand to take the oath of office.” (Moore 3/15/2004, pp. 18)

According to journalist Kathy Gannon, President Bush calls Pakistani President Pervez Musharraf at some point during the evening of 9/11. Bush tells Musharraf he has to choose between supporting or opposing the US. “Musharraf promised immediate and unconditional support for the United States and said he could stop Pakistan’s support for the Taliban. Overnight, Musharraf went from pariah to valued friend.” (Gannon 2005, pp. 146) Similar conversations will take place between US officials and the ISI Director who happens to be in Washington (see September 13-15, 2001). But despite these promises, the Pakistani ISI will continue to secretly help the Taliban (see for instance Mid-September-October 7, 2001, September 17-18 and 28, 2001 and Early October 2001).

The Pentagon creates a secret office to coordinate military information operations aimed at improving the United States’ image abroad. The office, named the Office of Strategic Influence, or OSI, is headed by Brigadier General Simon P. Wordon (Dao and Schmitt 2/19/2002) , an astrophysicist with experience in space operations and missile defense. (Ricks 2/20/2002) His assistant is Thomas A. Timmes. (Dao and Schmitt 2/19/2002) Worden reports to Undersecretary of Defense Douglas Feith. (Rich 2006, pp. 32) OSI is a small, but well-funded operation and there are reportedly plans to provide it with an annual budget of as much as $100 million. (Dao and Schmitt 2/19/2002; Whitworth 2/20/2002; Schmitt and Dao 2/27/2002) Many of OSI’s functions are contracted to private public relations firms such as the Rendon Group, whose client list includes the CIA, the Kuwaiti royal family, and the Iraqi National Congress. (Rich 2006, pp. 32) Soon after the office is formed, a proposal is floated to produce and disseminate disinformation. The New York Times will report: “[T]he new office has begun circulating classified proposals calling for aggressive campaigns that use not only the foreign media and the Internet, but also covert operations.… One of the office’s proposals calls for planting news items with foreign media organizations through outside concerns that might not have obvious ties to the Pentagon.… General Worden envisions a broad mission ranging from ‘black’ campaigns that use disinformation and other covert activities to ‘white’ public affairs that rely on truthful news releases.… ‘It goes from the blackest of black programs to the whitest of white,’ a senior Pentagon official said.… Another proposal involves sending journalists, civic leaders and foreign leaders e-mail messages that promote American views or attack unfriendly governments.” (Dao and Schmitt 2/19/2002) When OSI’s classified proposals are leaked to the press (see February 19, 2002), White House officials say they are “furious” that the use of disinformation is being considered and then a few days later announce that the office has been shut down (see February 26, 2002). (Allen 2/25/2002)

ISI Director Lt. Gen. Mahmood Ahmed, extending his Washington visit because of the 9/11 attacks, meets with US officials and negotiates Pakistan’s cooperation with the US against al-Qaeda. On September 12, 2001, Deputy Secretary of State Richard Armitage meets with Mahmood and allegedly demands that Pakistan completely support the US or “or be prepared to live in the Stone Age” (see September 12, 2001). (Deutsche Presse-Agentur (Hamburg) 9/12/2001; Japan Economic Newswire 9/17/2001; Rind 11/9/2001) On September 13, Armitage and Secretary of State Powell present Mahmood seven demands as a non-negotiable ultimatum. The demands are that Pakistan:
bullet Gives the US blanket overflight and landing rights for all US aircraft.
bullet Gives the US access to airports, naval bases, and borders for operations against al-Qaeda.
bullet Provides immediate intelligence sharing and cooperation.
bullet Cuts all shipments of fuel to the Taliban and stops Pakistani fighters from joining them.
bullet Publicly condemns the 9/11 attacks.
bullet Ends support for the Taliban and breaks diplomatic relations with them.
bullet Stops al-Qaeda operations on the Pakistan-Afghanistan border, intercepts arms shipments through Pakistan, and ends all logistical support for al-Qaeda.
Pakistan supposedly agrees to all seven. (Balz, Woodward, and Himmelman 1/29/2002; Rashid 2008, pp. 28) Mahmood also has meetings with Senator Joseph Biden (D-DE), Chairman of the Senate Foreign Relations Committee, and Secretary of State Powell, regarding Pakistan’s position. (Perlez 9/13/2001; Redden 9/13/2001; Associated Press 9/13/2001; Davies 9/16/2001) On September 13, the airport in Islamabad, the capital of Pakistan, is shut down for the day. A government official will later say the airport was closed because of threats made against Pakistan’s “strategic assets,” but will not elaborate. The next day, Pakistan declares “unstinting” support for the US, and the airport is reopened. It will later be suggested that Israel and India threatened to attack Pakistan and take control of its nuclear weapons if Pakistan did not side with the US. (Rind 11/9/2001) It will later be reported that Mahmood’s presence in Washington was a lucky blessing; one Western diplomat saying it “must have helped in a crisis situation when the US was clearly very, very angry.” (Bokhari 9/18/2001) By September 15, Mahmood is back in Pakistan, and he takes part in a meeting with Pakistani President Pervez Musharraf and other Pakistani leaders, discussing the US ultimatum. That evening, Musharraf announces that it completely agrees to the terms (see September 15, 2001). However, Pakistan soon begins backtracking on much of the agreement. For instance, just four days after agreeing to the ultimatum, Musharraf fails to condemn the 9/11 attacks or the Taliban or al-Qaeda in an important televised speech, even though he explicitly agreed to do so as part of the agreement (see September 19, 2001). The Pakistani ISI also continues to supply the Taliban with fuel, weapons, and even military advisers, until at least November 2001 (see Late September-November 2001). Pakistani Foreign Minister Abdul Sattar will later describe Pakistan’s policy: “We agreed that we would unequivocally accept all US demands, but then we would express out private reservations to the US and we would not necessarily agree with all the details.” (Rashid 2008, pp. 28)

General Hamid Gul, the former head of the Pakistani Inter-Services Intelligence agency (ISI), gives several interviews in which he says Osama bin Laden is not responsible for 9/11, and that he believes the attacks were perpetrated by the Israeli overseas intelligence service, Mossad, and renegade elements within the US Air Force. (Nordland 9/14/2001; Baweja 9/14/2001; de Borchgrave 9/26/2001)
Failure of US Air Defenses - Gul points to the failure of the US Air Force to halt the 9/11 attacks. He tells Newsweek: “F-16s don’t scramble in time, though they had 18 minutes after the first plane hit the World Trade Center.… A flight to Los Angeles turns to Washington and is in the air for 45 minutes, and the world’s most sophisticated air defense doesn’t go into action.” (Nordland 9/14/2001) In an interview with United Press International editor at large Arnaud de Borchgrave, he says: “The attacks against the Twin Towers started at 8:45 a.m. and four flights are diverted from their assigned air space and no air traffic controller sounds the alarm. And no Air Force jets scramble until 10 a.m. That also smacks of a small scale Air Force rebellion, a coup against the Pentagon perhaps? Radars are jammed, transponders fail. No IFF—friend or foe identification—challenge.” He adds: “In Pakistan, if there is no response to IFF, jets are instantly scrambled and the aircraft is shot down with no further questions asked. This was clearly an inside job.”
Bin Laden Innocent - Gul says he believes Osama bin Laden would have been incapable of perpetrating such a sophisticated attack. When de Borchgrave asks, “What makes you think Osama wasn’t behind September 11?” Gul responds: “From a cave inside a mountain or a peasant’s hovel? Let’s be serious.… He doesn’t have the means for such a sophisticated operation.” He comments: “Within ten minutes of the second Twin Tower being hit… CNN said Osama bin Laden had done it. That was a planned piece of disinformation by the real perpetrators. It created an instant mindset and put public opinion into a trance, which prevented even intelligent people from thinking for themselves.” (de Borchgrave 9/26/2001) He tells the Indian news website Tehelka.com that blaming bin Laden and Afghanistan “is a convenient bogey to divert attention.” (Baweja 9/14/2001)
Blames Israel - Israelis are Gul’s prime suspects for 9/11. He says: “Mossad and its American associates are the obvious culprits. Who benefits from the crime?” (de Borchgrave 9/26/2001) He tells Newsweek: “I can’t say for sure who was behind [9/11], but it’s the Israelis who are creating so much misery in the world. The Israelis don’t want to see any power in Washington unless it’s subservient to their interests, and President Bush has not been subservient.” (Nordland 9/14/2001) In his interview with Tehelka.com, he adds: “One knows that after the Florida fiasco of the presidential election, there is a big rift between the Jewish lobbies and George Bush and his administration. He has not taken a single Jew in his Cabinet. So [Israeli Prime Minister Ariel] Sharon and company are very upset with George Bush. They [the Jewish lobbies] have been told to indulge in acts of terrorism in the past. Why can’t they do it now?” (Baweja 9/14/2001)
Supports Taliban and Opposes US Action against Afghanistan - General Gul was the head of the ISI between 1987 and 1989 (see April 1987). (West 9/23/2001) As Newsweek describes, he is “widely considered the architect of the Afghan jihad: the man who, with financial and logistical support from the CIA, engineered the fight of the mujaheddin against the Soviet Union and its proxy government in Kabul in the 1980s. Now, he’s a big fan of the country’s ruling Taliban.” (Nordland 9/14/2001) He currently serves as an adviser to Pakistan’s extremist religious political parties, which oppose their government’s decision to support the US in any action against the Taliban. (de Borchgrave 9/26/2001) Newsweek comments: “If General Gul were anyone else, it would be easy to dismiss him as a crackpot. But here in military-ruled Pakistan, he remains an influential figure, even in semiretirement.” (Nordland 9/14/2001)

A self-styled White House “war council” begins meeting shortly after the 9/11 attacks, to discuss the administration’s response to the attacks and the methods it will use (see (After 10:00 a.m.) September 11, 2001). The ad hoc group is composed of White House counsel Alberto Gonzales, Justice Department lawyer John Yoo, Pentagon chief counsel William J. Haynes, and the chief aide to Vice President Dick Cheney, David Addington. According to Jack Goldsmith, who will become head of the Justice Department’s Office of Legal Counsel (OLC) in 2003 (see October 6, 2003), the four believe that the administration’s biggest obstacle to responding properly to the 9/11 attacks is the body of domestic and international law that arose in the 1970s to constrain the president’s powers after the criminal excesses of Richard Nixon’s White House. Chief among these restraints is the Foreign Intelligence Surveillance Act (FISA) of 1978 (see 1978). Though Addington tends to dominate the meetings with his imposing physical presence and aggressive personality, Yoo is particularly useful to the group; the head of the OLC, Jay Bybee (whom Goldsmith will replace) has little experience with national security issues, and delegates much of the responsibility for that subject to Yoo, even giving him the authority to draft opinions that are binding on the entire executive branch. Yoo agrees wholeheartedly with Addington, Gonzales, and Cheney about the need for vastly broadened presidential powers. According to Goldsmith, Yoo is seen as a “godsend” for the White House because he is eager to draft legal opinions that would protect Bush and his senior officials from any possible war crimes charges. However, Yoo’s direct access to Gonzales angers Attorney General John Ashcroft, who feels that the “war council” is usurping legal and policy decision-making powers that are legally his own. (Rosen 9/9/2007) In 2009, Goldsmith will say, “[I]it was almost as if they [Cheney and Addington] were interested in expanding executive power for its own sake.” (Murphy and Purdum 2/2009)

Pakistani ISI Director Lt. Gen. Mahmood Ahmed is periodically meeting and communicating with top Taliban leader Mullah Omar during this time. He is advising him to resist the US and not to hand over bin Laden (see September 17-18 and 28, 2001). According to journalist Kathy Gannon, he is also giving Omar and other Taliban leaders advice on how to resist the US military. Omar has almost no education and very little understanding of the Western world. Mahmood, by contrast, has just come from meetings with top officials in the US (see September 13-15, 2001). Gannon will later write that each time Mahmood visited Omar, he gave him “information about the likely next move by the United States. By then, [he] knew there weren’t going to be a lot of US soldiers on the ground. He warned Mullah Omar that the United States would be relying heavily on aerial bombardment and on the Northern Alliance.” Mahmood gives additional pointers on targets likely to be hit, command and control systems, anti-aircraft defense, what types of weapons the US will use, and so forth. (Gannon 2005, pp. 93-94) Immediately after 9/11, Mahmood had promised Pakistan’s complete support to help the US defeat the Taliban (see September 13-15, 2001).

The issue of possible Iraqi involvement in the 9/11 attacks is debated in a National Security Council meeting. According to journalist Bob Woodward, President Bush ends the debate by saying, “I believe Iraq was involved, but I’m not going to strike them now. I don’t have the evidence at this point.” Bush says wants to keep working on plans for military action in Iraq but indicates there will be plenty of time to do that later. Right now his focus is mainly on Afghanistan. (Woodward 2002, pp. 99) At the time Bush says this, no evidence has emerged possibly linking Iraq to 9/11. One day later, an account of hijacker Mohamed Atta meeting an Iraqi agent in Prague will become known, but it will ultimately be discredited (see September 18, 2001).

On September 12, 2001, President Bush spoke to counterterrorism “tsar” Richard Clarke and told him to look into possible Iraqi links to the 9/11 attacks (see September 12, 2001). Clarke works with CIA and FBI experts to make a report on the issue. (Burrough et al. 5/2004, pp. 238) On September 18, Clarke sends a memo to National Security Adviser Condoleezza Rice entitled, “Survey of Intelligence Information on Any Iraq Involvement in the September 11 Attacks.” It passes along a few foreign intelligence reports, including a report just coming out of the Czech Republic alleging that hijacker Mohamed Atta met an Iraqi agent in Prague in April 2001. But it concludes there is no compelling case that Iraq had planned the 9/11 attacks. It further points out that allegations of any ties between al-Qaeda and the Iraqi government are weak, especially since bin Laden resents the secular nature of Saddam Hussein’s government. (9/11 Commission 7/24/2004, pp. 335, 559) Clarke will later claim that the first draft of his memo was returned by National Security Adviser Rice or her deputy Stephen Hadley because it did not find any link between Iraq and al-Qaeda. He says, “It got bounced and sent back, saying ‘Wrong answer…. Do it again.’” Rice and Hadley will later deny that they asked to have the memo redone for this reason. Clarke does not know if Bush ever sees his report. “I don’t think he sees memos that he doesn’t-wouldn’t like the answer.” (Burrough et al. 5/2004, pp. 238; 9/11 Commission 7/24/2004, pp. 559)

Pakistani President Pervez Musharraf gives a speech on Pakistani television in Urdu, the main language of Pakistan. He draws a lengthy analogy between the situation facing Pakistan in the wake of 9/11 and an opportunistic alliance the Prophet Mohammed made to defeat his enemies. This message is widely interpreted in Pakistan as implying that the alliance with the US is only a temporary necessity. He says, “I have done everything for Afghanistan and the Taliban when the whole world was against them. We are trying our best to come out of this critical situation without any damage to them.” These comments are virtually ignored outside Pakistan at the time. (Harrison 6/24/2003; Harrison 9/5/2006) At no point in the speech does he condemn the Taliban or al-Qaeda, or link them to the 9/11 attacks, despite having promised US officials in recent days that he would do just that. He also says that by bending on Afghanistan, he has saved Islamist militancy in Kashmir, the region disputed between Pakistan and India. (Rashid 2008, pp. 32)

Douglas Feith suggests in a draft memo (Feith 8/7/2004) that the US should consider “hitting terrorists outside the Middle East in the initial offensive, perhaps deliberately selecting a non-al-Qaeda target like Iraq.” Other regions he proposes attacking include South America and Southeast Asia. He reasons that an initial attack against such targets would “surprise… the terrorists” and catch them off guard. (9/11 Commission 7/24/2004, pp. 277, 533; Hosenball and Isikoff 8/8/2004) According to Newsweek, the content of Feith’s memo derives from the work of the Counter Terrorism Evaluation Group (see Shortly After September 11, 2001), a project headed by Michael Maloof and David Wurmser. The group suggested that an attack on the remote Triborder region, where Paraguay, Argentina, and Brazil meet and where Iranian-backed Hezbollah is said to have a presence, would have a ripple effect among international Islamic militant groups. (Hosenball and Isikoff 8/8/2004) Feith later says his memo merely expands upon ideas put forth by Defense Secretary Donald Rumsfeld in a memo (see September 19, 2001) the secretary wrote the day before to Gen. Henry Shelton, chairman of the Joint Chiefs of Staff. (Feith 8/7/2004) The logic behind proposing strikes against targets outside of the Middle East, Feith says, was based on the need to “cast a wide net” and achieve “additional objectives,” such as creating fissures in the enemy network, highlighting “the global nature of the conflicts,” showing “seriousness of US military purpose,” and demonstrating that the “war would not be limited geographically to Afghanistan.” (Feith 8/7/2004)

