[Source: Washington Post]Judith Miller and Michael Gordon of the New York Times report in a front page story that Iraq is trying to obtain materials to build a nuclear weapon. Citing unnamed senior administration officials, they break the story of the aluminum tubes that were confiscated in Jordan in July 2001 (see July 2001) and write that both “American intelligence experts” and top officials believe the tubes were meant to be used as centrifuge rotors in a nuclear enrichment program. “In the last 14 months, Iraq has sought to buy thousands of specially designed aluminum tubes, which American officials believe were intended as components of centrifuges to enrich uranium,” reports the newspaper. “The diameter, thickness and other technical specifications of the aluminum tubes had persuaded American intelligence experts that they were meant for Iraq’s nuclear program….” Officials cited in the article warn that the US must not wait for more evidence before taking action to disarm Iraq because the first sign of a “smoking gun” may be a mushroom cloud. [New York Times, 9/8/2002] (The “smoking gun/mushroom cloud” analogy was conceived by presidential speech writer Michael Gerson a few days earlier; see September 4, 2002 for details.) What Gordon and Miller’s sources did not tell them, and what they neglected to find out on their own, was that the country’s top nuclear experts do not believe the tubes are suitable for rotors (see, e.g., July 2001-March 2003, August 17, 2001, and Late 2001). For example, Houston G. Wood III, a retired Oak Ridge physicist, filed a report with the US government more than a year before (see August 17, 2001) concluding that the tubes were not meant for centrifuges. When he reads the New York Times story, he is shocked. In an interview with the Australian Broadcasting Corporation more than a year later, he will recount his initial reaction: “My first thought was, ‘This must be some new tubes,’ you know. And then… and then when I realized that these were the tubes that I had been looking at a year before, I was just… I was… I was just shocked. I couldn’t believe that, you know, here we were, saying that these tubes were, you know, the same tubes that I’d come to the conclusion a year before were not valid for centrifuges, and here they’re saying they are. So, er… that was a real surprise.” [Australian Broadcasting Corporation, 10/27/2003] In subsequent stories about the tubes, the Times will note that there is a debate, however these reports will appear in the back pages of the newspaper (see, e.g., September 13, 2002). David Albright, a physicist who helped investigate Iraq’s nuclear weapons program following the 1991 Persian Gulf War as a member of the International Atomic Energy Agency’s inspection team, is disturbed to read Judith Miller’s story in the New York Times claiming that Iraq is trying to purchase aluminum tubes as part of an attempt to build centrifuges for a nuclear weapon (see September 8, 2002). After the aluminum tubes had been intercepted in the summer of 2001, Albright had been asked by an official to find out some information about them (see Late July 2001), and he had discovered that many experts doubted they were suitable for use in centrifuges. He had frequently worked with Miller in the past, and he contacts her and alerts her about the doubts of many officials, particularly those in the Department of Energy, regarding the Bush administration’s claims about the tubes.
Follow-up Article - Miller and Michael Gordon do write a follow-up article in the Times on September 13, 2002. But while the article does eventually note that “there have been debates among intelligence experts about Iraq’s intentions in trying to buy such tubes,” it states that “other, more senior, officials insisted last night that this was a minority view among intelligence experts and that the CIA had wide support, particularly among the government’s top technical experts and nuclear scientists. ‘This is a footnote, not a split,’ a senior administration official said.”
Insufficient - Albright is upset. He will later claim that he asked Miller “to alert people that there’s a debate, that there are competent people who disagreed with what the CIA was saying. I thought for sure she’d quote me or some people in the government who didn’t agree. It just wasn’t there.” He adds that the Times “made a decision to ice out the critics and insult them on top of it.” Albright goes to Joby Warrick of the Washington Post instead in hopes the Post will publish a better story. Warrick’s story comes out on September 19 and reveals the debate within the government about the tubes. It also notes reports that the Bush administration “is trying to quiet dissent among its own analysts over how to interpret the evidence.” But the story appears on page A18 and gets little notice compared to Miller’s front-page stories. [New York Review of Books, 2/26/2004] Still frustrated, Albright publishes his own report several days later challenging the aluminum tubes story (see September 23, 2002).

The US search for al-Qaeda figures Khalid Shaikh Mohammed (KSM) and Ramzi bin al-Shibh focuses on the city of Karachi, Pakistan, culminating in the capture of bin al-Shibh there on September 11, 2002. Accounts differ, but at some point in mid-2002 Al Jazeera reporter Yosri Fouda allegedly interviews bin al-Shibh and KSM in Karachi (see April, June, or August 2002). In 2003, Fouda will write a book about 9/11 with London Times reporter Nick Fielding. In the book, they will speculate why bin al-Shibh was arrested in Karachi on September 11, 2002, only a few months after the interview (see September 11, 2002), and within two days of when Fouda’s report (with audio from bin al-Shibh but not KSM) is first broadcast (see September 8-11, 2002): “Al Jazeera’s broadcasts probably confirmed what intelligence agencies already suspected, namely that bin al-Shibh and [KSM] were hiding in the Karachi area. That information would have been enough to justify the deployment of massive electronic resources in the area.” The authors further claim that, according to unnamed intelligence sources, while the NSA’s Echelon satellite network intercepts communications all over the world, the network’s “real strength” is that it “can concentrate huge resources into one specified area.” A source close to US intelligence will tell the authors: “Bin al-Shibh was apparently caught because he was a geek who was too willing to get onto his [satellite phone] and his e-mail. He thought he was too clever and had been getting away with things for too long.” Declassified Russian intelligence reports say that US intelligence satellites oscillate in their orbit in a way that allows the satellites to pick up the same satellite phone signals from slightly different angles and thus take bearings to identify the precise locations of the calls. The authors will further say that sources close to the NSA have dismissed the idea that bin al-Shibh was located by an electronic voice print based on his voice in the Al Jazeera interview, as such a technique is very hard to do, especially since his voice was electronically altered. [Fouda and Fielding, 2003, pp. 184] Three years after the book by Fouda and Fielding is published, a book by Ron Suskind will claim that this intensive US surveillance of Karachi begins not because of bin al-Shibh’s voice in the interview, but because shortly after the interview takes place, Fouda tells his superiors at Al Jazeera that the interview had been in Karachi, and this information gets passed on to US intelligence (see June 14, 2002 and Shortly After). This would have given US intelligence several months to home in on bin al-Shibh’s location instead of just two days (see September 9, 2002). KSM apparently makes it out of Karachi without being captured, and he will be captured elsewhere in Pakistan in early 2003 (see February 29 or March 1, 2003). However, just one day after the interview with Fouda is aired, there are reports that KSM was captured in Karachi in June 2002, close to the time the interview is said to have taken place (see June 16, 2002).

In a speech to the United Nations General Assembly, President Bush says: “Right now, Iraq is expanding and improving facilities that were used for the production of biological weapons.… Iraq has made several attempts to buy high-strength aluminum tubes used to enrich uranium for a nuclear weapon.” [PBS, 9/12/2002; US President, 9/16/2002; Age (Melbourne), 6/7/2003] Bush also says that the US “will work with the UN Security Council.” [US President, 9/16/2002; Vanity Fair, 5/2004, pp. 285] Deputy press secretary Scott McClellan will later describe the speech somewhat differently: “The UN speech… had been an ultimatum—either the UN acts to disarm Saddam Hussein or the United States will. The zero tolerance message was a further sign of how determined the president was to topple the regime by force. Saddam was never going to come completely clean. His power was grounded in brutality and in his ability to portray the regime as stronger than it was to intimidate the populace and potential enemies like Iran. The New York Times publishes a second article reporting that the Bush administration believes a shipment of aluminum tubes destined for Iraq, intercepted in Jordan by US authorities in July (see July 2001), was intended for use in a gas centrifuge. Unlike the Times’ previous report, this article, appearing on page A13, mentions that there is a debate over the tubes between the Energy Department and CIA. It says that according to an unnamed official “[T]here have been debates among intelligence experts about Iraq’s intentions in trying to buy such tubes.” The article says that the official claims “the dominant view in the administration was that the tubes were intended for use in gas centrifuges to enrich uranium.” Another official interviewed by the newspaper claims that Energy’s alternative view “is a footnote, not a split.” One administration official is even quoted by the paper falsely asserting “that the best technical experts and nuclear scientists at laboratories like Oak Ridge supported the CIA assessment.” [New York Times, 9/13/2002; New York Times, 10/3/2004] After the article is published, the Energy Department releases a directive forbidding employees from discussing the issue with reporters. Two days before the CIA is to issue an assessment (see August 2002) on Iraq’s supposed links to militant Islamic groups, Defense Department officials working in the Office of Special Plans (OSP) deliver a briefing in the White House to several top officials, including I. Lewis Libby, Vice President Dick Cheney’s chief of staff, and Deputy National Security Adviser Stephen Hadley. The briefing is entitled “Assessing the Relationship between Iraq and al-Qaeda,” and is an updated version of a briefing presented in July 2002 (see July 25, 2002). The OSP, working under Undersecretary of Defense for Policy Douglas J. Feith, is aggressively promoting any evidence it can find to support a decision to invade Iraq (see September 2002).

Around the same time, the briefing is also presented with slight variations to Defense Secretary Donald Rumsfeld and CIA Director George Tenet. The slide criticizing other intelligence agencies is excluded when a version of the briefing is given to Tenet. A later report by the Defense Department’s Office of Inspector General will conclude the briefing was entirely incorrect and deliberately ignored intelligence by the CIA, DIA, and other intelligence agencies that contradicted its conclusions (see February 9, 2007). [Washington Post, 4/6/2007] The CIA has already found the majority of the information in the presentation either completely false or largely unsupported by reliable evidence. [Savage, 2007, pp. 293]
Unusual Briefing - This briefing, delivered at the same time the White House is pressing Congress to authorize the upcoming war with Iraq (see October 11, 2002), is, in the words of author and reporter Charlie Savage, “highly unusual.” Usually, high-level administration officials making national security decisions rely on information vetted by top-flight analysts at the CIA, in order to ensure the information is as accurate and politically neutral as possible. No CIA analyst has ever found a meaningful link between Hussein and al-Qaeda; the few reports of such claims were seen as highly dubious. But Cheney and his supporters consider the CIA slow, pedantic, and incompetent, and believe Feith’s OSP can provide better—or at least more amenable—intelligence. Savage will write: “In Feith’s shop and elsewhere in the executive branch, neoconservative political appointees stitched together raw intelligence reports, often of dubious credibility, without any vetting or analysis by professional intelligence specialists. The officials cherry-picked the files for reports that supported the notion that Iraq had an active [WMD] program and that it was working hand-in-hand with al-Qaeda, ‘stovepiping’ such reports to top decision makers (and leaking them to the press) while discounting any skepticism mounted by the professionals.” [Savage, 2007, pp. 292]
Dismantling Intelligence Filtering System in Favor of Politically Controlled Intelligence Provisions - What the presentation accomplishes, according to former CIA intelligence analyst Kenneth Pollock, is to support a conclusion already drawn—the need to get rid of Saddam Hussein—by using slanted, altered, and sometimes entirely fabricated “intelligence.” The White House proceeded to “dismantle the existing filtering process that for 50 years had been preventing the policymakers from getting bad information.” Savage goes one step farther. He will write that the presentation is part of a larger White House strategy to alter the balance of power between the presidency and a key element of the bureaucracy. By setting up a politically controlled alternative intelligence filtering system, he will write, “the administration succeeded in diminishing the power of the CIA’s information bureaucracy to check the White House’s desired course of action.” [Savage, 2007, pp. 294]

Defense Secretary Donald Rumsfeld warns the House Armed Services Committee of the serious and imminent threat that Saddam Hussein poses to Western countries. He says: “No terrorist state poses a greater and more immediate threat to the security of our people and the stability of the world than the regime of Saddam Hussein.” He adds: “What has not changed is Iraq’s drive to acquire those weapons of mass destruction, and the fact that every approach that the United Nations has taken to stop Iraq’s drive has failed. This is a critical moment for our country and for the world. Our resolve is being put to the test. It is a test unfortunately the world’s free nations have failed before in recent history with unfortunate consequences.” [US Congress, 9/18/2002; Daily Telegraph, 9/19/2002; Agence France-Presse, 9/19/2002] Rumsfeld says of Iraq’s putative nuclear weapons program, “Some have argued that the nuclear threat from Iraq is not imminent—that Saddam [Hussein] is at least 5-7 years away from having nuclear weapons. I would not be so certain…. He has, at this moment, stockpiles of chemical and biological weapons, and is pursuing nuclear weapons.” [Salon, 3/6/2004] The Secretary of Defense also says that Congress must authorize the president to use military force against Iraq before the Security Council votes on the issue. “Delaying a vote in the Congress would send a message that the US may be unprepared to take a stand, just as we are asking the international community to take a stand and as we are cautioning the Iraqi regime to consider its options,” argues Rumsfeld, adding, “Our job today—the president’s, the Congress’ and the United Nations’—is to… anticipate vastly more lethal attacks before they happen and to make the right decision as to whether or not it’s appropriate for this country to take action…. The goal is not inspections, the goal is disarmament.” [US Congress, 9/18/2002; Associated Press, 9/19/2002] He also tries to discredit Iraq’s September 16, 2002 (see September 16, 2002), offer to admit UN inspectors without conditions. He says: “There’s no doubt in my mind but that the inspection program that currently is on the books wouldn’t work because it’s so much weaker than the earlier one. The more inspectors that are in there, the less likely something is going to happen. The longer nothing happens, the more advanced their weapons programs go along.” [US Congress, 9/18/2002] Rumsfeld is drastically revising his own stance from over a year before, when he told an interviewer on February 12, 2001, that Iraq was “probably not a nuclear threat” (see February 12, 2001).

Eleven days after the New York Times published a front-page article detailing Iraq’s supposed attempt to procure components for creating nuclear weapons (see August 2002 and September 8, 2002), the Washington Post’s Joby Warrick has a story published, “Evidence on Iraq Challenged; Experts Question if Tubes Were Meant for Weapons Program,” that disputes the Times’ article and questions whether the components—aluminum tubes—are indeed intended for nuclear use. Warrick cites “a report by independent experts” from the Institute for Science and International Security (ISIS) questioning the conclusion that the tubes must be for use in constructing nuclear weapons (see September 23, 2002). The ISIS report also notes that the Bush administration is trying to rein in dissent among its own analysts about how to interpret the evidence provided by the aluminum tubes. “By themselves, these attempted procurements are not evidence that Iraq is in possession of, or close to possessing, nuclear weapons,” the report says. “They do not provide evidence that Iraq has an operating centrifuge plant or when such a plant could be operational.” In recent days, National Security Adviser Condoleezza Rice has told television viewers that the tubes “are only really suited for nuclear weapons programs, centrifuge programs” (see September 8, 2002). But Warrick’s story is buried on page 18 of the Post and widely ignored. Author Craig Unger will later write: “No one paid attention. President Bush hosts a dinner meeting with a group of Republican governors at the White House. As deputy press secretary Scott McClellan will later recall, because the meeting is private—no press is allowed—Bush is “conspicuously candid with his former colleagues, now trusted friends and political allies.… Bush’s forthrightness about his thinking and approach on Iraq [is] revealing.” Bush boasts of the recent capture of Ramzi bin al-Shibh (see September 11, 2002) and says of Osama bin Laden, “[W]e don’t know where he is, but he has been diminished.” He then turns to Iraq: “It is important to know that Iraq is an extension of the war on terror,” he says. “In the international debate, we are starting to shift the burden of guilt to the guilty. The international community is risk averse. But I assure you I am going to stay plenty tough.” He repeats his belief that if the international community brings enough pressure to bear, the Iraqi people will take matters into their own hands: “I believe regime change can occur if we have strong, robust inspections. Saddam Hussein is a guy who is likely to have his head show up on a platter” if enough outside pressure is brought to bear. Of Hussein, Bush says: “He is a hateful, ugly, repugnant man who needs to go. He is also paranoid. This is a guy who killed his own security guards recently. I would like to see him gone peacefully. But if I unleash the military, I promise you it will be swift and decisive.” He then tells the governors how to handle questions from possible critics: “Don’t fall into the argument that there is no one to replace Saddam Hussein.… And our planning will make sure there is no oil disruption; we are looking at options to enhance oil flow.” To sum up, Bush says: “Military force is my last option, but it may be the only choice.… I’m gonna make a prediction. Write this down. Afghanistan and Iraq will lead that part of the world to democracy. They are going to be the catalyst to change the Middle East and the world.” In the questioning period, Bush tells the governors that while he intends to invade Iraq sooner rather than later, he is aware that the political timing of the decision is important, with the midterm elections approaching. He reiterates: “[I]f we have to go [into Iraq], we will be tough and swift and it will be violent so troops can move very quickly.… If we go, we will use the full force and the might of the US military (see February 25, 2003).… I believe in the power of freedom.” After the meeting, Governor John Rowland (R-CT), the chairman of the Republican Governors Association, calls the meeting a “heart to heart” on Iraq. But, McClellan will later reflect, “it was also a frank strategy powwow between the leader of a campaign and some important members of his team—a collection of local politicians who could play a crucial role in helping to generate popular support for the decision to invade.” [McClellan, 2008, pp. 139-141]

