Bella Abzug. [Source: Spartacus Educational]Staffers from the Church Committee (see April, 1976), slated with investigating illegal surveillance operations conducted by the US intelligence community, approach the NSA for information about Operation Shamrock (see 1945-1975). The NSA ostensibly closes Shamrock down the very same day the committee staffers ask about the program. Though the Church Committee focuses on a relatively narrow review of international cables, the Pike Committee in the House (see January 29, 1976) is much more far-ranging. The Pike Committee tries and fails to subpoena AT&T, which along with Western Union collaborated with the government in allowing the NSA to monitor international communications to and from the US. The government protects AT&T by declaring it “an agent of the United States acting under contract with the Executive Branch.” A corollary House subcommittee investigation led by Bella Abzug (D-NY)—who believes that Operation Shamrock continues under a different name—leads to further pressure on Congress to pass a legislative remedy. The Ford administration’s counterattack is given considerable assistance by a young lawyer at the Justice Department named Antonin Scalia. The head of the Office of Legal Counsel, Scalia’s arguments in favor of continued warrantless surveillance and the unrestricted rights and powers of the executive branch—opposed by, among others, Scalia’s boss, Attorney General Edward Levi—do not win out this time; Ford’s successor, Jimmy Carter, ultimately signs into law the Foreign Intelligence Surveillance Act (see 1978). But Scalia’s incisive arguments win the attention of powerful Ford officials, particularly Chief of Staff Donald Rumsfeld and Rumsfeld’s assistant, Dick Cheney. [Dubose and Bernstein, 2006, pp. 36-37] Scalia will become a Supreme Court Justice in 1986 (see September 26, 1986).

Representative Otis Pike. [Source: Spartacus Educational]A House of Representatives committee, popularly known as the Pike Committee after its chairman, Otis Pike (D-NY), investigates questionable US intelligence activities. The committee operates in tandem with the Senate’s investigation of US intelligence activities, the Church Committee (see April, 1976). Pike, a decorated World War II veteran, runs a more aggressive—some say partisan—investigation than the more deliberate and politically balanced Church Committee, and receives even less cooperation from the White House than does the Church investigation. After a contentious year-long investigation marred by inflammatory accusations and charges from both sides, Pike refuses demands from the CIA to redact huge portions of the report, resulting in an accusation from CIA legal counsel Mitchell Rogovin that the report is an “unrelenting indictment couched in biased, pejorative and factually erroneous terms.” Rogovin also tells the committee’s staff director, Searle Field, “Pike will pay for this, you wait and see…. There will be a political retaliation…. We will destroy him for this.” (It is hard to know exactly what retaliation will be carried out against Pike, who will resign from Congress in 1978.)
Battle to Release Report - On January 23, 1976, the investigative committee voted along party lines to release the report unredacted, sparking a tremendous outcry among Republicans, who are joined by the White House and CIA Director William Colby in an effort to suppress the report altogether. On January 26, the committee’s ranking Republican, Robert McCory, makes a speech saying that the report, if released, would endanger national security. On January 29, the House votes 246 to 124 not to release the report until it “has been certified by the President as not containing information which would adversely affect the intelligence activities of the CIA.” A furious Pike retorts, “The House just voted not to release a document it had not read. Our committee voted to release a document it had read.” Pike threatens not to release the report at all because “a report on the CIA in which the CIA would do the final rewrite would be a lie.” The report will never be released, though large sections of it will be leaked within days to reporter Daniel Schorr of the Village Voice, and printed in that newspaper. Schorr himself will be suspended from his position with CBS News and investigated by the House Ethics Committee (Schorr will refuse to disclose his source, and the committee will eventually decide, on a 6-5 vote, not to bring contempt of Congress charges against him). [Spartacus Educational, 2/16/2006] The New York Times will follow suit and print large portions of the report as well. The committee was led by liberal Democrats such as Pike and Ron Dellums (D-CA), who said even before the committee first met, “I think this committee ought to come down hard and clear on the side of stopping any intelligence agency in this country from utilizing, corrupting, and prostituting the media, the church, and our educational system.” The entire investigation is marred by a lack of cooperation from the White House and the CIA. Final Draft Accuses White House, CIA of 'Stonewalling,' Deception - The final draft of the report says that the cooperation from both entities was “virtually nonexistent,” and accuses both of practicing “foot dragging, stonewalling, and deception” in their responses to committee requests for information. CIA archivist and historian Gerald Haines will later write that the committee was thoroughly deceived by Secretary of State Henry Kissinger, who officially cooperated with the committee but, according to Haines, actually “worked hard to undermine its investigations and to stonewall the release of documents to it.” [Spartacus Educational, 2/16/2006] The final report accuses White House officials of only releasing the information it wanted to provide and ignoring other requests entirely. One committee member says that trying to get information out of Colby and other CIA officials was like “pulling teeth.” For his part, Colby considers Pike a “jackass” and calls his staff “a ragtag, immature, and publicity-seeking group.” The committee is particularly unsuccessful in obtaining information about the CIA’s budget and expenditures, and in its final report, observes that oversight of the CIA budget is virtually nonexistent. Its report is harsh in its judgments of the CIA’s effectiveness in a number of foreign conflicts, including the 1973 Mideast war, the 1968 Tet offensive in Vietnam, the 1974 coups in Cyprus and Portugal, the 1974 testing of a nuclear device by India, and the 1968 invasion of Czechoslovakia by the Soviet Union, all of which the CIA either got wrong or failed to predict. The CIA absolutely refused to provide any real information to either committee about its involvement in, among other foreign escapades, its attempt to influence the 1972 elections in Italy, covert actions in Angola, and covert aid to Iraqi Kurds from 1972 through 1975. The committee found that covert actions “were irregularly approved, sloppily implemented, and, at times, had been forced on a reluctant CIA by the President and his national security advisers.” Indeed, the Pike Committee’s final report lays more blame on the White House than the CIA for its illegal actions, with Pike noting that “the CIA does not go galloping off conducting operations by itself…. The major things which are done are not done unilaterally by the CIA without approval from higher up the line.… We did find evidence, upon evidence, upon evidence where the CIA said: ‘No, don’t do it.’ The State Department or the White House said, ‘We’re going to do it.’ The CIA was much more professional and had a far deeper reading on the down-the-road implications of some immediately popular act than the executive branch or administration officials.… The CIA never did anything the White House didn’t want. Sometimes they didn’t want to do what they did.” [Gerald K. Haines, 1/20/2003]

Almost immediately after a military coup in El Salvador is successful, reformist heads of the military junta are forced out and reactionaries are let in. Two rightists, Colonel José Guillermo García and CIA asset Colonel Nicolás Carranza, are given the positions of minister and vice-minister of defense, respectively. [Montgomery, 1995, pp. 75-76]
Lieutenant Colonel Oliver North uses a sophisticated brand of software known as PROMIS to track potential security threats in the United States. Intelligence officials will later tell Wired magazine that North has a command center connected to a larger Justice Department facility utilizing the software. “According to both a contractor who helped design the center and information disclosed during the Iran-Contra hearings,” North maintains a “similar, but smaller, White House operations room… connected by computer link to the [Justice Department]‘s command center.” According to Wired, North uses computers in his operations center to track “dissidents and potential troublemakers within the United States as part of a domestic emergency preparedness program.” North is assigned to work with FEMA on the secretive Continuity of Government (COG) program from 1982 to 1984 (see 1982-1984). Wired will later report, “Using PROMIS, sources point out, North could have drawn up lists of anyone ever arrested for a political protest, for example, or anyone who had ever refused to pay their taxes.” Compared to PROMIS, Wired notes, “Richard Nixon’s enemies list or Sen. Joe McCarthy’s blacklist look downright crude.” [Wired News, 3/1993]
A federal court rules that because of the government’s “state secrets” privilege (see March 9, 1953), a civilian plaintiff suing the US Navy over a contractual agreement cannot even access “non-privileged,” or unclassified, information from the Navy because to do so might “threaten disclosure” of material that goes against “the overriding interest of the United States… preservation of its state secrets privilege precludes any further attempt to pursue litigation.” [Siegel, 2008, pp. 196-197]
As a part of the plan to ensure Continuity of Government (COG) in the event of a Soviet nuclear strike or other emergency, the US government begins to maintain a database of people it considers unfriendly. A senior government official who has served with high-level security clearances in five administrations will say it is “a database of Americans, who, often for the slightest and most trivial reason, are considered unfriendly, and who, in a time of panic, might be incarcerated. The database can identify and locate perceived ‘enemies of the state’ almost instantaneously.” He and other sources say that the database is sometimes referred to by the code name Main Core, and one says it was set up with help from the Defense Intelligence Agency.