During President Bush’s presidential daily briefing (PDB), Bush is informed that the US intelligence community has found no evidence linking Saddam Hussein’s regime in Iraq to the 9/11 attacks, nor any evidence of links between Hussein and al-Qaeda. The briefing has been prepared at the request of Bush, who is said to be eager to learn of any possible connection between Iraq and al-Qaeda. Yet during the briefing, he is told that the few believable reports of contact between the two were in fact attempts by Hussein to monitor the group, which he considered a threat to his secular regime. Analysts believe that at one point Hussein considered infiltrating al-Qaeda with Iraqi nationals or Iraqi intelligence operatives, so as to learn more about its inner workings. A former US administration official later will state, “What the president was told on September 21 was consistent with everything he has been told since—that the evidence [linking Iraq to 9/11] was just not there.” The existence of the September 21 PDB will not be disclosed to the Senate Intelligence Committee until the summer of 2004, while the committee will be investigating whether the Bush administration misrepresented intelligence information in the period leading up to the March 2003 invasion of Iraq. As of the end of 2005, the Bush administration will still refuse to turn over the briefing, even on a classified basis, and will say nothing more about it other than the fact that it exists. (Waas 11/22/2005; MSNBC 11/22/2005; Agence France-Presse 11/23/2005; Unger 2007, pp. 217) According to journalist Ron Suskind, during the meeting, CIA Director George Tenet tells Bush about the alleged meeting hijacker Mohamed Atta had with an Iraqi agent in Prague, which has been reported in the media in recent days (see September 18, 2001). However, Tenet says: “Our Prague office is skeptical about the report. It just doesn’t add up.” He points out that credit card and phone records place Atta in Virginia during the time in question. (Suskind 2006, pp. 23)

Mustafa Ahmed Alhawsawi.Mustafa Ahmed Alhawsawi. [Source: FBI]In 2000, the 9/11 hijackers receive money from a man using “Mustafa Ahmed al-Hisawi” and other aliases. On September 8-11, 2001, the hijackers send money to a man in the United Arab Emirates who uses the aliases “Mustafa Ahmed,” “Mustafa Ahmad,” and “Ahamad Mustafa.” Soon the media begins reporting on who this 9/11 “paymaster” is, but his reported names and identities will continually change. The media has sometimes made the obvious connection that the paymaster is Saeed Sheikh—a British financial expert who studied at the London School of Economics, undisputedly sent hijacker Mohamed Atta money the month before the attacks, made frequent trips to Dubai (where the money is sent), and is known to have trained the hijackers. However, the FBI consistently deflects attention to other possible explanations, with a highly confusing series of names vaguely similar to Mustafa Ahmed or Saeed Sheikh:
bullet September 24, 2001: Newsweek reports that the paymaster for the 9/11 attacks is someone named “Mustafa Ahmed.” (Hosenball 10/1/2001) This refers to Mustafa Mahmoud Said Ahmed, an Egyptian al-Qaeda banker who was captured in Tanzania in 1998 then later released. (Riley 9/28/2001; Riley and Brune 10/3/2001)
bullet October 1, 2001: The Guardian reports that the real name of “Mustafa Mohamed Ahmad” is “Sheikh Saeed.” (Whitaker 10/1/2001) A few days later, CNN confirms from a “senior-level US government source” that this “Sheik Syed” is the British man Ahmed Omar Saeed Sheikh rescued from an Indian prison in 1999. (CNN 10/6/2001; Ressa 10/8/2001) However, starting on October 8, the story that ISI Director Lt. Gen. Mahmood Ahmed ordered Saeed to give Mohamed Atta $100,000 begins to break. References to the 9/11 paymaster being the British Saeed Sheikh (and the connections to the ISI Director) suddenly disappear from the Western media (with one exception (CNN 10/28/2001) ).

bullet December 26, 2002: US officials now say there is no such person as Shaikh Saiid al-Sharif. Instead, he is probably a composite of three different people: “[Mustafa Ahmed] Al-Hisawi, Shaikh Saiid al-Masri, al-Qaeda’s finance chief, and Saad al-Sharif, bin Laden’s brother-in-law and a midlevel al-Qaeda financier.” (Associated Press 12/27/2002) Shaikh Saiid al-Masri is likely a reference the Kenyan Sheik Sayyid el Masry. Note that, now, al-Hisawi is the assistant to Shaikh Saiid, a flip from a few months before. Saiid and/or al-Hisawi still haven’t been added to the FBI’s official most wanted lists. (McGrory 12/1/2001; Federal Bureau of Investigation 2002; Miniter 6/17/2002) Despite the confusion, the FBI isn’t even seeking information about them. (Federal Bureau of Investigation 2/14/2002) Mustafa Ahmed al-Hawsawi is said to be arrested with Khalid Shaikh Mohammed in Pakistan in 2003, but no photos of him are released, and witnesses of the supposed arrest did not see al-Hawsawi or Mohammed there (see February 29 or March 1, 2003). (Zakaria 3/3/2003) A few weeks later, it will be reported that “the man US intelligence officials suspected of being al-Qaeda’s financial mastermind, Sheik Said al-Masri, remains at large.” (McNamee, Woellert, and Matlack 3/17/2003)

John Yoo.John Yoo. [Source: University of California, Berkeley]In a secret 15-page memo to Deputy White House Counsel Timothy Flanigan, Justice Department lawyer John Yoo, a deputy in the Office of Legal Counsel, reasons that it is “beyond question that the president has the plenary constitutional power to take such military actions as he deems necessary and appropriate to respond to the terrorist attacks” of 9/11. Those actions can be extensive. “The president may deploy military force preemptively against terrorist organizations or the states that harbor or support them,” Yoo writes, “whether or not they can be linked to the specific terrorist incidents of Sept. 11.… Force can be used both to retaliate for those attacks, and to prevent and deter future assaults on the nation. Military actions need not be limited to those individuals, groups, or states that participated in the attacks on the World Trade Center and the Pentagon.” The memo is solicited and overseen by White House lawyers.
Power Derives from Constitution, Congressional Authorization for War - This power of the president, Yoo states, rests both on the US Congress’ Joint Resolution of September 14 (see September 14-18, 2001) and on the War Powers Resolution of 1973. “Neither statute, however, can place any limits on the president’s determinations as to any terrorist threat, the amount of military force to be used in response, or the method, timing, and nature of the response. These decisions, under our Constitution, are for the president alone to make.” (Most experts believe that the Constitution strictly limits the president’s power to declare and conduct war—see 1787).
Power More Extensive than Congress Authorized - Yoo argues further that the September 14 resolution does not represent the limits to the president’s authority. “We think it beyond question” that Congress cannot “place any limits on the president’s determinations as to any terrorist threat, the amount of military force to be used in response, or the method, timing, and nature of the response. These decisions, under our Constitution, are for the president alone to make.” Congress’s “Joint Resolution is somewhat narrower than the president’s constitutional authority,” Yoo writes, as it “does not reach other terrorist individuals, groups, or states which cannot be determined to have links to the September 11 attacks.” The president’s broad power can be used against selected individuals suspected of posing a danger to the US, even though it may be “difficult to establish, by the standards of criminal law or even lower legal standards, that particular individuals or groups have been or may be implicated in attacks on the United States.” Yoo concludes: “[W]e do not think that the difficulty or impossibility of establishing proof to a criminal law standard (or of making evidence public) bars the president from taking such military measures as, in his best judgment, he thinks necessary or appropriate to defend the United States from terrorist attacks. In the exercise of his plenary power to use military force, the president’s decisions are for him alone and are unreviewable.”
'Unenumerated' Presidential Powers - Yoo even asserts that the president has more power than his memo claims: “[T]he president’s powers include inherent executive powers that are unenumerated in the Constitution,” including but not limited to the power to take the country to war without Congressional input. (US Department of Justice 9/25/2001; Savage 2007, pp. 121-122)
Memo Remains Secret for Three Years - The contents of this memo are not disclosed until mid-December 2004. (Isikoff 12/18/2004; Isikoff, Klaidman, and Hirsh 12/27/2004)

During a National Security Council meeting attended by CIA Director Tenet, National Security Adviser Rice, Secretary of State Powell, Vice President Cheney and others, President Bush says of the 9/11 attacks, “Many believe Saddam [Hussein] is involved. That’s not an issue for now. If we catch him being involved, we’ll act. He probably was behind this in the end.” He also says, “What we do in Afghanistan is an important part of our effort. It’s important to be serious and that’ll be a signal to other countries about how serious we are on terror.” He mentions Syria and Iran as countries he wants to warn. This is according to journalist Bob Woodward, who interviews many top officials at the meeting. (Woodward 2002, pp. 167) One week earlier, the CIA advised Bush that there was no link between al-Qaeda and the Iraqi government. CIA Director Tenet also told Bush that the one alleged connection between Iraq and the 9/11 attack “just doesn’t add up” (see September 21, 2001).

Several media outlets report that, in addition to other transactions, the hijackers received $100,000 wired from Pakistan to two accounts of Mohamed Atta in Florida (see also Summer 2001 and before and Early August 2001). (ABC News 9/30/2001; CNN 10/1/2001; Fox News 10/2/2001; Margasak 10/2/2001) For example, CNN says, “Suspected hijacker Mohamed Atta received wire transfers via Pakistan and then distributed the cash via money orders bought here in Florida. A senior law enforcement source tells CNN, the man sending the money to Atta is believed to be Ahmed Omar Saeed Sheikh.” (CNN 10/6/2001; CNN 10/7/2001; Ressa 10/8/2001) The story will also be mentioned by Congressman John LaFalce at a hearing before the House of Representatives’ Committee on Financial Services. (US Congress 10/3/2001) However, Pakistan, a nuclear power, has already become a key US ally in the war on terror (see September 13-15, 2001). ISI Director Mahmood Ahmed, who is found to have had several telephone conversations with Saeed (see Summer 2000), is replaced (see October 7, 2001), and the story soon disappears from view (see September 24, 2001-December 26, 2002).

Mahmood Ahmed is supposedly helping the US defeat the Taliban (see September 13-15, 2001) while secretly helping the Taliban resist the US (see September 17-18 and 28, 2001 and Mid-September-October 7, 2001). Jalaluddin Haqqani is a Taliban leader close to bin Laden who controls the Khost region of eastern Afghanistan where most of bin Laden’s training camps and supporters are. Journalist Kathy Gannon will later note, “Had he wanted to, Haqqani could have handed the United States the entire al-Qaeda network.” (Gannon 2005, pp. 94) He also has extensive ties with the ISI, and was a direct CIA asset in the 1980s (see (1987)). Journalist Steve Coll will later say, “There was always a question about whether Haqqani was really Taliban, because he hadn’t come out of Kandahar; he wasn’t part of the core group. And it was quite reasonable to believe after 9/11 that maybe he could be flipped.… [US officials] summoned him to Pakistan, and they had a series of meetings with him, the content of which is unknown.” (Coll 10/3/2006) In early October 2001, Haqqani makes a secret trip to Pakistan and meets with Mahmood. Mahmood advises him to hold out and not defect, saying that he will have help. Haqqani stays with the Taliban and will continue to fight against the US long after the Taliban loses power. (Gannon 2005, pp. 94)

[Source: Public domain]ISI Director Lt. Gen. Mahmood Ahmed is replaced in the face of US pressure after links are discovered between him, Saeed Sheikh, and the funding of the 9/11 attacks. Mahmood instructed Saeed to transfer $100,000 into hijacker Mohamed Atta’s bank account prior to 9/11. This is according to Indian intelligence, which claims the FBI has privately confirmed the story. (Press Trust of India 10/8/2001; Joshi 10/9/2001; Gupta and Mehkri 10/15/2001; Kak 10/18/2001) The story is not widely reported in Western countries, though it makes the Wall Street Journal. (Zubrzycki 10/10/2001; Agence France-Presse 10/10/2001; Taranto 10/10/2001) It is reported in Pakistan as well. (Dawn (Karachi) 10/8/2001) The Northern Alliance also repeats the claim in late October. (Federal News Service 10/31/2001) In Western countries, the usual explanation is that Mahmood is fired for being too close to the Taliban. (Hussain 10/9/2001; Harding 10/9/2001) The Times of India reports that Indian intelligence helped the FBI discover the link, and says, “A direct link between the ISI and the WTC attack could have enormous repercussions. The US cannot but suspect whether or not there were other senior Pakistani Army commanders who were in the know of things. Evidence of a larger conspiracy could shake US confidence in Pakistan’s ability to participate in the anti-terrorism coalition.” (Joshi 10/9/2001) There is evidence some ISI officers may have known of a plan to destroy the WTC as early as July 1999. Two other ISI leaders, Lt. Gen. Mohammed Aziz Khan and Lt. Gen. Muzaffar Usmani, are sidelined on the same day as Mahmood (see October 8, 2001). (Kaplan 10/8/2001) Saeed had been working under Khan. The firings are said to have purged the ISI of its fundamentalists. However, according to one diplomat, “To remove the top two or three doesn’t matter at all. The philosophy remains.… [The ISI is] a parallel government of its own. If you go through the officer list, almost all of the ISI regulars would say, of the Taliban, ‘They are my boys.’” (Hersh 10/29/2001) It is believed Mahmood has been living under virtual house arrest in Pakistan (which would seem to imply more than just a difference of opinion over the Taliban), but no charges have been brought against him, and there is no evidence the US has asked to question him. (Shahzad 1/5/2002) He also has refused to speak to reporters since being fired (Gannon 2/21/2002) , and outside India and Pakistan, the story has only been mentioned infrequently in the media since. (Mackay 2/24/2002; Fielding 4/21/2002) He will reemerge as a businessman in 2003, but still will not speak to the media (see July 2003).

Lt. Gen. Ehsan ul-Haq.Lt. Gen. Ehsan ul-Haq. [Source: ISI Public Relations]When Pakistani President Pervez Musharraf fires ISI Director Lt. Gen. Mahmood Ahmed on October 7, 2001 (see October 7, 2001), the US government and the international media hail the move as an attempt to purge Islamist extremists from the ISI. But authors Adrian Levy and Catherine Scott-Clark will comment in a 2007 book, “But far from it being an attempt to come clean with the US, it was a move that further entrenched the extremist element in the military, as well as strengthening the hand of Musharraf.” They point out that only Mahmood and Lt. Gen. Muzzaffar Usmani had the background and power base to stand up to Musharraf, and both of them are fired. (Levy and Scott-Clark 2007, pp. 317-319) The new ISI director is Lt. Gen. Ehsan ul-Haq, a long-time friend of Musharraf. (Tamayo 10/9/2001; Popham 11/10/2001) While ul-Haq is presented as more moderate than Mahmood, media accounts from earlier in the year indicate that he is an Islamist extremist as well. He is quoted as saying, “There’s the American New World Order and this world order,” pointing to the Koran. “The whole of the globe belongs to Allah, and the whole of Allah’s law has to be executed on the globe.” (Feder 9/17/2001) And in a Newsweek profile, he proclaims that he is fighting a holy war for Allah, praising martyrdom and even saying that his forces in Kashmir have been aided by angels: “I have seen corpses where the heads were chopped off—not by man, but by angels.” (Power 2/19/2001) Musharraf also promotes two loyal allies, Lt. Gen. Mohammed Aziz Khan, and Gen. Mohammed Yusaf. Aziz Khan, who is promoted to chairman of the joint chiefs of staff (a mostly ceremonial position), has been particularly close to Islamist groups, and had previously convinced Musharraf not to clamp down on the Taliban and bin Laden in the face of US pressure. Yusaf is promoted to vice chief of army staff. Both are members of the Tablighi Jamaat movement, which advocates replacing Pakistan’s civilian government with a clerical one. Sharifuddin Pirzada, Musharraf’s legal counselor, will comment in 2007, “Although Musharraf had been presented to the outside world as leader since the coup of 1999, it was really a cabal of generals who had pitched in and elevated him. But after 9/11, those who acted as balances and power breaks were disposed of or died accidentally, leaving Musharraf preeminent.” (Levy and Scott-Clark 2007, pp. 317-319)

The Observer reports that investigators of the anthrax attacks (see October 5-November 21, 2001) believe Iraq is the prime suspect. One CIA source says, “They aren’t making this stuff in caves in Afghanistan. ‘This is prima facie evidence of the involvement of a state intelligence agency. Maybe Iran has the capability. But it doesn’t look likely politically. That leaves Iraq.” (Rose and Vulliamy 10/14/2001) However, this theory only remains the predominant one for a few days. On October 19, the New York Times is dismissive of the Iraq theory and suggests al-Qaeda or a disgruntled American loner could be behind the attacks instead (see October 19, 2001). In November, the American loner theory will become predominant (see November 10, 2001). But in late 2002, with war against Iraq growing increasingly likely, the Iraq theory appears to make a comeback (see October 28, 2002).