When a CIA officer notes that the alleged ties between Iraq and al-Qaeda are not supported by current intelligence, Douglas Feith cuts in insisting that Mohamed Atta had met an Iraqi agent in Prague, and that the director of Iraqi intelligence had met with Osama bin Laden in 1996. David Albright, a physicist who helped investigate Iraq’s nuclear weapons program following the 1991 Persian Gulf War as a member of the International Atomic Energy Agency’s inspection team, concludes in a study that Iraq’s attempt to import aluminum tubes is not “evidence that Iraq is in possession of, or close to possessing, nuclear weapons” or that Iraq has an operating centrifuge plant. His assessment is based on several factors, including the fact that the tubes are made of an aluminum alloy that is ill-suited for welding. He notes that Iraq had used maraging steel and carbon fiber in its earlier attempts to make centrifuges (see (Late 1980s)). Albright also challenges the CIA’s contention the tubes’ anodized coating is an indication that they are meant to be used as rotors in a gas centrifuge. The nuclear physicist notes that the fact the tubes are anodized actually supports the theory that they were meant to be used in rockets, not a centrifuge. He cites another expert who said that an “anodized layer on the inside of the tube… can result in hampering the operation of the centrifuge.” [Albright, 10/9/2003 Sources: David Albright] Though Albright is critical of the charges being made by the Bush administration against Iraq, concerning nuclear weapons, he is no sympathizer of Saddam Hussein. He believes that Iraq has weapons of mass destruction and advocates a tough stance towards his regime. [New York Review of Books, 2/26/2004] His report is widely dispersed and is covered in detail by the Washington Post on September 19, 2002 (see September 19, 2002). In a classified session, George Tenet and other intelligence officials brief the Senate Intelligence Committee on the 2002 National Intelligence Estimate (NIE) on Iraq (see October 1, 2002). In his summary of the document, Tenet reportedly says that Iraq attempted to obtain uranium from Niger. Though he mentions that there are some doubts about the reliability of the evidence, he does not provide any details. [Washington Post, 6/12/2003 pdf file; ABC News, 6/16/2003] Tenet also says that the aluminum tubes sought by Iraq (see July 2001) were intended for its nuclear program, that the country has a fleet of mobile biological weapons labs, and that Iraq has developed unmanned aerial vehicles (UAVs) that could be armed with chemical or biological weapons for an attack against the US mainland. At one point during the session, a committee staff member slips Senator Joe Biden (D-DE) a note suggesting that the senator ask Tenet what “technically collected” evidence does the CIA have that Iraq possesses weapons of mass destruction. Biden asks the question and Tenet replies, “None, Senator.” Everyone becomes silent. Biden, apparently annoyed by the answer, asks Tenet, “George, do you want me to clear the staff out of the room,” meaning that if the intelligence is so classified that it shouldn’t be shared with staffers he will ask them to leave. But Tenet says, “There’s no reason to.” When Tenet finishes his testimony, he leaves to attend his son’s basketball game. Other senators also leave. The next witnesses are Carl Ford, Jr., the State Department’s chief intelligence officer, and Rhys Williams, the chief intelligence officer in the Energy Department. Both men say they do not believe that the aluminum tubes sought by Iraq were intended for a nuclear program. But few senators are still in the room to hear these opinions. After the hearing, Peter Zimmerman, the committee’s scientific advisor, asks Robert Walpole the CIA’s national intelligence officer for nuclear weapons, to show him one of the tubes referred to by Tenet. Zimmerman looks at the sample Walpole brought and becomes immediately doubtful. He then grills Walpole on several technical details, who fails to provide any convincing answers. Zimmerman gets the impression that Walpole has little understanding of centrifuges. “I remember going home that night and practically putting my fist through the wall half a dozen times,” Zimmerman later recalls. “I was frustrated as I’ve ever been. I remember saying to my wife, ‘They’re going to war and there’s not a damn piece of evidence to substantiate it.’” [Isikoff and Corn, 2006, pp. 117-119]

In his weekly radio address, President Bush tells the nation: “The Iraqi regime possesses biological and chemical weapons, is rebuilding the facilities to make more, and, according to the British government, could launch a biological or chemical attack in as little as 45 minutes after the order is given. The regime has long-standing and continuing ties to terrorist groups, and there are al-Qaeda terrorists inside Iraq. This regime is seeking a nuclear bomb, and with fissile material could build one within a year.” Many Americans are shocked and frightened by Bush’s flat litany of assertions. What they do not know is that none of them are true. The CIA had reluctantly agreed to produce a National Intelligence Estimate (NIE) on Iraq less than three weeks before (see September 5, 2002); the result is an NIE packed with half-truths, exaggerations, and outright lies (see October 1, 2002). None of Bush’s statements are supported by hard intelligence, and all will later be disproven. The CIA distributes a classified report on the aluminum tubes (see July 2001) concluding that Iraq probably intended to use the tubes as rotors in gas centrifuges. The report, titled “Iraq ‘s Hunt for Aluminum Tubes: Evidence of a Renewed Uranium Enrichment Program,” is the most detailed to date and will serve as the basis for the draft text of the majority position on the aluminum tubes in the October 2002 National Intelligence Estimate on Iraq (see October 1, 2002). It summarizes Iraq’s “efforts to hide the tube procurement attempts, the materials, high cost, tight tolerances, dimensions and the anodized coating of the tubes, and CIA’s assessment that the tubes ‘matched’ known centrifuge rotor dimensions,” according to a later Senate Intelligence report The CIA assessment also states that the US Army’s National Ground Intelligence Center (NGIC) does not believe it is likely that the tubes were intended for a conventional rocket program. [US Congress, 7/7/2004; New York Times, 10/3/2004] The two analysts responsible for the NGIC opinion, George Norris and Robert Campos, will receive job performance awards in 2002, 2003, and 2004 even though, according to a later investigation headed by former Senator Charles Robb (D-Va.) and Judge Laurence H. [Source: CIA]The National Intelligence Council, a board of senior analysts that prepares reports on crucial national security issues, completes a National Intelligence Estimate (NIE) on Iraq. The purpose of an NIE is to provide policy-makers with an intelligence assessment that includes all available information on a specific issue so they can make sound policy decisions. The formal document is supposed to be the result of a collaborative effort of the entire intelligence community and is supposed to be untainted by political interests. The decision to produce the assessment on Iraq followed criticisms that the administration had already made a decision to invade Iraq without having thoroughly reviewed all available intelligence on Iraq. Congress wanted the NIE completed prior to voting on a bill authorizing the president to use force against Iraq (see September 5, 2002). NIEs such as this usually take months to prepare, however this document took a mere three weeks. The person in charge of preparing the document was weapons expert Robert Walpole. According to the Independent of London, Walpole has a track record of tailoring his work to support the biases of his superiors. “In 1998, he had come up with an estimate of the missile capabilities of various rogue states that managed to sound considerably more alarming than a previous CIA estimate issued three years earlier,” the newspaper later reports. “On that occasion, he was acting at the behest of a congressional commission anxious to make the case for a missile defense system; the commission chairman was none other than Donald Rumsfeld….” [Independent, 11/3/2003; New York Times, 10/3/2004]
Summary of NIE Conclusions - The NIE says there are potentially links between Iraq and al-Qaeda, but uses cautionary language and acknowledges that its sources—Iraqi defectors and captured al-Qaeda members—have provided conflicting reports. The sections dealing with weapons of mass destruction are also filled with caveats and nuanced statements. In the second paragraph of its “key judgment” section, the NIE states that US intelligence lacks “specific information” on Iraq’s alleged arsenal of weapons of mass destruction. And while the NIE says that Iraq probably has chemical and biological weapons, it also says that US intelligence analysts believe that Saddam Hussein would only launch an attack against the US if he felt a US invasion were inevitable. It also concludes that Saddam would only provide terrorists with chemical or biological agents for use against the United States as a last resort in order to “exact vengeance by taking a large number of victims with him.” [Central Intelligence Agency, 10/1/2002; Washington Post, 6/22/2003; Agence France-Presse, 11/30/2003]
Reconstituted nuclear weapons programs - According to the NIE, “most” of the US’ six intelligence agencies believe there is “compelling evidence that Saddam [Hussein] is reconstituting a uranium enrichment effort for Baghdad’s nuclear weapons program.” The one agency that disagrees with this conclusion is the State Department’s Bureau of Intelligence and Research (INR), which says in its dissenting opinion: “The activities we have detected do not, however, add up to a compelling case that Iraq is currently pursuing what INR would consider to be an integrated and comprehensive approach to acquire nuclear weapons. Iraq may be doing so, but INR considers the available evidence inadequate to support such a judgment. Lacking persuasive evidence that Baghdad has launched a coherent effort to reconstitute its nuclear weapons programs, INR is unwilling to… project a timeline for the completion of activities it does not now see happening.” It is later learned that nuclear scientists in the Department of Energy’s in-house intelligence office were also opposed to the NIE’s conclusion and wanted to endorse the State’s alternative view. However, the person representing the DOE, Thomas Ryder, silenced them and inexplicably voted to support the position that Iraq had reconstituted its nuclear weapons program (see Late September 2002). The DOE’s vote was seen as critical, since the department’s assessment was supposed to represent the views of the government’s nuclear experts. Iraqi attempts to obtain uranium from Africa - According to the NIE, Iraq is “vigorously trying” to obtain uranium and “reportedly” is working on a deal to purchase “up to 500 tons” of uranium from Niger. It reads: “A foreign government service reported that as of early 2001, Niger planned to send several tons of ‘pure uranium’ (probably yellowcake) to Iraq. As of early 2001, Niger and Iraq reportedly were still working out arrangements for this deal, which could be for up to 500 tons of yellowcake. We do not know the status of this arrangement. Reports indicate Iraq also has sought uranium ore from Somalia and possibly the Democratic Republic of the Congo.” But the alternative view—endorsed by the State Department’s Bureau of Intelligence and Research (INR)—says that it is doubtful Iraq is trying to procure uranium from Africa. ”(T)he claims of Iraqi pursuit of natural uranium in Africa are, in INR’s assessment, highly dubious,” it reads. Iraqi attempts to obtain aluminum tubes - The NIE says that most “agencies believe that Saddam’s personal interest in and Iraq’s aggressive attempts to obtain high-strength aluminum tubes for centrifuge rotors—as well as Iraq’s attempts to acquire magnets, high-speed balancing machines, and machine tools—provide compelling evidence that Saddam is reconstituting a uranium enrichment effort for Baghdad’s nuclear weapons program.” To support its analysis of the tubes, it includes a chart which compares the dimensions of the aluminum tubes sought by Iraq with those that would be needed for a “Zippe-type” centrifuge. The chart’s comparison of the tubes makes it appear that the tubes are similar. But the NIE neglects to say that the aluminum tubes are an exact match with those used in Iraq’s 81-millimeter rocket. The estimate also claims that the tubes are not suitable for rockets. The assertion ignores the fact that similar tubes are used in rockets from several countries, including the United States. [US Congress, 7/7/2004, pp. 84; New York Times, 10/3/2004] It does note however that the 900 mm tubes ordered by Iraq would have to have been cut in half to make two 400 mm rotors, and that the tubes would have needed other modifications as well in order to be used in centrifuge rotors. [The Commission on the Intelligence Capabilities of the United States Regarding Weapons of Mass Destruction (aka 'Robb-Silberman Commission'), 3/31/2005] The NIE’s conclusion about the tubes is challenged by two US intelligence agencies, the DOE’s in house intelligence agency, and the State Department’s Bureau of Intelligence and Research. In its dissenting opinion, the DOE says, “It is well established in open sources that bare aluminum is resistant to UF6 and anodization is unnecessary for corrosion resistance, either for the aluminum rotors or for the thousands of feet of aluminum piping in a centrifuge facility. Instead, anodization would likely introduce uncertainties into the design that would need to be resolved before a centrifuge could be operated.” The DOE’s dissenting opinion—written mainly by nuclear physicist William Domke at the Energy Department’s Lawrence Livermore National Laboratory and nuclear physicist Jeffrey Bedell at the Los Alamos National Laboratory—also notes that anodization is a standard practice in missile construction for environmental protection. The Energy Department’s centrifuge physicists suggested more than a year before that the tubes were meant to serve as casings for conventional rockets (see May 9, 2001), but CIA analysts held fast to their theory. [Washington Post, 7/19/2003; USA Today, 7/31/2003; Washington Post, 10/26/2003; US Congress, 7/7/2004, pp. 59] Years later a DOE intelligence analyst will tell two journalists, “[The DOE’s nuclear scientists] are the most boring people. Their whole lives revolve around nuclear technology. They can talk about gas centrifuges until you want to jump out of a window. And maybe once every ten years or longer there comes along an important question about gas centrifuges. That’s when you should really listen to these guys. If they say an aluminum tube is not for a gas centrifuge, it’s like a fish talking about water.” [Isikoff and Corn, 2006, pp. 40] The State Department’s Bureau of Intelligence and Research, similarly writes in its dissenting footnote: “In INR’s view Iraq’s efforts to acquire aluminum tubes is central to the argument that Baghdad is reconstituting its nuclear weapons program, but INR is not persuaded that the tubes in question are intended for use as centrifuge rotors. INR accepts the judgment of technical experts at the US Department of Energy (DOE) who have concluded that the tubes Iraq seeks to acquire are poorly suited for use in gas centrifuges to be used for uranium enrichment and finds unpersuasive the arguments advanced by others to make the case that they are intended for that purpose. INR considers it far more likely that the tubes are intended for another purpose, most likely the production of artillery rockets. The very large quantities being sought, the way the tubes were tested by the Iraqis, and the atypical lack of attention to operational security in the procurement efforts are among the factors, in addition to the DOE assessment, that lead INR to conclude that the tubes are not intended for use in Iraq’s nuclear weapon program.” [Washington Post, 7/19/2003; USA Today, 7/31/2003]
Chemical and Biological Weapons - On the question of chemical and biological weapons, the NIE says: “We judge Iraq has some lethal and incapacitating BW agents and is capable of quickly producing and weaponizing a variety of such agents, including anthrax, for delivery by bombs, missiles, aerial sprayers, and covert operatives.” But the document also highlights the belief that it is unlikely that Iraq has any intention to use these against the US. “… Baghdad for now appears to be drawing a line short of conducting terrorist attacks with conventional or CBW [Chemical/Biological Weapons] against the United States, fearing that exposure of Iraqi involvement would provide Washington with a stronger case for making war.” Iraq would probably only use such weapons against the United States if it “feared an attack that threatened the survival of the regime were imminent or unavoidable, or possibly for revenge.” [Central Intelligence Agency, 10/1/2002]
Unmanned Aerial Vehicles - Citing defectors and exiles, the NIE states that Iraq possesses unmanned aerial vehicles (UAVs) which can be used to deploy biological and chemical weapons. But the document includes a dissenting opinion by the Air Force’s National Air and Space Intelligence Center. The center, which controls most of the US military’s UAV fleet, says there is little evidence that Iraq’s drones are related to the country’s suspected biological weapons program. Current intelligence suggests that the drones are not capable of carrying much more than a camera and a video recorder. The Air Force believes that Iraq’s unmanned aerial vehicles (UAVs) are for reconnaissance, like its counterparts in the US. The dissenting opinion reads: “… The Director, Intelligence, Surveillance and Reconnaissance, US Air Force, does not agree that Iraq is developing UAVs primarily intended to be delivery platforms for chemical and biological warfare (CBW) agents. The small size of Iraq’s new UAV strongly suggests a primary role of reconnaissance, although CBW delivery is an inherent capability.” [Associated Press, 8/24/2003; Washington Post, 9/26/2003; Knight Ridder, 2/10/2004] Bob Boyd, director of the Air Force Intelligence Analysis Agency, will tell reporters in August 2003 that his department thought the allegation in the NIE “was a little odd,” noting that Air Force assessments “all along” had said that reconnaissance, not weapons delivery, was the purpose of Iraq’s drones. “Everything we discovered strengthened our conviction that the UAVs were to be used for reconnaissance,” he will explain. “What we were thinking was: Why would you purposefully design a vehicle to be an inefficient delivery means? Wouldn’t it make more sense that they were purposefully designing it to be a decent reconnaissance UAV?” [Associated Press, 8/24/2003; Washington Post, 9/26/2003] The NIE also says that Iraq is attempting to obtain commercially available route-planning software that contains topographic data of the United States. According to the NIE, this data could facilitate targeting of US sites. But Air Force analysts were not convinced by the argument, noting that this sort of information could easily be retrieved from the Internet and other highly accessible sources. “We saw nothing sinister about the inclusion of the US maps in route-planning software,” Boyd will tell reporters. [Washington Post, 9/26/2003] Analysts at the Pentagon’s Missile Defense Agency are said to back the Air Force’s National Air and Space Intelligence Center’s position. [Associated Press, 8/24/2003]