Alleged Link to PROMIS - The database will be said to be linked to a system known as PROMIS, the Prosecutor’s Management Information System, over which the US government conducts a long-lasting series of disputes with the private company Inslaw. The exact connection between Main Core and PROMIS is uncertain, but one option is that code from PROMIS is used to create Main Core. PROMIS is most noted for its ability to combine data from different databases, and an intelligence expert briefed by high-level contacts in the Department of Homeland Security will say that Main Core “is less a mega-database than a way to search numerous other agency databases at the same time.”
Definition of National Emergency - It is unclear what kind of national emergency could trigger such detention. Executive orders issued over the next three decades define it as a “natural disaster, military attack, [or] technological or other emergency,” while Defense Department documents include eventualities like “riots, acts of violence, insurrections, unlawful obstructions or assemblages, [and] disorder prejudicial to public law and order.” According to one news report, even “national opposition to US military invasion abroad” could be a trigger.
How Does It Work? - A former military operative regularly briefed by members of the intelligence community will be told that the program utilizes software that makes predictive judgments of targets’ behavior and tracks their circle of associations using “social network analysis” and artificial intelligence modeling tools. “The more data you have on a particular target, the better [the software] can predict what the target will do, where the target will go, who it will turn to for help,” he will say. “Main Core is the table of contents for all the illegal information that the US government has [compiled] on specific targets.”
Origin of Data - In 2008, sources will reportedly tell Radar magazine that a “host of publicly disclosed programs… now supply data to Main Core,” in particular the NSA’s domestic surveillance programs initiated after 9/11. [Radar, 5/2008]
Mahmut Bakalli, president of the League of Communists’ Kosovo Provincial Committee, resigns and is replaced by Veli Deva, also a Kosovar Albanian. Bakalli is blamed for not seeing a series of demonstrations that have rocked the province coming, although at a committee meeting on March 8 he did say there was a lack of basic goods and that conditions had to be alleviated for those without jobs or with low wages, as well as students. The next month another senior official resigns and in all six of the nine committee members leave their positions. In his last speech, Bakalli blames “subversive propaganda” from Albania, and says letting the situation get out of hand is his responsibility. In September 1981 a report by the Serbian and Kosovo committees of the League of Communists of Yugoslavia will blame Bakalli’s administration, saying it did not warn the Yugoslav and Serbian governments, though it allegedly knew the Marxist-Leninist Party of Albanians in Yugoslavia was planning demonstrations and that Albanian nationalism was increasing. Veli Deva is a former committee president and has the support of Albanians, for opposing Serb chauvinism, but is also against the Albanian government. [Vickers, 1998, pp. 201, 208; Kola, 2003, pp. 161-162]
Pristina University students begin protesting over dormitory and dining hall conditions at the school. The protest grows and hundreds of protesters go off campus, where they are blocked by police. The police try to detain the alleged organizers, which brings out more people overnight, and begins to radicalize their demands. In coming weeks and months, the government and media will blame many groups and countries for the demonstrations, but in interviews years later with Albanian scholar and diplomat Paulin Kola, Kosovan nationalist Xhafer Shatri will say that he thinks the events were unplanned. On the morning of March 12, the crowd is dispersed with tear gas. More demonstrations will erupt in a week.
The Students of Kosovo - Because unemployment is high in Kosovo, many Kosovars turn to further education, making Kosovo’s ratio of students to population the greatest in Yugoslavia—274.7 out of 1,000, while Yugoslavia’s national ratio is 194.9. One in three Kosovars is a student of some kind, yet educational facilities for Albanians are underfunded. Pristina University has 36,000 full-time and 18,000 extension program students, two-thirds more than planned when the university was created, forcing some students to share beds. About 80 percent of the students are in programs such as Islamic art, Albanian history, or folklore, graduating more students than there are available jobs in these fields. Their professors are generally poorly qualified, more than half lack PhDs, and they generally produce little new research and are not well regarded by their colleagues elsewhere in Yugoslavia. The student body is generally disaffected. Many ignore Rilindja, an Albanian language newspaper in Pristina, which covers university news on Wednesdays, and prefer TV and radio from Albania rather than Yugoslavia’s Albanian stations.
Economic Conditions - Kosovo is the poorest part of Yugoslavia, and Albanians are generally poorer than Slavs—for example, in 1980 67,000 Kosovars were unemployed, over 10 percent of the population and the highest rate in Yugoslavia. Out of every 1,000 people newly employed in Kosovo in the early ‘80s, 258 are Montenegrin, 228 Serb, and 109 Albanian, though the majority of Kosovars are Albanians. By 1988, Serbs will be 23.6 percent of the population and have 36 percent of the jobs, and Montenegrins will be 2.5 percent of the population and have 9.3 percent of the jobs. Mahmut Bakalli, president of the Kosovo Provincial Committee of the League of Communists of Yugoslavia, is unable to change Kosovo’s economic relations with the rest of Yugoslavia, which pays very little for natural resources obtained from Kosovo. Protesters, now including workers, farmers, police, soldiers, and members of the League of Communists of Yugoslavia, along with the students, continue to demonstrate, and in greater numbers, demanding the release of those arrested earlier and more. Some say that Kosovo should be a Yugoslav republic, instead of an autonomous province, or join Albania. Many Serbs agree with Tihomir Vlaskalic, president of the Central Committee of the Serbian LCY, who says, “We have taken it for granted that Kosovo has its own Republic in Yugoslavia—the Socialist Republic of Serbia.” On March 26, students in Pristina attack Serbs and Monenegrins, and rob and burn houses and businesses. Students in Podujeve, Vucitern, Gjakova, Gjilan, Ferizaj, and Mitrovice join in on April 1-2. Serbia calls in the Yugoslav police and army and fighting occurs during a state of emergency, prohibition on gathering, and a curfew on April 2, throughout Kosovo. Thirty thousand soldiers and tanks are deployed, which some Albanians see as an occupation. Kosovo LCY President Mahmut Bakalli urges the military and police not to guard the radio and TV studios, because it would inflame the public. The last large demonstration is the May 18 occupation of Pristina University dormitories, which is ended by police using tear gas on May 19. The university is closed and its University Council is disbanded. High school students are expelled for demonstrating. More than 1,000 LCY members will be expelled or unilaterally removed from membership, and 11 LCY basic organizations will be disbanded during the emergency measures. Two months later martial law will end, but major towns are patrolled by security forces and covert officers of the Yugoslav Ministry of the Interior afterward.
Casualties - From March 11 to April 2, nine Albanians and a Serb policeman are killed, according to the Yugoslav government. In 1989 a Yugoslav source will say the wounded include 75 Albanians (55 of whom were wounded by gunshots), three militia with serious injuries, and 127 with less serious wounds. Kosovar Albanian sources say as many as 1,000 are killed and even more hurt. Amnesty International will later say that the Serbian LCY Central Committee was told more than 300 were killed. In 1992 the Council for the Defense of Human Rights and Freedoms, located in Pristina, will find only 13 Albanians known to have been killed.