Italy’s military intelligence service (SISMI) provides Jeff Castelli, the CIA station chief in Rome, with papers documenting an alleged uranium deal between Iraq and Niger. Castelli, who is not permitted to duplicate the papers, writes a summary of them and sends the report to Langley. (Hersh 10/27/2003; Landay 11/4/2005; Bonini and D'Avanzo 11/11/2005)
The allegations - The report includes four allegations:
bullet The report states that Iraq first communicated its interest in purchasing uranium from Niger at least as early as 1999. (US Congress 7/7/2004) As blogger ERiposte will conclude through his analysis at TheLeftCoaster.Org (ERiposte 10/31/2005) , none of the documents that are later provided to the US as the basis for this allegation include actual proof of uranium negotiations in 1999. Two of the source documents for this allegation do mention a 1999 visit by Wissam Al-Zahawi to Niger; however, no evidence has ever surfaced suggesting that there were any discussions about uranium during that visit (see February 1999). The first document (possibly authentic) is a letter, dated February 1, 1999, from the Niger embassy in Rome to Adamou Chekou, the Minister of Foreign Affairs in Niger, announcing Zahawie’s trip. It does not mention uranium. (Note that the SISMI report does not mention Al-Zahawi’s trip, it only states that uranium negotiations between the two countries began by at least 1999.) The second document is a letter dated July 30, 1999 from the Niger Ministry of Foreign Affairs to his ambassador in Rome requesting that he contact Zahawie, concerning an agreement signed June 28, 2000 to sell uranium to Iraq. The letter is an obvious forgery because it refers to an event that it describes as taking place 11 months later. (Unknown n.d.; La Repubblica (Rome) 7/16/2003)
bullet The SISMI report states that in “late 2000,” the State Court of Niger approved an agreement with Iraq whereby Niger would sell Iraq a large quantity of uranium. This allegation appears to be based on a forged document titled “Annex 1,” which was possibly an annex to the alleged uranium agreement. It is evident that this document was forged because it says that the state court “met in the chamber of the council in the palace… on Wednesday, July 7, 2000.” But July 7, 2000 was, in fact, a Friday, not a Wednesday. One of SISMI’s reports to the US, possibly this one, actually reproduces this error. (Unknown n.d.; La Repubblica (Rome) 7/16/2003; ERiposte 10/31/2005)
bullet According to the report, Nigerien President Mamadou Tandja approved the agreement and communicated this decision to Iraqi President Saddam Hussein. The source for this is apparently a forged letter from the president of Niger to Saddam Hussein, in which the president refers to his authority under the country’s obsolete 1966 constitution. At the time the letter was presumed to have been written, the constitution in effect would have been that of December 26, 1992, which was subsequently revised by national referendum on May 12, 1996 and again by referendum on July 18, 1999. (Unknown n.d.; Charbonneau 3/26/2003; La Repubblica (Rome) 7/16/2003; US Department of State 9/2005)
bullet The report also alleges that in October 2000, Nigerien Minister of Foreign Affairs Nassirou Sabo informed one of his ambassadors in Europe that Niger had agreed to provide several tons of uranium to Iraq. (Unknown n.d.; La Repubblica (Rome) 7/16/2003) This is seemingly based on a forged letter that accompanied the alleged uranium sales agreement. The letter, dated October 10, 2000, is stamped as being received in Rome on September 28, 2000—nearly two weeks before the letter was presumably written. Furthermore, there is a problem with the signature. Unlike what is reported in the SISMI papers provided to the CIA, the actual letter is signed by Allele Elhadj Habibou, who left office in 1989. This indicates that someone must have corrected this information, replacing the name of Allele Elhadj Habibou with that of Nassirou Sabo (the minister in October 2000), before the letter was included in this report. Distribution within US Intelligence Community - After receiving the report from its Rome station, the CIA distributes it to other US intelligence agencies. According to a later Senate investigation, the “CIA, Defense Intelligence Agency (DIA), and Department of Energy (DOE) analysts considered the reporting to be ‘possible’ while the Department of State’s Bureau of Intelligence and Research (INR) regarded the report as ‘highly suspect,’ primarily because INR analysts did not believe that Niger would be likely to engage in such a transaction and did not believe Niger would be able to transfer uranium to Iraq because a French consortium maintained control of the Nigerien uranium industry.” (US Congress 7/7/2004) Sources later interviewed by New Yorker’s Seymour Hersh portray US intelligence analysts’ assessment of the report in slightly harsher terms, saying that they “dismissed [it] as amateurish and unsubstantiated.” (Hersh 10/27/2003) “I can fully believe that SISMI would put out a piece of intelligence like that,” a CIA consultant later tells Hersh, “but why anybody would put credibility in it is beyond me.” (Hersh 5/17/2004, pp. 227) Langley asks for further clarification from Rome and receives a response three days later (see October 18, 2001). Repeated Dissemination - The documents and reports based on the documents are sent to the CIA at least three separate times. They are also sent to the White House, the US embassy in Rome, British and French intelligence, and Italian journalist Elisabetta Burba of the news magazine Panorama. Each recipient in turn shares the documents, or their contents, with others, creating what author Craig Unger later calls “an echo chamber that gives the illusion that several independent sources had corroborated an Iraq-Niger uranium deal.” (Unger 2007, pp. 237)

Following a number of meetings in Rome and London between SISMI, Italy’s military intelligence, and the British MI6 (Bamford 2004, pp. 303-304) , SISMI provides the British with an intelligence report on Iraq’s alleged efforts to obtain uranium from Niger. The report—delivered by freelance SISMI agent Rocco Martino to the Vauxhall Cross headquarters of Britain’s MI6 in south London—is reportedly based on the collection of mostly forged documents put together in Italy (see Between Late 2000 and September 11, 2001). MI6 will include this information in a report it sends to Washington saying only that it was obtained from a “reliable source.” Washington treats the report as an independent confirmation of the Italian report (see October 15, 2001). (Bonini and d'Avanzo 10/24/2005; Bonini and d'Avanzo 10/25/2005; Collier 10/30/2005; Buncombe, Phillips, and Whitaker 11/6/2005; Unger 2007, pp. 228-229)

Vice President Cheney chairs a National Security Council meeting because President Bush is overseas. According to journalist Bob Woodward, who later interviews many participants in the meeting, the topic of the recent anthrax attacks is discussed (see October 5-November 21, 2001). CIA Director George Tenet suggests that al-Qaeda is behind the attacks. He also adds, “I think there’s a state sponsor involved. It’s too well thought out, the powder’s too well refined. It might be Iraq, it might be Russia, it might be a renegade scientist,” perhaps from Iraq or Russia. Vice President Cheney’s chief of staff I. Lewis Libby also suggests the anthrax attacks were state sponsored. “We’ve got to be careful on what we say. If we say it’s al-Qaeda, a state sponsor may feel safe and then hit us thinking they will have a bye because we’ll blame it on al-Qaeda.” Tenet replies, “I’m not going to talk about a state sponsor.” Vice President Cheney comments, “It’s good that we don’t, because we’re not ready to do anything about it.” (Woodward 2002, pp. 244) No strong evidence will emerge tying the attacks to al-Qaeda or any state sponsor. The anthrax attacks still remain completely unsolved.

Nicolo Pollari, chief of Italy’s military intelligence service (SISMI—see (After October 18, 2001) and September 9, 2002), responds to the CIA’s request for clarification on the alleged uranium deal between Iraq and Niger (see October 15, 2001). Pollari’s page and a half letter explains that “the information comes form a creditable source, La Signora [Laura Montini],” who has in the past “given SISMI the cryptographic codes and memorandum ledgers from the Niger Embassy.” (Bonini and D'Avanzo 11/11/2005) Some time around this same date, according to La Repubblica, Pollari discusses the issue with Italy’s Minister of Defense, Antonio Martino (no relation to Rocco Martino, the document peddler—see March 2000, Late June 2002, Afternoon October 7, 2002, and Summer 2004). Martino tells Pollari to expect a visit from “an old friend of Italy,” Martino’s longtime friend and colleague Michael Ledeen (see (After October 18, 2001) and April 3, 2005). Ledeen will later deny that any such meeting with Pollari ever happened. Pollari will deny any involvement with the Iraq-Niger affair. (Unger 2007, pp. 235-236)

(It is not clear from the reporting what exactly Pollari is dissappointed about. It has been interpreted to have meant that Pollari is disappointed about US intelligence’s refusal to take SISMI’s October 15 report seriously) Prime Minister Silvio Berlusconi had reportedly asked Pollari to establish closer relations with Washington (see Shortly after September 11, 2001). According to La Repubblica, the prime minister’s diplomatic advisor, Gianni Castellaneta, advises Pollari to look in “other directions.” The Italian minister of defense, Antonio Martino, invites Pollari to meet with American neoconservative Michael Ledeen, which he does in December (see December 9, 2001). One of its brochures described it as investing “in niche opportunities created in industries heavily affected by changes in governmental policies.” (Warner 3/18/2002) It is also the 11th-largest defense contractor in the US. (Red Herring 12/11/2001) Since being established in 1987, it has signed up many former politicians and used their contacts and influence to promote itself. (Burkeman and Borger 10/31/2001) Those on its payroll include former Secretary of State James Baker, former White House budget director Dick Darman, former British Prime Minister John Major, and former US President George H. W. Bush. Its chairman is former CIA Director Frank Carlucci. (Warner 3/18/2002) Following 9/11, news reports revealed that Carlyle had a business relationship with Osama bin Laden’s family. According to a Carlyle executive, in 1995 the bin Ladens invested $2 million in the Carlyle Partners II fund, which includes various defense holdings. This was a fairly small amount considering the entire fund is worth $1.3 billion. However, a foreign financier with ties to the bin Ladens claimed their overall investment with Carlyle was much larger. (Golden, Bandler, and Walker 9/27/2001; Briody 5/8/2003) Shafig bin Laden, one of Osama’s brothers, had actually been in Washington, DC, on the morning of 9/11, attending the Carlyle Group’s annual investor conference there (see (9:00 a.m.) September 11, 2001). Former President George H. W. Bush, who is senior adviser to Carlyle Group’s Asian Partners fund, has twice met with the bin Laden family on behalf of the company (see November 1998; January 2000). On this day though, the Carlyle Group ends its relationship with the bin Ladens, and gives them back their investment. (Red Herring 12/11/2001; Warner 3/18/2002) But the family is very well-connected, and their investment in Carlyle is hardly unusual for them. The New Yorker will note, “Much of the family’s private banking is handled by Citigroup, which is chaired by former Treasury Secretary Robert Rubin. The family has equity investments with Merrill Lynch and Goldman, Sachs. Among the family’s business partners is General Electric. A spokesman for Jack Welch, the chairman of G.E., says that the family threw a party for him in the nineteen-nineties in Saudi Arabia, and that Welch ‘considers them good business partners.’ One American diplomat says, ‘You talk about your global investors, it’s them. They own part of Microsoft, Boeing, and who knows what else.’” (Mayer and Szechenyi 11/5/2001)

A London Times article by Daniel McGrory claims that not only did Mohamed Atta meet with an Iraqi agent in Prague, but that “a special FBI team” is studying “a report from Prague that anthrax spores were given to Atta” during the meeting. Furthermore, “Saddam’s agents were spotted at various times this year with Atta in Germany, Spain, Italy and the Czech Republic,” and that Atta met with the agent in Prague at least four times. Additionally, an Iraqi intelligence agent in Rome was seen with Atta in Prague and Hamburg and then disappeared shortly before the 9/11 attacks. The article also alleges numerous meetings between Iraqi agents and Osama bin Laden, as well as a meeting between al-Qaeda second-in command Ayman Zawahiri and Iraqi Vice-President Taha Yasin Ramadan. Furthermore, al-Qaeda operatives were supposedly given advanced weapons training in Iraq supervised by Saddam Hussein’s son Uday Hussein. The article mentions no sources at all for these stunning allegations, except to refer to some other recent articles in a couple of cases. However, the article does mention former CIA Director James Woolsey, and it seems probable that Woolsey is a force behind the article, since he is in London at the time attempting to find evidence supporting the Prague meeting and Iraqi involvement in the anthrax attacks (see Mid-September-October 2001). (McGrory 10/27/2001) This article represents the height of the propaganda effort attempting to link al-Qaeda and the Iraqi government together. Many of the allegations in the article are never mentioned in any other newspaper article, and all of them will eventually be debunked.

[Source: Publicity photo]Defense Secretary Donald Rumsfeld announces the establishment of a new unit within the Office of the Secretary of Defense, called the Office of Force Transformation (OFT). Rumsfeld had called for the establishment of this office “as part of President Bush’s broad mandate to transform the Department of Defense. This transformation process challenges the organizational status quo with a new architecture for American defense in order to ensure an overwhelming and continuing competitive advantage for America’s military for decades to come.” He appoints retired Navy Vice Admiral Arthur Cebrowski—the former president of the Naval War College in Newport, Rhode Island—as its director. (US Department of Defense 11/26/2001; Keller 3/10/2002) Also recruited for this new department, as assistant for strategic futures, is Thomas Barnett, a senior strategic researcher at the Naval War College. As the “vision guy,” Barnett’s job is “to generate and deliver a compelling brief that would mobilize the Defense Department toward generating the future fighting force demanded by the post-9/11 strategic environment.” Barnett claims that, over time, senior military officials will come to cite his brief as “a Rosetta stone for the Bush administration’s new national security strategy.” (Barnett 2004, pp. 5-6) Prior to 9/11, Barnett was the director of a research partnership between the Naval War College and the Wall Street bond firm Cantor Fitzgerald, called the New Rule Sets Project (see May 1, 2000-June 4, 2001). Considering that the OFT is a personal initiative of the defense secretary, it is interesting that Rumsfeld was in the late 1990s one of the founders of the neoconservative think tank, Project for the New American Century (PNAC) (see June 3, 1997). (BBC 8/25/2005; Kamen 6/12/2006; Rogin 9/4/2006) In September 2000, PNAC published a strategy document called “Rebuilding America’s Defenses” (see September 2000). Among other things, this laid out the need to establish “four core missions” for US military forces, one of these being to “transform US forces to exploit the ‘revolution in military affairs.’” The OFT appears to be fulfilling this mission. However, the PNAC document had continued, “the process of transformation, even if it brings revolutionary change, is likely to be a long one, absent some catastrophic and catalyzing event—like a new Pearl Harbor.” (Project for the New American Century 9/2000, pp. iv and 51 pdf file)

According to a September 2002 USA Today article, the decision to invade Iraq is made at this time. Significantly, the decision is made independent of normal policy-making procedures—a National Intelligence Estimate (NIE) on Iraq was not requested, members of Congress were not consulted, and the concerns of senior military officers and intelligence analysts were ignored. Explaining why the White House did not request a NIE on Iraq, an unnamed US intelligence official explains it didn’t want to detail the uncertainties regarding the threat Iraq allegedly poses to the US. A senior administration official says the White House did not believe an NIE would be helpful. However in September 2002, an NIE will finally be requested as a result of pressure from Congress. The classified version of the document will include many qualified and nuanced statements, but the shorter, unclassified version, which is given to Congress, will not include these uncertainties (see October 1, 2002). John Yoo, a lawyer for the Justice Department’s Office of Legal Counsel and a member of Vice President Cheney’s ad hoc legal team tasked to radically expand the power of the presidency, writes a legal brief declaring that President Bush does not need approval from Congress or the federal courts for denying suspected terrorists access to US courts, and instead can be tried in military commissions (see (After 10:00 a.m.) September 11, 2001). Two other team members, Cheney’s chief of staff David Addington and White House deputy counsel Timothy Flanigan, have decided that the government bureaucrats need to see that Bush can and will act, in the words of author Craig Unger, “without their blessing—and without the interminable process that goes along with getting that blessing.” Yoo’s opinion is a powerful object lesson. Yoo later says that he saw no need to seek the opinion of the State Department’s lawyers; that department hosts the archives of the Geneva Conventions and its lawyers are among the government’s top experts on the laws of war. “The issue we dealt with was: Can the president do it constitutionally?” Yoo will say. “State—they wouldn’t have views on that.” Neither does Yoo see a need to consult with his own superiors at the Justice Department. Attorney General John Ashcroft is livid upon learning that the draft gives the Justice Department no say in which alleged terrorists will be tried in military commissions. According to witnesses, Ashcroft confronts Cheney and David Addington over the brief, reminding Cheney that he is the president’s senior law enforcement officer; he supervises the FBI and oversees terrorism prosecutions throughout the nation. The Justice Department must have a voice in the tribunal process. He is enraged, participants in the meeting recall, that Yoo had recommended otherwise as part of the White House’s strategy to deny jurisdiction to the courts. Ashcroft talks over Addington and brushes aside interjections from Cheney: “The thing I remember about it is how rude, there’s no other word for it, the attorney general was to the vice president,” one participant recalls. But Cheney refuses to acquiesce to Ashcroft’s objections. Worse for Ashcroft, Bush refuses to discuss the matter with him, leaving Cheney as the final arbiter of the matter. In the following days, Cheney, a master of bureaucratic manipulation, will steer the new policy towards Bush’s desk for approval while avoiding the usual, and legal, oversight from the State Department, the Justice Department, Congress, and potentially troublesome White House lawyers and presidential advisers. Cheney will bring the order to Bush for his signature, brushing aside any involvement by Ashcroft, Secretary of State Colin Powell, or National Security Adviser Condoleezza Rice (see November 11-13, 2001). Richard Perle, chairman of the Defense Policy Board, says in a speech delivered at the Foreign Policy Research Institute’s annual dinner that Saddam Hussein “is busily at work on a nuclear weapon” and that “it’s simply a matter of time before he acquires nuclear weapons.” His assertion is based on information that was provided to him personally by Iraqi defector Khidir Hamza. According to Perle, Hamza said that after the Israeli strikes against Iraq’s Osirak reactor in 1981 (see June 7, 1981), Iraq built some 400 uranium enrichment facilities all over the country in order to protect its nuclear program from future attacks. “Some look like farmhouses, some of them look like classrooms, some of them look like warehouses. You’ll never find them. They don’t turn out much but every day they turn out a little bit of nuclear materials.” (Perle 11/14/2001)

