Sam Wyly. [Source: Forbes]A group called “Republicans for Clean Air” begins running ads attacking Republican presidential candidate John McCain in New York. The ads accuse McCain of voting against alternative energy sources. At the same time, ads paid for by the campaign of Republican presidential candidate George W. Bush accuse McCain of labeling breast cancer programs as wasteful. Governor George Pataki (R-NY) accuses McCain of voting “anti-New York” in the Senate, while Representative John Sweeney (R-NY) says McCain was wrong to vote for raising heating oil taxes, a major issue in cold-weather states such as New York. [Salon, 3/2/2000] The group also runs ads in primary states claiming that Bush, as Texas governor, passed laws intended to reduce air pollution in Texas by over a quarter-million tons a year. The evidence does not support the claim; what few anti-pollution laws have taken effect in Texas were written mostly by Democratic state legislators and signed into law, often reluctantly, by Bush.
RFCA Consists of Two Texas Billionaires - An investigation by the New York Times soon proves that “Republicans for Clean Air” (RFCA) is funded by Dallas billionaire Sam Wyly, a Bush supporter, who has contributed $2.5 million to the group. Wyly and his brother Charles Wyly, also a RFCA contributor, are the co-founders of Sterling Software in Dallas. They are also owners, founders, or executives in firms that own Bonanza Steakhouse, the “Michael’s” chain of arts and craft stores, the hedge fund Maverick Capital, and more. Both are heavy Bush campaign donors, having donated over $210,000 to the Bush gubernatorial campaigns. They are apparently the only two members of the RFCA. Craig McDonald of Texans for Public Justice says of Sam Wyly: “He’s one of the elite. He’s one of the movers and shakers. He’s very big money in the state.” McCain’s campaign accuses the Bush campaign of being responsible for the advertising, and says the Bush campaign is trying to evade campaign finance laws (see February 7, 1972 and May 11, 1992). The McCain campaign complains that the Bush campaign is using unethical and possibly illegal campaign tactics to “steal” the primary election by saturating New York, California, and Ohio with anti-McCain ads just days before the primary elections in those critical states. “There is no question in our campaign’s mind that the ads are being sponsored, coordinated, and managed by the George Bush for President campaign,” says McCain’s campaign manager Rick Davis. “I think it’s incumbent on the Bush campaign to prove somehow that they are not involved in this incredible act.” Davis has no direct evidence for his claim, but cites what the Times calls “a tangle of personal, business, and political relationships between Mr. Wyly and his family and the Bush campaign to suggest that their interests were so close as to be indistinguishable.” One of those relationships cited by Davis is the fact that RFCA uses the same public relations firm, Multi Media Services Corporation, as Pataki, who chairs the Bush campaign in New York and who appears in Bush campaign ads. Bush himself denies any connection with RFCA, and says: “There is no coordination.… I had no idea the ad was going to run.” Wyly also disclaims any coordination with the Bush campaign. He says he laughed during the production of the commercials, and mused over how “surprised” the Bush campaign would be to see them on the airwaves. McCain uses the ads to draw attention to one of his favorite campaign themes, campaign finance reform. On a recent morning talk show, McCain said: “I think maybe the Bush campaign is out of money and somebody’s putting in $2 million to try to hijack the campaign here in New York. Nobody knows where it came from. [When McCain filmed the interview, Wyly’s identity had not been revealed.] We’ll probably find out, but probably too late. Thomas and Danny Lee McDonald, 4/2002; New York Times, 8/23/2010] The press soon learns that Charles Wyly is an official member of the Bush presidential campaign, as a “Pioneer” donor, and has contributed the maximum amount under the law. [New York Times, 3/4/2000] It also learns that RFCA’s stated address is a post office box in Virginia belonging to Lydia Meuret, a consultant who runs a political action committee headed by Representative Henry Bonilla (R-TX), a Bush ally. Meuret denies any connection between RFCA and Bonilla or Bonilla’s PAC, but admits she is a consultant to both. [New York Times, 3/3/2000]
'527' Group Operates in Campaign Finance Law 'Gray Areas' - RFCA is a “527” group (see 2000 - 2005); such groups operate in a “gray area” of campaign law, as the monies they use are not contributed directly to a candidate or a political party. However, they are banned from coordinating their efforts with candidate campaigns. Their ads must not make direct appeals to voters in support of, or opposition to, a particular candidate. If they comply with this portion of the law, the donors behind the ads, and the amounts they contribute, do not have to be identified. The law does not even require the groups to declare their existence, as was the case for a time with RFCA. The Times reports, “While some of the groups behind issue advertising are vague about their membership, Mr. Wyly’s effort was a rare instance in which commercials were aired without any hint of their origin.” Fred Wertheimer of Democracy 21, a group advocating campaign finance reform, says of so-called “issue” ads such as these: “The secrecy aspects of this are taking campaign finance problems to yet another new and dangerous level. What we’re seeing here is the use of unlimited, undisclosed money to influence a federal election, and that’s totally at odds with the whole notion of campaign finance disclosure.” [New York Times, 3/3/2000; San Jose Mercury News, 3/6/2000; New York Times, 3/29/2000; New York Times, 8/23/2010] Progressive columnist Molly Ivins calls the RFCA ads examples of “sham issue” advertisements. Bush Claims RFCA Ads Not Helpful - After Bush secures the nomination over McCain, he tells a reporter, “I don’t think these [Republicans for Clean Air] ads are particularly helpful to me.” But Slate reporter Chris Suellentrop writes: “Of course they were helpful. Otherwise Bush would have called the group and told them to call off the dogs.” [Slate, 8/25/2000]