Government Countermeasures - Around 1,400 Albanians are given prison terms of up to 15 years, 3,000 given sentences of up to three months in prison, and 6,000 are otherwise punished. During the summer break, almost 300 students are given trials as brief as a few hours, and given up to 15-year prison terms. In June, the government says 506 people were summarily fined or jailed for up to 60 days under the Code for Petty Offenses. By August 31, another 245 people are given one to 15-year prison terms by the federal authorities and 60 people are convicted in September. The education minister of Croatia and other Croatian and Slovenian authorities will say Serbia should be less draconian. Many professors will be blacklisted in the Komunist magazine. The Kosovo Committee of the LCY calls for a 10 percent smaller student body at Pristina University and dispersal of some departments elsewhere in the province. When the fall semester begins in September, Albanian history, literature, language, culture, and art courses will be censored. Translated Serbian textbooks replace uniformly banned textbooks from Albania. The number of Albanian students, and their former quota of two-thirds of the student body, will be reduced annually.
Continuing Unrest - For years after spring 1981, government offices, monuments, and Serb graves will be vandalized and subversive literature circulated in Kosovo, western Macedonia, and parts of Montenegro. Slavs will begin to leave Kosovo out of intimidation rather than for economic reasons, and refer to threats, attacks, murder, arson, and vandalism. Many settle in Smederevo, Kragujevac, Nis, Kraljevo, Svetozarevo, and Belgrade. Belgrade residents insultingly call them Vrcani, and reportedly Slavs from Kosovo are considered tainted by association with Albanians. Edwin Meese, Counsellor to President Ronald Reagan, praises the PROMIS application at a gathering of prosecutors. He calls it “one of the greatest opportunities for [law enforcement] success in the future.” PROMIS is a database search system to help prosecutors find information about cases and people involved in them. [Wired News, 3/1993]
The Party of Labor of Albania’s newspaper, Zeri i Popullit, prints an article on April 8, condemning Yugoslavia’s police actions and the treatment of Yugoslav Albanians, and supporting the protest demands. It also says, “The London and Versailles Treaties, which settled the frontiers between Yugoslavia and Albania, can no longer be imposed to the detriment of the Albanian people.” PLA First Secretary Enver Hoxha may be the anonymous author of the article. A Zeri i Popullit article two weeks later says hundreds were killed, wounded, missing, or arrested, and that it is Albania’s right to condemn Yugoslavia’s repeated actions, which it has not done officially. Zeri i Popullit points to Yugoslavia’s charges about the treatment of Croats and Slovenes across its border in Carinthia, which the article compares to Albanian concerns about Kosovar Albanians. Albania denies seeking to annex Kosova. The Yugoslav government sees these articles as evidence that Albania is behind the demonstrations, after initially blaming domestic and Western sources. As a result, previously increasing economic and cultural cooperation between the two countries will be reduced. On April 29, Lazar Kolisevski, a member of the Yugoslav Presidency, presents a report to a meeting of the Presidency and the Federal Council for the Protection of the Constitutional Order, charging that the PLA caused the demonstrations, which were “hostile and counter-revolutionary,” and sought unification with Albania. Kolisevski calls nationalism the greatest threat to Yugoslavia and says “economic nationalism,” economic divisions between groups in Yugoslavia, is the main cause of friction, which a Zeri i Popullit article also pointed out.
Allegedly PLA-Linked Kosovar Groups - Several allegedly PLA-linked organizations will be blamed for the protests: the Revolutionary Movement of Albanian Unification (whose leader, Adam Demaci, has been in jail since 1975), the Red Popular Front (considered closer to the PLA), eight “irredentist” groups arrested before the events, and the Albanian Communist Marxist-Leninist Party in Yugoslavia (represented at the 8th Congress of the PLA, in September 1981, and having almost the same program as the PLA). Besides these “extremists,” Kosovo President Xhavid Nimami blames “Ballists” led by Abaz Ermeni and “Zogists” led by Leka Zog, Zog I’s son, and equates calls for “united Albanians” to “United Serbs,” etc., saying they would destroy Yugoslavia. In 1997 an anonymous high-ranking official will allege that a meeting of officials and professors was held in Tirana to propose inciting Kosovars to seek more rights. Albanian anti-communist scholar Paulin Kola will suggest that this was done to distract Albanians from economic problems caused by the break in relations with China in the late ‘70s. Others will allege that Albania’s Sigurimi security agency organized the demonstrations, through ties with Albanians in Western Europe, especially Switzerland. Some Kosovars will say they received support from Albanians, but not from the Albanian government. Kola will point to the alleged role of the ex-communist Socialist Party of Albania in the formation of the KLA in the ‘90s as evidence that Albania was behind the 1981 events. In 1992-1993 and 2001 interviews, Xhafer Shatri will tell Kola that he thought the March 1981 demonstrations were unplanned. On the other hand, Albania benefits from trade with Yugoslavia and Yugoslavia acts as a buffer against the USSR. Albania will repatriate 249 Kosovar Albanian asylum seekers back to Yugoslavia from 1981 to 1983.
Alleged Soviet Involvement - In late April, Yugoslavia’s Fadil Hoxha says “Greater Albanian nationalism” would destabilize the Balkans as much as other nationalisms, and implies that the USSR wants to destabilize the Balkans to undermine the Non-Aligned Movement. In June, Zeri i Popullit will accuse the USSR of trying to use Serbia’s crackdown to cause problems in the Balkans and NATO. [Vickers, 1998, pp. 202-207, 211-212; Kola, 2003, pp. 158-160, 163]

Two explosive devices are allegedly hurled onto a terrace at Yugoslavia’s embassy in Tirana, Albania, and damage the building while a reception is being held to commemorate Yugoslavia’s Youth Day. Yugoslavia says this is a violation of diplomatic immunity and undermines relations between the two countries. Albania says its forensic analysis finds that the explosives were not bombs and had to have been placed by someone inside the embassy. Subsequently, neither country makes a big deal of the attack. The incident follows Albanian protests throughout Yugoslavia earlier this spring and Albania’s first public advocacy for making the Kosovo a republic of Yugoslavia. [Kola, 2003, pp. 164]
Leaflets calling for local Albanians to rebel are distributed in western Macedonia, leading to a government crackdown more intensive than that in Kosovo. A ban on the Albanian flag is contemplated, but not imposed. [Vickers, 1998, pp. 207]
The PROMIS database application is used for a program called “Follow the Money” to track loans made by Western banks to the Soviet Union and its allies. The top-secret program is run for the National Security Council (NSC) by Norman Bailey, who uses NSA signals intelligence to track the loans. Bailey will later say that the PROMIS application is “the principal software element” used by the NSA and the Treasury Department in their electronic surveillance programs that track financial flows to the Soviet bloc, organized crime, and terrorist groups. According to Bailey, this program marks a significant shift in resources from human spying to electronic surveillance, as a way to track money flows to suspected criminals and American enemies. Jusuf Gervalla, founder of the Movement for the National Liberation of Kosova (MNLK), his brother Bardhosh Gervalla, and Kadri Zeka, leader of the Group of Marxist-Leninists of Kosova (GMLK), are shot to death following a meeting near Stuttgart, which some say is about finalizing an alliance between the groups. The MNLK and GMLK are the primary pro-Hoxha communist dissident groups in Kosovo province, and were discovered and hunted for by the police following the unrest in 1981. Subsequently those behind the assassination will remain unidentified; Albania will blame the Yugoslavs and the Yugoslavs will say Albania did it, to gain control and ideological dominance in the Kosovar struggle. On the other hand, Albania at this time sees Yugoslavia as a buffer against the USSR and a valuable trade partner, following the break in relations with China. Albania returns Kosovars seeking asylum to Yugoslavia. Inslaw wins a $9.6 million contract from the Justice Department to install the public domain vesion of PROMIS application in 20 US attorneys’ offices as a pilot program. PROMIS is an application designed to be used by prosecutors to keep track of case records (see Mid-1970s). If the trial installation is successful, the company will install PROMIS in the remaining 74 federal prosecutors’ offices around the country. The contract is also for the necessary training, maintenance, and support for three years. According to William Hamilton, one of Inslaw’s owners, the eventual market for complete automation of the Federal court system is worth up to $3 billion. However, this is the last contract Inslaw receives from the Justice Department for PROMIS, as the deal becomes mired in a series of disputes. [US Congress, 9/10/1992; Wired News, 3/1993]
C. Madison “Brick” Brewer gets the job of supervising a contract with Inslaw for the installation of the PROMIS database and search application (see March 1982). [US Congress, 9/10/1992; Wired News, 3/1993] According to a report by the House Judiciary Committee, Brewer gets the job from William P. Tyson of the Justice Department’s Executive Office for US Attorneys (EOUSA). [US Congress, 9/10/1992] However, according to Wired magazine, Brewer is appointed by EOUSA Director Laurence McWhorter, who had told a previous candidate for the position that he was “out to get Inslaw” (see Spring 1981). [Wired News, 3/1993] Brewer had originally been hired by the EOUSA in January. [US Congress, 9/10/1992] He once worked for Inslaw, but was allowed to resign when its founder William Hamilton found his performance inadequate (see 1976). [Wired News, 3/1993] Brewer will soon demonstrate his hostility to Inslaw, and the company will ask that he be replaced (see April 14, 1982, April 19, 1982, and Mid-April 1982).