Defense Policy Board member Richard Perle, discussing the US’s planned reaction to the 9/11 attacks, says that Iraq is next on the US’s military strike list. CNN anchor John King asks, “Next phase Saddam Hussein?” and Perle replies, “Absolutely.” The day before, on ABC, Perle explained why the US had to make such a move: “Weapons of mass destruction in the hands of Saddam Hussein, plus his known contact with terrorists, including al-Qaeda terrorists, is simply a threat too large to continue to tolerate.” And what would the upshot of such an invasion be? Perle tells his CNN listeners, “We would be seen as liberators in Iraq.” (Moyers 4/25/2007)

The US Embassy in Niamey, Niger’s capital, disseminates a cable summarizing a recent meeting between the US ambassador and the director general of Niger’s French-led mining consortium. The director general reportedly explained that “there was no possibility” that the government of Niger could have diverted any of the 3,000 tons of uranium produced by the consortium’s two mines. (US Congress 7/7/2004)

Greg Thielmann, director for strategic proliferation and military affairs at the State Department’s Bureau of Intelligence and Research (INR), reviews Iraq’s alleged WMD programs for Secretary of State Colin Powell. Thielmann’s review concludes that Italian reports of a possible uranium deal between Iraq and Niger (see Between Late 2000 and September 11, 2001, October 15, 2001, October 18, 2001, November 20, 2001, February 5, 2002, Late April or Early May 2002-June 2002, and Late June 2002) are completely false. Thielmann will later recall: “A whole lot of things told us that the report was bogus. This wasn’t highly contested. There weren’t strong advocates on the other side. It was done, shot down” (see March 1, 2002). (Unger 2007, pp. 229)

Michael Ledeen, an avid admirer of Machiavelli, argues in a piece published by National Review Online that the US must be “imperious, ruthless, and relentless” against the Muslim world until there has been “total surrender.” Any attempt on the part of the US to be “reasonable” or “evenhanded” will only empower Islamic militants, he asserts. He writes: “We will not be sated until we have had the blood of every miserable little tyrant in the Middle East, until every leader of every cell of the terror network is dead or locked securely away, and every last drooling anti-Semitic and anti-American mullah, imam, sheikh, and ayatollah is either singing the praises of the United States of America, or pumping gasoline, for a dime a gallon, on an American military base near the Arctic Circle.” (Ledeen 12/7/2001) The piece is republished in the Jewish World Review four days later. (Ledeen 12/11/2001)

[Source: Ted Thai / Getty Images]The Bush administration sends two defense officials, Harold Rhode and Larry Franklin, to meet with Iranians in Rome in response to an Iranian government offer to provide information relevant to the war on terrorism. The offer had been backchanneled by the Iranians to the White House through Manucher Ghorbanifar, an Iranian arms trader and a central person in the Iran-Contra affair, who contacted another Iran-Contra figure, Michael Ledeen of the American Enterprise Institute. Ledeen passed the information on to his friends in the Defense Department who then relayed the offer to Deputy National Security Adviser Stephen Hadley. Hadley, who expressed no reservations about the proposed meeting, informed CIA Director George Tenet and Deputy Secretary of State Richard L. Armitage. According to officials interviewed by the New York Times, the United States Embassy in Rome was not notified of the planned meeting as required by standard interagency procedures. Neither the US embassy nor the CIA station chief in Rome learns of the three-day meeting until after it happens (see December 12, 2001). When they do catch wind of the meeting, they notify CIA and State Department headquarters in Washington which complain to the administration about how the meetings were arranged. (Royce and Phelps 8/9/2003; Graham and Slevin 8/9/2003; Risen 12/7/2003) In addition to Ghorbanifar, Ledeen, Franklin, and Rhode, the meeting is attended by Nicolo Pollari, head of SISMI, and Antonio Martino, Italy’s minister of defense. (Marshall, Rozen, and Glastris 9/2004)
Destabilizing the Iraqi Government - According to the Boston Globe, either at this meeting, a similar one in June (see June 2002), or both, Ledeen and Ghorbanifar discuss ways to destabilize the Iranian government, possibly using the Mujahedeen-e Khalq (MEK), a US-designated terrorist group, as a US proxy. (Bender 8/31/2004) The meetings are suspected of being an attempt by what investigative reporters Joshua Micah Marshall, Laura Rozen, and Paul Gastris will later call “a rogue faction at the Pentagon… trying to work outside normal US foreign policy channels to advance a ‘regime-change’ agenda.” The fact that MEK members attend the meetings adds weight to the claim. (Unger 2007, pp. 234-235)
Italian Intelligence on Iraq-Niger Allegations - Additionally, according to an unnamed SISMI source, Pollari speaks with Ledeen about intelligence his agency has collected (see October 15, 2001) suggesting that Iraq made a deal with Niger to purchase several tons of uranium. SISMI already sent a report to Washington on the matter in mid-October (see October 15, 2001). Reportedly, Pollari has also approached CIA Station Chief Jeff Castelli about the report, but Castelli has since indicated he is not interested in the information. (Bonini and d'Avanzo 10/25/2005)

According to a later report by the Senate Intelligence Committee, Pentagon officials conceal potentially life-saving intelligence gleaned from Iranian agents. The report will find that in 2001, the officials, Larry Franklin and Harold Rhode, fail to pass along information gained from Iranian agents to US intelligence agencies, including reports that Iran has sent “hit squads” to Afghanistan to kill Americans. The findings will be based on information from highly unreliable sources: Iranian arms merchant Manucher Ghorbanifar and former Pentagon official Michael Ledeen, both of whom have often provided false or questionable information gathered from questionable sources (see April 3, 2005). In a series of meetings authorized by then-Deputy National Security Adviser Stephen Hadley (see December 9, 2001, December 12, 2001, June 2002, July 2002, and June 2003), two Pentagon officials, including one who reported to then-Undersecretary of Defense for Policy Douglas Feith (see September 2002), meet with Ghorbanifar, Ledeen, and other Iranians. Hadley does not fully brief CIA Director George Tenet and Deputy Secretary of State Richard Armitage about the meetings. The head of the DIA is briefed on the meeting but is not authorized to keep a written summary of it or to discuss it on the orders of then-Deputy Defense Secretary Paul Wolfowitz. For his part, Ledeen will say he twice briefed the US ambassador to Italy about the meetings. “Any time the CIA wanted to find out what was going on all they had to do was ask,” he will say. Though the report will admit that the sources of the intelligence are unreliable, it will still criticize the Pentagon for failing to allow what it calls “potentially useful and actionable intelligence” to be shared with intelligence agencies. Vice President Cheney says on Fox News, “I never say anything is inevitable, but if I were Saddam Hussein, I’d be thinking very carefully about the future and I’d be looking very closely to see what happened to the Taliban in Afghanistan.” (Kirk 6/20/2006)

The newly-installed US ambassador to Italy, Mel Sembler, learns during the course of a private dinner with Iran-Contra figure Michael Ledeen and Italian defense minister Antonio Martino about the secret backchannel meeting they attended three days before (see December 9, 2001) with US defense officials, former Iran-Contra figures, and Iranian government officials. After the dinner, Sembler immediately contacts Jeff Castelli, the CIA station chief in Rome, to find out if he knows about the meeting. But the station chief says he was also unaware of the meeting. “Soon both Sembler and the Rome station chief were sending anxious queries back to the State Department and CIA headquarters in Langley, Va., respectively, raising alarms on both sides of the Potomac” since all US government contact with foreign government intelligence agencies is supposed to be overseen by the CIA. (Marshall, Rozen, and Glastris 9/2004) Old State Department hands are horrified to learn of Ledeen’s involvement with the Iraq-Niger fabrications. Bad enough that Elliott Abrams was brought into the administration (see November 2002-December 2002), they say, but with Ledeen and his associate [Iranian arms dealer Manucher] Ghorbanifar making an appearance, it seems to these State Department veterans that the days of Reagan-era “cowboy diplomacy” are back in full swing. “One of the truly remarkable elements of the neocon story is their addiction to Ghorbanifar,” a State Department official will say in 2007. “It is part of their ‘we are smarter, you are stupid’ attitude.” Author Craig Unger will note, “The key players in Iran-Contra were back in business.” (Unger 2007, pp. 234-235)

Yunus Qanooni, the interior minister of Afghanistan’s new government, accuses elements of Pakistan’s ISI of helping bin Laden and Mullah Omar escape from Afghanistan to Pakistan. He further asserts that the ISI are still “probably protecting” both bin Laden and Mullah Omar and “concealing their movements and sheltering leaders of Taliban and al-Qaeda.” (BBC 12/30/2001; Jehl 2/13/2002) In addition, New Yorker magazine will report in early 2002, “Some CIA analysts believe that bin Laden eluded American capture inside Afghanistan with help from elements of the [ISI].” (Hersh 1/21/2002) Another report suggests that Hamid Gul, former director of the ISI, is behind moves to help the Taliban establish a base in remote parts of Pakistan just across the Afghanistan border. Gul was head of the ISI from 1987 to 1989, but has remained close to Afghan groups in subsequent years and has been nicknamed the “godfather of the Taliban.” One report will later suggest that he was one of the masterminds of the 9/11 plot (see July 22, 2004). The US is said to be interested in interrogating Gul, but “because of his high profile and the ripples it would cause in the Pakistan army, this is unlikely to happen…” Yet, at the same time that the ISI is reportedly helping al-Qaeda and the Taliban escape, the Pakistan army is deployed to the Afghanistan border in large numbers to prevent them from escaping. (Shahzad 12/13/2001) In November 2001, it was reported that the US was continuing to rely on the ISI for intelligence about Afghanistan, a move none other than Gul publicly derided as “foolish.”(see November 3, 2001).

After fleeing Iraq, Adnan Ihsan Saeed al-Haideri, 43, defects to the US. Before he is debriefed by the CIA, he spends several days in a Bangkok hotel room being coached by Zaab Sethna, the spokesman of the Iraqi National Congress, on what he should tell his debriefer. On December 17, he meets with a CIA official who questions him. Strapped to a polygraph machine (Bamford 11/17/2005) , al-Haideri proceeds to tell the agent he is a civil engineer who helped hide Iraq’s illicit weapons in subterranean wells, private villas, and even beneath the Saddam Hussein Hospital. After reviewing the polygraph, which was requested by the Defense Intelligence Agency, the intelligence debriefer concludes that Haideri made the entire story up. (Mayer 6/7/2004; Bamford 11/17/2005)

Zaab Sethna of the Iraqi National Congress (INC) arranges for Iraqi defector Adnan Ihsan Saeed al-Haideri to be interviewed by Judith Miller of the New York Times. Miller, who has known Chalabi for about eight years (see May 1, 2003), immediately flies out to Bangkok for the interview. Her story is published on December 20, just three days after Haideri told his story to a CIA agent who subjected him to a polygraph and determined Haideri’s story was a complete fabrication (see December 17, 2001). Miller’s front-page article, titled “An Iraqi defector tells of work on at least 20 hidden weapons sites,” reports: “An Iraqi defector who described himself as a civil engineer, said he personally worked on renovations of secret facilities for biological, chemical and nuclear weapons in underground wells, private villas and under the Saddam Hussein Hospital in Baghdad as recently as a year ago.” If verified, Miller notes, “his allegations would provide ammunition to officials within the Bush administration who have been arguing that Mr. Hussein should be driven from power partly because of his unwillingness to stop making weapons of mass destruction, despite his pledges to do so.” Sethna also contacts freelance journalist Paul Moran. Moran is a former employee of the INC and has been employed for years by the Rendon Group, a firm specializing in “perception management” and which helped develop the INC (see May 1991). Moran’s on-camera interview with Haideri is broadcast worldwide by the Australian Broadcasting Corp. (Weapons 12/20/2001; Hoskings 7/23/2003; Massing 2/26/2004; Bamford 11/17/2005) Reporter Jonathan Landay will later say that he and others were skeptical from the outset: “There were some red flags that the New York Times story threw out immediately, which caught our eye, immediately. The first was the idea that a Kurd—the enemy of Saddam—had been allowed into his most top secret military facilities. I don’t think so. That was, for me, the biggest red flag. And there were others, like the idea that Saddam Hussein would put a biological weapons facility under his residence. I mean, would you put a biological weapons lab under your living room? I don’t think so.” Landay’s partner Warren Strobel will add, “The first rule of being an intelligence agent, or a journalist, and they’re really not that different, is you’re skeptical of defectors, because they have a reason to exaggerate. They want to increase their value to you. They probably want something from you. Doesn’t mean they’re lying, but you should be—journalists are supposed to be skeptical, right? And I’m afraid the New York Times reporter in that case and a lot of other reporters were just not skeptical of what these defectors were saying. Nor was the administration…” (Moyers 4/25/2007)

US aid to Pakistan skyrockets from a mere $5 million in 2001 to over $1.1 billion in 2002 (see February 14, 2002). (Kaplan et al. 6/2/2003) In 2003, the New Yorker will report: “Since September 11th, Pakistan has been rescued from the verge of bankruptcy. The United States lifted economic sanctions that were imposed in 1998, after Pakistan began testing nuclear weapons, and it restored foreign aid.” Rahimullah Yusufzai, a Pakistani journalist who has interviewed Osama bin Laden, will say, “Essentially, [Pakistani President Pervez] Musharraf was very lucky this happened in his neighborhood.” (Mayer 7/28/2003) Ironically, there have been reports that the ISI Pakistani intelligence agency was involved in the 9/11 attacks and even that ISI Director Mahmood Ahmed ordered money to be sent to hijacker Mohamed Atta (see October 7, 2001).

John Yoo, a neoconservative lawyer in the Justice Department’s Office of Legal Counsel serving as deputy assistant attorney general, writes a classified memo to senior Pentagon counsel William J. Haynes, titled “Application of Treaties and Law to al-Qaeda and Taliban Detainees.” (Lewis 5/21/2004)
Yoo: Geneva Conventions Do Not Apply in War on Terror - Yoo’s memo, written in conjunction with fellow Justice Department lawyer Robert Delahunty, echoes arguments by another Justice Department lawyer, Patrick Philbin, two months earlier (see November 6, 2001). Yoo states that, in his view, the laws of war, including the Geneva Conventions, do not apply to captured Taliban or al-Qaeda prisoners, nor do they apply to the military commissions set up to try such prisoners.
Geneva Superseded by Presidential Authority - Yoo’s memo goes even farther, arguing that no international laws apply to the US whatsoever, because they do not have any status under US federal law. “As a result,” Yoo and Delahunty write, “any customary international law of armed conflict in no way binds, as a legal matter, the president or the US armed forces concerning the detention or trial of members of al-Qaeda and the Taliban.” In essence, Yoo and Delahunty argue that President Bush and the US military have carte blanche to conduct the global war on terrorism in any manner they see fit, without the restrictions of law or treaty. However, the memo says that while the US need not follow the rules of war, it can and should prosecute al-Qaeda and Taliban detainees for violating those same laws—a legal double standard that provokes sharp criticism when the memo comes to light in May 2004 (see May 21, 2004). Yoo and Delahunty write that while this double standard may seem “at first glance, counter-intuitive,” such expansive legal powers are a product of the president’s constitutional authority “to prosecute the war effectively.” The memo continues, “Restricting the president’s plenary power over military operations (including the treatment of prisoners)” would be “constitutionally dubious.” (Mother Jones 1/9/2002; US Department of Justice 6/9/2002 pdf file; Isikoff 5/21/2004; Lewis 5/21/2004)
Overriding International Legal Concerns - Yoo warns in the memo that international law experts may not accept his reasoning, as there is no legal precedent giving any country the right to unilaterally ignore its commitment to Geneva or any other such treaty, but Yoo writes that Bush, by invoking “the president’s commander in chief and chief executive powers to prosecute the war effectively,” can simply override any objections. “Importing customary international law notions concerning armed conflict would represent a direct infringement on the president’s discretion as commander in chief and chief executive to determine how best to conduct the nation’s military affairs.” (Savage 2007, pp. 146) The essence of Yoo’s argument, a Bush official later says, is that the law “applies to them, but it doesn’t apply to us.” (Isikoff 5/21/2004) Navy general counsel Alberto Mora later says of the memo that it “espoused an extreme and virtually unlimited theory of the extent of the president’s commander-in-chief authority.” (Savage 2007, pp. 181)
White House Approval - White House counsel and future Attorney General Alberto Gonzales agrees (see January 25, 2002), saying, “In my judgment, this new paradigm renders obsolete Geneva’s strict limitations on questioning of enemy prisoners and renders quaint some of its provisions.” (Mother Jones 1/9/2002)
Spark for Prisoner Abuses - Many observers believe that Yoo’s memo is the spark for the torture and prisoner abuses later reported from Iraq’s Abu Ghraib prison (see Evening November 7, 2003), Guantanamo Bay (see December 28, 2001), and other clandestine prisoner detention centers (see March 2, 2007). The rationale is that since Afghanistan is what Yoo considers a “failed state,” with no recognizable sovereignity, its militias do not have any status under any international treaties. (Isikoff 5/21/2004; Barry, Hirsh, and Isikoff 5/24/2004)
Resistance from Inside, Outside Government - Within days, the State Department will vehemently protest the memo, but to no practical effect (see January 25, 2002).