Aftermath - After the completion of the National Intelligence Estimate, the Bush administration will continue to make allegations concerning Iraq’s weapons capabilities and ties to militant Islamic groups, but will include none of the qualifications and nuances that are present in the classified NIE. After excerpts from the classified version of the NIE are published in the press in July of 2003 (see 3:09 p.m. July 11, 2003), administration officials will claim that neither Bush, Rice, nor other top officials were informed about the alternative views expressed by the DOE, INR, and the Air Force intelligence agency. They will also assert that the dissenting views did not significantly undermine the overall conclusion of the NIE that Iraq was continuing its banned weapons program despite UN resolutions. [Washington Post, 7/19/2003; New York Times, 7/19/2003; Washington Post, 7/27/2003] But this claim is later disputed in an article by the Washington Post, which reports: “One person who has worked with Rice describes as ‘inconceivable’ the claims that she was not more actively involved. Indeed, subsequent to the July 18 briefing, another senior administration official said Rice had been briefed immediately on the NIE—including the doubts about Iraq’s nuclear program—and had ‘skimmed’ the document. The official said that within a couple of weeks, Rice ‘read it all.’” [Washington Post, 7/27/2003] The official’s account, will in fact be confirmed by Rice herself, who reportedly tells Gwen Ifill at the National Association of Black Journalists Convention in Dallas on August 7, 2003: “I did read everything that the CIA produced for the president on weapons of mass destruction. I read the National Intelligence Estimate cover to cover a couple of times. I read the reports; I was briefed on the reports. This is—after 20 years, as somebody who has read a lot of intelligence reports—this is one of the strongest cases about weapons of mass destruction that I had ever read.” [Daily Howler, 8/11/2003]
Conclusions 'Overstated' - George Bush is also provided with a summary of the NIE’s dissenting views. According to the Robb-Silberman report, released in early 2005, the president’s summary of the NIE notes that “INR and DOE believe that the tubes more likely are intended for conventional weapon uses.” [The Commission on the Intelligence Capabilities of the United States Regarding Weapons of Mass Destruction (aka 'Robb-Silberman Commission'), 3/31/2005] Additionally, senior CIA analyst Stuart Cohen, the acting chairman of the National Intelligence Council at this time, who helped write the document, will tell the Agence France-Presse, “Any reader would have had to read only as far as the second paragraph of the Key Judgments to know that as we said, ‘we lacked specific information on many key aspects of Iraq’s WMD program.’” The Key Judgments section is also where INR’s detailed dissent on the aluminum tubes allegation was located. [Agence France-Presse, 11/30/2003] A Senate Intelligence Committee investigation will determine in July 2004 that “most of the major key judgments in the Intelligence Community’s October 2002 National Intelligence Estimate (NIE), Iraq’s Continuing Programs for Weapons of Mass Destruction, either overstated, or were not supported by, the underlying intelligence reporting.” [US Congress, 7/7/2004, pp. 59] And in 2006, one of the report’s authors, CIA senior analyst Paul Pillar, will admit the NIE had been written with the intent of “strengthen[ing] the case of going to war with the American public.” [PBS Frontline, 6/20/2006]
NIE 'Distorted' Due to Political Pressures, Author Claims - In 2007, author Craig Unger will write, “At the time, to virtually everyone in Congress, the NIE was still sacrosanct. It was still the last word in American intelligence. Yet it had been distorted thanks to political pressures from the neocons and the White House. If one took it seriously, the Niger documents were real. Curveball had credibility. And the aluminum tubes were part of Saddam’s nuclear program. Only one conclusion could be drawn: Saddam Hussein post an extraordinarily grave threat.” [Unger, 2007, pp. 266]

The Associated Press reports that Islamist militant leader Abu Musab al-Zarqawi “was in Baghdad about two months ago, and US officials suspect his presence was known to the government of Iraqi President Saddam Hussein, a defense official said…” This anonymous US official also calls al-Zarqawi among al-Qaeda’s top two dozen leaders. The article notes that “some US officials… contend the United States has no solid evidence of Iraq and al-Qaeda working together to conduct terrorist operations.” [Associated Press, 10/2/2002] But despite this caveat, just five days later, in a public speech President Bush mentions “one very senior al-Qaeda leader who received medical treatment in Baghdad this year, and who has been associated with planning for chemical and biological attacks” (see October 7, 2002). This is a reference to al-Zarqawi, and is said to be based on communications intercepts. But the same day as the speech, Knight Ridder Newspapers reports that according to US intelligence officials, “The intercepts provide no evidence that [al-Zarqawi] was working with the Iraqi regime or that he was working on a terrorist operation while he was in Iraq.” [Knight Ridder, 10/7/2002; US President, 10/14/2002] After the US invades Iraq in March 2003, evidence of this Baghdad connection will start to be questioned. Reports that al-Zarqawi was there to have a leg amputated will later be debunked (see January 26, 2003). In June 2003, Newsweek will report, “Bush Administration officials also have acknowledged that their information about al-Zarqawi’s stay in Baghdad is sketchy at best.” [Newsweek, 6/25/2003] Whether al-Zarqawi stayed in Baghdad and if the Hussein government was aware of his movements remains unclear.

The US and Britain continue to demand that weapons inspectors not return to Iraq until after a stronger resolution—one that authorizes the use of force—is agreed upon by the National Security Council. Bush threatens to lead a coalition against Iraq if the UN Security Council fails to back him. During an address in Washington to Hispanic leaders, Bush says: “My intent, of course, is for the United Nations to do its job. I think it’ll make it easier for us to keep the peace…. My intent is to put together a vast coalition of countries who understand the threat of Saddam Hussein. The military option is my last choice, not my first. It’s my last choice…. The choice is up to the United Nations to show its resolve. The choice is up to Saddam Hussein to fulfill its word—his word. And if neither of them acts, the United States, in deliberate fashion, will lead a coalition to take away the world’s worst weapons from one of the world’s worst leaders.” [Reuters, 10/3/2002; US President, 10/7/2002] But Russia, France, and China maintain their opposition to the US-British draft resolution which would pave the way for using military force against Iraq. Russian Deputy Foreign Minister Alexander Saltanov strongly disagrees that a tougher resolution is needed. And France remains insistent that any further resolutions against Iraq should be broken into two parts—one defining the terms of inspections, and a second outlining the consequences if Iraq does not comply. The CIA releases a 25-page declassified version of its October 1 National Intelligence Estimate on Iraq (see October 1, 2002) and posts it on the agency’s website for public viewing. [Washington Post, 6/22/2003; Vanity Fair, 5/2004, pp. 281] The document, titled “Iraq’s Weapons of Mass Destruction Programs,” presents a very different assessment of the threat posed by Iraq than the original document. Printed on slick glossy magazine-style paper, and full of colorful maps, graphs, tables, and photos, the document contains few of the caveats and nuances that are in the classified version. Nor does it include the dissenting opinions of the Energy Department’s in-house intelligence agency, the State Department’s Bureau of Intelligence and Research, or the Air Force’s National Air and Space Intelligence Center. When Senator Bob Graham (D-FL) reads the CIA’s white paper on Iraq, a document written for public consumption that was supposed to have been an accurate summary of the agency’s recently released NIE (see October 1, 2002), he begins “to question whether the White House [is] telling the truth—or even [has] an interest in knowing the truth,” he later says. The document includes none of the dissenting opinions or caveats that were in the NIE, and therefore makes the CIA’s evidence against Saddam Hussein appear much stronger than it actually is. When Graham calls CIA Director George Tenet to ask what happened, Tenet becomes defensive and accuses the senator of questioning his professionalism and patriotism. Graham then sends the CIA a letter requesting that the agency declassify the dissenting opinions as well as the passages that contained more nuanced and cautionary language. He also requests that the agency declassify his October 2 exchange (see October 2, 2002) with Deputy CIA Director John McLaughlin concerning the NIE. In that exchange, McLaughlin had conceded that the likelihood of Saddam Hussein launching an attack with weapons of mass destruction were “low.” [Isikoff and Corn, 2006, pp. 140-141]

Preparing for a major speech by President Bush on Iraq (see October 7, 2002), the National Security Council has sent the sixth draft of the speech to the CIA for vetting. It includes a line saying that Iraq “has been caught attempting to purchase up to 500 metric tons of uranium oxide from Africa—an essential ingredient in the enrichment process.” It is essentially the same language turned down by the CIA for an earlier speech (see September 11, 2002). In response, the CIA’s associate deputy director for intelligence [ADDI] sends a four-page memo to Bush administration officials, including Bush’s Deputy National Security Adviser, Stephen J. Hadley, and the chief speechwriter, Michael Gerson, expressing doubt over claims that Iraq had attempted to obtain uranium from Niger. On page three of the memo, the ADDI advises removing the allegation from the draft of Bush’s upcoming speech in Cincinnati. “[R]emove the sentence because the amount is in dispute and it is debatable whether it can be acquired from the source. We told Congress that the Brits have exaggerated this issue (see September 24, 2002). Finally, the Iraqis already have 550 metric tons of uranium oxide in their inventory.” [Washington Post, 7/23/2003; Unger, 2007, pp. 261-262] Despite the warning, the White House refuses to make substantial changes. Draft seven of the speech, completed later in the day (see October 6, 2002), contains the passage, “[T]he regime has been caught attempting to purchase substantial amounts of uranium oxide from sources in Africa.” [US Congress, 7/7/2004] Hadley will later claim in July 2003 that he did not brief his boss, Condoleezza Rice, on the memo. The attack takes places in the Gulf of Aden off the coast of Yemen. One crew member is killed and over 90,000 barrels of oil leak into the sea. The attack is similar to the one on the USS Cole almost two years before (see October 12, 2000) and is planned by one of the same people, Abd al-Rahim al-Nashiri. [Source: CIA]In a televised speech, President Bush presents the administration’s case that Saddam Hussein’s regime is a threat to the security of the nation and insists that regime change would improve lifes for Iraqis. “Some worry that a change of leadership in Iraq could create instability and make the situation worse. The situation could hardly get worse, for world security and for the people of Iraq. The lives of Iraqi citizens would improve dramatically if Saddam Hussein were no longer in power, just as the lives of Afghanistan’s citizens improved after the Taliban.” The speech is widely criticized for including false and exaggerated statements.
Iraq has attempted to purchase equipment used to enrich uranium for nuclear weapons - Bush claims that a shipment of 3,000 aluminum tubes to Iraq, which were intercepted in Jordan by US authorities in July of 2001 (see July 2001), had been destined for use in a uranium enrichment program. But by this time numerous experts and government scientists have already warned the administration against making this allegation. [US President, 10/14/2002] Three weeks before Bush’s speech, The Washington Post ran a story on the aluminum tubes. The article summarized a study by the Institute for Science and International Security (ISIS), disputing the administration’s claim that the tubes were to be used for gas centrifuges. The report was authored by the institute’s president and founder, David Albright, a respected nuclear physicist, who had investigated Iraq’s nuclear weapons program after the First Gulf War as a member of the International Atomic Energy Agency’s inspection team and who has spoken before Congress on numerous occasions. In his study, he concluded that Iraq’s attempts to import the tubes “are not evidence that Iraq is in possession of, or close to possessing, nuclear weapons” and “do not provide evidence that Iraq has an operating centrifuge plant or when such a plant could be operational.” [Washington Post, 9/19/2002; Guardian, 10/9/2002; San Francisco Chronicle, 10/12/2002; Albright, 10/9/2003] Soon after the speech, Albright tells The Guardian newspaper that there is still no evidence to substantiate that interpretation. As one unnamed specialist at the US Department of Energy explains to the newspaper, “I would just say there is not much support for that [nuclear] theory around here.” [Guardian, 10/9/2002] The Washington Post article also reported that government experts on nuclear technology who disagreed with the White House view had told Albright that the administration expected them to remain silent. [Washington Post, 9/19/2002; Independent, 9/22/2002] Houston G. Wood III, a retired Oak Ridge physicist considered to be “among the most eminent living experts” on gas centrifuges reviewed the tube question in August 2001 (see 1950s) and concluded at that time that it was very unlikely that the tubes had been imported to be used for centrifuges in a uranium enrichment program. He later tells The Washington Post in mid-2003 that “it would have been extremely difficult to make these tubes into centrifuges,” adding that it stretched “the imagination to come up with a way.” He also says that other centrifuge experts whom he knew shared his assessment of the tubes. [Washington Post, 8/10/2003] In addition to the several outside experts who criticized the tubes allegation, analysts within the US intelligence community also doubted the claim. Less than a week before Bush’s speech, the Energy Department and the State Department’s intelligence branch, the INR, had appended a statement to a National Intelligence Estimate on Iraq disputing the theory (see October 1, 2002). Saddam Hussein ordered his nuclear program to continue in 1998 - Bush says that US intelligence has information that Saddam Hussein ordered his nuclear program to continue after inspectors left in 1998. “Before being barred from Iraq in 1998, the International Atomic Energy Agency dismantled extensive nuclear weapons-related facilities, including three uranium enrichment sites,” Bush charges. “That same year, information from a high-ranking Iraqi nuclear engineer who had defected revealed that despite his public promises, Saddam Hussein had ordered his nuclear program to continue.” [San Francisco Chronicle, 10/12/2002; US President, 10/14/2002] But Bush’s “high-ranking” source turns out to be Khidir Hamza, who is considered by many to be an unreliable source. Albright, who was president of the Institute for Science and International Security where Hamza worked as an analyst from 1997 to 1999, says that after Hamza defected, “he went off the edge [and] started saying irresponsible things.” [San Francisco Chronicle, 10/12/2002] And General Hussein Kamel, Saddam Hussein’s son-in-law who was in charge of the dictator’s former weapons program but who defected in 1995, told UNSCOM and IAEA inspectors, as well as US and British intelligence, that Khidir Hamza was “a professional liar.” Kamel explained, “He worked with us, but he was useless and always looking for promotions. He consulted with me but could not deliver anything…. He was even interrogated by a team before he left and was allowed to go.” [United Nations Special Commission, 4/16/1998; New Yorker, 5/12/2003]
Iraq is developing drones that could deploy chemical and biological weapons - The President claims that Iraq is developing drones, or unmanned aerial vehicles (UAVs), which “could be used to disperse chemical or biological weapons across broad areas.” He goes so far as to say, “We’re concerned that Iraq is exploring ways of using these UAVs for missions targeting the United States.” [Guardian, 10/9/2002; US President, 10/14/2002] But this claim comes shortly after US intelligence agencies completed a National Intelligence Estimate on Iraq, in which Air Force intelligence had disputed the drone allegation (see October 1, 2002). Bush’s drone allegation is quickly derided by experts and other sources. The Guardian of London reports two days later that according to US military experts, “Iraq had been converting eastern European trainer jets, known as L-29s, into drones, but… that with a maximum range of a few hundred miles they were no threat to targets in the US.” [Guardian, 10/9/2002] And the San Francisco Chronicle will cite experts who say that “slow-moving unmanned aerial vehicles would likely be shot down as soon as they crossed Iraq’s borders” because “Iraqi airspace is closely monitored by US and British planes and radar systems.” The report will also note, “It’s also unclear how the vehicles would reach the US mainland—the nearest point is Maine, almost 5, 500 miles away—without being intercepted.” [San Francisco Chronicle, 10/12/2002] Anthony Cordesman, a security analyst at the Center for Strategic and International Studies, will say he believes the drone allegation is unrealistic. In an interview with the San Francisco Chronicle, he says, “As a guesstimate, Iraq’s present holdings of delivery systems and chemical and biological weapons seem most likely to be so limited in technology and operational lethality that they do not constrain US freedom of action or do much to intimidate Iraq’s neighbors.” [San Francisco Chronicle, 10/12/2002] These criticisms of Bush’s claim are validated after the US invasion of Iraq. Two US government scientists involved in the post-invasion hunt for weapons of mass destruction will tell the Associated Press in August 2003 that they inspected the drones and concluded that they were never a threat to the US. “We just looked at the UAVs and said, ‘There’s nothing here. There’s no room to put anything in here,’” one of the scientists will say. “The US scientists, weapons experts who spoke on condition of anonymity, reached their conclusions after studying the small aircraft and interviewing Iraqi missile experts, system designers and Gen. Ibrahim Hussein Ismail, the Iraqi head of the military facility where the UAVs were designed,” the Associated Press will explain in its report. [Associated Press, 8/24/2003]
Saddam Hussein could give terrorists weapons of mass destruction - Bush asserts, “Iraq could decide on any given day to provide a biological or chemical weapon to a terrorist group or individual terrorists.” [US President, 10/14/2002] But not only have numerous experts and inside sources disputed this theory (see July 2002-March 19, 2003), US intelligence’s National Intelligence Estimate on Iraq—completed just one week before—concluded that this is an unlikely scenario (see October 1, 2002). “Baghdad, for now, appears to be drawing a line short of conducting terrorist attacks with conventional or CBW against the United States,” the document clearly stated. “Should Saddam conclude that a US-led attack could no longer be deterred he probably would become much less constrained in adopting terrorist actions.” [San Francisco Chronicle, 10/12/2002]
Iraq rebuilding facilities associated with production of biological and chemical weapons - Bush claims that surveillance photos indicate that Iraq “is rebuilding facilities that it had used to produce chemical and biological weapons.” [US President, 10/14/2002] On the following day, photos are published on the White House website showing that Iraq had repaired three sites damaged by US bombs—the Al Furat Manufacturing Facility, the Nassr Engineering Establishment Manufacturing Facility, and Fallujah II. [US President, 10/14/2002] But no evidence is provided by the White House demonstrating that these sites have resumed activities related to the production of weapons of mass destruction. Iraqi authorities will give reporters a tour of the facilities on October 10 (see October 10, 2002).
Iraq has trained al-Qaeda members in bomb-making and poisons and deadly gases - Bush alleges that Iraq has trained al-Qaeda operatives “in bomb-making and poisons and deadly gases.” [US President, 10/14/2002] The claim is based on a September 2002 CIA document which had warned that its sources were of “varying reliability” and that the claim had not yet been substantiated (see September 2002). The report’s main source, Ibn al-Shaykh al-Libi, an al-Qaeda operative who offered the information to CIA interrogators while in custody, later recants the claim (see February 14, 2004). A Defense Intelligence Agency report in February 2002 (see February 2002) had also expressed doubt in the claim, going so far as to suggest that al-Libi was “intentionally misleading [his] debriefers.” [CNN, 9/26/2002; New York Times, 7/31/2004; Newsweek, 7/5/2005; New York Times, 11/6/2005] And earlier in the month, US intelligence services had concluded in their National Intelligence Estimate on Iraq that this allegation could not be confirmed. [CNN, 9/26/2002; Newsday, 10/10/2002; San Francisco Chronicle, 10/12/2002; Washington Post, 6/22/2003]
A very senior al-Qaeda leader received medical treatment in Baghdad - Bush claims: “Some al-Qaeda leaders who fled Afghanistan went to Iraq. These include one very senior al-Qaeda leader who received medical treatment in Baghdad this year, and who has been associated with planning for chemical and biological attacks.” The allegation refers to Abu Musab al-Zarqawi, a Jordanian-born Palestinian who is the founder of al-Tawhid, an organization whose aim is to kill Jews and install an Islamic regime in Jordan. It was first leaked to the press by an anonymous US official several days before Bush’s speech (see October 2, 2002). The allegation is partly based on intercepted telephone calls in which al-Zarqawi was overheard calling friends or relatives (see December 2001-Mid-2002). But on the same day as Bush’s speech, Knight Ridder Newspapers reports that according to US intelligence officials, “The intercepts provide no evidence that the suspected terrorist was working with the Iraqi regime or that he was working on a terrorist operation while he was in Iraq.” [Knight Ridder, 10/7/2002; US President, 10/14/2002] Al-Zarqawi will link with al-Qaeda, but only in 2004, after the start of the war in Iraq (see October 17, 2004).