Importance of Job - As the project manager, Brewer is involved in all major contract and technical decisions, including forming the department’s position on Inslaw’s claim that it should be paid for privately-funded enhancements it makes to PROMIS. Brewer also reports on progress on the contract to the department’s PROMIS Oversight Committee (see August 13, 1981 or Before).
Comment by Assistant Attorney General - Assistant Attorney General Lowell Jensen will later comment: “I would think that the better path of wisdom is not to do that [i.e. hire an allegedly fired employee to direct the contract of his former employer] if that’s possible to do. I think that it’s better to have these kinds of issues undertaken by people who don’t have questions raised about them one way or the other whether they are biased in favor of or against the people they deal with.” However, this thinking apparently does not impact the department’s decision to hire Brewer.
House Judiciary Committee Investigation - In the light of these circumstances, the House Judiciary Committee will call the appointment a “curious choice,” partly because Brewer tells it: “I was not a computer person. We talked about my role viewed as being liaison, the person who would make things happen, a coordinator. It was not contemplated that I would, by osmosis or otherwise, learn computer science.” After interviewing Justice Department staff, the committee will find that it is “unable to determine how Mr. Brewer came to be considered for the position.” The committee will also point out: “The potential conflict of interest was an unsatisfactory situation irrespective of his admittedly negative feelings about his forced resignation from the company. Had Mr. Brewer taken actions which could have been construed to unduly favor Inslaw throughout the life of the contract, similar questions of potential conflict could just as easily have arisen either from within the department or from outside competitors of the company.”
Findings of Government Accountability Office and Permanent Subcommittee on Investigations - The Government Accountability Office and Congress’s Permanent Subcommittee on Investigations (PSI) will find that Brewer’s appointment as project manager creates an appearance of a conflict of interest that should have been avoided by the department. The PSI report will say, “The staff finds that the department exercised poor judgment in ignoring the potential for a conflict of interest in its hiring of the PROMIS project director [Brewer], and then, after receiving allegations of bias on his part, in failing to follow standard procedures to investigate them in a timely manner.”
Courts' Opinions - During the legal proceedings that stem from a dispute between Inslaw and the department, two courts will comment on the issue. George Bason, of the Bankruptcy Court for the District of Columbia, will say, “On the basis of the evidence taken as a whole, this court is convinced beyond any doubt that Brewer was consumed by hatred for and an intense desire for revenge against Mr. Hamilton and Inslaw, and acted throughout this matter in a thoroughly biased and unfairly prejudicial manner toward Inslaw.” William Bryant, of the District Court for the District of Columbia, will add, “The nature and circumstances of his separation from that employment are somewhat in dispute, but it is clear that Brewer was not happy in his job when he left it after being urged to do so by Hamilton.”
Brewer's Motivation - Inslaw attorney Harvey Sherzer will comment in court on one of the motivations apparently driving Brewer: “[H]e seemed to think there was something wrong with a contractor benefiting from a government contract.… The gist of what he seemed to be saying was that by performing this contract Inslaw and Mr. Hamilton, specifically, was making an effort to expand the company. And there seemed to be a negative inference toward Inslaw’s ability to use the base created by this contract to expand.” [US Congress, 9/10/1992]
Office of Professional Responsibility Conclusion - On the contrary, the Justice Department’s Office of Professional Responsibility will examine the matter and rule there is no conflict of interest. Brewer will later tell a federal court that everything he does regarding Inslaw is approved by Jensen. Jensen had previously supervised a product known as DALITE, which lost a major contract to Inslaw in the 1970s. [Wired News, 3/1993]

In the second of two rulings in the case of Halkin v Helms, the judiciary comes down squarely on the side of the US government against charges of illegal surveillance and wiretapping leveled against American anti-war protesters. The district and appellate courts uphold the federal government’s “state secrets” claim as codified in US v Reynolds (see March 9, 1953), thereby denying the plaintiffs the right to see government information that they claim would prove their case. The DC Court of Appeals writes that the federal courts do not have any constitutional role as “continuing monitors of the wisdom and soundness of Executive action,” and instead the courts “should accord utmost deference to executive assertions of privilege on grounds of military or diplomatic secrets… courts need only be satisfied that there is a reasonable danger” that military secrets might be exposed. [Source: GifS (.com)]Three white supremacists living in the Elohim City, Oklahoma, compound (see 1973 and After) visit Oklahoma City and make plans to blow up the Murrah Federal Building there. The three are: James Ellison, the leader of the Covenant, Sword, and Arm of the Lord (CSA) who will be arrested in 1985 after a four-day standoff with federal authorities; Kerry Noble; and Richard Wayne Snell, who will be executed for murdering a black police officer and a businessman he erroneously believed to be Jewish (see 9:00 p.m. April 19, 1995). All three men have close ties to the neo-Nazi Aryan Nations (see Early 1970s). The evidence of their plan is released during the investigation of the 1995 Oklahoma City bombing (see 8:35 a.m. - 9:02 a.m. April 19, 1995), and is collated by former US prosecutor Steven N. Snyder, who once worked out of the Fort Smith, Arkansas District Attorney’s office. The plan involves parking a van or trailer in front of the building and exploding it with rockets detonated by a timer. Snyder will come across the information on the bombing plot while preparing for the trial of a sedition case against a 14-man group of white supremacists, 10 of whom are charged with planning to overthrow the government. (All 14 will be acquitted in a 1988 trial—see Late 1987 - April 8, 1998.) Snyder will get the information from Ellison, who provides information to him as part of his role as chief witness for the prosecution. The other defendants in the trial, many of whom are believed to have had some connection to the bombing plot, will be Richard Butler, the head of Aryan Nations; Robert E. Miles, a former Klansman who heads the Mountain Church of Jesus Christ the Saviour in Cohoctah, Michigan; and Louis R. Beam Jr., a former grand dragon of the Texas Ku Klux Klan and “ambassador at large” of the Aryan Nations. Ellison will tell Snyder that in July 1983, he attends a meeting of extremist groups in Hayden Lake, Idaho, the location of the Aryan Nations headquarters, where he informs them of the death of fellow white supremacist Gordon Kahl in a gun battle with law enforcement agents in Arkansas (see March 13 - June 3, 1983). Snyder’s notes of Ellison’s statement read, “Kahl was the catalyst that made everyone come forth and change the organizations from thinkers to doers.” According to Ellison, the leaders of the various supremacist groups discuss how to overthrow the federal government, using as a sourcebook the novel The Turner Diaries (see 1978), which tells of a successful move by white supremacists to overthrow the government and then commit genocide against Jews and blacks. Ellison will tell Snyder that he volunteers to assassinate federal officials in Arkansas as part of the plot. The leaders discuss blowing up the Murrah Building in Oklahoma City, other federal buildings, and the Dallas office of a Jewish organization. According to Ellison’s trial testimony, in October 1983 Snell and another participant, Steve Scott, “asked me to design a rocket launcher that could be used to destroy these buildings from a distance.” Of Snell, Ellison will testify: “On one of the trips when I was with Wayne, he took me to some of the buildings and asked me to go in the building and check the building out. This kind of thing.” Ellison will tell Snyder that at Snell’s request, he surveills the Murrah Building to assess what it would take to damage and destroy it. He makes preliminary sketches and drawings. According to the preliminary plans, rocket launchers are to be “placed in a trailer or a van so that it could be driven up to a given spot, parked there, and a timed detonating device could be triggered so that the driver could walk away and leave the vehicle set in position, and he would have time to clear the area before any of the rockets launched.