Pakistani President Pervez Musharraf makes “a forceful speech… condemning Islamic extremism.” (Hoagland 3/28/2002) He is essentially forced to make the speech in response to intense international pressure, as incursions by Islamist militants backed by Pakistan into the disputed region of Kashmir have brought Pakistan and India to the brink of nuclear war. For instance, on January 6, President Bush says publicly, “I think it’s very important for President Musharraf to make a clear statement to the world that he intends to crack down on terror. And I believe if he does that… it’ll provide relief… on a situation that’s still serious.” The US even gives Musharraf a list of points to cover in the speech, and he says everything the US wants him to say. In the speech, Musharraf says: “Pakistan has been made a soft state where the supremacy of law is questioned. This situation cannot be tolerated any longer.… Pakistan rejects and condemns terrorism in all its forms and manifestations. Pakistan will not allow its territory to be used for any terrorist activity anywhere in the world.… No organization will be allowed to indulge in terrorism in the name of Kashmir.” He specifically denounces violent jihad for the first time. However, he does not renounce Pakistan’s claims to Kashmir, saying, “Kashmir runs in our blood.” He announces a ban on five militant groups, and more than a thousand militants are arrested after the speech. The speech does cool tensions with India temporarily. But within several months it is clear that the attacks in Kashmir are continuing and most of the arrested militants have been released (see Shortly After January 12-March 2002). Pakistan and India come close to nuclear war again by May 2002. (Rashid 2008, pp. 116-118, 146)

Two analysts in CIA’s WINPAC division review the Niger documents and notice some inconsistencies. But as they later explain to congressional investigators, they don’t see anything “jumping out at [them] that the documents [are] forgeries.” (Isikoff and Corn 2006, pp. 164) By this time, at least three other US intelligence analysts, and one Italian journalist have reviewed the documents and raised questions about their authenticity (see Afternoon October 7, 2002, October 9, 2002, October 15, 2002, and Mid-October 2002).

FBI Director Mueller visits India, and is told by Indian investigators that Saeed Sheikh sent ransom money to hijacker Mohamed Atta in the US. In the next few days, Saeed is publicly blamed for his role with gangster Aftab Ansari in financing Atta and organizing the Calcutta attack (see January 22, 2002). (Press Trust of India 1/22/2002; Watson 1/23/2002; Popham 1/24/2002; France-Presse 1/27/2002; Syal and Hastings 1/27/2002) Meanwhile, on January 23, Saeed helps kidnap reporter Daniel Pearl and is later arrested. Also on January 23, Ansari is placed under surveillance after flying to Dubai, United Arab Emirates. On January 24, Mueller and US Ambassador to Pakistan Wendy Chamberlin discuss Saeed at a previously scheduled meeting with Pakistani President Pervez Musharraf. Apparently Saeed’s role in Pearl’s kidnapping is not yet known. (Yost 2/24/2002) On Mueller’s way back to the US he flies to Dubai to pressure the government there to arrest Ansari and deport him to India. Ansari is arrested on February 5 and deported four days later. (Sharma 2/10/2002; Swami 2/16/2002; India Today 2/25/2002)

President Bush’s State of the Union speech describes an “axis of evil” consisting of Iraq, Iran, and North Korea. Osama bin Laden is not mentioned in the speech. (US President 2/4/2002) Bush says: “States like these and their terrorist allies, constitute an axis of evil, arming to threaten the peace of the world. By seeking weapons of mass destruction, these regimes pose a grave and growing danger. They could provide these arms to terrorists, giving them the means to match their hatred. They could attack our allies or attempt to blackmail the United States. In any of these cases, the price of indifference would be catastrophic.” Bush goes on to suggest for the first time that the US might be prepared to launch pre-emptive wars by saying, “The United States of America will not permit the world’s most dangerous regimes to threaten us with the world’s most destructive weapons.” (Burrough et al. 5/2004) When Bush advisor Richard Perle was asked one month before 9/11 about new challenges the US faced, he replied by naming these exact three countries (see August 6, 2001). Michael Gerson, head of the White House speechwriting team at the time, will later claim that, as Newsweek will later put it, “Bush was already making plans to topple Saddam Hussein, but he wasn’t ready to say so.” Iran and North Korea are inserted into the speech in order to avoid focusing solely on Iraq. The speech is followed by a new public focus on Iraq and a downplaying of bin Laden (see September 15, 2001-April 6, 2002). Prior to the speech, the Iranian government had been very helpful in the US fight against the Taliban, since the Taliban and Iran were enemies. (Hirsh and Bahari 2/12/2007) At the time, al-Qaeda operatives had been streaming into Iran from Afghanistan following the defeat of the Taliban. Iran has been turning over hundreds of suspects to US allies and providing US intelligence with the names, photographs, and fingerprints of those it is holding. (Linzer 2/10/2007) Newsweek will later say that it is “beyond doubt” the Iranian government was “critical… to stabilizing [Afghanistan] after the fall of Kabul.” But all this cooperation comes to an end after the speech. Iranian Deputy Foreign Minister Mohammad Hossein Adeli will later say that “Those [inside the Iranian government] who were in favor of a rapprochement with the United States were marginalized. The speech somehow exonerated those who had always doubted America’s intentions.” (Hirsh and Bahari 2/12/2007) In August 2003, reporter Jeffrey St. Clair will write that “the Axis of Evil [is not] an ‘axis’ at all, since two of the states, Iran and Iraq, hate… each other, and neither [have] anything at all to do with the third, North Korea.” (Clair 8/13/2003)

When asked why he included Iran in the “axis of evil” (see January 29, 2002), President Bush answers: “It is very important for the American president at this point in history to speak very clearly about the evils the world faces.… I believe the United States is the beacon for freedom in the world. And I believe we have a responsibility to promote freedom that is as solemn as the responsibility is to protecting the American people, because the two go hand in hand.” (Scoblic 2008, pp. 247)

The State Department’s Bureau of Intelligence and Research (INR) sends Colin Powell a memo warning that the current draft (see January 30-February 4, 2003) of Powell’s UN speech contains 38 “weak” and “unsubstantiated” allegations. It says the allegation that Saddam has plans to conceal his WMDs is from mostly “questionable sources” and that the alleged decontamination vehicles—purported to be evidence of Iraqi WMD—are “water trucks that can have legitimate uses.” The memo emphatically warns that the section on the aluminum tubes is “WEAK” and contains “egregious errors.” It also disputes the speech’s claim that terrorists “could come through Baghdad and pick-up biological weapons.” As a result of the memo’s warnings, 28 of the 38 allegations identified by INR as weak are removed from the draft. Two days later, three more claims are removed when INR objects to seven more of the speech’s allegations. (Isikoff and Corn 2006, pp. 179)

The Defense Intelligence Agency issues a four-page Defense Intelligence Terrorism Summary (DITSUM No. 044-02) stating that it is probable that prisoner Ibn al-Shaykh al-Libi intentionally misled debriefers when he claimed Iraq was supporting al-Qaeda in working with illicit weapons. During interviews with al-Libi, the DIA noted the Libyan al-Qaeda operative could not name any Iraqis involved, any chemical or biological material used, or where the alleged training took place. “It is possible he does not know any further details; it is more likely this individual is intentionally misleading the debriefers,” the report says. “Ibn al-Shaykh has been undergoing debriefs for several weeks and may be describing scenarios to the debriefers that he knows will retain their interest.” The DIA report is presumably circulated widely within the government, and is available to the CIA, the White House, the Pentagon, the National Security Council, and other agencies.
No Evidence of Connections between Iraq, al-Qaeda - On the general subject of Iraq’s alleged ties to al-Qaeda, the DIA report notes: “Saddam [Hussein]‘s regime is intensely secular and is wary of Islamic revolutionary movements. Moreover, Baghdad is unlikely to provide assistance to a group it cannot control.” The report also questions the reliability of information provided by high-value al-Qaeda detainees being held in secret CIA facilities or who have been “rendered” to foreign countries where they are believed to undergo harsh interrogation tactics.
Using al-Libi's Information to Bolster Case for War - Information supplied by al-Libi will be the basis for a claim included in an October 2002 speech (see October 7, 2002) by President Bush, in which he states, “[W]e’ve learned that Iraq has trained al-Qaeda members in bomb making and poisons and gases.” Intelligence provided by al-Libi will also be included in Colin Powell’s February speech (see February 5, 2003) to the UN. In that speech, Powell will cite “the story of a senior terrorist operative telling how Iraq provided training in these weapons to al-Qaeda.” (Jehl 11/6/2005; Pincus 11/6/2005; Gaouette 11/7/2005; Isikoff and Hosenball 11/10/2005)
Report Released as Proof of Administration's Reliance on Poor Intelligence Sources - Declassified portions of the DIA report will be issued on November 6, 2005 by two senators, Carl Levin (D-MI) and John D. Rockefeller (D-WV). Rockefeller will tell CNN that al-Libi is “an entirely unreliable individual upon whom the White House was placing a substantial intelligence trust.” The situation was, Rockefeller will say, “a classic example of a lack of accountability to the American people.” (Gaouette 11/7/2005)

The CIA Directorate of Operations issues a second intelligence report from SISMI, Italy’s military intelligence service, on Iraq’s alleged agreement with Niger to purchase 500 tons of uranium annually. This report provides details that were not included in Italy’s October 15 report (see October 15, 2001), including a “verbatim text” of the accord. (It is not clear what the source is for the “verbatim text”. (ERiposte 3/6/2006) ) According to the report, the purported agreement was signed by Iraqi and Niger officials during meetings held July 5-6, 2000. (US Congress 7/7/2004; Landay 11/4/2005) The SISMI report also draws attention to a 1999 trip to Niger made by Wissam al-Zahawie (see February 1999), Iraq’s former ambassador to the Vatican, and alleges that its mission was to discuss the future purchase of uranium. This is the first report from SISMI that names al-Zahawie and refers directly to his 1999 trip. (SISMI’s previous report had only stated that negotiations had begun by at least 1999.) This report, as well as the previous report, is based on the forged Niger documents. (Hersh 10/27/2003; US Congress 7/7/2004; ERiposte 11/3/2005) Analysts at the CIA and the DIA are more impressed with the detail and substance of this second report, but analysts at the Department of State’s Bureau of Intelligence and Research (INR) remain skeptical of the report’s allegations noting that it was unlikely that Niger would sell uranium to Iraq because the Nigeriens would have considered the risk of being caught too great. An INR analyst asks the CIA if the source of the report would submit to a polygraph. A CIA analyst who also asks about the source is told by the DO that the source is “very credible.” (US Congress 7/7/2004)

Unnamed US intelligence officials tell the New York Times that the CIA has no evidence that Saddam Hussein’s government has participated in any militant operations against the United States in nearly a decade. The agency also believes that Saddam Hussein has not provided chemical or biological weapons to al-Qaeda or other militant Islamic organizations. (Risen 2/6/2002 Sources: Unnamed US Intelligence Officials)

Former CIA Director James Woolsey telephones Deputy Assistant Defense Secretary Linton Wells to arrange a meeting between Defense Intelligence Agency (DIA) analysts and Mohammad Harith, an Iraqi defector being supplied by the Iraqi exile group, the Iraqi National Congress. (Landay and Strobel 7/16/2004 Sources: Classified Pentagon report) After the phone call, Wells issues an “executive referral,” requesting that the Iraqi National Congress (INC) introduce Harith to the Pentagon’s Defense Intelligence Agency (DIA). (Landay and Strobel 7/16/2004) Later in the day, two DIA officers meet with Ahmed Chalabi to arrange an interview with Harith. In an email to Knight Ridder Newspapers, Wells will later recall, “I discussed the issue of an individual with information on Iraq[i] weapons of mass destruction with intelligence community members. They said they would follow up. I never met with any member of the INC.” (Landay and Strobel 7/16/2004)

The Defense Intelligence Agency (DIA) issues “a finished intelligence product” summarizing the February 5, 2002 SISMI report (see February 5, 2002). The report, entitled “Niamey Signed an Agreement to Sell 500 Tons of Uranium a Year to Baghdad,” states as irrefutable fact that Iraq intends to buy weapons-grade uranium from Niger (see Between Late 2000 and September 11, 2001, October 15, 2001, October 18, 2001, November 20, 2001, February 5, 2002, March 1, 2002, Late April or Early May 2002-June 2002, and Late June 2002). It concludes, “Iraq probably is searching abroad for natural uranium to assist in its nuclear weapons program.” It does not comment on the credibility of the sourcing. The report is sent directly to Vice President Dick Cheney. Within hours, Cheney directs the CIA (see February 5, 2002) to investigate the claims. According to the Senate Intelligence Committee’s 2004 report on Iraqi WMD (see July 9, 2004), CIA and DIA analysts find the subsequent reports more informative and believable than the first, more sketchy reports (see February 5, 2002). The CIA’s Directorate of Operations tells one agency analyst that the report comes from a “very credible source.” Analysts with the State Department’s Bureau of Intelligence and Research (INR) continue to find the reports unconvincing. (US Congress 7/7/2004; Unger 2007, pp. 239) Former CIA analyst Ray McGovern will later describe Cheney’s receipt of this document as “odd.” “[I]n more than two years of briefing then-Vice President George H. W. Bush every other morning, not once did he ask a question about a DIA report or even indicate that he had read one,” McGovern will note. “That this particular report was given to Cheney almost certainly reflects the widespread practice of ‘cherry picking’ intelligence.” (McGovern 7/25/2005)