Wyly Brothers Will Fund 2004 'Swift Boat' Campaign, Later Charged with Securities Fraud, Insider Trading - A month after the ads air, Sam Wyly says he will no longer involve himself in politics. Wyly, who says he is a staunch environmentalist, says he admires Bush’s Democratic challenger, Vice President Al Gore (whom Wyly has called a regulation-happy environmentalist, and whom Wyly has considered attacking with television ads). Of his foray into the presidential campaign, Wyly says: “I learned from it. Many of you are aware of my recent foray into presidential politics. It is to be my last.” In 2004, the Wyly brothers will be two of the primary donors behind the “Swift Boat” campaign that will slander and impugn the character and military service of presidential candidate John Kerry (D-MA). In 2010, the Wyly brothers will be charged with securities fraud and insider trading that netted them at least $581 million in illegal gains, according to the Securities and Exchange Commission. ’Donahue’ show logo. [Source: American Renaissance (.com)]MSNBC, the cable news channel owned by NBC, cancels Phil Donahue’s nightly talk show. MSNBC cites “disappointing ratings” for “Donahue.” The show, originally conceived as a more liberal alternative for Fox News’s overtly conservative “O’Reilly Factor,” started very slow and never came close to challenging either O’Reilly’s ratings or CNN’s Connie Chung, whose show is also in the same time slot. But in recent weeks, Donahue’s ratings have steadily increased to the point where it is the top-rated show on the network, even beating MSNBC’s flagship political show, “Hardball With Chris Matthews.”
'Tired Left-Wing Liberal' - An internal report commissioned by the network’s executives, later obtained by media analyst Rick Ellis, calls Phil Donahue “a tired, left-wing liberal out of touch with the current marketplace.” The report says that Donahue’s show presents a “difficult public face for NBC in a time of war.… He seems to delight in presenting guests who are anti-war, anti-Bush, and skeptical of the administration’s motives.” If the show continues on the air, the report warns that it could become “a home for the liberal anti-war agenda at the same time that our competitors are waving the flag at every opportunity.” As Donahue exits the lineup, MSNBC brings aboard former Republican House Majority Leader Dick Armey and former Republican congressman Joe Scarborough as commentators, and radical right-wing talk show host Michael Savage and libertarian Jesse Ventura, the former governor of Minnesota, as hosts. Donahue’s time slot will be taken temporarily by the expansion of another show, “Countdown: Iraq,” to two hours. Nation columnist John Nichols writes: “Talk about adding insult to injury. Getting canceled is bad enough; getting canceled to make way for a program devoted to anticipating an unnecessary war is just plain awful.” [New York Times, 2/26/2003; AllYourTV (.com), 2/26/2003; Nation, 2/27/2003] In 2007, Donahue says he knew nothing of the internal memo at the time (see April 25, 2007). “I didn’t know about that till I read about it in the New York Times.” When asked: “What did you think? What does that say to you? That dissent is unpatriotic?” Donahue will reply, “Well, not only unpatriotic, but it’s not good for business.” [PBS, 4/25/2007]
MSNBC 'Tak[ing] the Coward's Road' - A source close to Donahue says that Donahue’s cancellation is “no coincidence.” The MSNBC executives are “scared,” the source says, “and they decided to take the coward’s road and slant towards the conservative crowd that watch Fox News.” Ellis, a veteran media analyst with strong connections in the TV news industry, writes that MSNBC, “[r]ather than building a unique voice, the news channel has opted to become a lesser alternative to the Fox News Channel.” Interestingly, the NBC report recommended against such a course: “The temptation is to chase the audience that is already out there and play to what seems to be working at Fox. But there is another road, and if we build our unique voices from within, we have a chance to develop a loyal and valuable audience.” Nichols writes, “[I]t is a pretty good bet that, now that ‘Donahue’ is going off the air, we will not soon see another show like the one where he featured [consumer advocate] Ralph Nader and [progressive columnist] Molly Ivins in front of a crowd of laid-off Enron employees.” Nichols adds that while Donahue’s show may have been conceived as a liberal alternative to O’Reilly, it was never allowed to be such: “For every program that featured Ralph Nader and Molly Ivins, there were ten where Donahue was forced to ask polite questions of second-string conservative pundits. Where his conservative competitors never worry about fairness or balance, Donahue was under constant pressure to clog his show’s arteries with deadly dull apologists for all things Bush. And when that got too boring, he was pressured to steer the show away from politics and toward the glitzy and the maudlin.” Only in its last few weeks did MSNBC allow Donahue to do what he does best—interview interesting guests in front of a live audience. The show’s ratings began climbing rapidly. Whether the show could have challenged O’Reilly or other conservative shows’ ratings can never be known.