… And I was asked to make it so it would fit in either a trailer or a van or a panel truck.” Synder will later say that Snell is embittered towards the government because of the IRS, which took him to court and seized property from him for failure to pay taxes. But, Snyder will add, “you can’t be sure about any of this, because a federal raid, to a lot of these people, is any time the postman brings the mail.” Ellison will be taken into custody after a four-day standoff with state and federal authorities in 1985, only convinced to surrender after white supremacist Robert Millar talks him into giving up (see 1973 and After). Ellison will be convicted of racketeering charges and sentenced to 20 years in prison. He will enter the federal witness protection program until completing his parole and leaving the program on April 21, 1995, two days after the Oklahoma City bombing. US Army Warrant Officer Robert Rendon, a convicted drug dealer and admitted black-marketer, is assigned to the ultra-secretive Continuity of Government (COG) program, which is designed to keep the federal government functioning in times of disaster. Rendon, who first enlisted in the Army in 1977, is hired despite telling Army officers involved with the secret program that he had been convicted of selling drugs to schoolchildren in Los Angeles in the 1970s and served about 15 months in prison. Rendon also tells Army officers that he ran a black market operation while stationed as an intelligence officer for two years in West Germany. He says he financed the black market operation with funds given to him for espionage assignments by the Army’s Intelligence and Security Command (INSCOM). Rendon says INSCOM case officers taught him how to conceal his past under questioning. He also admits to using drugs and soliciting prostitutes while serving as an Army officer. The Army promises not to expose Rendon’s past beyond the COG program and grants him one of the government’s highest security clearances. Rendon will be stationed at Fort Huachuca, Arizona, and will spearhead a campaign to discredit whistleblowers that attempt to expose corruption within the COG project, most notably Army intelligence veteran Tom Golden (see After July 1987). Rendon will serve in the secret program until 1989 and later join an Army counterespionage unit (see December 1990). [Philadelphia Inquirer, 12/16/1990]
The DC Court of Appeals rejects a claim by civilian plaintiffs to force the government to disclose classified information as part of a lawsuit, citing the “state secrets” privilege (see March 9, 1953). Furthermore, the court broadens the definition of “state secrets” to include “disclosure of intelligence-gathering methods or capabilities and disruption of diplomatic relations.” [Siegel, 2008, pp. 197]
A company called SCT attempts to purchase Inslaw, which designed the PROMIS database and search application. SCT is assisted by the New York investment bank Allen & Co., which helps with the finance for the proposed deal. The attempt fails, but, according to Inslaw’s founder William Hamilton, in the process a number of Inslaw’s customers are warned by SCT that Inslaw will soon go bankrupt and will not survive reorganization. Wired magazine will say that Allen & Co. has “close business ties” to Earl Brian, a businessman who is said to be interested in PROMIS software and who is well-connected inside the Ronald Reagan administration. Systems Evaluations Incorporated, a company recently founded by Fred Westerman, a newly retired 20-year Army intelligence veteran, is contracted by the Army Corps of Engineers to help set up secret storage facilities in five states for the ultra-secretive Continuity of Government program. The Federal Emergency Management Agency (FEMA) and the clandestine National Program Office (see (1982 -1991)) will operate the facilities and oversee their construction. Within a year, Westerman will begin to report to government officials instances of waste, fraud, and abuse within the program (see 1986-1987). His job will be threatened in November 1987 (see November 1987) and his contract will be canceled in December of that year (see December 1987). Westerman will file a lawsuit against the government alleging FEMA burglarized Systems Evaluations’ offices in late 1987 (see Late 1987) and that the government launched a surveillance campaign against him (see November 1988). The lawsuit will be frozen when the Justice Department opens an investigation of Westerman (see November 1988) and the suit will later be sealed after an in-depth report highlighting Westerman’s case is published by a major magazine (see August 8, 1989). Westerman will lose another contract, along with his security clearances, in 1990 (see 1990), and by November 1991, he will be unemployable, several hundred thousand dollars in debt, and unable to gain any restitution from the government (see November 1991). Neoconservative author and likely Israeli spy Michael Ledeen (see April 9, 1985), a consultant for the National Security Council (see Late 1984), has his security clearance downgraded by the Department of Defense. Ledeen formerly held “Top Secret-SCI” clearance; he now holds only “Secret” clearance. [CounterPunch, 2/28/2004]
Defense Department official Noel Koch arranges to discuss a matter of potential espionage with the FBI. Koch is worried that his former aide, neoconservative Michael Ledeen, has access to highly classified information in his role as a National Security Council consultant (see Late 1984 and May 3, 1985). Koch feels that Ledeen had possibly given classified information to Israel during his tenure at the Defense Department (see 1983). Koch is debriefed for two hours by FBI investigators, who tell him that they are only worried about possible Soviet espionage. Koch wonders at this, considering that Naval intelligence analyst Jonathan Pollard had been arrested just months before and charged with espionage on behalf of Israel. A frustrated Koch writes up his knowledge of Ledeen’s actions at the Defense Department and sends the report to Senator Charles Grassley (R-IA), a member of the Senate Intelligence Committee. Nothing concrete comes from Koch’s attempts to alert the FBI and Congress to potential espionage by Ledeen. [CounterPunch, 2/28/2004]
Fred Westerman, a retired Army intelligence veteran who now heads a government contracted security firm, reports several instances of waste, fraud, and abuse within the highly secretive Continuity of Government (COG) program, which is supposed to ensure the survival of the federal government during disaster situations. Westerman’s company, Systems Evaluations Incorporated, was hired by the Army Corps of Engineers in 1985 to set up secret COG storage facilities around the country for the Federal Emergency Management Agency (FEMA) and the clandestine National Program Office (see 1985). Within a year, however, Westerman becomes disturbed by problems he notices within the secret COG program. He alerts officials that engine parts are falling off emergency vehicles at several secret sites. He reports that security systems and alarms at secure government facilities are faulty. He says doors and locks at the secret locations are weak and flimsy. He says his workers have been exposed to toxic chemicals from leaking containers at multiple government installations. Westerman reports that at one location water has seeped onto high-voltage electrical lines. He also becomes concerned about payments being made to companies for inadequate work. Westerman is repeatedly pressured by superiors not to complain about the problems, but nonetheless brings his complaints to the FBI, the Justice Department, and the inspector general’s office within FEMA. Westerman’s job will be threatened after he refuses to hand over corporate documents to a competitor (see November 1987). FEMA officials will allegedly burglarize Westerman’s office in search of the documents in late 1987 (see Late 1987). System Evaluation’s contract with the government will be canceled in December 1987 (see December 1987) and Westerman will later file a lawsuit against the government seeking reimbursement (see November 1988). National Security Council official Oliver North tells National Security Adviser John Poindexter that his consultant, neoconservative Michael Ledeen, is no longer trustworthy. Ledeen has long been suspected of operating as a spy for Israel (see April 9, 1985 and August 20, 1985). North tells Poindexter that “for [the] security of the Iran initiative,” Ledeen should be asked to take periodic polygraph examinations. [CounterPunch, 2/28/2004]