Valerie Plame Wilson.Valerie Plame Wilson. [Source: PEP]In response to questions from Vice President Dick Cheney (see (February 13, 2002)), CIA operative Valerie Plame Wilson and officials from the CIA’s DO counterproliferation division (CPD) meet to discuss what the agency should do to determine the validity of recent Italian intelligence reports (see October 15, 2001 and February 5, 2002) alleging that Iraq had sought to purchase uranium from Niger. During the meeting, Plame Wilson suggests sending her husband, Joseph Wilson, an Africa expert and former US diplomat, to Niger to investigate the reports. (US Congress 7/7/2004) The meeting is chronicled in an internal agency memo obtained by the Wall Street Journal in October 2003. (Cloud 10/17/2003) Intelligence officials subsequently will not deny that Plame Wilson was involved in the decision to send Wilson to Niger, but will say she was not “responsible” for the decision. (Cloud 10/17/2003)
CIA Alerted to Cheney's Concerns - In her 2007 book Fair Game, Plame Wilson recalls that shortly after Cheney’s initial questions, a young officer rushes into her CPD office and tells her “someone from the vice president’s office” just called the officer on her secure telephone line. The caller, apparently a member of Cheney’s staff, wants information about an intelligence report that the Italian government has passed to the US, alleging that in 1999 Iraq attempted to buy yellowcake uranium from Niger. Cheney is, according to the staffer, “interested and want[s] more information.” Plame Wilson will write, “If the report was true at all, I knew that it would be damning evidence indeed that Iraq was seeking to restart its nuclear program.”
'Nonplussed' at White House Contact - “I was momentarily nonplussed that someone from the vice president’s office had reached down into the junior working levels of the agency to discuss or find an answer to an intelligence report,” she will write. “In my experience, I had never known that to happen. There were strict protocols and procedures for funneling intelligence to policy makers or fielding their questions. Whole offices within the agency were set up and devoted to doing just that. A call to a random desk officer might get the policy maker a quick answer in the heat of the moment, but it was also a recipe for trouble. Handing a senior policy maker ‘raw’ intelligence that had not been properly vetted, placed into context, or appropriately caveated by intelligence professionals usually led to misinterpretation—at a minimum.” She adds that at the time, she is “not aware of the unprecedented number of visits the vice president had made to our headquarters to meet with analysts and look for any available evidence to support the Iraq WMD claims the administration was beginning to make.… I was still blissfully ignorant of any special visits or pressure from the administration vis-a-vis Iraq. I just wanted to get some answers.”
Decision to Ask Wilson Originates with Records Officer, Not Plame Wilson - Plame Wilson tables her concerns about the unusual contact, and begins pondering how best to find answers to Cheney’s questions. The “first and most obvious choice,” she will write, “would be to contact our [REDACTED] office in Niger and ask them to investigate these allegations using local sources available on the ground.” But the budget cuts of the mid-1990s had forced the closing of numerous CIA offices in Africa, including its station in Niamey, Niger. Plame Wilson will recall, “A midlevel reports officer who had joined the discussion in the hallway enthusiastically suggested, ‘What about talking to Joe about it?’” The reports officer is referring to Plame Wilson’s husband, former ambassador Joseph Wilson. “He knew of Joe’s history and role in the first Gulf War (see September 5, 1988 and After and September 20, 1990), his extensive experience in Africa, and also that in 1999 the CIA had sent Joe on a sensitive mission to Africa on uranium issues. Of course, none of us imagined the firestorm this sincere suggestion would ignite. At the moment, the only thought that flashed through my mind was that if Joe were out of the country for an extended period of time I would be left to wrestle two squirmy toddlers into bed each evening.… So I was far from keen on the idea, but we needed to respond to the vice president’s office with something other than a lame and obviously unacceptable, ‘We don’t know, sorry.’” Plame Wilson and the reports officer make the suggestion to send Wilson to Niger; her supervisor decides to meet with Wilson “and the appropriate agency and State [Department] officials.” At her supervisor’s behest, Plame Wilson sends an e-mail to her division chief (whom she will only identify as “Scott”), informing him of the decision and noting that “my husband has good relations with both the PM [prime minister] and the former minister of mines (not to mention lots of French contacts), both of whom could possibly shed some light on this sort of activity.” Plame Wilson will write that her words are intended to “gently remind [her division chief] of Joe’s credentials to support why my boss thought he should come into headquarters in the first place.” She will note: “Months later, those words would be ripped out of that e-mail and cited as proof that I had recommended Joe for the trip (see February 13, 2002). But at the time, I simply hit the ‘send’ button and moved on to the other tasks that were demanding my attention.” That night, Plame Wilson broaches the subject of going to Niger with her husband; he agrees to meet with her superiors at the CPD. (US Congress 7/7/2004; Wilson 2007, pp. 108-110)
Cheney Later Denies Knowledge of Iraq-Niger Claims - During the investigation of the Plame Wilson leak (see September 26, 2003), Cheney will repeatedly deny any knowledge that the CIA was following up on his request for more information. This is a lie. Among other refutations, the Senate Intelligence Committee will report in 2004 that he was told on February 14 that CIA officers were working with clandestine sources to find out the truth behind the Niger allegations (see July 9, 2004). (Wilson 2007, pp. 368)

Pakistani President Pervez Musharraf meets with President Bush in Washington, DC. Bush lavishly praises Musharraf, saying: “President Musharraf is a leader with great courage and vision.… I am proud to call him my friend.” Since 9/11, Pakistan has received $600 million in emergency aid, $500 million for supporting US forces, a moratorium on paying back its debt to the US, and the US has canceled economic sanctions against it. Bush announces the US will now cancel $1 billion of Pakistan’s US debt, reschedule the remaining $1.8 billion, and give $100 million for education reform. (Rashid 2008, pp. 148-149) The month before, Musharraf denounced terrorism in a public speech (see January 12, 2002). But by the start of February, it is already clear that the militant groups Musharraf banned just after the speech have resumed operations under new names with the encouragement of the Pakistani ISI. (Rashid 2008, pp. 147) Furthermore, CIA communications intercepts indicate the Pakistani army deliberately left portions of the border with Afghanistan unguarded, allowing Osama bin Laden and thousands of other al-Qaeda operatives to flee into Pakistan (see December 10, 2001). The Pakistani army still has not moved into the regions where al-Qaeda is regrouping (see Late May 2002), and will not allow US troops to enter these regions either (see Early 2002 and After).

The CIA’s Directorate of Operations (DO) Counterproliferation Division (CPD) holds a meeting with former ambassador Joseph Wilson, intelligence analysts from both the CIA and State Department’s Bureau of Intelligence and Research (INR), and several individuals from the DO’s Africa and CPD divisions. The purpose of the meeting is to discuss the merits of sending Wilson to Niger. Wilson is introduced by his wife Valerie Plame Wilson, who heads CPD’s Joint Task Force on Iraq (JTFI). (US Congress 7/7/2004, pp. 59; Isikoff and Corn 2006, pp. 94-95)
Wife Does Not Participate in Meeting - In her 2007 book Fair Game, Plame Wilson will write that she brings her husband into the briefing room, introduces him to the “10 or so participants,” and “[a]fter a minute or so, I went back to my desk to attend to what seemed like a hundred other operational crises. When the meeting broke, Joe poked his head in my office to say that the group had asked him to consider going to Niger to discuss the report.” (Wilson 2007, pp. 111)
Wilson's Qualifications - Wilson will later describe himself as “the insider increasing [the CIA analysts’] store of information, supplying that perspective missing from their raw data. I had served as a junior diplomatic officer in Niger in the mid-1970s, a period that happened to coincide with the growth in the uranium business there. We had followed this issue closely from the American Embassy in Niamey, Niger’s capital, just as my staff and I had when I was ambassador to Gabon, another uranium-producing country, from 1992 to 1995. When I worked on the National Security Council in the Clinton administration two years later, among my areas of responsibility was the African uranium industry. Rarely did conversations with Africans from uranium-producing countries fail to touch on the subject. Niger, where I had traveled frequently over the years, was always of particular interest.” (Wilson 2004, pp. 8)
Details Shared with Wilson - In the meeting, Wilson learns of a report that purports to document a memorandum of sale from Niger to Iraq, and that the report had aroused the interest of Vice President Dick Cheney (see (February 13, 2002)). Cheney’s office has tasked the CIA to determine the truth or falsity of the report. The report is lacking in key details. Wilson’s knowledge of the region, particularly of the government and private interests involved in mining and distributing uranium, will be particularly helpful. Wilson later writes, “The Nigeriens were the same people I had dealt with during and after my time at the National Security Council, people I knew well.” The former minister of mines, the man responsible for oversight of the industry at the time of the alleged sales, is a friend of his.
Skepticism among Participants about Report - Wilson will later describe himself as “skeptical, as prudent consumers of intelligence always are about raw information.” He will note that much of this kind of intelligence is classified as “rumint,” or rumors passing as fact, and is usually “no more reliable than Bigfoot sightings. Rumint is a necessary and unfortunate reality in a world where many people will tell you what they think you want to hear, as opposed to simple facts.” (Wilson 2004, pp. 14-15) Notes taken by INR analyst Douglas Rohn, as well as e-mails from other participants, indicate that INR expresses skepticism that the alleged uranium contract could have taken place. Rohn, who served as deputy chief of mission in Niger during the ‘90s, writes that it would have been very difficult to conceal such a large shipment of yellowcake because “the French appear to have control of the uranium mining, milling and transport process, and would seem to have little interest in selling uranium to the Iraqis.” INR also says that the embassy in Niger has good contacts and is thus in a position to get to the truth on the matter, and therefore believes the proposed trip to Niger would be redundant. Others attending the meeting argue that the trip would probably not resolve the matter because the Nigeriens would be unlikely to admit to a uranium sales agreement with Iraq. An e-mail from a WINPAC analyst to CPD following the meeting notes, “[I]t appears that the results from this source will be suspect at best, and not believable under most scenarios.” CPD nonetheless concludes that sending Wilson would be worth a try. (US Congress 7/7/2004, pp. 59; Isikoff and Corn 2006, pp. 94-95)
Open and Public Visit - Wilson is willing, but points out that he is not a spy, but a former diplomat with no experience with clandestine work. He will be recognized in Niger. Therefore, there can be no expectation of any covert or clandestine actions on his part; everything he does will be open and above board. He also insists on obtaining the approval of both the State Department and the US Ambassador to Niger, Barbro Owens-Kirkpatrick, before entering the country. He expects no payment for his visit, but will accept reimbursement for expenses. The others in the meeting agree. The rest of the two-hour meeting is spent considering and plotting out various scenarios, based on who he might see and what he might learn during his visit. (Wilson 2004, pp. 16-17) “I went through what I knew about… uranium,” Wilson later recalls. “I went through what I knew about the personalities.… People chimed in, and I answered them as best I could. It was a kind of free-for-all, and at the end they sort of asked, ‘Well, would you be able to clear your schedule and go out there if we wanted?’ and I said, ‘Sure.’” (Ward 1/2004)

The CIA’s Directorate of Operations (DO) Counterproliferation Division (CPD) provides former ambassador Joseph Wilson with talking points for his scheduled trip to Niger (see February 19, 2002). The points specify that Wilson should ask Nigerien officials if they have been approached, conducted discussions, or entered into any agreements concerning uranium transfers with any “countries of concern.” Wilson should also determine how Niger accounts for all of its uranium each year, the points say. (US Congress 7/7/2004)

Wilson, a retired US diplomat, to Niger to investigate claims that Iraq had sought to purchase uranium from that country (see February 13, 2002). The CIA pays Wilson’s expenses for the trip, but does not pay him in any other respect. The identity of the party who requests the mission is later disputed. While Wilson will claim the trip was requested directly by Dick Cheney’s office, other sources will indicate that the CIA had decided (see February 19, 2002) that a delegation to Niger was needed in order to investigate questions raised by one of Dick Cheney’s aides (see (February 13, 2002)). Reason behind Request - Former CIA analyst Melvin Goodman will later note that “Wilson was asked to go to Niger for one specific purpose. It was the CIA’s idea to get Cheney off their backs. Cheney would not get off their backs about the yellowcake documents. They couldn’t get Cheney to stop pressing the issue. He insisted that was the proof of reconstitution of [Iraq’s nuclear] program.” (Dubose and Bernstein 2006, pp. 214)
Normal Skepticism - Wilson goes into the situation with a healthy dose of skepticism. “My skepticism was the same as it would have been with any unverified intelligence report, because there is a lot of stuff that comes over the transom every day,” he will recall in 2006. Wilson knows nothing of the influence of the Pentagon neoconservatives (see July 8, 1996, January 26, 1998, July 1998, September 2000, Late December 2000 and Early January 2001, Shortly after January 20, 2001, and Shortly After September 11, 2001) or the growing rift in the intelligence community over the reports: “I was aware that the neocons had a growing role in government and that they were interested in Iraq,” he will recall. “But the administration had not articulated a policy at this stage.” He is not given a copy of the Niger documents before leaving for Africa, nor is he told of their history. “To the best of my knowledge, the documents were not in the possession of the [CIA] at the time I was briefed,” he will recall. “The discussion was whether or not this report could be accurate. During this discussion, everyone who knew something shared stuff about how the uranium business worked, and I laid out what I knew about the government in Niger, what information they could provide.” With this rather sketchy preparation, Wilson leaves for Niger. (Unger 2007, pp. 240; Wilson 2007, pp. 113) Wilson’s wife, senior CIA case officer Valerie Plame Wilson, will later write, “He figured that if the vice president had asked a serious and legitimate question, it deserved a serious answer and he would try to help find it.” (Wilson 2007, pp. 111)
No Trouble Finding Information - Wilson, who knows the Nigerien government and many of its officials, has little trouble finding the information he needs in the following week. In 2006, he will recall: “Niger has a simplistic government structure. Both the minister of mines and the prime minister had gone through the mines. The French were managing partners of the international consortium [which handles Niger’s uranium]. The French mining company actually had its hands on the project. Nobody else in the consortium had operators on the ground.” Wilson also personally knows Wissam al-Zahawie, Iraq’s ambassador to the Vatican who supposedly negotiated the uranium deal with Niger (see February 1999). Wilson will later observe: “Wissam al-Zahawie was a world-class opera singer, and he went to the Vatican as his last post so he could be near the great European opera houses in Rome. He was not in the Ba’athist inner circle. He was not in Saddam [Hussein]‘s tribe. The idea that he would be entrusted with the super-secret mission to buy 500 tons of uranium from Niger is out of the question.” (Unger 2007, pp. 240-241) Wilson meets with, among other officials, Niger’s former minister of mines, Mai Manga. As later reported by the Senate Intelligence Committee (see July 9, 2004), Manga tells Wilson “there were no sales outside of International Atomic Energy Agency (IAEA) channels since the mid-1980s,” and he “knew of no contracts signed between Niger and any rogue states for the sale of uranium.” Manga says a “French mining consortium controls Nigerien uranium mining and keeps the uranium very tightly controlled from the time it is mined until the time it is loaded onto ships in Benin for transport overseas,” and, “it would be difficult, if not impossible, to arrange a special shipment of uranium to a pariah state given these controls.” (Leupp 11/9/2005)
Meeting with US Ambassador - Wilson arrives in Niger on February 26, two days after Marine General Carlton W. Fulford Jr.‘s meeting (see February 24, 2002) with Nigerien officials. Wilson first meets with US Ambassador to Niger Barbro Owens-Kirkpatrick, a veteran Foreign Service official, whom Wilson will later describe as “crisp” and well-informed. Over tea in the US Embassy offices in Niamey, Niger’s capital, Owens-Kirkpatrick tells Wilson that she has already concluded that the allegations of uranium sales to Iraq are unfounded. “She had already debunked them in her reports to Washington,” Wilson will later recall. “She said, yeah, she knew a lot about this particular report. She thought she had debunked it—and, oh, by the way, a four-star Marine Corps general had been down there as well—Carlton Fulford. And he had left satisfied there was nothing to report.” (Wilson 2004, pp. 20-22)
Details of Alleged Uranium Production - Niger extracts uranium from two mines, both located in remote locations in the Sahara Desert. It takes well over a day to drive from the mines to Niamey. The mines are owned by a consortium of foreign companies and the Nigerien government, and managed by a French mining company, COGEMA. Because of a recent upswing in the production of Canadian uranium, Niger’s uranium is mined at a net loss, and its only customers are consortium members. Wilson will later write, “[T]he Nigerien government has sold no uranium outside the consortium for two decades.” If Iraq had bought 500 tons of uranium, as the story is told, that would have represented a 40 percent production increase. “There is no doubt,” Wilson will later write, “that such a significant shift from historic production schedules would have been absolutely impossible to hide from the other partners, and most certainly from the managing partner, COGEMA. Everyone involved would have known about it.” Any Nigerien government decision to produce such an amount of uranium would have involved numerous government officials and many well-documented meetings. Because the transaction would have been to a foreign country, Niger’s Foreign Ministry would also have been involved in the decision. To sell Iraq uranium during that time would have been a violation of international law and of UN sanctions against Iraq, a weighty decision that would have ultimately been made by the president of Niger in conjuction with the foreign minister and the minister of mines. Such a decision would have been published in the Nigerien equivalent of the Federal Register and would have dramatic tax and revenue implications. The unexpected huge infusion of cash from the sale would have had a strong impact on the Nigerien economy, and would have been much anticipated and talked about throughout the Nigerien business community. (Wilson 2004, pp. 22-25)
Off-the-Books Production Virtually Impossible - It is conceivable that such an enormous operation could have been conducted entirely “off the books,” Wilson will write, but virtually impossible to pull off. True, a military junta was in power at the time of the alleged sale, one that felt no responsibility or accountability to the Nigerien people. But even a secret transaction would have been impossible to conceal. Such a transaction would have involved thousands of barrels of clandestinely shipped uranium, extensive and complex adjustments to shipping schedules, and other ramifications. “It simply could not have happened without a great many people knowing about it, and secrets widely known do not remain hidden for long. And again, COGEMA, as the managing partner, would have had to know and be complicit.” Add to that Niger’s dependence on US foreign economic aid and its unwillingness to threaten the loss of that aid by secretly shipping uranium to a country that the US considers a dangerous rogue nation. All told, Wilson concludes, the possibility of such a clandestine operation is remote in the extreme. (Wilson 2004; Wilson 2004)
1999 Meeting with Iraqi Official - While speaking with a US Embassy official, Wilson learns about a 1999 meeting between the embassy official and an Iraqi representative in Algiers, perhaps in concert with a similar meeting between Iraqi officials and Niger’s prime minister (see June 1999). (Wilson 2004, pp. 27-28)
Confirmation that Allegations are Unrealistic - After spending several days talking with current government officials, former government officials, and people associated with the country’s uranium business, Wilson concludes the rumors are completely false. He will later call the allegations “bogus and unrealistic.” (Pincus 6/12/2003 pdf file; Landay 6/13/2003; Buncombe and Whitaker 6/29/2003; Wilson, 7/6/2003; CBS News 7/11/2003; Ward 1/2004; Wilson 2004, pp. 20-28, 424; Burrough et al. 5/2004, pp. 282; Wilson 2007, pp. 113)