Senior Bush neoconservatives, angry at the US intelligence community’s refusal to allow the Iraq-Niger uranium deal allegations into President Bush’s Cincinnati speech (see October 5, 2002 and October 6, 2002), begin purging “troublesome” intelligence analysts. One such victim is Bruce Hardcastle (see Early 2002), the DIA’s intelligence officer for the Middle East, South Asia, and Counterterrorism. Hardcastle has challenged Bush officials, telling them “that the way they were handling evidence was wrong.” In retaliation, not only does Hardcastle lose his job, but his position is eliminated entirely. DIA analyst Patrick Lang will later recall: “They wanted just liaison officers who were junior. They didn’t want a senior intelligence officer who argued with them.” Lang will recall Hardcastle saying, “I couldn’t deal with these people.” Lang continues: “They are such ideologues that they know what the outcome should be.… They start with an almost psuedo-religious faith. They wanted the intelligence agencies to produce material to show a threat, particularly an imminent threat. Then they worked back to prove their case. It was the opposite of what the process should have been like, that the evidence should prove the case.” [Unger, 2007, pp. 262-263]

Italian Panorama journalist Elisabetta Burba goes to the US Embassy in Rome and gives US officials copies of the Niger uranium documents (see March 2000) that she had obtained two days before (see Afternoon October 7, 2002). [Agence France-Presse, 7/19/2003; Agence France-Presse, 7/19/2003; Washington Post, 7/20/2003; Associated Press, 7/20/2003; Agence France-Presse, 9/19/2003; New Yorker, 10/27/2003] Up till now, the embassy had only received reports of the documents. [Unger, 2007, pp. 261] It is likely that the so-called “Italian Letter,” a letter purporting to be from the president of Niger to Iraq’s Saddam Hussein confirming the Iraq-Niger uranium deal, is not in the bundle of documents Burba brings to the embassy. [ERiposte, 3/6/2006] Burba meets with the embassy’s press spokesman, Ian Kelly. Over coffee, she tells him that she has documents purporting to show that Iraq has signed a deal to buy uranium from Niger, and she needs his help to confirm their authenticity and accuracy. Kelly brings three others into the discussion—a political officer, one of his own staffers, and perhaps a US military official, as Burba will later recall—and moves the entire group into his office. The subsequent discussion is brief; Burba hands over the documents. Kelly tells her the embassy will look into the matter. The CIA station chief, Jeff Castelli, refuses to meet with Burba. [Washington Post, 4/3/2007] Castelli is told about Burba’s visit, but is not interested. As the CIA’s head of European operations, Tyler Drumheller, will later recall, Castelli says, “This is bullsh_t we don’t have time to waste on.” Castelli receives a copy of the documents but quickly forgets about them. According to Drumheller, Castelli is “not the most organized guy in the world. And his view was, ‘This is the least important thing that’s coming across my desk now.’ He just made a mistake.” [Isikoff and Corn, 2006, pp. 148; CBS News, 4/23/2006] Several newspapers cite sources (mostly unnamed, so it’s possible they are all relying on the same sources) that appear to support Drumheller’s account. [New York Times, 3/23/2003; Washington Post, 7/20/2003; New Yorker, 10/27/2003] For example, an unnamed senior CIA official will tell Knut Royce of Newsday in July of 2003 that the CIA “had serious questions about [the claims] from day one” (see July 21, 2003). The agency “had accounts (see October 15, 2001, February 5, 2002, and March 25, 2002) of them [the letters] and that was close enough. We didn’t take it that seriously to begin with.… We didn’t put a lot of stock in these reports from Niger. We didn’t rush around to get the actual documents.” [Newsday, 7/11/2003] The documents are faxed to the State Department on October 15 (see October 15, 2002), and its intelligence unit will quickly conclude that the papers are probably fakes. Iraqi Minister Abdul Tawab Mullah Hawaish, who is in charge of Iraq’s weapons programs, invites reporters and members of the Bush administration to visit two of the alleged WMD sites, Furat and Nasser al-Azim. Bush had referred to the sites in his October 7 speech (see October 7, 2002). “The American administration are invited to inspect these sites,” Hawaish says, “As I am responsible for the Iraqi weapons programs, I confirm here that we have no weapons of mass destruction and we have no intention to produce them…. I am saying here and now that we do not have weapons of mass destruction and we do not have programs to develop them.” [BBC, 10/10/2002; Reuters, 10/10/2002] But the White House rejects the offer. Press Secretary Ari Fleischer says, “This matter is not up to Iraq…. It is… up to the United Nations to decide.” [White House, 10/10/2002] Reporters, however, accept the offer and tour the Nasser State Establishment, a facility that Iraq claims produces goods for civilian use as well as components for conventional weapons. Two days after General Rick Baccus has been relieved from duty as the guard commander at Guantanamo (see October 9, 2002), and almost one and a half months since the writing of the Office of Legal Counsel’s (OLC) August memo on torture (see August 1, 2002), military intelligence at Guantanamo begin suggesting new rules of interrogation. Lieutenant Colonel Jerald Phifer, Director J2, sends a memo, to Major General Michael E. Dunlavey, Commander of Joint Task Force (JTF) 170, requesting approval for more severe interrogation techniques. Three Categories of Techniques - The memo states, “The current guidelines for interrogation procedures at GTMO [Guantanamo] limit the ability of interrogators to counter advanced resistance.” Phifer proposes three categories of techniques. The mildest, which includes yelling and weak forms of deception, are included in category one. Category two techniques are more severe and require approval by an “interrogator group director.” They include the use of stress positions for up to four hours; use of falsified documents; isolation for up to 30 days; sensory deprivation and hooding; 20-hour interrogations; removal of comfort and religious items; replacing hot food with cold military rations; removal of clothing; forced grooming, including the shaving of beards; and playing on detainees’ phobias to induce stress, such as a fear of dogs. The harshest techniques, listed in category three, are to be reserved for a “very small percentage of the most uncooperative detainees” and only used with permission from the commander of the prison. These methods include using non-injurious physical contact like poking or grabbing; threatening a detainee with death or severe pain or threatening that a family member would be subjected to such harm; exposing him to cold weather or water; using a wet towel to “induce the misperception of suffocation.” [US Department of Defense, 10/11/2002 pdf file; New Yorker, 2/27/2008]
Desire to Extract More Information from Detainee - The request is prompted in part by military intelligence’s belief that Guantanamo detainee Mohamed al-Khatani has more information than the FBI has managed to extract from him. “Al-Khatani is a person in… whom we have considerable interest,” Dell’Orto will explain during a 2004 press briefing at the White House. “He has resisted our techniques. And so it is concluded at Guantanamo that it may be time to inquire as to whether there may be more flexibility in the type of techniques we use on him.” [Washington File, 6/23/2004]
JAG Officer Concludes Tactics are Legal - The same day, a staff judge advocate, Lieutenant Colonel Diane E. Beaver, reviews Phifer’s proposed techniques for legality and, while making qualifications and recommending further review, concludes in a memo to Dunlavey that they are legal. Also the same day, Dunlavey sends the list of techniques to his superior, General James T. Hill, commander of the Southern Command, requesting approval for their use. Dunlavey writes: “Although [the techniques currently employed] have resulted in significant exploitable intelligence the same methods have become less effective over time. Eighty-eight of those killed are Australian, while most of the rest are Indonesian. A much smaller device explodes outside the US consulate in nearby Denpasar, causing only minor damage and no casualties. No group claims responsibility, but Jemaah Islamiyah (JI), al-Qaeda’s main affiliate in Southeast Asia, is believed to be behind the bombings. Mukhlas), Imam Samudra, and Amrozi bin Nurhasyim, will be arrested in Indonesia and sentenced to death in 2003 for their roles in the Bali bombings. Ali Imron, brother to both Gufron and Amrozi, will be sentenced to life in prison. At a Republican fundraiser, President Bush erroneously labels captured Islamic militant Abu Zubaida (see March 28, 2002) as “one of the top three leaders” of al-Qaeda. Senior government officials have long been aware that many intelligence officials believe Zubaida to be little more than a low-level “gofer” for al-Qaeda (see Shortly After March 28, 2002 and April 9, 2002 and After). Bush says, apparently boasting of the deaths of some captured suspects: “I would say we’ve hauled in—arrested, or however you want to put it—a couple of thousand of al-Qaeda. Some of them are former leaders. Abu Zubaida was one of the top three leaders in the organization. Like number weren’t as lucky, they met a different kind of fate. But they’re no longer a problem. We’re slowly but surely rounding them up. The other day we got this guy, [Ramzi b]in al-Shibh. He popped his head up. He’s not a problem (see September 11, 2002). Slowly but surely. The US embassy in Rome faxes the Niger documents to the State Department’s Bureau of Nonproliferation, which then passes a copy of the documents to the Bureau of Intelligence and Research (INR), the State Department’s intelligence bureau. [US Congress, 7/7/2004, pp. 58] Simon Dodge, an INR nuclear analyst, receives a copy, and after a brief review of the documents immediately suspects that they are bogus. One particularly strange document that is included in the Niger papers describes a secret meeting that allegedly took place on June 14, 2002 at the home of the Iraqi ambassador in Rome. According to the document, the meeting was attended by military officials from Iraq, Iran, Sudan, Libya, and Pakistan. The purpose of the meeting was to form a coalition of Islamic nations against the West. They would seek “Global Support,” which would include backing from the “Islamic patriots accused of belonging to criminal organizations.” Dodge finds the scenario depicted in the document “completely implausible.” He notices that the document bears the same official seal that is stamped on the Niger documents. He concludes that the documents are probably all fakes, and he sends an email to other analysts in the intelligence community explaining this conclusion. The briefing notes the new intelligence on the documents, but adds what Washington Post reporter Peter Eisner will call “important caveats,” including the fact that there is no corroboration for the claims made in the documents, and that Iraq has “no known facilities for processing or enriching” uranium. Concurrent with the New York Times’s revelation of the existence of the Office of Special Plans (OSP—see October 24, 2002), Defense Secretary Donald Rumsfeld announces the existence of a similar operation, the Counter-Terrorism Evaluation Group (CTEG—see Shortly After September 11, 2001). CTEG has been absorbed into the OSP by this point. The Washington Post will call CTEG “a small team of defense officials outside regular intelligence channels to focus on unearthing details about Iraqi ties with al-Qaeda and other terrorist networks.” The unveiling of CTEG coincides with Rumsfeld’s move to take over the financing and management of an outside project, the “Information Collection Project,” sponsored by the Iraqi National Congress and one of CTEG’s primary sources of information. Before now, the State Department had financed and overseen the INC project, and had grown increasingly reluctant to maintain what Defense Intelligence Agency official Patrick Lang later calls an “off the reservation” intelligence operation (see September 15, 2001). Rumsfeld tells reporters, “Any suggestion that [CTEG is] an intelligence-gathering activity or an intelligence unit of some sort, I think would be a misunderstanding of it.” Rumsfeld’s assertion is contradicted by former CIA case officer, enthusiastic neoconservative, and CTEG consultant Reuel Marc Gerecht, who describes the intelligence-gathering mission of CTEG: “The Pentagon is setting up the capability to assess information on Iraq in areas that in the past might have been the realm of the agency (CIA). The Washington Post reports in a front-page story, “A significant number of scientists and biological warfare experts are expressing skepticism about the FBI’s view that a single disgruntled American scientist prepared the spores and mailed the deadly anthrax letters that killed five people last year.” More than a dozen experts suggest investigators should “reexamine the possibility of state-sponsored terrorism, or try to determine whether weaponized spores may have been stolen by the attacker from an existing, but secret, biodefense program or perhaps given to the attacker by an accomplice.” These experts suggest that making the type of anthrax used could take a team of experts and millions of dollars. The article focuses on the possibility that Iraq could be to blame, and mentions that unnamed senior Bush administration officials believe Iraq was behind the attacks (see October 28, 2002). However, even though the Post claims “a consensus has emerged in recent months among experts,” only one expert, Richard Spertzel, is named who supports the Iraq theory. Spertzel was the chief biological inspector for the UN Special Commission from 1994 to 1998. He says: “In my opinion, there are maybe four or five people in the whole country who might be able to make this stuff, and I’m one of them. And even with a good lab and staff to help run it, it might take me a year to come up with a product as good.” [Washington Post, 10/28/2002] Although the article doesn’t mention it, the other scientists Spertzel say could make the anthrax are renowned bioterrorism expert William Patrick and several unnamed scientists at Dugway Proving Ground, the US Army’s bioweapons laboratory in Utah, that Patrick trained in anthrax production in 1998. [Vanity Fair, 9/15/2003] This renewed focus on an Iraq-anthrax link coincides with the US push to go to war with Iraq, and will fade after the Iraq war starts.

The difference in opinion is acknowledged by UN Secretary-General Kofi Annan, who says, “The US does seem… to have a lower threshold than others may have” to justify the use of military force. According to the ambassador, “The letter says that Iraq accepts the resolution, and accepts the return of inspectors. There are no conditions, no reservations. US and British warplanes attack a radar installation in southern Iraq near Al Najaf about 85 miles southeast of Baghdad at around 2:50 EST after Iraqi air defenses fired on “coalition” aircraft that were patrolling the southern “no-fly” zone. This is the first such incident to have occurred after the passing of UN resolution 1441 (see November 8, 2002). The US- and British- imposed “no-fly” zones have never been recognized by the UN and the two countries’ jurisdiction over the zones has no legal basis. Iraq has consistently regarded this “patrolling” as a violation of its airspace and as a threat to its security. US and British warplanes have attacked Iraqi targets more than forty times during the 2002. After the attacks, the Bush administration claims that Iraq’s action was a violation of UN Resolution 1441. Shortly after his arrest in the United Arab Emirates in early October 2002 (see Early October 2002), al-Qaeda leader Abd al-Rahim al-Nashiri is taken to an unknown location and tortured. He is waterboarded, which is a technique simulating drowning that is widely regarded as torture. He is only one of about three high-ranking detainees waterboarded, according to media reports (see May 2002-2003). [Associated Press, 12/11/2007] Much will later be written about the torture and interrogation of other top al-Qaeda leaders such as Abu Zubaida, but next to nothing is publicly known about what happens to al-Nashiri in the months after his arrest. However, in late 2007 it will be reported that at least some of his interrogations were videotaped by the CIA (see Spring-Late 2002) and his waterboarding was videotaped. [Washington Post, 12/18/2007] But these videotapes will later be destroyed in controversial circumstances (see November 2005). The waterboarding likely takes place in Thailand, because the videotape of al-Nashiri’s torture will be destroyed there in 2005 (see November 2005). [Newsweek, 6/28/2008]

US and British warplanes attack sites northeast of Mosul after Iraqi defense forces fire anti-aircraft artillery at coalition aircraft patrolling the so-called “no-fly” zones. In a separate incident, warplanes attack two Iraqi air defense communications facilities and one air defense radar site in southern Iraq in Wassit and Dhi Oar after “Iraqi air defenses fired multiple surface-to-air missiles and anti-aircraft artillery at coalition aircraft.” [New York Times, 11/19/2002; Scotsman, 11/19/2002; Reuters, 11/19/2002; Associated Press, 11/20/2002] According to Iraqi authorities, four Iraqi civilians were wounded as a result of the attacks in southern Iraq. [Associated Press, 11/20/2002] White House spokesperson Scott McClellan says in a press briefing, “The United States believes that firing upon our aircraft in the no-fly zone, or British aircraft, is a violation—it is a material breach.” [White House, 11/18/2002; New York Times, 11/19/2002] And Defense Secretary Donald Rumsfeld, who is in Chile, says: “I do find it unacceptable that Iraq fires. The US will conduct at least 22 more aerial attacks on Iraq before the March 19, 2003 invasion. Secretary-General Kofi Annan states, “Let me say that I don’t think that the council will say this is in contravention of the resolution of the Security Council.” [Reuters, 11/19/2002] Responding to Annan’s remarks, Rumsfeld argues, “I don’t know that he (Annan) necessarily reflects the UN, the center of gravity of the Security Council, on any particular issue at any particular time…. Whenever resolutions are passed, they tend to be compromises, and there tend to be calculated ambiguities written into them to gain votes. So it does not come as a surprise to me…. The United Nations sat there for years with 16 resolutions being violated. On the eve of a two-day NATO summit in Prague, Czech Republic, President Bush addresses the UN mandate for Iraq to declare its arsenal of unconventional weapons (see November 8, 2002): “Saddam Hussein has been given a very short time to declare completely and truthfully his arsenal of terror. Should he again deny that this arsenal exists, he will have entered his final stage with a lie. And deception this time will not be tolerated. Delay and defiance will invite the severest of consequences. America’s goal, the world’s goal, is more than the return of inspectors to Iraq. Our goal is to secure the peace through the comprehensive and verified disarmament of Iraq’s weapons of mass destruction. Voluntary or by force, that goal will be achieved.” [New York Times, 11/21/2002; US President, 11/25/2002] Bush is echoing and reiterating calls from conservatives and neoconservatives both inside and outside the White House to label Hussein a liar no matter what he declares (see November 20, 2002 and December 2, 2002). They go farther than Bush in demanding that the US invade Iraq as soon as the December 8 deadline for declaring his weapons expires (see December 7, 2002). Former ambassador Joseph Wilson will write: “If the neoconservatives had been angry before the UN deal—and they were—they were truly furious afterward. The ink on the resolution was barely dry before they launched attacks on [Secretary of State] Colin Powell for having led the president down the wrong path, one in which he was placing his faith in what they said was a feckless international community.” [Wilson, 2004, pp. 301]