Inslaw files a complaint for a declaratory judgment, the enforcement of automatic stay bankruptcy protection provisions, and damages against the Justice Department in the dispute over the department’s alleged theft of enhanced PROMIS software. The automatic stay is one of the fundamental debtor protections provided by bankruptcy laws. It stops all collection efforts, harassments, and foreclosure actions, giving the debtor temporary relief from creditors. It is important because it allows a bankruptcy court to centralize all disputes concerning property of the debtor’s estate so that reorganization can proceed orderly and efficiently. [US Congress, 9/10/1992] Inslaw’s attorney for the case, Leigh Ratiner of the Washington firm Dickstein, Shapiro & Morin, chooses the bankruptcy court for the filing based on the premise that the Justice Department, as the creditor, has control of enhanced PROMIS. He will later say: “It was forbidden by the Bankruptcy Act for the creditor to exercise control over the debtor property. And that theory—that the Justice Department was exercising control—was the basis that the bankruptcy court had jurisdiction. As far as I know, this was the first time this theory had been used. This was ground-breaking.” [Wired News, 3/1993] Inslaw claims that Justice Department manager C. Madison Brewer, who was responsible for implementing PROMIS in the department, was instrumental in propelling Inslaw into bankruptcy (see April 1982, April 14, 1982, and April 19, 1982), and that he then hindered Inslaw in its development of a reorganization plan. Inslaw also alleges that its concerns were made known to the highest levels of Justice Department’s management, without any response. [US Congress, 9/10/1992]
Dave Frasca, who will later go on to play a key role in the FBI’s failure to get a warrant to search Zacarias Moussaoui’s belongings before 9/11 (see August 21, 2001 and August 29, 2001), joins the FBI. Frasca initially works at the bureau’s Newark, New Jersey, field office. It is unclear what cases he works on in the first three years of his employment, but they are not related to counterterrorism. Testimony in the Iran-Contra investigations turns to the possibility that NSC aide Michael Ledeen may have profited from the US sales of arms to Iran through Israel (see January 24, 1986). Ledeen’s former supervisor at the Department of Defense, Noel Koch, who has long suspected Ledeen of spying for Israel (see 1983 and 1986), says that he first became suspicious of Ledeen when he learned that the price Ledeen had negotiated for the sale to the Israeli government of basic TOW missiles was $2,500 each. Koch found that no TOW missile had ever been sold to any foreign government for less than $6,800 per unit. Under orders from his superiors in the department, Koch renegotiated the deal with an Israeli official, eventually raising the price to $4,500 per missile, almost twice what Ledeen had “negotiated” in Israel. Author Stephen Green, who will write two books on US-Israeli relations, will comment, “There are two possibilities here—one would be a kickback, as suspected by his NSC colleagues, and the other would be that Michael Ledeen was effectively negotiating for Israel, not the US.” [CounterPunch, 2/28/2004]
The Office of Professional Responsibility (OPR), an oversight component at the Justice Department, begins an investigation into allegations made by the software company Inslaw against some Justice Department staff. The OPR had conducted a preliminary investigation the previous year (see 1986), concluding the officials were not biased against the company. However, after a bankruptcy court finds serious wrongdoing by departmental officials (see September 28, 1987), Deputy Attorney General Arnold Burns asks for “a complete and thorough investigation into the allegation of bias and misconduct by various Justice Department officials against Inslaw.” The full investigation will again conclude that the officials were not biased against Inslaw (see March 31, 1989). The software company Inslaw submits allegations about the Justice Department’s conduct in the dispute over the enhanced PROMIS application to the Public Integrity Section (PIS), a departmental oversight component. The allegations follow on from the findings of a bankruptcy court favourable to Inslaw (see September 28, 1987 and January 25, 1988). In the complaint, Inslaw charges the department with:
Procurement fraud. Inslaw claims that Attorney General Edwin Meese and former Deputy Attorney General Lowell Jensen schemed to ensure that enhancements made to the PROMIS software by Inslaw would be obtained for free by the department, which would then make them available to a businessman named Earl Brian;
Violation of automatic stay debtor protection provisions invoked by the bankruptcy court. Inslaw says that by using the enhancements it made to the software after the bankruptcy case was filed, the department violated federal bankruptcy law. The bankruptcy court found that the department committed such violation, an act that could constitute an obstruction of the bankruptcy proceedings; and
Attempts to change Inslaw’s Chapter 11 bankruptcy, for the company’s reorganization, into a Chapter 7 bankruptcy, for the company’s liquidation. Inslaw says that the department unsuccessfully attempted to have an official named Harry Jones detailed from the US Trustee’s office in New York to Washington to take over the Inslaw bankruptcy to get Inslaw liquidated. Inslaw also says unsuccessful pressure was exerted by departmental official Thomas Stanton on US Trustee William White to convert the bankruptcy case into a Chapter 7 liquidation.
The PIS says it will examine some of the allegations, but in the end it will not open a formal preliminary investigation (see February 29, 1988). [US Congress, 9/10/1992]
The Public Integrity Section (PIS), a Justice Department oversight component, decides not to open a preliminary investigation of the Inslaw affair over the department’s alleged misappropriation of PROMIS software (see February 1988). The decision is communicated in a memo drafted by William F. Weld, the assistant attorney general for the department’s criminal division, of which the PIS is a part. The PIS finds that at least some of the people Inslaw complains about, including Attorney General Edwin Meese, former Deputy Attorney General Lowell Jensen, and Deputy Attorney General Arnold Burns, are appropriate targets of an investigation and that Inslaw is generally a credible source for allegations. However, according to Weld, the information Inslaw provides is not specific enough to constitute grounds to begin a preliminary investigation of the need for an independent counsel. This is because the PIS regards the facts Inslaw presented as unsupported speculation that the officials were involved in a scheme to get the enhanced PROMIS software. Therefore, the review should be closed “due to lack of evidence of criminality.” The House Judiciary Committee will be critical of the PIS’s finding, calling its investigation “shallow and incomplete,” and saying the department appeared to be “more interested in constructing legal defenses for its managerial actions rather than investigating claims of wrongdoing which, if proved, could undermine or weaken its litigating posture.” [US Congress, 9/10/1992]
Dr. Stephen Bryen, a neoconservative serving in the Defense Department who dodged espionage charges a decade before (see March 1978 and April 1979), helps Israel obtain secret US weapons information. Israel is in the final stages of building its “Arrow” anti-ballistic missile. It does not have “klystrons,” small microwave amplifiers needed for the missile’s target acquisition system to function. Klystrons are among the most secret of American weapons research products. Bryen is the director of the Pentagon’s Defense Technology Security Administration (DTSA), which itself is contained within the Pentagon’s Office of International Security Policy, headed by fellow neoconservative Richard Perle. Bryen attempts to secure the authority to allow four klystrons to be exported to Israel via Varian Associates, a private defense manufacturing firm, without consulting with tech transfer officials from the Army, the Air Force, or other agencies. Navy tech transfer official Richard Levine refuses the request, and holds a meeting with officials from the above agencies. All the officials agree that the transfer should not be approved. Bryen responds by suggesting that he go back to the Israelis to ask why they needed the klystrons. After the Israelis provide what one Defense Department official later calls “a little bullsh_t answer,” Bryen tells the participants that he had received an acceptable response. Varien is granted a license, he says, and the klystrons will be sent to Israel. The license is withdrawn after Assistant Secretary of Defense for International Security Affairs, Richard Armitage, objects to Bryen’s maneuvering. Two senior Defense Department officials later say that the attempt to provide Israel with classified weapons materials is “standard operating procedure” for Bryen, who has often ignored Defense and State Department refusals to provide sensitive information and materials to Israel. Later in the year, Bryen will leave the government and work as a consultant for a number of defense technology firms. [CounterPunch, 2/28/2004]