Fulford Jr., deputy commander of the US European Command, arrives in Niger on a scheduled refueling stop. At the request of US Ambassador to Niger Barbro Owens-Kirkpatrick, Fulford joins the ambassador at a meeting with Niger’s President Mamadou Tandja and Foreign Minister Aichatou Mindaoudou. He explains the importance of keeping Niger’s ore deposits secure. At the meeting, President Tandja assures the ambassador and General Fulford that Niger is determined to keep its uranium “in safe hands.” (Priest and Milbank 7/15/2003; Belida 7/15/2003; Burrough et al. 5/2004, pp. 282; US Congress 7/7/2004) After the meeting, Fulford concludes that Niger’s uranium is securely under the control of a French consortium and that there is little risk that the material will end up in the wrong hands. These findings are passed on to General Joseph Ralston who provides them to General Richard B. Myers, chairman of the Joint Chiefs of Staff. (Priest and Milbank 7/15/2003; Belida 7/15/2003; Burrough et al. 5/2004, pp. 282) The Pentagon will later say that Defense Secretary Donald Rumsfeld was not informed about the trip or its conclusions. (Belida 7/15/2003)

Secretary of Defense Donald Rumsfeld announces the closure of the Office of Strategic Influence (see Shortly after September 11, 2001), after news of the Pentagon propaganda initiative causes a public stir (see February 19, 2002). “The office has clearly been so damaged that it is pretty clear to me that it could not function effectively,” he tells reporters. “So it is being closed down.” Asked if he instructed Rumsfeld to close the office, President Bush says: “I didn’t even need to tell him this. He knows how I feel about this.” (Schmitt and Dao 2/27/2002) Nine months later, Rumsfeld says that after the OSI was closed, “I went down that next day and said fine, if you want to savage this thing fine I’ll give you the corpse. There’s the name. You can have the name, but I’m gonna keep doing every single thing that needs to be done and I have.” (US Department of Defense 11/18/2002) Much of its operations are apparently shifted to another unit called the Information Operations Task Force. Some operations are farmed out to the Rendon Group, a private public relations firm with extensive experience marketing wars and foreign policy for Republican administrations (see May 1991 and Late May 2001). (Bamford 11/17/2005; Rich 2006, pp. 189)

While former ambassador Joseph Wilson is still in Africa learning about the supposed Iraq-Niger uranium deal (see February 21, 2002-March 4, 2002), Douglas Rohn, an analyst for the State Department’s Bureau of Intelligence and Research (INR), writes an intelligence assessment, titled “Niger: Sale of Uranium to Iraq Is Unlikely,” that disputes recent Italian intelligence reports (see October 15, 2001 and February 5, 2002) suggesting that Iraq attempted to purchase uranium from Niger. The assessment reiterates INR’s view that France controls the uranium industry and “would take action to block a sale of the kind alleged in a CIA report of questionable credibility from a foreign government service.” It adds that though “some officials may have conspired for individual gain to arrange a uranium sale,” Nigerien President Mamadou Tandja’s government would have been unlikely to risk relations with the US and other key aid donors. And it cites the logistical difficulties of a secret transaction requiring “25 hard-to-conceal 10-ton trailers” that would have had to travel 1,000 miles and cross one international border before reaching the sea. “A whole lot of things told us that the report was bogus,” Greg Thielmann, a high-ranking INR official, will later explain to Time magazine. “This wasn’t highly contested. There weren’t strong advocates on the other side. It was done, shot down.” The assessment, drafted in response to interest from the vice president’s office (see (February 13, 2002)), is sent to the White House Situation Room and Secretary of State Colin Powell. (Carney and Duffy 7/21/2003; US Congress 7/7/2004, pp. 59; Isikoff and Corn 2006, pp. 96-97; Unger 2007, pp. 241)

A few days after the State Department determines that the reported secret uranium deal between Iraq and Niger is “unlikely” (see March 1, 2002), former ambassador Joseph Wilson returns from his fact-finding trip to Niger (see February 21, 2002-March 4, 2002). Wilson tells CIA officials that he found no evidence to show that any such deal ever took place. (Unger 2007, pp. 241) Wilson’s wife, senior CIA case officer Valerie Plame Wilson, will later write that the debriefing actually begins shortly after Wilson’s arrival in the US, with “two clean-cut CIA officers, one of whom was the reports officer who had suggested sending Joe to Niger in the first place” (see February 13, 2002), arriving at the Wilson home, “clearly eager to debrief Joe so they could immediately write up an intelligence report on his trip.” Plame Wilson deliberately absents herself from the debriefing taking place in her living room, though she joins her husband and the two CIA officers for a late dinner of takeout Chinese food, where they discuss general subjects. (Wilson 2004, pp. 29; Wilson 2007, pp. 112) Based on Wilson’s information, the CIA’s Directorate of Operations (DO)‘s case officer writes a draft intelligence report and sends it to the DO reports officer, who adds additional relevant information from his notes. (US Congress 7/7/2004) The report will be distributed by March 8, 2002 (see March 8, 2002). (Wilson 2007, pp. 370)

In response to a request from Vice President Dick Cheney for an update on the Niger uranium issue made a few days earlier, CIA WINPAC analysts provide an analytic update to Cheney’s intelligence briefer stating that the government of Niger has said it is making all efforts to ensure that its uranium will be used for only peaceful purposes. The update says the foreign government service (Italian military intelligence agency, SISMI) that provided the original report “was unable to provide new information, but continues to assess that its source is reliable.” The update also notes that the CIA would “be debriefing a source [Joseph Wilson] who may have information related to the alleged sale on March 5 (see March 4-5, 2002).” (US Congress 7/7/2004)

Senior CIA case officer Valerie Plame Wilson (see April 2001 and After), whose husband, former ambassador Joseph Wilson, has recently returned from a trip to Africa to find out the facts behind the allegation that Iraq had attempted to buy uranium from Niger (see February 13, 2002), receives a copy of the final intelligence report written about her husband’s trip (see March 4-5, 2002). In her 2007 book Fair Game, Plame Wilson says she receives the report “as a simple courtesy [from] the reports officer” who had suggested Wilson journey to Niger and investigate the allegations. Plame Wilson will recall the report as being “a couple of pages long and fairly straightforward, in the typical bland style of such reports.” She reads the report, makes “no changes,” and gives it back to the reports officer. (Wilson 2007, pp. 113)

The CIA sends a one-and-a-half-page cable to the White House, the FBI, the Justice Department, the Joint Chiefs of Staff, and the Defense Intelligence Agency, with news that a CIA source sent to Niger has failed to find any evidence to back claims that Iraq sought uranium from that country (see February 21, 2002-March 4, 2002). The cable contains an initial report of the source’s findings in Niger. (Landay 6/12/2003; ABC News 6/12/2003; Landay 6/13/2003; Pincus 6/13/2003; BBC 7/8/2003; BBC 7/8/2003; US Congress 7/7/2004) The agency rates the quality of the information in the report as “good,” with a rating of 3 out of 5. (Leupp 11/9/2005)
Caveats and Denials - The report does not name the CIA source or indicate that the person is a former ambassador. Instead it describes the source as “a contact with excellent access who does not have an established reporting record” and notes that the Nigeriens with whom he spoke “knew their remarks could reach the US government and may have intended to influence as well as inform.” A later Senate report on the US’s pre-war intelligence on Iraq will state: “The intelligence report indicated that former Nigerien Prime Minister Ibrahim Mayaki was unaware of any contracts that had been signed between Niger and any rogue states for the sale of yellowcake while he was prime minister (1997-1999) or foreign minister (1996-1997). Mayaki said that if there had been any such contract during his tenure, he would have been aware of it.” Mayaki, according to the report, also acknowledged a June 1999 visit (see June 1999) by a businessman who arranged a meeting between Mayaki and an Iraqi delegation to discuss “expanding commercial relations” between Niger and Iraq. The intelligence report says that Mayaki interpreted “expanding commercial relations” to mean that the delegation wanted to discuss purchasing uranium. The meeting did take place, but according to the report, “Mayaki let the matter drop due to UN sanctions on Iraq.” The intelligence report also says that Niger’s former Minister for Energy and Mines, Mai Manga, told Wilson that there have been no sales outside of International Atomic Energy Agency (IAEA) channels since the mid-1980s. Mai Manga is also reported to have described how the French mining consortium controls Nigerien uranium mining and keeps the uranium very tightly controlled from the time it is mined until the time it is loaded onto ships in Benin for transportation overseas. White House: Report Left Out Details, Considered Unimportant - Bush administration officials will say in June 2003 that the report left out important details, such as the trip’s conclusions. And consequently, the Washington Post will report in June 2003, “It was not considered unusual or very important and not passed on to Condoleezza Rice, the president’s national security adviser, or other senior White House officials.” (Pincus 6/12/2003 pdf file; Pincus 6/13/2003; Landay 6/13/2003)
CIA Source Doubts White House Claims - But the CIA source who made the journey, former ambassador Joseph Wilson, will find this explanation hard to believe. “Though I did not file a written report [he provided an oral briefing (see March 4-5, 2002)], there should be at least four documents in United States government archives confirming my mission,” he will later explain. “The documents should include the ambassador’s report of my debriefing in Niamey, a separate report written by the embassy staff, a CIA report summing up my trip, and a specific answer from the agency to the office of the vice president (this may have been delivered orally). While I have not seen any of these reports, I have spent enough time in government to know that this is standard operating procedure.” (Wilson, 7/6/2003)
Senior CIA Case Officer Backs Up Source - In 2007, Wilson’s wife, senior CIA case officer Valerie Plame Wilson, will write of the report (see March 4-5, 2002) that if standard protocol has been followed, the report is distributed to “all the government departments that have intelligence components, such as the State Department’s Bureau of Intelligence and Research (INR), the National Security Agency (NSA), the Pentagon, and the overseas military commands. All of us had every reason to believe that their finished report would indeed be sent to the vice president’s office as part of the established protocol.” According to Plame Wilson, who read the report when it was completed (see (March 6, 2002)), much of the report focuses on “Niger’s strict, private, and government controls on mining consortia to ensure that no yellowcake went missing between the uranium mines and the marketplace.” She will write in 2007 that her husband’s report “corroborated and reinforced what was already known.” Both she and her husband assume that the allegations are sufficiently disproven and will not be heard of again. (Wilson 2007, pp. 112-114)
Little New Information - According to intelligence analysts later interviewed by Congressional investigators, the intelligence community does not believe the trip has contributed any significant information to what is already known about the issue, aside from the details of the 1999 Iraqi delegation. Testifying before the Senate Intelligence Committee, CIA Director George Tenet says: “There is no doubt that there have been (Iraqi) contacts and linkages to the al-Qaeda organization. As to where we are on September 11, the jury is still out. As I said carefully in my statement, it would be a mistake to dismiss the possibility of state sponsorship whether Iranian or Iraqi and we’ll see where the evidence takes us…. There is nothing new in the last several months that changes our analysis in any way…. There’s no doubt there have been contacts or linkages to the al-Qaeda organization…. I want you to think about al-Qaeda as a front company that mixes and matches its capabilities…. The distinction between Sunni and Shia that have traditionally divided terrorists groups are not distinctions we should make any more, because there are common interests against the United States and its allies in this region, and they will seek capabilities wherever they can get it…. Their ties may be limited by divergent ideologies, but the two sides’ mutual antipathies toward the United States and the Saudi royal family suggests that tactical cooperation between them is possible.” (PBS 3/19/2002; Agence France-Presse 3/20/2002)

Peter Ricketts, the British Foreign Office’s political director, offers advice to Foreign Secretary Jack Straw who is to provide Tony Blair with a note (see March 25, 2002) before he sets off for a planned meeting with Bush in Texas. In the memo, Ricketts recommends that Blair back the Bush policy on regime change, in a broad sense, because it would allow the British to exert some influence on the exact shape of the administration’s policy. “In the process, he can bring home to Bush some of the realities which will be less evident from Washington,” he says. “He can help Bush make good decisions by telling him things his own machine probably isn’t.” But he acknowledges that the British, in backing US plans against Iraq, may have a difficult time convincing Parliament and the British public to support the use of military force against Iraq because of scant evidence supporting Washington’s allegations against Iraq. “The truth is that what has changed is not the pace of Saddam Hussein’s WMD programs, but our tolerance of them post-11 September.” He adds that the “figures” being used in a dossier on Iraq that Downing Street is drafting needs more work in order for it to be “consistent with those of the US.” He explains: “[E]ven the best survey of Iraq’s WMD programs will not show much advance in recent years on the nuclear, missile, or chemical weapons/biological weapons fronts: the programs are extremely worrying but have not, as far as we know, been stepped up.” He also says the US has little evidence to support its other allegation. “US scrambling to establish a link between Iraq and al-Qaeda is so far frankly unconvincing,” he says. Two weeks after the CIA informed the White House and other departments that evidence of an Iraqi attempt to purchase Nigerien uranium is scanty (see March 8, 2002), Vice President Dick Cheney appears on CNN to assert the opposite: that Iraq is actively pursuing nuclear weapons. Cheney says that Iraq “has chemical weapons… has biological weapons… [and is] pursuing nuclear weapons.” (CNN 3/24/2002)

The CIA’s Directorate of Operations (DO) distributes a third and final intelligence report from Italy’s military intelligence service, SISMI, on the alleged 2000 Niger-Iraq uranium purchase deal. The report does not provide any information about its source. (Priest and DeYoung 3/22/2003; Landay 6/13/2003; Landay 11/4/2005)

Shadi Abdellah.Shadi Abdellah. [Source: Associated Press]In April 2002, Shadi Abdellah, a militant connected to the al-Tawhid group led by Abu Musab al-Zarqawi, is arrested by German police. Abdellah also briefly worked as one of bin Laden’s bodyguards (see Early 2001). He begins cooperating with German authorities. He reveals that al-Zarqawi is not a part of al-Qaeda but is actually the founder of al-Tawhid, which he says works “in opposition” to al-Qaeda (see 1989-Late 1999). The aim of the group is to kill Jews and install an Islamic regime in Jordan. The group is not really interested in the US, and this is the key ideological difference between it and al-Qaeda. Abdallah recounts one instance where al-Zarqawi vetoed a proposal to share charity funds collected in Germany with al-Qaeda. According to Abdallah, al-Zarqawi’s organization had also “competed” with al-Qaeda for new recruits. He also reveals that al-Zarqawi’s religious mentor is Abu Qatada, an imam openly living in Britain. (Buncombe and Milmo 2/6/2003; Isikoff 6/25/2003; Bergen 2006, pp. 356-358) A German intelligence report compiled in April 2002 based on Abdellah’s confessions further states that “Al-Zarqawi mentioned to Abdellah that the possibility of a merger conflicted with the religious orientation of [Mahfouz Walad Al-Walid (a.k.a. Abu Hafs the Mauritanian)] who was responsible within al-Qaeda for religious or Islamic matters, which contradicted the teachings practices by al-Zarqawi.” (Bergen 2006, pp. 359-422) Newsweek will later report that “several US officials” claim “they were aware all along of the German information about al-Zarqawi.” (Buncombe and Milmo 2/6/2003) Nonetheless, Bush will claim in a televised speech on October 7, 2002 (see October 7, 2002) that a “very senior al-Qaeda leader… received medical treatment in Baghdad this year,” a reference to al-Zarqawi. And Colin Powell will similarly state on February 5, 2003 (see February 5, 2003) that “Iraq is harboring the network of Abu Musab al-Zarqawi, an associate and collaborator of Osama bin Laden and his al-Qaeda lieutenants.” Both statements are made even though “US intelligence already had concluded that al-Zarqawi was not an al-Qaeda member…” (BBC 2/5/2003; Powell 2/5/2003; Pincus 6/22/2003 Sources: Unnamed US intelligence sources)

[Source: Associated Press]Crown Prince Abdullah, the de facto ruler of Saudi Arabia, is due to arrive in Houston, Texas, to meet with President Bush at his ranch in nearby Crawford, Texas. Abdullah’s entourage is so large that it fills eight airplanes. As these planes land, US intelligence learns that one person on the flight manifests is wanted by US law enforcement, and two more are on a terrorist watch list. An informed source will later claim that the FBI is ready to “storm the plane and pull those guys off.” However, the State Department fears an international incident. An interagency conflict erupts over what to do. The Wall Street Journal will report in 2003, “Details about what happened to the three men in the end are not entirely clear, and no one at [the State Department] was willing to provide any facts about the incident. What is clear, though, is that the three didn’t get anywhere near Crawford, but were also spared the ‘embarrassment’ of arrest. And the House of Saud was spared an ‘international incident.’” (Mowbray 10/13/2003) The next day, Osama Basnan, an alleged associate of 9/11 hijackers Nawaf Alhazmi and Khalid Almihdhar, reports his passport stolen to Houston police. (Isikoff and Thomas 11/24/2002) This confirms that Basnan is in Houston on the same day that Crown Prince Abdullah, Prince Saud al-Faisal, and Saudi US Ambassador Prince Bandar meet with President Bush, Vice President Cheney, Secretary of State Powell, and National Security Adviser Rice at Bush’s Crawford ranch. (US-Saudi Arabian Business Council 4/25/2002) While in Texas, it is believed that Basnan “met with a high Saudi prince who has responsibilities for intelligence matters and is known to bring suitcases full of cash into the United States.” (Isikoff and Thomas 11/24/2002; Borger 11/25/2002) The still-classified section of the 9/11 Congressional Inquiry is said to discuss the possibility of Basnan meeting this figure at this time. (Lumpkin and Solomon 8/2/2003) It is unknown if Basnan and/or the Saudi prince he allegedly meets have any connection to the three figures wanted by the FBI, or even if one or both of them could have been among the wanted figures. Basnan will be arrested in the US for visa fraud in August 2002, and then deported two months later (see August 22-November 2002).