A NATO summit is convened in Prague to welcome the Eastern European states of Bulgaria, Estonia, Latvia, Lithuania, Romania, Slovakia and Slovenia, who will become members of the alliance in 2004. These seven countries, along with Albania, Croatia and Macedonia, release a statement [New York Times, 11/22/2002] , which says, “NATO allies stand united in their commitment to take effective action to assist and support the efforts of the UN to ensure full and immediate compliance by Iraq, without conditions or restrictions, with UN [Resolution] 1441 (see November 8, 2002).” [Daily Telegraph, 11/22/2002] The statement also says, “[W]e are prepared to contribute to an international coalition to enforce its provisions and the disarmament of Iraq.” [New York Times, 11/22/2002] Bruce Jackson, a former US Defense Department official who heads the Committee for the Liberation of Iraq, helps draft the statement. France also releases a statement, which is a bit less confrontational. [Agence France-Presse, 11/20/2002] A French official explains to the London Telegraph that the Eastern states’ statement was “his [Bush’s] own interpretation [of UN Resolution 1441] and we do not share it. On December 8, we will take note of what Iraq says it has… and we will see if its behavior is consistent with its statement.” Germany remains opposed to the use of military force. [Daily Telegraph, 11/22/2002] German Foreign Minister Joschka Fischer tells reporters, “We are against military action. We don’t support military action. We want the possibility not to become the reality.” [New York Times, 11/22/2002] On the night of November 21, in an interview with Dan Rather of CBS News, Secretary of State Colin Powell also makes the US position clear. He says, “If the [December 8] declaration is patently false and everybody can see it. If he does not let the inspectors do their job, then the president is fully ready to take the necessary step, which is military force.” [Evening News With Dan Rather, 11/21/2002] Secretary of Defense Donald Rumsfeld is also in town for the summit. Before he leaves Prague to meet with Slovak Prime Minister Mikulas Dzurinda in Slovakia, he says he will not believe Iraq if its declaration claims Iraq has no weapons of mass destruction. Iraq submits its declaration of military and civilian chemical, biological and nuclear capabilities to the UN one day early. It consists of 12 CD-ROMs and 43 spiral-bound volumes containing a total of 11,807 pages. General Hussam Amin, the officer in charge of Iraq’s National Monitoring Directorate, tells reporters a few hours before the declaration is formally submitted: “We declared that Iraq is empty of weapons of mass destruction. I reiterate Iraq has no weapons of mass destruction. This declaration has some activities that are dual-use.” Lt. Gen. Amer al-Saadi, a senior adviser to Iraqi President Saddam Hussein, says the next day that Iraq’s pre-1991 nuclear program may have been close to developing a nuclear bomb, but denies that Baghdad continued the program. Meanwhile, the Bush administration remains furious over the Security Council’s previous day ruling that no member state—including the US—will be permitted access to the report until after “sensitive information about weapons manufacture had been removed.” White House officials say they were “blind-sided” by the decision. An Army memorandum released to the American Civil Liberties Union (ACLU) in 2006 (see January 12, 2006) will refer to the “SERE INTERROGATION SOP” (standard operating procedure) for Guantanamo. SERE refers to “Survival, Evasion, Resistance, and Escape,” a classified military program originally designed to teach US soldiers how to resist torture, and subsequently “reverse-engineered” for use in subjecting US prisoners to harsh interrogation and torture (see December 2001, January 2002 and After, and July 2002). The memo, which is heavily redacted, shows that torture techniques used in SERE training may have been authorized in a memo to military personnel at Guantanamo. [Source: Publicity photo via Washington Post]On December 12, 2002, the Washington Post publishes a front-page story by reporter Barton Gellman entitled “US Suspects Al-Qaeda Got Nerve Agent From Iraqis.” It states: “The Bush administration has received a credible report that Islamic extremists affiliated with al-Qaeda took possession of a chemical weapon in Iraq last month or late in October, according to two officials with firsthand knowledge of the report and its source. They said government analysts suspect that the transaction involved the nerve agent VX and that a courier managed to smuggle it overland through Turkey.” [Washington Post, 12/12/2002] The story proves so controversial that the Post’s ombudsman Michael Getler writes a column about in on December 22. Getler notes that, “[B]eginning with the second paragraph, which started out, ‘If the report proves true…’ the story contains an extraordinary array of flashing yellow lights.” He asks, “[W]hat, after all, is the use of this story that practically begs you not to put much credence in it? Why was it so prominently displayed, and why not wait until there was more certainty about the intelligence?” However, he says the Post stands by publishing the story. [Washington Post, 12/12/2002] Slate will comment in 2004, “[T]he Gellman scoop withered on the vine.… nobody advanced or refuted the story—not even Gellman.” Gellman will later admit that he should have run a follow-up story, if only to point out that no confirming evidence had come out. David Brant, the head of the Naval Criminal Investigative Service (NCIS), learns of the horrific abuse of a Saudi detainee, Mohamed al-Khatani (sometimes spelled “al-Qahtani”—see February 11, 2008), currently detained at Guantanamo Bay. Al-Khatani is one of several terror suspects dubbed the “missing 20th hijacker”; according to the FBI, al-Khatani was supposed to be on board the hijacked aircraft that crashed in a Pennsylvania field on 9/11 (see (10:06 a.m.) September 11, 2001). Al-Khatani was apprehended in Afghanistan a few months after the terrorist attacks. He is one of the examples of prisoner abuse (see August 8, 2002-January 15, 2003) that Brant takes to Naval General Counsel Alberto Mora (see December 17-18, 2002). In 2006, Brant will say that he believes the Army’s interrogation of al-Khatani was unlawful. If any NCIS agent had engaged in such abuse, he will say, “we would have relieved, removed, and taken internal disciplinary action against the individual—let alone whether outside charges would have been brought.” Brant fears that such extreme methods will taint the cases to be brought against the detainees and undermine any efforts to prosecute them in military or civilian courts. Confessions elicited by such tactics are unreliable. And, Brant will say, “it just ain’t right.” [New Yorker, 2/27/2006]

Tenet is scheduled to meet with President Bush in three days to discuss the case for invading Iraq. Tenet wants to cement his case by allowing the Iraqi defector known as “Curveball” to appear on television and tell his story; failing that, Tenet wants the Germans to allow an American expert to debrief Curveball (later revealed as a fabricator named Rafid Ahmed Alwan—see November 4, 2007) and then himself appear on television with his findings. Two days later, Hanning rejects Tenet’s requests. Hanning calls Curveball’s information “plausible and believable,” but adds that “attempts to verify the information have been unsuccessful.” Therefore, all of Curveball’s reports “must be considered unconfirmed.” However, Hanning would allow Curveball’s information to be used, if Tenet still desired to use that unconfirmed information, if the source is protected. In November 2007, Tenet denies ever seeing Hanning’s letter. The CIA’s former European division chief, Tyler Drumheller, believes Tenet is lying. “He needs to talk to his special assistants if he didn’t see it. And the fact is, he had very good special assistants. I’m sure they showed it to him. And I’m sure it was just, it wasn’t what they wanted to see,” Drumheller says. [CBS News, 11/4/2007]

Iraq provides the United Nations with the names of more than 400 scientists who are involved in Iraq’s weapons programs. One of the provisions of UN Security Council Resolution 1441 is that Iraq must supply the names of all of its weapons experts (see November 8, 2002). United Nations Secretary-General Kofi Annan says in an interview with Israel’s Army Radio that Saddam’s government is cooperating with UN weapons inspectors and that he sees no reason for the use of force against Iraq. “Iraq is cooperating and they [inspectors] are able to do their work in an unimpeded manner and therefore I don’t see an argument for a military action now,” the secretary-general says. “They may give an interim report before the [January] 27 [deadline] and I really do not see any basis for an action until then, particularly as they are able to carry out their work in an unimpeded manner.” [Reuters, 12/31/2001; BBC, 12/31/2001; Independent, 1/1/2003] The Independent of London call his remarks “a blunt warning to Britain and the United States that they will need clear evidence of clandestine weapons programs in Iraq to win support from other nations for any military campaign against Saddam Hussein this winter.” [Independent, 1/1/2003]

The CIA issues an updated version of its September 2002 classified internal report (see September 2002) which stated that according to “sources of varying reliability,” Iraq had provided “training in poisons and gases” to al-Qaeda operatives. The allegation in that report was based on information provided by a captured Libyan national by the name of Ibn al-Shaykh al-Libi. In this new updated version of the report, the CIA adds that “the detainee [al-Libi] was not in a position to know if any training had taken place.” It is not known whether this report is seen by White House officials. [Newsweek, 11/10/2005] Intelligence provided by al-Libi about Iraq will also be included in Secretary of State Colin Powell’s speech to the UN one month later (see February 5, 2003).

The International Atomic Energy Agency (IAEA) submits a preliminary report to the UN Security Council on the results of the inspections so far. The report says: “To date, no new information of significance has emerged regarding Iraq’s past nuclear program (pre-1991) or with regard to Iraq activities during the period between 1991 and 1998…. [N]o evidence of ongoing prohibited nuclear or nuclear-related activities has been detected, although not all of the laboratory results of sample analysis are yet available.” [Reuters, 1/9/2003; International Atomic Energy Agency, 1/9/2003; New York Times, 1/10/2003; Independent, 1/10/2003; Guardian, 1/10/2003] It also states that Washington’s claim that the aluminum tubes were meant for a centrifuge is highly unlikely. In one section of the report, its authors write: “While the matter is still under investigation and further verification is foreseen, the IAEA’s analysis to date indicates that the specifications of the aluminum tubes sought by Iraq in 2001 and 2002 appear to be consistent with reverse engineering of rockets. Iraqi engineers working at the facility explained that they had been seeking more aluminum tubes at the time US authorities intercepted the July 2001 shipment (see July 2001) because their supply was low. The engineers provided additional information which supported the view that the tubes were not meant for use in a gas centrifuge. They told the inspectors that the rigid specifications for the tubes were intended to improve the rocket’s accuracy without requiring any major changes to the design. Documents reviewed by the inspectors confirmed the Iraqi engineers’ account. It was also explained that the tubes, which were stored outside, were anodized so they would not corrode. Vice President Cheney, national security adviser Condoleezza Rice, and dozens of senior White House officials receive a highly classified intelligence assessment, a Senior Executive Memorandum titled “Questions on Why Iraq Is Procuring Aluminum Tubes and What the IAEA Has Found to Date,” on the issue of the disputed use of the Iraqi aluminum tubes. The report concludes that the CIA, Defense Intelligence Agency, National Geospatial-Intelligence Agency, and National Security Agency all believe that the aluminum tubes were most likely intended for centrifuges. The memo says that only the intelligence units at the Departments of Energy and State, along with the UN’s International Atomic Energy Agency (IAEA), disagree with that assessment and believe the tubes were purchased to be used in Iraq’s conventional rocket program, and includes discussion of the dissenting opinions. Simon Dodge, an Iraq nuclear analyst from the State Department’s Bureau of Intelligence and Research (INR), writes in an email to other intelligence community analysts that the “uranium purchase agreement probably is a hoax.” He adds that the document (see October 15, 2002) suggesting that Iraq, Iran, Sudan, Libya, and Pakistan had met to discuss forming an anti-West coalition was “clearly a forgery.” [US Congress, 7/7/2004; Isikoff and Corn, 2006, pp. 164] A July 2003 memo from the INR’s Carl Ford will note that on the same day as Dodge’s email, the bureau “expressed concerns to the CIA that the documents pertaining to the Iraq-Niger deal were forgeries.” [Carl W. A disagreement arises among UN Security Council members over the weapons inspections schedule. UN Resolution 1441 (see November 8, 2002) specifies that after 60 days, the inspectors must report to the Council on the progress of inspections. But the resolution provides no instructions for how the inspections are to proceed after this date. The resolution also fails to explain what is to happen if no weapons of mass destruction are found. Hans Blix believes that after the 60 day report—due January 27—his team should revert to the terms contained within 1999 UN Resolution 1284. According to the provisions of this agreement, an additional report would be due in late March, which would contain a list of disarmament requirements that Iraq would have to satisfy prior to the lifting of sanctions. National Security Adviser Condoleezza Rice flies to New York City to meet with Hans Blix. She attempts to discourage him from his plans to revert to the provisions of UN Resolution 1284 after his January 27 report to the UN Security Council—the last update required by UN Resolution 1441 (see November 8, 2002). She also attempts to persuade him to press ahead with plans to aggressively interview Iraqi scientists. [Sydney Morning Herald, 1/16/2003; New York Times, 1/16/2003] At a Council luncheon, US ambassador to the UN John Negroponte attempts to convince delegates of the other member states that the inspections timetable should not be based on the 1999 resolution. Conducting its first raid of a private home, that of Faleh Hassan, a specialist in laser equipment who was once associated with Iraq’s nuclear program, UN inspectors discover 3,000 documents containing information that some initial reports say is related to Iraq’s former nuclear weapons program. [Daily Telegraph, 1/18/2003; Associated Press, 1/18/2003; BBC, 1/19/2003; Observer, 1/20/2003; International Atomic Energy Agency, 1/27/2003; New York Times, 1/28/2003] Mohamed ElBaradei, director-general of the International Atomic Energy Agency (IAEA), is bothered by the discovery, saying, “We haven’t received these original documents before and that’s precisely the point we have been emphasizing, Iraq should be pro-active. We shouldn’t have to find these on our own. Why should these documents be in a private home? Why are they not giving them to us?” [New York Times, 1/20/2003; Agence France-Presse, 1/20/2003] But Hassan denies that the documents are related to Iraq’s former nuclear weapons program. He later explains to reporters: “The inspectors put their hands on personal documents which have nothing to do with the former [nuclear] program. We did research on laser isotopic separation, and in 1988 we reached the conclusion that this technology was very difficult given our infrastructure, so the decision was taken to abandon that approach.” He adds that he is ready to go through the documents with ElBaradei, “page by page, line by line and even word by word to prove that everything they found is in alignment with what we declared in 1991.” [Associated Press, 1/18/2003; BBC, 1/19/2003] After the discovery of the documents, Hassan accompanies inspectors to a field where they inspect what appears to be a man-made mound. The field is part of a farm Hassan sold in 1996. While at the farm, a female American inspector offers to arrange a trip outside of Iraq for him and his wife, so his wife can undergo treatment for kidney stones, diabetes and high blood pressure. The Iraqi scientist is angered by the offer and later refers to the woman’s tactics as “mafia-like behavior.” Recalling the incident he will also tell reporters, “We would rather live as beggars in our country than live as kings abroad,” also saying, “Never, never will I leave my country.” [Associated Press, 1/18/2003; BBC, 1/18/2003; Observer, 1/20/2003] Hassan then goes with inspectors to a hotel in Baghdad where he spends most of the night arguing over whether he will be permitted to keep copies of the documents. [Observer, 1/20/2003] Three weeks later in the inspectors’ February 14 update to the UN Security Council (see February 14, 2003), ElBaradei will say: “While the documents have provided some additional details about Iraq’s laser enrichment development efforts, they refer to activities or sites already known to the IAEA and appear to be the personal files of the scientist in whose home they were found. Citing inspectors’ discovery of 12 empty “warheads” (see January 16, 2003) and documents related to a failed nuclear program’s attempt at laser enrichment of uranium (see Afternoon October 7, 2002), critics of the Bush administration’s planned invasion argue that the inspections are working and that they should continue under the terms of 1999 UN Resolution 1284. They contend that if Iraq still possesses illegal weapons that it can be peacefully and effectively disarmed by the inspections process, thus making the argument for war moot. But the Bush administration argues instead that the inspection process has demonstrated that Saddam Hussein is not willing to disarm. This debate occurs as weapons inspectors are preparing their January 27 (see January 27, 2003) update on inspections, as required by UN Resolution 1441 (see November 8, 2002). Washington is hoping that the report will demonstrate that Iraq is not cooperating, so that they can use it to justify using military force against Iraq. Sometime after Joe Turner’s presentation to IAEA scientists, US analysts collect and photograph tubes in Iraq that are “virtually identical” to the Medusa tubes made in Italy. The tubes even have a stamped logo of the rocket’s Italian manufacturer and the words, “81mm rocket.” This is reported by the Washington Post on January 24: “The quantity and specifications of the tubes—narrow, silver cylinders measuring 81 millimeters in diameter and about a meter in length—made them ill-suited to enrich uranium without extensive modification, the experts said. But they are a perfect fit for a well-documented 81mm conventional rocket program in place for two decades. Iraq imported the same aluminum tubes for rockets in the 1980s. Cheney’s chief of staff, I. Lewis Libby, presents the latest draft of a paper that is meant to serve as a rebuttal to Iraq’s December 7 declaration (see February 5, 2003) to Condoleezza Rice, Stephen Hadley, Paul Wolfowitz, Karl Rove, Richard Armitage, Michael Gerson, and Karen Hughes. The paper, written with the help of John Hannah, is supposed to serve as the basis for the speech Secretary of State Colin Powell will deliver to the UN Security Council on February 5 (see February 5, 2003). In his presentation, Libby says that intercepts and human intelligence reports indicate that Saddam Hussein has been attempting to conceal items. He doesn’t know what items are being hidden by the Iraqis, but he says it must be weapons of mass destruction. He also claims that Iraq has extensive ties to al-Qaeda, and cites the alleged meeting between Mohamed Atta and an Iraqi Intelligence agent (see April 8, 2001) as one example. While Armitage is disappointed with Libby’s presentation, Wolfowitz and Rove seem impressed. Karen Hughes warns Libby not to stretch the facts. [Source: Ali Haider / EPA / Corbis]On January 26, 2003, Newsweek reports that in 2002, Islamist militant leader Abu Musab al-Zarqawi “supposedly went to Baghdad, where doctors amputated his leg (injured in Afghan fighting) and replaced it with a prosthesis.” Newsweek also claims that al-Zarqawi “is supposed to be one of al-Qaeda’s top experts on chemical and biological weapons” and that he also met with “Hezbollah militants” and “Iranian secret agents.” This new account builds on previous reports claiming that al-Zarqawi was in Baghdad for some unspecified medical treatment (see October 2, 2002). The article does note, “Not surprisingly, reports putting al-Zarqawi in Iraq piqued the interest of Pentagon hard-liners eager to find evidence to support their suspicion that Saddam [Hussein] and bin Laden are allied and may have plotted 9/11 together. But neither the CIA nor Britain’s legendary MI6 put much stock in al-Zarqawi’s alleged Iraqi visits, stressing such reports are ‘unconfirmed.’” [Newsweek, 1/26/2003] Despite these caveats, it soon will be widely reported that al-Zarqawi had a leg amputated in Baghdad, with at least the tacit knowledge of the Iraqi government. For instance, several days later, USA Today reports, “To those who operate with and against the shadowy al-Zarqawi, including the Kurds of northern Iraq, he is called ‘the man with the limp.’ That is a reference to a poorly fitting artificial limb that replaced a leg amputated in Baghdad last August.” [USA Today, 2/5/2003] And Secretary of State Colin Powell will claim in his February 5, 2003 presentation to the United Nations that al-Zarqawi went to Baghdad in May 2002 for medical treatment and stayed two months (see February 5, 2003). But in October 2004, Knight Ridder will report, based on a new CIA report (see October 4, 2004), “Al-Zarqawi originally was reported to have had a leg amputated, a claim that officials now acknowledge was incorrect.” [Knight Ridder, 10/4/2004] In early 2006, al-Zarqawi will be seen walking in a videotape, clearly in possession of both his legs. And when he is killed later that year, x-rays of his dead body will show a fracture of his right lower leg, but apparently that was caused by the blast that killed him. Blix’s assessment is notably more critical than the IAEA report by Mohamed ElBaradei. A secret CIA report on possible links between al-Qaeda and Saddam Hussein’s Iraqi government is finished and sent to top US officials. The report, entitled “Iraqi Support of Terrorism,” was substantially finished by December 2002, but was delayed while other US officials put pressure on the CIA to withdraw or revise the report, because it did not find as much evidence of a Hussein-al-Qaeda link as they would have liked. In a 2007 book, former CIA Director George Tenet will describe in detail what was in the report. “Our analysts believed that there was a solid basis for identifying three areas of concern with regard to Iraq and al-Qaeda: safe haven, contacts, and training. But they could not translate this data into a relationship where these two entities had ever moved beyond seeking ways to take advantage of each other.… Ansar al-Islam, a radical Kurdish Islamic group [based in northern Iraq areas out of Iraqi government control], was closely allied to al-Qaeda.… We believed that up to two hundred al-Qaeda fighters began to relocate [to Ansar al-Islam] camps after the Afghan campaign began in the fall of 2001.” He says that one of their camps near the town of Khurmal linked to militant leader Abu Musab al-Zarqawi “engaged in production and training in the use of low-level poisons such as cyanide.” He says that nearly 100 operatives in Western Europe connected to this camp were arrested, but, “What was even more worrisome was that by the spring and summer of 2002, more than a dozen al-Qaeda-affiliated extremists converged on Baghdad, with apparently no harassment on the part of the Iraqi government. They had found a comfortable and secure environment in which they moved people and supplies to support al-Zarqawi’s operations in northeastern Iraq.” He mentions Thirwat Salah Shehata and Yussef Dardiri, considered to be among Islamic Jihad’s best operational planners, as those in Baghdad at the time, and that “Credible information told us that Shehata was willing to strike US, Israeli, and Egyptian targets sometime in the future.” He concludes, “Do we know just how aware Iraqi authorities were of these terrorists’ presence either in Baghdad or northeastern Iraq? No, but from an intelligence point of view it would have been difficult to conclude that the Iraqi intelligence service was not aware of their activities. Certainly, we believe that at least one senior [Ansar al-Islam] operative maintained some sort of liaison relationship with the Iraqis. But operational direction and control? No.” [Tenet, 2007, pp. 349-351] It is not clear from Tenet’s book just how much of the above description is of what the CIA believed at the time and how much is what Tenet still believed to be true in 2007. Some of Tenet’s claims from his book appear overblown, such as the danger of poison production in the Khurmal camp (see March 31, 2003). A new CIA report in 2005 (ignored in Tenet’s book) will conclude that Hussein’s government “did not have a relationship, harbor, or even turn a blind eye toward al-Zarqawi and his associates” (see October 2005). [New York Times, 9/8/2006] In 2006, a bipartisan US Senate report on “Pre-war Intelligence on Iraq” will note that “detainees that originally reported on [links between Ansar al-Islam and Iraqi intelligence] have recanted, and another detainee, in September 2003, was deemed to have insufficient access and level of detail to substantiate his claims.” The report will conclude, “Postwar information reveals that Baghdad viewed Ansar al-Islam as a threat to the regime and that [Iraqi intelligence] attempted to collect intelligence on the group.” [US Senate and Intelligence Committee, 9/8/2006 pdf file]