US Representative Lester Aspin (D-WI), chairman of the House Armed Services Committee, sends a letter to Army Secretary John Marsh criticizing the Army Inspector General’s Office for failing to keep the identity of a key whistleblower confidential and for botching an investigation into corruption within the highly secretive Continuity of Government (COG) program (see Summer 1987). The House Armed Services Committee is currently investigating the case of Army intelligence officer Tom Golden, who was retaliated against after revealing to Army investigators several instances of waste, fraud, and abuse within the COG unit stationed at Fort Hauchuca, Arizona (see July 1987 and After July 1987). Aspin expresses “concern about the objectivity and competence of the investigation,” noting that “confidentiality was breached almost immediately by the head of the inspector general inspection team,” referring to Colonel Ned Bacheldor, formally the chief of the inspector general’s intelligence oversight division, who spoke with Golden personally and later leaked his identity to the very officers Golden had implicated. Bacheldor left the inspector general’s office midway through the investigation of Golden’s case to join the COG unit at Fort Hauchuca. Aspin’s committee will conclude that Golden is the victim of a retaliatory smear campign led in part by Bacheldor. The Army Inspector General’s Office has reached a similar conclusion (see Summer 1987), as will the Justice Department (see January-November 1990), but the effort to discredit Golden will continue (see August 1990). James Nichols, a Michigan farmer, anti-government white separatist, and the brother of Terry Nichols (see March 24, 1988 - Late 1990), formulates a plan to use a “megabomb” to destroy an Oklahoma City federal building; an unnamed FBI informant will later tell the FBI that James Nichols specifically indicates the Murrah Federal Building. Nichols, who says he is upset over the US’s “role” in the terrorist bombing of Pan Am Flight 103, shares the plan with the informant, who will swear to the information in 1995, after James’s brother Terry Nichols is arrested for helping destroy the Murrah Building (see 8:35 a.m. - 9:02 a.m. April 19, 1995). “[James] Nichols… made a specific reference to a federal building in Oklahoma City and began looking through the toolshed and workbench for a newspaper clipping depicting the Oklahoma City building,” the informant will say, according to an FBI affidavit. Nichols is unable to find the newspaper clipping, the informant will say, and instead draws a diagram remarkably similar to the Murrah Building. Nichols “later located a newspaper article containing a reference to the Federal Building in Oklahoma City and showed it” to the informer, the affidavit says. The informer is a regular visitor to the Nichols farm. [New York Times, 6/13/1995; Nicole Nichols, 2003] James Nichols routinely stamps US currency with red ink in a protest against the government, and calls his neighbors “sheeple” for obeying authority “like livestock.” A neighbor, Dan Stomber, will recall Nichols criticizing him and others for using drivers’ licences and Social Security cards, and for voting and paying taxes. “He said we were all puppets and sheeple,” Stomber will tell a reporter. “That was the first time I ever heard that word.” Stomber will not recall Nichols discussing any plans to bomb any federal buildings. [New York Times, 4/24/1995] After the Oklahoma City bombing, a friend of Nichols, an Indiana seed dealer named Dave Shafer, will tell authorities that Nichols showed him a diagram of a building remarkably similar to the Murrah Building, still under construction at the time, and said that building would be an excellent target. Shafer will say that he thought Nichols was joking. [Serrano, 1998, pp. 110] It is possible that Shafer and the unnamed FBI informant are the same person. Five years ago, a group of white supremacists had conceived of a plan to destroy the Murrah Building (see 1983).
Erwin Griswold. [Source: US Department of Justice]Former Solicitor General Erwin Griswold, who represented the United States before the Supreme Court in the landmark Pentagon Papers case in 1971 (see March 1971 and June 30, 1971), now writes that he saw nothing in those documents that threatened national security. In 1971, without ever actually reading the documents, Griswold argued that their publication constituted a “grave and immediate danger to the security of the United States.” Griswold writes in a Washington Post op-ed that he relied on the judgment of “three high officials, one each from the Defense Department, the State Department and the National Security Agency” to explain to him why the documents posed such a threat. (In 2006, then-White House counsel John Dean will write that Griswold “did not insist on knowing what was actually contained in the Pentagon Papers, and he never found out, even as he insisted on the importance of their continued secrecy.”) In 1971, Griswold told the Court: “I haven’t the slightest doubt myself that the material which has already been published and the publication of the other materials affects American lives and is a thoroughly serious matter. I think to say that it can only be enjoined if there will be a war tomorrow morning, when there is a war now going on, is much too narrow.” Griswold now writes: “I have never seen any trace of a threat to the national security from the publication [of the documents]. Indeed, I have never seen it even suggested that there was such an actual threat.… It quickly becomes apparent to any person who has considerable experience with classified material that there is massive overclassification and that the principal concern of the classifiers is not with national security, but rather with governmental embarrassment of one sort or another.” [Washington Post, 2/15/1989; FindLaw, 6/16/2006; Siegel, 2008, pp. 200]
Kosovo’s Assembly, in a highly irregular vote on March 23, approves the new Serbian constitution, already approved by the Assembly of the Republic of Serbia on February 3. The Kosovo vote does not meet the three-fourths majority necessary for amendments and is not held with a quorum, people from Belgrade and security personnel vote, and the votes are not actually counted. Assembly members are threatened if they vote no. The vote occurs under “a state of exception,” with disorder in the province and mobilization of the military.
Kosovo's Position under the New Serbian Constitution - Under the new Serbian constitution, the province is again called Kosovo and Metohija, and the autonomous provinces are defined as “a form of territorial autonomy,” regulated by the Serbian constitution. The 1968, 1971, and 1974 constitutional changes opposed by Serbs are nullified and Kosovo is in about the same position as it was under the 1945 and 1963 Yugoslav constitutions. The province loses its Executive Council and Assembly, and autonomy in police, courts, finance, and planning. Kosovo can pass statutes with the approval of Serbia’s Assembly.
Kosovar Demonstrations - Following the vote, hundreds of thousands protest, saying, “Long live the 1974 Constitution!” and “Tito-Party!” resulting in the declaration of martial law. Twenty-four civilians and two police are killed, but Paulin Kola will later put the number at over 100 killed and hundreds injured, while Miranda Vickers will say 28 are killed. Kola will refer to The Times’s March 31 issue, saying 12 police are critically injured and 112 less seriously injured on March 23; Radio Ljubljana says 140 Albanians are killed and 370 wounded through April; Albanian academic Rexhep Qosja will say in 1995 that 37 are killed, hundreds injured, and 245 intellectuals and 13 leaders arrested; The Times of June 2 says 900 are arrested, and on April 22 the Union of Kossovars writes to UN Secretary General Javier Peres de Cuellar, saying over 1,000 were killed and thousands hurt. More than 1,000 are tried in Ferizaj, according to a 1998 book by Noel Malcolm. Kosovo is again placed under a state of emergency. Workers who do not work are fired or arrested.
Slovenian Reaction - About 450,000 Slovenians sign a petition supporting their government’s views and opposing the crackdown in Kosovo.
Serbian Reaction - Hearing of the Slovenian petition, over 100,000 demonstrate the following day around Serbia, Vojvodina, Skopje, and Titograd.
Albania's Reaction - Albania’s relations with Yugoslavia had been deepening in the late 1980s, but Albania reacts more strongly to the March events. Foto Cami condemns Yugoslavia’s “erroneous policies” on the ethnic Albanians and says it will damage regional cooperation. Protests follow throughout Albania. Yugoslavia blames Albania for the violence in Kosovo. Ramiz Alia, now general secretary of the PLA, will say at a Political Bureau session in August 1990 that Western governments told Kosovar Albanians that to solve the problems in Kosovo, Albania had to change its government.
Soviet Reaction - Soviet media support the Serbs and refer to violence by Albanian nationalists, while saying that the majority in Kosovo and Vojvodina support the new Serbian constitution.
Western European Reactions - The UK says nothing. Although Yugoslavia’s Foreign Minister, Budimir Loncar, meets with British Prime Minister Margaret Thatcher in April, the contents of their talks are unknown to the public. Three years in the future a high-ranking official in Germany will regret this inaction.