In part due to pressure from Vice President Cheney, the CIA sends a cable to France’s intelligence agency, the Direction Generale de la Securite Exterieure (DGSE), communicating concerns about intelligence suggesting that Iraq is attempting to purchase uranium from Niger. (Another cable had been sent the year before (see Summer 2001).) Specifically, the CIA says it is concerned about an alleged agreement between Iraq and Niger on the sale of 500 tons of uranium that was signed by Nigerian officials. (In an interview with the Los Angeles Times, DGSE official Alain Chouet will note that the details of this agreement matched those of the forged documents.) (Hamburger, Wallsten, and Drogin 12/11/2005; Unger 2007, pp. 241) Niger is a former French colony, and the French keep a tight rein on Niger’s uranium production. Hence, the CIA turns to French intelligence to vet the claim of Nigerien uranium going to Iraq. “The French were managing partners of the international consortium in Niger,” former US ambassador Joseph Wilson will later say. “The French did the actual mining and shipping of [uranium].” (Unger 2007, pp. 208-209) The CIA asks for an immediate answer about the authenticity of the information. (Bonni and D'Avanzo 12/1/2005) In response, the DGSE sends its head of security intelligence, Chouet, to look into the uranium deal. The initial information Chouet receives from the CIA is vague, he will later recall, except for one striking detail: Iraq’s ambassador to the Vatican, Wissam al-Zahawie, made an unusual trip to four African countries in 1999, including Niger. CIA analysts fear the trip may have been a prelude to the uranium deal. But Chouet soon learns that the al-Zawahie trip (see February 1999) had not been secret, as the CIA avers, but had been well covered by, among other news outlets, the local Nigerien press. In addition, French, British, and US intelligence had received routine reports on al-Zawahie’s visits. Chouet, head of a 700-person intelligence unit specializing in weapons proliferation and terrorism, sends an undercover team of five or six men to Niger to check on the security of Niger’s uranium. The investigation produces no evidence that al-Zawahie had even discussed uranium with the Nigeriens. (Bonni and D'Avanzo 12/1/2005; Hamburger, Wallsten, and Drogin 12/11/2005; Unger 2007, pp. 208-209) Chouet will later recall, “[O]nce back, they told me a very simple thing: ‘the American information on uranium is all bullsh_t.’” (Bonni and D'Avanzo 12/1/2005) The French summarize the results of their investigation in a series of formal cables they send to CIA offices in Langley and Paris. Chouet will later tell the Times that they communicated their doubts about the claims in no uncertain terms. “We told the Americans, ‘Bullshi_t. It doesn’t make any sense.’” (Bonni and D'Avanzo 12/1/2005; Hamburger, Wallsten, and Drogin 12/11/2005) Choeut’s formal reports to the CIA use less coarse language, but he later describes them as candid. “We had the feeling we had been heard,” he will recall. (Unger 2007, pp. 241) The DGSE considers the issue closed. (Unger 2007, pp. 208-209)

Former ambassador Joseph Wilson participates in the annual conference of the American Turkish Council. One of the keynote speakers is Richard Perle, the neoconservative head of the Defense Policy Board and the chief author of the 1996 position paper “A Clean Break,” which argued for the forcible redrawing of the political map of the Middle East (see July 8, 1996). In 1996, Perle had called for the overthrow of the Iraqi government. At the conference, Perle makes the same call. Wilson will later recall being deeply troubled by Perle’s “fire and brimstone” speech. The next afternoon, when Wilson is scheduled to speak, he voices his concerns over Perle’s position. Although he had journeyed to Niger to learn the truth or falsity about the Iraq-Niger uranium claims (see February 21, 2002-March 4, 2002), he has not spoken publicly about Iraq in over a decade. He does so because he urgently feels that Perle’s views need to be countered. “No decision is more important than that to send a nation’s sons and daughters to a foreign land in order to kill and perhaps die for their country,” he will write. “As a democracy, we are all participants in that decision. Not to speak out would amount to complicity in whatever decision was taken.” Wilson tells the assemblage that “if we were prepared to entertain the possibility that in coming year Iraq might be reduced to a chemical, biological, and nuclear wasteland, then we should march in lockstep to the martial music played by Perle; if not, we should think about alternatives to war.” His partner at the podium, former Turkish military commander Cevik Bir, is, Wilson will recall, “even more strident than me in his opposition to military action.” The audience, “largely American and Turkish businessmen, [largely] agreed with us,” Wilson will recall. For his part, Perle has long since departed the conference. Wilson will later write: “As I discovered while debating the issue, the prowar advocates were little inclined to listen to the views of others. They had made up their minds long ago, and now it was a matter of ramming their agenda through the decision-making process.” (Wilson 2004, pp. 291-292)

[Source: CNN]National Security Adviser Condoleezza Rice states, “I don’t think anybody could have predicted that these people would take an airplane and slam it into the World Trade Center, take another one and slam it into the Pentagon, that they would try to use an airplane as a missile,” adding that “even in retrospect” there was “nothing” to suggest that. (White House 5/16/2002) Contradicting Rice’s claims, former CIA Deputy Director John Gannon acknowledges that such a scenario has long been taken seriously by US intelligence: “If you ask anybody could terrorists convert a plane into a missile? [N]obody would have ruled that out.” Rice also states, “The overwhelming bulk of the evidence was that this was an attack that was likely to take place overseas.” (MSNBC 5/17/2002) Slate awards Rice the “Whopper of the Week” when the title of Bush’s August 6 briefing is revealed: “Bin Laden Determined to Strike in US.” (Noah 5/23/2002) Rice later will concede that “somebody did imagine it” but will say she did not know about such intelligence until well after this conference. (Associated Press 9/21/2002)

In the wake of the defeat of al-Qaeda and the Taliban at Tora Bora, Afghanistan, many of them flee into the tribal region of Waziristan, just across the Pakistani border (see December 2001-Spring 2002). These tribal regions normally have no Pakistani military presence, and the Pakistani army left the border near Waziristan unguarded (see December 10, 2001). (Rashid 2008, pp. 148, 268) In early May, the US begins applying pressure on Pakistan to act. On anonymous Defense Department official tells the Washington Post, “We know where there is a large concentration of al-Qaeda.” He notes there are several hundred in one Waziristan border town alone. A senior US offical says, “We are trying to encourage, wheedle, coerce, urge the Pakistanis to move more aggressively” against the Waziristan safe haven, but have not been having much progress. (Ricks and Khan 5/12/2002) Pakistan finally moves army units into Waziristan in late May 2002, but even then the 8,000 troops remain in the administrative capital of Wana and do not attempt to seal the border with Afghanistan. (Rashid 2008, pp. 148, 268)

In Paris, Defense Department officials (including either Harold Rhode or Larry Franklin) meet with Iranian officials and Manucher Ghorbanifar, an Iranian arms trader who had been a central figure in the Iran-Contra affair. The meeting reportedly resulted from “an unplanned, unscheduled encounter” that took place without White House approval. An earlier meeting involving several of the same figures had taken place seven months earlier (See December 9, 2001). (Graham and Slevin 8/9/2003; Risen 12/7/2003) When Secretary of State Colin Powell learns of the meeting, he complains directly to Condoleezza Rice and the office of Defense Secretary Donald Rumsfeld. (Royce and Phelps 8/9/2003; Graham and Slevin 8/9/2003)

The CIA issues a classified report titled, “Iraq and al-Qaeda: A Murky Relationship.” According to its cover note, the report “purposely aggressive in seeking to draw connections” between Iraq and Osama bin Laden’s organization. The document, which was prepared in response to pressure from the White House and vice president’s office, is heavily criticized by analysts within the agency. Analysts in the Near East and South Asia division complain that the report inflates “sporadic, wary contacts” between two independent actors into a so-called “relationship.” A complaint is filed with the CIA’s ombudsman for politicization. After interviewing 24 analysts, the ombudsman concludes that the report was crafted under pressure from the administration, later telling Senate investigators that “about a half-dozen [analysts] mentioned ‘pressure’ from the administration; several others did not use that word, but spoke in a context that implied it.” Despite being “purposely aggressive,” the report does not satisfy Undersecretary of Defense for Policy Douglas Feith, an adamant hawk who strongly believes Iraq is working closely with Islamic militant groups. In a memo to Donald Rumsfeld, he says that the report should be read “for content only—and CIA’s interpretation should be ignored.” (Hoagland 10/20/2002; Risen 4/28/2004; US Congress 7/7/2004, pp. 359; Coman 7/11/2004; Isikoff and Corn 2006, pp. 112)

Entifadh Qanbar, a lobbyist for the Iraqi National Congress (INC), sends a memo to the staff of the Senate Appropriations Committee, in which he provides information about a State Department-funded intelligence program, known as the “information-collection program,” run by the INC (see September 2004-September 2006). Qanbar, who says he is the overall manager of the group, states in the memo that under the program, “defectors, reports and raw intelligence are cultivated and analyzed,” and “the results are reported through the INC newspaper (Al Mutamar), the Arabic and Western media and to appropriate governmental, nongovernmental and international agencies.” Information is also passed on to William Luti, who will later run the Office of Special Plans (see September 2002), and John Hannah, a senior national-security aide on Cheney’s staff, who Qunbar describes as the “principal point of contact.” (Hosenball and Isikoff 12/15/2003; Risen 2/12/2004 Sources: Memo) The memo provides a description of some of the people involved in the group and their activities. It says that the analytical group includes five analysts with a background in Iraq’s military, Iraq’s intelligence services and human rights. One person, a consultant, monitors the Iraqi government’s alleged efforts to develop banned weapons. The five analysts process information and write reports, which are sent to Al Mutamar, the INC’s newspaper, as well as the US government and many mainstream news organizations. Qanbar says that the information-collection program issued 30 reports between August 2001 and June 2002, which were sent to Al Mutamar. (Al Mutamar is only available inside Iraq on the Internet; the effectiveness of other government-funded projects to disseminate propaganda inside Iraq could not be proven, and may not have ever existed.) According to the memo, the group published 28 private reports in collaboration with the INC’s headquarters in London. The memo reveals that between October 2001 and May 2002, information provided by the INC was cited in 108 articles published by a variety of English-language news publications, including the New York Times, the Washington Post, Time, Newsweek, the New Yorker, CNN, Fox News, and several others. (Risen 2/12/2004; Mayer 6/7/2004; McCollam 7/1/2004) New York Daily News reporter Helen Kennedy will say in 2004, “The INC’s agenda was to get us into a war.” Kennedy’s name appears on Qanbar’s list. “The really damaging stories all came from those guys, not the CIA. They did a really sophisticated job of getting it out there.” Bob Drogin of the Los Angeles Times will say, “I think something that hasn’t gotten a lot of attention is how [the INC] used the British press to plant a lot of this stuff, some of it pretty outlandish.” British journalist Jamie Dettmer points the finger the other way. “I’ve been utterly appalled by the lack of skepticism about this entire Iraq project and the war on terrorism” in the press. When Dettmer learns that his name is on the list, he shouts, “Complete bollocks!” Other journalists on the list will refuse to admit that they were duped by the INC, even though some of their stories contain extensive interviews and dramatic claims from INC sources that were later disproven. Qanbar will say, “We did not provide information. We provided defectors. We take no position on them. It’s up to you reporters to decide if they are credible or not.” (McCollam 7/1/2004)

Rocco Martino, an Italian information peddler, attempts to sell a collection of mostly forged documents (though it is not clear precisely what documents these are) to the Direction Generale de la Securite Exterieure (DGSE), France’s intelligence agency for $100,000. (According to Martino, he has been selling documents to the French since 1999 (see June or July 1999).) The documents suggest that Niger agreed to sell uranium to Iraq in 2000. (Drogin and Hamburger 2/17/2004; Bonini and d'Avanzo 10/24/2005; Landay and Strobel 10/25/2005; Smith 11/6/2005) The French insist on reviewing the documents before there is any exchange of money. (Bonni and D'Avanzo 12/1/2005) In a matter of days, French intelligence determines the documents are not authentic. (Hamburger, Wallsten, and Drogin 12/11/2005) SISMI, Italy’s military intelligence service, is reportedly aware of Martino’s dealing with the French, and may have actually arranged them. (Bonini and d'Avanzo 10/24/2005)

Michael Ledeen contacts Mel Sembler, the US ambassador to Italy, and informs him that he will be traveling to Rome again (see December 9, 2001) to continue “his work” with the Iranians. Sembler passes this on to Washington, and National Security Adviser Stephen Hadley sends word to Ledeen reminding him that he is not to deal with the Iranians. (Marshall, Rozen, and Glastris 9/2004)

Numerous US and British, current and former, intelligence, military, and other government officials who have inside knowledge refute claims made by the Bush administration that Saddam Hussein’s regime has or is seeking ties with international militant Islamic groups. (Scowcroft 8/15/2002; Priest 9/10/2002; O'Hanlon 9/26/2002; Strobel, Landay, and Walcott 10/7/2002; Sunday Herald (Glasgow) 10/13/2002; Donovan 10/29/2002; Ibrahim 11/1/2002; CBC News 11/1/2002; Rotella 11/4/2002; Risen and Johnston 2/3/2003; Smith and Rennie 2/4/2003; Lashmar and Whitaker 2/9/2003)

The International Atomic Energy Agency sends the US a report reiterating its previous conclusion (see July 2001) regarding the intended use of the aluminum tubes that Iraq attempted to import in July 2001 (see 2000). The IAEA believes that while the tubes could be modified for use as rotors in a gas centrifuge system, the tubes are not directly suited to that use. (United Kingdom 7/14/2004 pdf file)

[Source: Radio Bremen]Khidir Hamza, “who played a leading role in Iraq’s nuclear weapon program before defecting in 1994,” tells the Senate Judiciary Committee that according to German intelligence, Iraq has “more than 10 tons of uranium and one ton of slightly enriched uranium… in its possession” which would be “enough to generate the needed bomb-grade uranium for three nuclear weapons by 2005.” He says that Iraq is “using corporations in India and other countries to import the needed equipment for its program and channel it through countries like Malaysia for shipment to Iraq.” He also claims that Iraq is “gearing up to extend the range of its missiles to easily reach Israel.” The testimony is widely reported in the media. (CNN 8/1/2002; Borger 8/1/2002; Harnden 8/1/2002) Hamza, however, is considered by many to be an unreliable source. David Albright, president of the Institute for Science and International Security where Hamza worked as an analyst from 1997 to 1999, says that after Hamza defected “he went off the edge” and “started saying irresponsible things.” (Collier 10/12/2002; Massing 2/26/2004) And General Hussein Kamel, Saddam Hussein’s son-in-law who was in charge of the dictator’s former weapons program but who defected in 1995, told UNSCOM and IAEA inspectors at the time of his defection, as well as US and British intelligence, that Hamza was not a reliable source (see August 22, 1995). (Kamal 8/22/1995 pdf file; Hersh 5/12/2003) The International Atomic Energy Agency (IAEA) will say in 2004 that before the US invasion of Iraq, it had warned journalists reporting on Iraq’s alleged nuclear weapons program that Hamza was not a credible source. “Hamza had no credibility at all.