He will be interrupted some 70 times by thunderous applause from the assembled lawmakers in the House chambers. One of his biggest applause lines is his statement about the US’s war on “international terrorism:” “The war goes on, and we are winning.” [Unger, 2007, pp. 269-270]
African Uranium - He says: “The British government has learned that Saddam Hussein recently sought significant quantities of uranium from Africa. Saddam Hussein has not credibly explained these activities.… He clearly has much to hide.” [US President, 2/3/2003; White House, 4/18/2003; Independent, 6/5/2003] The British allegation cited by Bush concerns a SISMI (Italy’s military intelligence) report (see Mid-October 2001) based on a set of forged documents. Months after the speech, with evidence mounting that the statement was completely false, the administration will retract this claim (see 3:09 p.m. July 11, 2003).
Aluminum Tubes - Bush alleges that a shipment of aluminum tubes imported by Iraq was intended to be used in the country’s alleged nuclear weapons program. “Our intelligence sources tell us that he has attempted to purchase high-strength aluminum tubes suitable for nuclear weapons production. Saddam Hussein has not credibly explained these activities. He clearly has much to hide.” [US President, 2/3/2003]
Biological Agents - Bush lists a parade of agents: “anthrax, botulinum toxin, Ebola, and plague,” many of which Iraq has never been accused of possessing, and warns against “outlaw regimes that seek and possess nuclear, chemical, and builogical weapons… blackmail, terror, and mass murder.” He then moves from the general to the specific, accusing Iraq of having enough material “to produce over 25,000 liters of anthrax—enough doses to kill several million people… more than 38,000 liters of botulinum toxin—enough to subject millions of people to death by respiratory failure… as much as 500 tons of sarin, mustard and VX nerve agent.” [US President, 2/3/2003; Unger, 2007, pp. 270-271]
False Testimony from Iraqi Scientists - Bush alleges: “Iraqi intelligence officers are posing as the scientists inspectors are supposed to interview. Real scientists have been coached by Iraqi officials on what to say.” [US President, 2/3/2003] But Hans Blix, the chief UNMOVIC weapons inspector, tells the New York Times in an interview that he knows of no evidence supporting this claim. [New York Times, 1/31/2003]
Defector Allegations - Bush, citing intelligence provided by “three Iraqi defectors,” says, “We know that Iraq, in the late 1990s, had several mobile weapons labs… designed to produce germ warfare agents and can be moved from place to a place to evade inspectors.” One of the defectors referred to by Bush is ‘Curveball,’ whom the CIA station chief in Germany warned was not reliable the day before (see January 27, 2003). German intelligence officials watching Bush’s speech are “shocked.” One official later recalls: “Mein Gott! We had always told them it was not proven.… It was not hard intelligence.” [Los Angeles Times, 11/20/2005] Another source for the claim was Mohammad Harith, whom the Defense Intelligence Agency had labeled a “fabricator” the previous May (see May 2002).
Torture, Murder, and 9/11 - Bush accuses Iraqi dictator Saddam Hussein of routinely torturing his own people, using such techniques as “electric shock, burning with hot irons, dripping acid on the skin, mutilation with electric drills, cutting out tongues, and rape.” He then connects Hussein, the torturer, murderer, and terrorist supporter, to the 9/11 attacks, saying: “[I]magine those 19 hijackers with other weapons and other plans—this time armed by Saddam Hussein. It would take one vial, one canister, one crate slipped into this country to bring a day of horror like none we have ever known.” He invites “all free nations” to join him in ensuring no such attack ever happens, but notes that “the course of this nation does not depend on the decisions of others.” After another long burst of applause, Bush continues, “Whatever action is required, whatever action is necessary, I will defend the freedom and security of the American people.” [Unger, 2007, pp. 270-271]
'Direct Personal Threat' - Bush states what former ambassador Joseph Wilson later writes can only be interpreted by Hussein “as a direct personal threat,” saying: “Tonight I have a message for the brave and oppressed people of Iraq: Your enemy is not surrounding your country, your enemy is ruling your country. And the day he and his regime are removed from power will be the day of your liberation.” Wilson will later write: “Not simply promising the disarmament of Iraq as he had in his recent speeches, the president now stated outright his intention to rout Saddam from power, and to kill or capture him. It was an unwise thing to say. It made whatever strategy we adopted for Iraq that much more dangerous because it so blatantly telegraphed our next move and our ultimate goal.” [US President, 2/3/2003; Wilson, 2004, pp. 315]
Defending America - To America’s soldiers, he says: “Many of you are assembling in or near the Middle East, and some crucial hours lay ahead. In these hours, the success of our cause will depend on you. Your training has prepared you. Your honor will guide you. You believe in America, and America believes in you.” In 2007, Unger will write: “A few years earlier, Bush had confided that he thought to be a great president meant being a great commander in chief. Now George W. Bush was leading his nation into war.” [Unger, 2007, pp. 270-271]

French officials are shocked by the claims Bush made in his state of the union speech (see 9:01 pm January 28, 2003) concerning Iraqi attempts to obtain uranium from Africa. One government official will later recall in an interview with the Los Angeles Times that French experts considered Bush’s claim, which he attributed to the British, as “totally crazy because, in our view, there was no backup for this.” Notwithstanding, the French launch another investigation (see Late April or Early May 2002-June 2002) and again, find no evidence supporting the US and British claim. US Secretary of State Colin Powell reluctantly accepts the task of making the administration’s case for war to the United Nations Security Council. He assigns his close friend and chief of staff Larry Wilkerson to go to the CIA and put together a team to craft a presentation. Though Powell has long harbored deep misgivings about the war, in public he has consistently and staunchly promoted the war, even when it came to repeating claims he knew to be false (see January 23, 2008). Powell also gives Wilkerson a 48-page report from the White House on Iraq’s alleged arsenal of banned weapons. The report is meant to serve as the basis for Powell’s upcoming speech to the UN (see February 5, 2003). Powell, skeptical of the report’s data, instructs Wilkerson to have it looked over by the CIA. The dossier was written primarily by two senior aides to Vice President Cheney, John Hannah and I. Lewis Libby (see January 25, 2003). [Bamford, 2004, pp. 368; Vanity Fair, 5/2004, pp. 281; Unger, 2007, pp. 275] The analysts at CIA will quickly determine that the documents are based on unreliable sources (see January 30-February 4, 2003). Speculation is already rampant throughout the State Department and among well-informed observers as to why Powell became such a reliable spokesman for the administration’s war plans. A State Department official will echo the opinion of others in saying that Powell is “completely aware of the machinations going on,” but wants to avoid any sort of public dispute among top White House officials—and Powell wants to keep relations with Vice President Dick Cheney on an even keel. Author Craig Unger will later note, “Regardless of what he really believed, Powell ultimately accommodated the White House to such an extent that he became the most articulate spokesman for the war effort” (see January 26, 2003). Colin Powell’s chief of staff, Larry Wilkerson, meets with other administration officials and aides at the CIA’s Langley headquarters in a conference room down the hall from George Tenet’s office to review two White House reports on Iraq’s alleged illegal activities. The team includes George Tenet, John McLaughlin, William Tobey and Robert Joseph from the National Security Council, and John Hannah from Vice President Cheney’s office. (Tenet had intended to leave for a Middle East junket, but Powell stopped him from going, insisting on his input and participation.) The two dossiers are meant to serve as the basis for Powell’s upcoming speech at the UN (see February 5, 2003). One of the reports—a 48-page dossier that had been provided to Powell’s office a few days earlier (see January 29, 2003)—deals with Iraq’s supposed arsenal of weapons of mass destruction while the other, a slightly more recent report totaling some 45 pages, addresses the issue of Iraq’s history of human rights violations and its alleged ties to Islamic militant groups. Dossiers Contain Large Amounts of White House Misinformation - Wilkerson has been given three dossiers: about 90 pages of material on Iraq’s WMD, on its sponsorship of terrorism, and on its violation of human rights. Wilkerson is not well informed about the variety of machinations surrounding the WMD issue, but it doesn’t take him long to realize there is a problem. The CIA has an array of analysts with decades of experience studying Iraq’s weapons programs, rigorous peer review procedures to prevent unreliable intelligence from making it into the final assessments, and a large budget devoted to Middle East intelligence. But the CIA had not produced Wilkerson’s dossiers. They had been prepared by Libby, Cheney’s chief of staff. Wilkerson is taken aback by such a breach of procedure, especially on such a critically important matter of state. Former NSC counterterrorism chief Richard Clarke later says, “It’s very strange for the Vice President’s senior adviser to be… saying to the Secretary of State, ‘This is what you should be saying.’” As Wilkerson goes through the material, he realizes, in Unger’s words, “just how aggressively Cheney and his men have stacked the deck.” Wilkerson first reads the 48-page WMD dossier, and is not impressed. “It was anything but an intelligence document,” he later says. “It was, as some people characterized it later, sort of a Chinese menu from which you could pick and choose.”
Cherry-Picked Intel - Wilkerson will continue, “When we had a question, which was virtually every line, John Hannah from the vice president’s office would consult a huge clipboard he had.” Hannah, a former official of the pro-Israel Washington Institute for Near East Policy, had coauthored the dossier with Libby. He had also worked closely with Libby in the White House Iraq Group (see August 2002). Hannah cites the source of each questionable datum Wilkerson asks about, and Wilkerson and his team set about tracking down the original sources of each item. They spend hours poring over satellite photos, intercepts of Iraqi military communications, and various foreign intelligence reports. Wilkerson and his team find that in almost every instance, the original sources do not support the conclusions drawn in the dossier. “Once we read the entirety of those documents,” he will recall, “we’d find that the context was not quite what the cherry-picked item imparted.” Wilkerson believes that much of the dossier’s intelligence comes from Ahmed Chalabi and the Iraqi National Congress (see 1992-1996), a belief given credence by the fact that Hannah had served as the chief liaison between the INC and Cheney’s office. As Wilkerson will later recall, “It was clear the thing was put together by cherry-picking everything from the New York Times to the DIA.” Reporters Michael Isikoff and David Corn will later write that “a Defense Intelligence Agency report was not being used properly, a CIA report was not being cited in a fair way, a referenced New York Times article was quoting a DIA report out of context,” and will confirm that much of the material had come from the Iraqi National Congress. Incomprehensible 'Genealogy' - According to Wilkerson, Feith’s office had strung together an incomprehensible “genealogy.” “It was like the Bible,” Wilkerson later recalls. “It was the Old Testament. It was ‘Joe met Bob met Frank met Bill met Ted met Jane in Khartoum and therefore we assume that Bob knew Ralph.’ It was incredible.” [Isikoff and Corn, 2006, pp. 180-181]
Link to Office of Special Plans? - Powell’s staff is also “convinced that much of it had been funneled directly to Cheney by a tiny separate intelligence unit set up by Defense Secretary Donald Rumsfeld” (see Summer 2002 and September 2002), Vanity Fair magazine later reports. [Vanity Fair, 5/2004, pp. 230]
Cheney's Aides Attempt to Reinsert Deleted Material - Soon Wilkerson’s team faces the same difficulties with the dossier on Iraq’s connections to Islamist terrorism that it faced with the White House-prepared dossier on Iraq’s WMD (see January 30-February 4, 2003). Tenet has tried manfully to give the administration what it so desperately wants—proof of Iraq’s connections to the 9/11 attacks. The CIA’s unit on Osama bin Laden had gone through 75,000 pages of documents and found no evidence of any such connections. Vice President Cheney and his staffers have always insisted that such a connection does indeed exist. Their strongest claim to that effect is the supposed meeting between 9/11 hijacker Mohamed Atta and an Iraqi intelligence agent in April 2000 (see September 14, 2001). This claim has long been discredited (see September 18, 2001), but Cheney’s people keep attempting to bring it back into play (see February 1, 2003-February 4, 2003). Information about Australian Software Erroneous - One item in the White House’s original draft alleged that Iraq had obtained software from an Australian company that would provide Iraqis with sensitive information about US topography. The argument was that Iraqis, using that knowledge, could one day attack the US with biological or chemical weapons deployed from unmanned aerial vehicles (UAVs). But when Powell’s intelligence team investigated the issue, it became “clear that the information was not ironclad” (see October 1, 2002). [US News and World Report, 6/9/2003]
'Idiocy' - “We were so appalled at what had arrived from the White House,” one official later says. [Vanity Fair, 5/2004, pp. 230] As another senior official (likely Wilkerson) will later recall, “We went through that for about six hours—item by item, page by page and about halfway through the day I realized this is idiocy, we cannot possibly do this, because it was all bullsh_t—it was unsourced, a lot of it was just out of the newspapers, it was—and I look back in retrospect—it was a [Undersecretary of Defense for Policy Douglas] Feith product, it was a Scooter Libby product, it was a Vice President’s office product. It was a product of collusion between that group. And it had no way of standing up, anywhere, I mean it was nuts.” [Bamford, 2004, pp. 368-9]
Starting from Scratch - After several hours, Wilkerson and Tenet are both so fed up that they decide to scrap the WMD dossier entirely. “Let’s go back to the NIE,” Tenet suggests, referring to the recently released National Intelligence Estimate on Iraq (see October 1, 2002). Wilkerson is not aware of how badly the NIE had been, in author Craig Unger’s words, “tampered with,” but Powell should have known, as his own intelligence bureau in the State Department had disputed key elements of the NIE. He had been in the lab. He had been there when an accident occurred. He’d seen people killed. And the implication was, strong implication, that they weren’t killed because of the accident in the explosion, they were killed because they were contaminated. Yes, the source was very credible. On February 1, Secretary of State Colin Powell begins rehearsing for his February 5 presentation to the UN Security Council (see February 5, 2003). Powell is assisted by members of his staff, including his chief of staff, Larry Wilkerson, and Deputy Secretary of State Richard Armitage (see January 30-February 4, 2003). Discredited Items Keep Reappearing - One item that keeps reoccurring is the discredited claim that 9/11 hijacker Mohamed Atta met with Iraqi officials in Prague (see September 14, 2001 and September 18, 2001). Cheney’s people keep attempting to insert it into the presentation. It takes Powell’s personal intervention to have the claim removed from the presentation. “He was trying to get rid of everything that didn’t have a credible intelligence community-based source,” Wilkerson will later recall. But even after Powell’s decision, Cheney loyalist Stephen Hadley, the deputy national security adviser, tries to have it reinserted. “They were just relentless,” Wilkerson will recall. “You would take it out and they would stick it back in. That was their favorite bureaucratic technique—ruthless relentlessness.” An official (probably Wilkerson) later adds: “We cut it and somehow it got back in. And the secretary said, ‘I thought I cut this?’ And Steve Hadley looked around and said, ‘My fault, Mr. Secretary, I put it back in.’ ‘Well, cut it, permanently!’ yelled Powell. It was all cartoon. The specious connection between al-Qaeda and Saddam Hussein, much of which I subsequently found came probably from the INC and from their sources, defectors and so forth, [regarding the] training in Iraq for terrorists.… No question in my mind that some of the sources that we were using were probably Israeli intelligence. That was one thing that was rarely revealed to us—if it was a foreign source.” Powell becomes so angry at the machinations that he throws the dossier into the air and snaps: “This is bullsh_t. I’m not doing this.” But he continues working on the presentation. Mobile Bioweapons Claim Survives Editing Process - One of the allegations Powell rehearses is the claim that Iraq has developed mobile biological weapons laboratories, a claim based on sources that US intelligence knows are of questionable reliability (see Late January, 2003 and February 4, 2003). Referring to one of the sources, an Iraqi major, Powell later tells the Los Angeles Times, “What really made me not pleased was they had put out a burn [fabricator] notice on this guy, and people who were even present at my briefings knew it.” Nor does anyone inform Powell that another source, an Iraqi defector known as Curveball, is also a suspected fabricator (see January 27, 2003). [Los Angeles Times, 11/20/2005] In fact, the CIA issued an official “burn notice” formally retracting more than 100 intelligence reports based on Curveball’s information. [ABC News, 3/13/2007]
Powell 'Angry, Disappointed' in Poor Sourcing of Claim - In March 2007, Powell will claim he is “angry and disappointed” that he was never told the CIA had doubts about the reliability of the source. “I spent four days at CIA headquarters, and they told me they had this nailed.” But former CIA chief of European operations Tyler Drumheller will later claim in a book that he tried and failed to keep the Curveball information out of the Powell speech (see February 4-5, 2003). “People died because of this,” he will say. “All off this one little guy who all he wanted to do was stay in Germany.” Drumheller will say he personally redacted all references to Curveball material in an advance draft of the Powell speech. “We said, ‘This is from Curveball. Don’t use this.’” But Powell later says neither he nor his chief of staff, Larry Wilkerson, were ever told of any doubts about Curveball. “In fact, it was the exact opposite,” Wilkerson will assert. “Never from anyone did we even hear the word ‘Curveball,’ let alone any expression of doubt in what Secretary Powell was presenting with regard to the biological labs.” [ABC News, 3/13/2007]