Never Trusted the American Viewing Audience - Nichols concludes: “Now that ‘Donahue’ has been ditched, conservative commentators and network executives will tell themselves that there is no audience for progressive voices on television. They will, of course, be wrong on the broad premise—some of O’Reilly’s best shows feature feisty progressives like US [Representatives] Jan Schakowsky and Bernie Sanders. And they will be wrong more specifically about Donahue. We will never know for sure whether Phil Donahue could have seriously competed with conservative hosts like Bill O’Reilly or Sean Hannity. What we do now, for sure, is that MSNBC executives were never willing to trust Phil Donahue—or the American television viewing audience.” [New York Times, 2/26/2003; AllYourTV (.com), 2/26/2003; Nation, 2/27/2003]

Katharine Gun, who leaked an NSA memo to the British press in February 2003 that revealed the existence of an elaborate US plan to “bug” UN delegates (see January 31, 2003), is arrested and charged with violating the Official Secrets Act for giving a copy of the memo to the press. Gun was a translator for British intelligence, who worked at the Government Communications Headquarters (GCHQ) before losing her job over the leak in June. Gun does not dispute leaking the memo, instead calling it “justified.” Any leaks she made exposed “serious illegality and wrongdoing on the part of the US Government,” she says, and were made to prevent “wide-scale death and casualties among ordinary Iraqi people and UK forces.” [BBC, 11/13/2003] Gun has had the support of a wide array of antiwar and civil rights activists, led in the US by actor Sean Penn and activist Jesse Jackson, who signed a statement shortly before her court appearance praising her as a whistleblower. [Observer, 1/18/2004] The British government decides to drop the charges against her. No official explanation for this is forthcoming, though it may have been precipitated by the defense’s intent to argue that Gun leaked to the media in order to save lives from being lost in a war, an argument that would cause political damage to the government. Liberty spokeswoman Shami Chakrabarti says the decision to charge Gun may itself have been politically motivated, perhaps to cow future whistleblowers, and observes, “One wonders whether disclosure in this criminal trial might have been a little too embarrassing.” Sir Menzies Campbell, the Liberal Democrats’ foreign affairs spokesman, says the reason for dropping the charges might be to keep the Attorney General’s legal advice for war with Iraq a secret. Prosecutor Mark Ellison merely tells the court, “There is no longer sufficient evidence for a realistic prospect of conviction. It would not be appropriate to go into the reasons for this decision.” The only thing needed for a successful prosecution under the Official Secrets Act is for the prosecution to show that Gun is covered by the act, which she is, and that she revealed information covered by the Act, which she has admitted. Gun’s lawyer, James Webb, calls the prosecution’s excuse “rather lame.” [BBC, 11/13/2003; Evening Standard, 2/25/2004] Gun says that leaking the NSA memo was “necessary to prevent an illegal war in which thousands of Iraqi civilians and British soldiers would be killed or maimed.… I have only ever followed my conscience.” [ZNet, 12/28/2005] A month before the court proceedings, the New York Times’s Bob Herbert writes in defense of Gun, “We are not talking about a big-time criminal here. We are not talking about someone who would undermine the democratic principles that George W. Bush and Tony Blair babble about so incessantly, and self-righteously, even as they are trampling on them. Ms. Gun is someone who believes deeply in those principles and was willing to take a courageous step in support of her beliefs. She hoped that her actions would help save lives. She thought at the time that if the Security Council did not vote in favor of an invasion, the United States and Britain might not launch the war.” [New York Times, 1/19/2004] And just days before the court proceedings begin, liberal columnist Molly Ivins wrote, “…Gun may be sentenced to prison for doing precisely what we all hope every government employee will try to do: Prevent the government from committing an illegal and immoral act.