The Independent reports on February 3 that according to security sources in London, Colin Powell will attempt to link Iraq to al-Qaeda in his February 5 presentation to the UN. But the sources say that intelligence analysts in both Washington and London do not believe such links exist. [Independent, 2/3/2003 Sources: Unnamed British intelligence sources] This is followed by a report the next day in the London Telegraph, reporting that the Bush administration’s insistence of a link between al-Zarqawi, Ansar al-Islam, and Saddam Hussein “has infuriated many within the United States intelligence community.” The report cites one unnamed US intelligence source who says, “The intelligence is practically non-existent,” and explains that the claim is largely based on information provided by Kurdish groups, which are enemies of Ansar al-Islam. “It is impossible to support the bald conclusions being made by the White House and the Pentagon given the poor quantity and quality of the intelligence available. There is uproar within the intelligence community on all of these points, but the Bush White House has quashed dissent.” [Daily Telegraph, 2/4/2003 Sources: Unnamed US and British intelligence sources] The Telegraph predicts that “if Mr. Powell tries to prove the link between Iraq and al-Qaeda, the whole thing could fall apart,” explaining that the veto-wielding Security Council members, “France, Russia, and China… all have powerful intelligence services and their own material on al-Qaeda and they will know better than to accept the flimsy evidence of a spurious link with Baghdad.” [Daily Telegraph, 2/4/2003]

CIA Director George Tenet and Deputy Director John McLaughlin assure Colin Powell that the statements he will be making in his February 5 speech (see February 5, 2003) to the UN are backed by solid intelligence. Powell is apparently concerned that the allegations about mobile biological weapons laboratories have little evidence behind them. “Powell and I were both suspicious because there were no pictures of the mobile labs,” Powell’s deputy, Larry Wilkerson, will later recall in an interview with the Washington Post. But the two CIA officials claim that evidence for the mobile units is based on multiple sources whose accounts have been independently corroborated. “This is it, Mr. Secretary. You can’t doubt this one,” Wilkerson remembers them saying. [Washington Post, 6/25/2006]

Around midnight, CIA Director George Tenet calls CIA official Tyler Drumheller at home and asks for the phone number of Richard Dearlove, the British intelligence chief. Tenet wants to get Dearlove’s approval to use British intelligence in Secretary of State Colin Powell’s speech to the UN (see February 5, 2003). Drumheller takes the opportunity to remind Tenet that the source for the alleged mobile labs, Curveball, is not reliable. “Hey, boss, you’re not going to use that stuff in the speech… ? There are real problems with that,” Drumheller asks. Tenet, distracted and tired, tells him not to worry. [Isikoff and Corn, 2006, pp. 184; Washington Post, 6/25/2006] Tenet will later deny having such a conversation with Drumheller, writing: “I remember no such midnight call or warning.… Drumheller had dozens of opportunities before and after the Powell speech to raise the alarm with me [about Curveball], yet he failed to do so.” [Unger, 2007, pp. 283]

Colin Powell’s speech to the UN Security Council (see February 5, 2003) has a far more powerful effect on the American populace than it does among others. [Unger, 2007, pp. 286-288]
Did Not Convince Skeptical Governments - The presentation does little to change minds on the Security Council. France, Russia, and China remain opposed to the idea of a new resolution that would pave the way for the US to invade Iraq. These countries say that Powell’s speech demonstrates that inspections are working and must be allowed to continue. “Immediately after Powell spoke, the foreign ministers of France, Russia and China—all of which hold veto power—rejected the need for imminent military action and instead said the solution was more inspections,” reports the Washington Post. But governments who have been supportive of the United States’ stance remain firmly behind Washington. [Washington Post, 2/6/2003; Washington Post, 2/7/2003]
European Press Skeptical - The European press’s response to Powell’s evidence is also mixed. The Times of London, a relatively conservative daily newspaper, describes Powell’s presentation as a “few smudgy satellite photographs, a teaspoon of talcum powder, some Lego-style drawings of sinister trucks and trains, a picture of an American U2 spy plane, several mugshots of Arabic men, and a script that required a suspension of mistrust by the world’s doves.” [London Times, 2/6/2003]
American Media Strongly Positive - The US media’s reaction to Powell’s presentation is immediate and overwhelmingly positive. Over 100 press outlets compare his speech to Adlai Stevenson’s 1962 denunciation of the USSR during the Cuban Missile Crisis (see January 30-February 4, 2003). One poll shows that 90 percent of Americans now believe Iraq has an active WMD program that poses a dire threat to the nation. Another shows 67 percent of Americans believe that the US is justified in going to war with Iraq because of that nation’s illicit WMD. The San Francisco Chronicle calls the speech “impressive in its breadth and eloquence.” The Denver Post compares Powell to “Marshal Dillon facing down a gunslinger in Dodge City,” and adds that he showed the world “not just one ‘smoking gun’ but a battery of them.” Perhaps the most telling reaction is among the media’s liberals. The Washington Post’s Mary McGrory says Powell won her over. Richard Cohen, a moderate Post colleague, writes that Powell’s evidence is “absolutely bone-chilling in its detail… [and] had to prove to anyone that Iraq not only hadn’t accounted for its weapons of mass destruction but without a doubt still retains them. Only a fool, or possibly a Frenchman, could conclude otherwise.” And the New York Times writes three separate stories praising Powell as “powerful,” “sober,” “factual,” and “nearly encyclopedic.” Columnist William Safire says Powell’s presentation has “half a dozen smoking guns” and makes an “irrefutable and undeniable” case. Safire’s colleague at the Times, Michael Gordon, concludes, “It will be difficult for skeptics to argue that Washington’s case against Iraq is based on groundless suspicions and not intelligence information.” [Unger, 2007, pp. 286-288] In the days after the speech, the Washington Post opinion pages are filled with praises for Powell and the presentation. [New York Review of Books, 2/26/2004] One Post editorial proclaims that after the presentation, it is “hard to imagine how anyone could doubt that Iraq possesses weapons of mass destruction.” [Washington Post, 2/6/2004]
Powell 'Trusted' - Former ambassador Joseph Wilson will write in 2004: “[I]t was Powell’s credibility that finally put public opinion over the top. Over and over again, I was told, ‘Colin Powell wouldn’t lie to us.‘… Powell’s support for invading Iraq with a pseudo-coalition was essential, and he deserves at least as much of the responsibility for the subsequent situation that we find ourselves in as anybody else in the administration, because, more than anybody else, it was his credibility and standing among the American people that tipped the scales.” [Wilson, 2004, pp. 317-318] In 2007, CBS anchor Dan Rather gives a simple reason why Powell’s presentation is so strongly accepted by so many. “Colin Powell was trusted. Is trusted, I’d put it—in a sense. He, unlike many of the people who made the decisions to go to war, Colin Powell has seen war. He knows what a green jungle hell Vietnam was. He knows what the battlefield looks like. And when Colin Powell says to you, ‘I, Colin Powell, am putting my personal stamp on this information. It’s my name, my face, and I’m putting it out there,’ that did make a difference.… I was impressed. And who wouldn’t be?” [PBS, 4/25/2007]

[Source: CBS News]US Secretary of State Colin Powell presents the Bush administration’s case against Saddam to the UN Security Council, in advance of an expected vote on a second resolution that the US and Britain hope will provide the justification to use military force against Iraq. [US Department of State, 2/5/2003] At the insistence of Powell, CIA Director George Tenet is seated directly behind him to the right. “It was theater, a device to signal to the world that Powell was relying on the CIA to make his case that Iraq had weapons of mass destruction,” Vanity Fair magazine will later explain. [Bamford, 2004, pp. 371-2; Vanity Fair, 5/2004, pp. 232] In his speech before the Council, Powell makes the case that Iraq is in further material breach of past UN resolutions, specifically the most recent one, UN Resolution 1441 (see November 8, 2002). Sources cited in Powell’s presentation include defectors, informants, communication intercepts, procurement records, photographs, and detainees. [US Department of State, 2/5/2003] Most of the allegations made by Powell are later demonstrated to be false. “The defectors and other sources went unidentified,” the Associated Press will later report. “The audiotapes were uncorroborated, as were the photo interpretations. No other supporting documents were presented. Little was independently verifiable.” [Associated Press, 8/9/2003]
Iraq's December 7 Declaration Was Inaccurate - Powell contends that Iraq’s December 7 declaration was not complete. According to UN Resolution 1441 the document was supposed to be a “currently accurate, full and complete declaration of all aspects” of its programs to develop weapons of mass destruction. But Saddam has not done this, says Powell, who explains that Iraq has yet to provide sufficient evidence that it destroyed its previously declared stock of 8,500 liters of anthrax, as it claimed in the declaration. Furthermore, notes the secretary of state, UNSCOM inspectors had previously estimated that Iraq possessed the raw materials to produce as much as 25,000 liters of the virus. Iraq Has Ties to Al-Qaeda - Powell repeats earlier claims that Saddam Hussein’s government has ties to al-Qaeda. Powell focuses on the cases of the militant Islamic group Ansar-al-Islam and Abu Musab Zarqawi, a Jordanian-born Palestinian, who had received medical treatment in Baghdad during the summer of 2002 (see December 2001-Mid-2002). [US Department of State, 2/5/2003] However, just days before Powell’s speech, US and British intelligence officials—speaking on condition of anonymity—told the press that the administration’s allegations of Iraqi-al-Qaeda ties were based on information provided by Kurdish groups, who, as enemies of Ansar-al-Islam, should not be considered reliable. Furthermore, these sources unequivocally stated that intelligence analysts on both sides of the Atlantic remained unconvinced of the purported links between Iraq and al-Qaeda (see February 3-4, 2003). [Independent, 2/3/2003; Daily Telegraph, 2/4/2003] Powell also claims that Iraq provided “chemical or biological weapons training for two al-Qaeda associates beginning in December 2000.” The claim is based on a September 2002 CIA document which had warned that its sources were of “varying reliability” and that the claim was not substantiated (see September 2002). The report’s main source, Ibn al-Shaykh al-Libi, an al-Qaeda operative who offered the information to CIA interrogators while in custody, later recounts the claim (see February 14, 2004). [CNN, 9/26/2002; New York Times, 7/31/2004; Newsweek, 7/5/2005] Larry Wilkerson, Powell’s chief of staff, will later say that neither he nor Powell ever received “any dissent with respect to those lines… indeed the entire section that now we know came from [al-Libi].” [Newsweek, 11/10/2005] Senior US officials will admit to the New York Times and Washington Post after the presentation that the administration was not claiming that Saddam Hussein is “exercising operational control” of al-Qaeda. Iraq Has Missiles Capable of Flying Up to 1,200 Kilometers - Describing a photo of the al-Rafah weapons site, Powell says: “As part of this effort, another little piece of evidence, Iraq has built an engine test stand that is larger than anything it has ever had. Notice the dramatic difference in size between the test stand on the left, the old one, and the new one on the right. Note the large exhaust vent. This is where the flame from the engine comes out. The exhaust vent on the right test stand is five times longer than the one on the left. The one of the left is used for short-range missiles. The one on the right is clearly intended for long-range missiles that can fly 1,200 kilometers. This photograph was taken in April of 2002. Since then, the test stand has been finished and a roof has been put over it so it will be harder for satellites to see what’s going on underneath the test stand.” [US Department of State, 2/5/2003; New York Times, 2/5/2003] But according to the Associated Press, “… UN missile experts have reported inspecting al-Rafah at least five times since inspections resumed Nov. 27, have studied the specifications of the new test stand, regularly monitor tests at the installation, and thus far have reported no concerns.” [Associated Press, 2/7/2003] Similarly, Reuters quotes Ali Jassem, an Iraqi official, who explains that the large stand referred to in Powell’s speech is not yet in operation and that its larger size is due to the fact that it will be testing engines horizontally. [Reuters, 2/7/2003; Guardian, 2/15/2003] Several days later, Blix will report to the UN that “so far, the test stand has not been associated with a proscribed activity.” [Guardian, 2/15/2003]
Iraqis Attempted to Hide Evidence from Inspectors - Powell shows the UN Security Council satellite shots depicting what he claims are chemical weapons bunkers and convoys of Iraqi cargo trucks preparing to transport ballistic missile components from a weapons site just two days before the arrival of inspectors. “We saw this kind of housecleaning at close to 30 sites,” Powell explains. “We must ask ourselves: Why would Iraq suddenly move equipment of this nature before inspections if they were anxious to demonstrate what they had or did not have?” [US Department of State, 2/5/2003] But the photos are interpreted differently by others. An unnamed UN official and German UN Inspector Peter Franck both say the trucks in the photos are actually fire engines. [Mercury News (San Jose), 3/18/2003; Agence France-Presse, 6/6/2003]
'Literally Removed the Crust of the Earth' - Another series of photos—taken during the spring and summer of 2002—show that Iraqis have removed a layer of topsoil from the al-Musayyib chemical complex. This piece of evidence, combined with information provided by an unnamed source, leads Powell to draw the following conclusion: “The Iraqis literally removed the crust of the earth from large portions of this site in order to conceal chemical weapons evidence that would be there from years of chemical weapons activity.” [US Department of State, 2/5/2003; Washington Post, 2/6/2003] Showing another series of pictures—one taken on November 10 (before inspections) and one taken on December 22—Powell says that a guard station and decontamination truck were removed prior to the arrival of inspectors. Powell does not explain how he knows that the truck in the photograph was a decontamination truck. [US Department of State, 2/5/2003; Washington Post, 2/6/2003; Washington Post, 2/6/2003] AP reporter Charles Hanley says that some of Powell’s claims that Iraq is hiding evidence are “ridiculous.” Powell says of a missile site, “This photograph was taken in April of 2002. Since then, the test stand has been finished and a roof has been put over it so it will be harder for satellites to see what’s going on underneath the test stand.” Hanley later says, “What he neglected to mention was that the inspectors were underneath, watching what was going on.” [PBS, 4/25/2007]
Communication Intercepts Demonstrate Iraqi Attempts to Conceal Information from Inspectors - Powell plays recordings of three conversations intercepted by US intelligence—one on November 26, another on January 30, and a third, a “few weeks” before. The conversations suggest that the Iraqis were attempting to hide evidence from inspectors. [New York Times, 2/5/2003; US Department of State, 2/5/2003; London Times, 2/6/2003; Sydney Morning Herald, 2/7/2003] Senior administration officials concede to the Washington Post that it was not known “what military items were discussed in the intercepts.” [Washington Post, 2/13/2003] Some critics argue that the intercepts were presented out of context and open to interpretation. [Sydney Morning Herald, 2/7/2003; Sydney Morning Herald, 2/9/2003] Others note that the conversations were translated from Arabic by US translators and were not analyzed or verified by an independent specialist. [Newsday, 2/6/2003]
Biological Weapons Factories - Colin Powell says that US intelligence has “firsthand descriptions” that Iraq has 18 mobile biological weapons factories mounted on trucks and railroad cars. Information about the mobile weapons labs are based on the testimonies of four sources—a defected Iraqi chemical engineer who claims to have supervised one of these facilities, an Iraqi civil engineer (see December 20, 2001), a source in “a position to know,” and a defected Iraqi major (see February 11, 2002). Powell says that the mobile units are capable of producing enough dry biological agent in a single month to kill several thousand people. He shows computer-generated diagrams and pictures based on the sources’ descriptions of the facilities. Powell says that according to the chemical engineer, during the late 1990s, Iraq’s biological weapons scientists would often begin the production of pathogens on Thursday nights and complete the process on Fridays in order to evade UNSCOM inspectors whom Iraq believed would not conduct inspections on the Muslim holy day. [New York Times, 2/5/2003; US Department of State, 2/5/2003; Washington Post, 2/6/2003; Reuters, 2/11/2003] Powell tells the delegates, “The source was an eyewitness, an Iraqi chemical engineer, who supervised one of these facilities. He actually was present during biological agent production runs. He was also at the site when an accident occurred in 1998. Twelve technicians died from exposure to biological agents.” He displays models of the mobile trucks drawn from the source’s statements. [CBS News, 11/4/2007] Responding to the allegation, Iraqi officials will concede that they do in fact have mobile labs, but insist that they are not used for the development of weapons. According to the Iraqis, the mobile labs are used for food analysis for disease outbreaks, mobile field hospitals, a military field bakery, food and medicine refrigeration trucks, a mobile military morgue and mobile ice making trucks. [Guardian, 2/5/2003; ABC News, 5/21/2003] Iraq’s explanation is consistent with earlier assessments of the UN weapons inspectors. Before Powell’s presentation, Hans Blix had dismissed suggestions that the Iraqis were using mobile biological weapons labs, reporting that inspections of two alleged mobile labs had turned up nothing. “Two food-testing trucks have been inspected and nothing has been found,” Blix said. And Ewen Buchanan, spokesman for the UN Monitoring, Verification and Inspection Commission, said, “The outline and characteristics of these trucks that we inspected were all consistent with the declared purposes.” [Guardian, 2/5/2003; ABC News, 5/21/2003]
'Curveball' Primary Source of Claims - Powell’s case is further damaged when it is later learned that one of the sources Powell cited, the Iraqi major, had been earlier judged unreliable by intelligence agents at the Defense Intelligence Agency (see February 11, 2002). In May 2002, the analysts had issued a “fabricator notice” on the informant, noting that he had been “coached by [the] Iraqi National Congress” (INC) (see May 2002). But the main source for the claim had been an Iraqi defector known as “Curveball,” who was initially believed to be the brother of a top aide to Ahmed Chalabi. The source claimed to be a chemical engineer who had helped design and build the mobile labs. His information was passed to Washington through Germany’s intelligence service, the Bundesnachrichtendienst (BND), which had been introduced to the source by the INC. In passing along the information, the BND noted that there were “various problems with the source.” And only one member of the US intelligence community had actually met with the person—an unnamed Pentagon analyst who determined the man was an alcoholic and of dubious reliability. Yet both the DIA and the CIA validated the information. [Veteran Intelligence Professionals for Sanity, 8/22/2003; Los Angeles Times, 3/28/2004; Knight Ridder, 4/4/2004; Newsweek, 4/19/2004; Newsweek, 7/19/2004] Powell says that the US has three other intelligence sources besides Curveball for the mobile bioweapons labs. Powell will be infuriated to learn that none of those three sources ever corroborated Curveball’s story, and sometimes their information contradicted each other. One of the three had failed a polygraph test and was determined to have lied to his debriefers. Another had already been declared a fabricator by US intelligence community, and had been proven to have mined his information off the Internet. [Buzzflash (.com), 11/27/2007] In November 2007, Curveball is identified as Rafid Ahmed Alwan. Serious questions about Curveball’s veracity had already been raised by the time of Powell’s UN presentation. He will later be completely discredited (see November 4, 2007).
Further Problems with Mobile Lab Claims - In addition to the inspectors’ assessments and the dubious nature of the sources Powell cited, there are numerous other problems with the mobile factories claim. Raymond Zilinskas, a microbiologist and former UN weapons inspector, argues that significant amounts of pathogens such as anthrax, could not be produced in the short span of time suggested in Powell’s speech. “You normally would require 36 to 48 hours just to do the fermentation…. The short processing time seems suspicious to me.” He also says: “The only reason you would have mobile labs is to avoid inspectors, because everything about them is difficult. We know it is possible to build them—the United States developed mobile production plants, including one designed for an airplane—but it’s a big hassle. That’s why this strikes me as a bit far-fetched.” [Washington Post, 2/6/2003] After Powell’s speech, Blix will say in his March 7 report to the UN that his inspectors found no evidence of mobile weapons labs (see March 7, 2003). [CNN, 3/7/2003; Agence France-Presse, 3/7/2003; CNN, 3/7/2003] Reporter Bob Drogin, author of Curveball: Spies, Lies and the Con Man Who Caused a War, says in 2007, “[B]y the time Colin Powell goes to the UN to make the case for war, he shows the world artists’ conjectures based on analysts’ interpretations and extrapolations of Arabic-to-German-to-English translations of summary debriefing reports of interviews with a manic-depressive defector whom the Americans had never met. [CIA director George] Tenet told Powell that Curveball’s information was ironclad and unassailable. It was a travesty.” [Alternet, 10/22/2007]
'Four Tons' of VX Toxin - Powell also claims that Iraq has “four tons” of VX nerve toxin. “A single drop of VX on the skin will kill in minutes,” he says. “Four tons.” Hanley later notes, “He didn’t point out that most of that had already been destroyed. And, on point after point he failed to point out that these facilities about which he was raising such alarm were under repeated inspections good, expert people with very good equipment, and who were leaving behind cameras and other monitoring equipment to keep us a continuing eye on it.” [PBS, 4/25/2007]
Iraq is Developing Unmanned Drones Capable of Delivering Weapons of Mass Destruction - Powell asserts that Iraq has flight-tested an unmanned drone capable of flying up to 310 miles and is working on a liquid-fueled ballistic missile with a range of 745 miles. He plays a video of an Iraqi F-1 Mirage jet dispersing “simulated anthrax.” [US Department of State, 2/5/2003; New York Times, 2/5/2003; Washington Post, 2/6/2003] But the Associated Press will later report that the video was made prior to the 1991 Gulf War. Apparently, three of the four spray tanks shown in the film had been destroyed during the 1991 military intervention. [Associated Press, 8/9/2003]
Imported Aluminum Tubes were Meant for Centrifuge - Powell argues that the aluminum tubes which Iraq had attempted to import in July 2001 (see July 2001) were meant to be used in a nuclear weapons program and not for artillery rockets as experts from the US Energy Department, the INR, and the IAEA have been arguing (see February 3, 2003) (see January 11, 2003) (see August 17, 2001) (see January 27, 2003). To support the administration’s case, he cites unusually precise specifications and high tolerances for heat and stress. “It strikes me as quite odd that these tubes are manufactured to a tolerance that far exceeds US requirements for comparable rockets,” he says. “Maybe Iraqis just manufacture their conventional weapons to a higher standard than we do, but I don’t think so.” Powell also suggests that because the tubes were “anodized,” it was unlikely that they had been designed for conventional use. [US Department of State, 2/5/2003; Washington Post, 2/5/2003; Washington Post, 3/8/2003] Powell does not mention that numerous US nuclear scientists have dismissed this claim (see August 17, 2001) (see September 23, 2002) (see December 2002). [Albright, 10/9/2003] Powell also fails to say that Iraq has rockets identical to the Italian Medusa 81 mm rockets, which are of the same dimensions and made of the same alloy as the 3,000 tubes that were intercepted in July 2001 (see After January 22, 2003). [Washington Post, 8/10/2003] This had been reported just two weeks earlier by the Washington Post. [Washington Post, 1/24/2003] Moreover, just two days before, Powell was explicitly warned by the US State Department’s Bureau of Intelligence and Research not to cite the aluminum tubes as evidence that Iraq is pursuing nuclear weapons (see February 3, 2003). Iraq Attempted to Acquire Magnets for Use in a Gas Centrifuge Program - Powell says: “We… have intelligence from multiple sources that Iraq is attempting to acquire magnets and high-speed balancing machines. Both items can be used in a gas centrifuge program to enrich uranium. In 1999 and 2000, Iraqi officials negotiated with firms in Romania, India, Russia and Slovenia for the purchase of a magnet production plant. Iraq wanted the plant to produce magnets weighing 20 to 30 grams. That’s the same weight as the magnets used in Iraq’s gas centrifuge program before the Gulf War.” [US Department of State, 2/5/2003; New York Times, 2/6/2003] Investigation by the UN’s International Atomic Energy Agency [IAEA] will demonstrate that the magnets have a dual use. IAEA Director Mohamed ElBaradei said a little more than a week before, on January 27, in his report to the Security Council: “Iraq presented detailed information on a project to construct a facility to produce magnets for the Iraqi missile program, as well as for industrial applications, and that Iraq had prepared a solicitation of offers, but that the project had been delayed due to ‘financial credit arrangements.’ Preliminary investigations indicate that the specifications contained in the offer solicitation are consistent with those required for the declared intended uses. However, the IAEA will continue to investigate the matter….” (see January 27, 2003) [Annan, 1/27/2003 pdf file] On March 7, ElBaradei will provide an additional update: “The IAEA has verified that previously acquired magnets have been used for missile guidance systems, industrial machinery, electricity meters and field telephones. Through visits to research and production sites, reviews of engineering drawings and analyses of sample magnets, IAEA experts familiar with the use of such magnets in centrifuge enrichment have verified that none of the magnets that Iraq has declared could be used directly for a centrifuge magnetic bearing.” (see March 7, 2003) [CNN, 3/7/2003]
Iraq Attempted to Purchase Machines to Balance Centrifuge Rotors - Powell states: “Intercepted communications from mid-2000 through last summer show that Iraq front companies sought to buy machines that can be used to balance gas centrifuge rotors. One of these companies also had been involved in a failed effort in 2001 to smuggle aluminum tubes into Iraq.” [US Department of State, 2/5/2003; New York Times, 2/6/2003]
Powell Cites Documents Removed from Home of Iraqi Scientist Faleh Hassan - Powell cites the documents that had been found on January 16, 2003 by inspectors with the help of US intelligence at the Baghdad home of Faleh Hassan, a nuclear scientist. Powell asserts that the papers are a “dramatic confirmation” that Saddam Hussein is concealing evidence and not cooperating with the inspections. The 3,000 documents contained information relating to the laser enrichment of uranium (see January 16, 2003). [Daily Telegraph, 1/18/2003; Associated Press, 1/18/2003; BBC, 1/19/2003; US Department of State, 2/5/2003] A little more than a week later, in the inspectors’ February 14 update to the UN Security Council (see February 14, 2003), ElBaradei will say, “While the documents have provided some additional details about Iraq’s laser enrichment development efforts, they refer to activities or sites already known to the IAEA and appear to be the personal files of the scientist in whose home they were found. Nothing contained in the documents alters the conclusions previously drawn by the IAEA concerning the extent of Iraq’s laser enrichment program.” [Guardian, 2/15/2003; BBC, 2/17/2003; Associated Press, 8/9/2003]
Iraq is Hiding Missiles in the Desert - Powell says that according to unidentified sources, the Iraqis have hidden rocket launchers and warheads containing biological weapons in the western desert. He further contends that these caches of weapons are hidden in palm groves and moved to different locations on a weekly basis. [US Department of State, 2/5/2003] It will later be suggested that this claim was “lifted whole from an Iraqi general’s written account of hiding missiles in the 1991 war.” [Associated Press, 8/9/2003]
Iraq Has Scud Missiles - Powell also says that according to unnamed “intelligence sources,” Iraq has a few dozen Scud-type missiles. [Associated Press, 8/9/2003]
Iraq Has Weapons of Mass Destruction - Secretary of State Colin Powell states unequivocally: “We… have satellite photos that indicate that banned materials have recently been moved from a number of Iraqi weapons of mass destruction facilities. There can be no doubt that Saddam Hussein has biological weapons and the capability to rapidly produce more, many more.” Elsewhere in his speech he says: “We know that Saddam Hussein is determined to keep his weapons of mass destruction, is determined to make more.” [US Department of State, 2/5/2003; CNN, 2/5/2003]
Governments, Media Reaction Mixed - Powell’s speech will fail to convince many skeptical governments, nor will it impress many in the European media. But it will have a tremendous impact in the US media (see February 5, 2003 and After).

'Vast Arsenal' of WMDs - “The regime has never accounted for a vast arsenal of deadly biological and chemical weapons. …. The Iraqi regime has actively and secretly attempted to obtain equipment needed to produce chemical, biological, and nuclear weapons. Firsthand witnesses have informed us that Iraq has at least seven mobile factories for the production of biological agents, equipment mounted on trucks and rails to evade discovery. Using these factories, Iraq could produce within just months hundreds of pounds of biological poisons.… Iraq has never accounted for thousands of bombs and shells capable of delivering chemical weapons. The regime is actively pursuing components for prohibited ballistic missiles. And we have sources that tell us that Saddam Hussein recently authorized Iraqi field commanders to use chemical weapons—the very weapons the dictator tells the world he does not have.” [US President, 2/10/2003]
WMD Delivery Systems - “The Iraqi regime has acquired and tested the means to deliver weapons of mass destruction. All the world has now seen the footage of an Iraqi Mirage aircraft with a fuel tank modified to spray biological agents over wide areas. Iraq has developed spray devices that could be used on unmanned aerial vehicles with ranges far beyond what is permitted by the Security Council. A UAV launched from a vessel off the American coast could reach hundreds of miles inland.” [US President, 2/10/2003]
Iraq and al-Qaeda - “One of the greatest dangers we face is that weapons of mass destruction might be passed to terrorists, who would not hesitate to use those weapons. Saddam Hussein has longstanding, direct and continuing ties to terrorist networks. Senior members of Iraqi intelligence and al-Qaeda have met at least eight times since the early 1990s. Iraq has sent bomb-making and document forgery experts to work with al-Qaeda. Iraq has also provided al-Qaeda with chemical and biological weapons training.” [US President, 2/10/2003; Newsweek, 11/10/2005]
Harboring Terrorists - “We also know that Iraq is harboring a terrorist network, headed by a senior al-Qaeda terrorist planner. The network runs a poison and explosive training center in northeast Iraq, and many of its leaders are known to be in Baghdad. The head of this network traveled to Baghdad for medical treatment and stayed for months. Nearly two dozen associates joined him there and have been operating in Baghdad for more than eight months.” [US President, 2/10/2003]
Choice of Freedom - “[W]e can give the Iraqi people their chance to live in freedom and choose their own government.… Saddam Hussein has made Iraq into a prison, a poison factory, and a torture chamber for patriots and dissidents.” [US President, 2/10/2003]