American Reaction to the Turmoil in Kosovo - On March 9, three US senators proposed Senate Concurrent Resolution 20—Relating to the Conditions of Ethnic Albanians in Yugoslavia, which was passed prior to March 23. US policy supports Kosova’s position under the 1974 Constitution and the resolution asked President George H. W. Bush to reiterate this to the Yugoslav leadership. The Senate Foreign Relations Committee conducted a hearing on March 15. [Vickers, 1998, pp. 234-238; Kola, 2003, pp. 180-184, 190]

Elliot Richardson, an attorney acting for the software company Inslaw, writes to Attorney General Richard Thornburgh about the dispute with the Justice Department over the department’s alleged misappropriation of enhanced PROMIS software. Richardson complains about a review of the case by the Public Integrity Section (PIS), an oversight component at the department, which came down against Inslaw’s claims (see February 29, 1988). He says that there is a conflict of interest because the department is defending itself against a civil action by Inslaw while at the same time investigating itself over the allegations that form the basis of the action. If the internal investigation found wrongdoing by the department, this would destroy the department’s case in court. His view is that the department has given priority to defending itself against the civil action, not the criminal investigation of its own wrongdoing. Richardson adds that no one from the PIS has contacted him, Inslaw counsel Charles Work, some of the witnesses in the case, or Inslaw’s owners. Despite this, the owners provided the PIS with the names of 30 people who had information relevant to the investigation in December 1988. Therefore, Richardson concludes that the only solution is for the department to appoint an independent counsel. [US Congress, 9/10/1992]
A US District Court rules that Attorney General Richard Thornburgh does not have to appoint a special prosecutor in the Inslaw affair. Inslaw’s attorney Elliot Richardson had filed the case because of a dispute with the Justice Department over allegations that the department had stolen a version of the PROMIS database and search application from the company. However, the court rules against Inslaw, stating that a prosecutor’s decision not to investigate—“no matter how indefensible”—cannot be corrected by any court. [Wired News, 3/1993]
Author Richard Kelly Hoskins, in his book Vigilantes of Christiandom, puts forth the concept of the “Phineas Priesthood.” Hoskins is a Christian Identity adherent (see 1960s and After). The idea comes from an obscure Biblical character, “Phinehas,” an Israelite who used a spear to kill a “race-mixing” fellow Israelite and the Midianite woman with whom he had had sexual relations. Hoskins concocts the idea of a “brotherhood” of “Phineas Priests,” self-professed “warriors” who would use extreme violence against “race-mixers,” gays, abortionists, and others. Over time, some “Phineas Priests” will commit bombings and bank robberies around Spokane, Washington (see October 8, 1996). In 2002, two Aryan Nations (see Early 1970s) splinter groups will openly adopt “Phineas Priest” names or symbols. [Anti-Defamation League, 2005]
Dave Frasca, who will later go on to play a key role in the FBI’s failure to get a warrant to search Zacarias Moussaoui’s belongings before 9/11 (see August 21, 2001 and August 29, 2001), starts to work on counterterrorism issues at the FBI’s Newark, New Jersey, field office. Frasca joined the FBI three years previously (see 1987), but has worked on other, unknown issues before this. [US Department of Justice, 11/2004, pp. 123 ]
As part of its ongoing battle against drug trafficking, the US routinely monitors the phone records of thousands of US citizens and others inside the country who make phone calls to Latin America. The NSA works with the Drug Enforcement Agency in collecting phone records that show patterns of calls between the US, Latin America, and other drug-producing regions. The program is significantly expanded after George W. Bush takes office in 2001. Government officials will say in 2007 that the phone conversations themselves are not monitored, but the NSA and DEA use phone numbers and e-mail addresses to analyze possible links between US citizens and foreign nationals. The program is approved by Justice Department officials in both the Bush and Clinton administrations, and does not require court approval to demand communications records. In 2004, one US telecommunications firm, who is not identified, will refuse to turn over its phone records to the government (see 2004). [New York Times, 12/16/2007] The Bush administration will repeatedly claim that the government did not begin monitoring US citizens until after the attacks of September 11, 2001. However, this NSA/DEA program proves otherwise.
At the end of January, ethnic Albanians demonstrate in favor of Kosovar communist party leader Rahman Morina. This follows Morina’s refusal to meet with the Free Students, a new group calling for political reforms, the suspension of political trials, and the release of political prisoners. The protesters in January are joined by workers, and tens of thousands protest for the end of the state of emergency, for civil liberties, open elections, and for the freedom of a group of arrested miners and Azem Vllasi, who has been on trial in fits and starts since October in a courthouse ringed by tanks and off limits to diplomats and observers. Demonstrators assault trains, buses, and cars before being attacked by Serbian police, leading to more demonstrations. Academic Paulin Kola will say that 27 protesters and one officer are killed, and over 100 are wounded in all, while author Miranda Vickers will say 31 demonstrators die. The Yugoslav military intervenes and a curfew is declared in late February. However, in mid-April Serbia’s ministry of the interior takes control of Kosovo’s police, and then the Yugoslav presidency ends the emergency and curfew, and releases 108 prisoners, including the miners, Vllasi, and Adem Demaci. Demaci is a popular figure among Kosovar Albanians and advocates non-violent means. Albanian police officers are replaced by 2,500 Serbian police. [Vickers, 1998, pp. 241-243; Kola, 2003, pp. 185-186]
A lawsuit against the FBI’s investigation of a sixth-grade boy and his school project to create an “encyclopedia of the world” is stopped when an appeals court rules that the agency is shielded by the “state secrets” privilege (see March 9, 1953). Unable to secure information from the FBI as to why it investigated him, the child had therefore “failed to sustain his burden of proof [and] the cause of action was properly dismissed.” [Siegel, 2008, pp. 197]
Rick Rescorla, a security chief for a company at the World Trade Center, and Dan Hill, a former Army colleague of his, write a report in which they warn that terrorists could attack the WTC by detonating a truck filled with explosives in the underground parking garage, but the Port Authority, which manages the WTC, dismisses their warning. Rescorla, who previously served in the US Army, is now working as the director of security at brokerage firm Dean Witter, and his office is on the 44th floor of the WTC’s South Tower. [Stewart, 2002, pp. 173-177; New Yorker, 2/11/2002]
Former Army Ranger Agrees to Identify WTC Vulnerabilities - Rescorla has become increasingly concerned about the possibility of a terrorist attack in the United States, especially after Pan Am Flight 103 was blown up by a terrorist bomb over Scotland in December 1988, and he thinks the WTC is “an obvious target.” He therefore asks his friend Hill to join him in New York and be his consultant. [Stewart, 2002, pp. 173] Hill, a former Army Ranger, has been trained in counterterrorism, unconventional warfare, demolition, and the use of explosives. [Stewart, 2002, pp. 152-153] “If anyone can figure out how to hurt this building, you can,” Rescorla tells him, and adds, “I want to know the worst.” Hill agrees to help Rescorla. After he arrives in New York, Rescorla takes him to the WTC. Rescorla explains the basic engineering of the Twin Towers and suggests they examine the buildings, starting at the bottom and then working up.
Parking Area Has No Visible Security - The two men begin by walking around the entire 16-acre WTC complex. Hill then asks Rescorla where the loading and docking operations are, and Rescorla takes him to a ramp that goes to the basement levels of the WTC. After they walk down the ramp, past a loading dock, and into a parking area, Hill asks, “Where are the guards?” Rescorla replies, “There are no guards.” Hill then notices that all the major columns and supporting beams in the parking area are visible and exposed.
Hill Thinks Parking Area Is a 'Soft Touch' - After thinking for a few minutes, Hill says: “Hell, Rick. This is a soft touch. It’s not even a challenge.” He then explains to Rescorla how he would attack the WTC if he was a terrorist. According to journalist and author James B. Stewart, Hill says he would “bring in a stolen truck, painted like a delivery truck. He’d fill it with a mixture of ammonium nitrate and diesel fuel, then drive down the ramp and park. With four or five men dressed in coveralls, he could plant additional charges near key supporting pillars within 15 minutes. Then he and the men would walk out and disperse, and he’d remove his coveralls.” He would then take a taxi to another location, where he would have a van waiting with a woman, two children, and possibly a dog inside. He would use a cell phone or a beeper to detonate the truck bomb and then make his getaway. “Nobody’s going to stop a family and a dog on Interstate 95,” Hill tells Rescorla.
Port Authority Dismisses Rescorla's Concerns - Later on, the two men analyze Hill’s findings and incorporate them into a report for the Port Authority of New York and New Jersey, which manages the WTC buildings. The following day, Rescorla meets with some Port Authority officials and notifies them of his and Hill’s concerns, but they are uninterested. Rescorla later tells Hill that the officials’ response was to say, “You worry about your floors and we’ll worry about the rest, including the basements and parking.” All the same, Rescorla sends copies of his and Hill’s report to the Port Authority and also the New York City Police Department, but he receives no responses. Rescorla and Hill are unaware that the Port Authority’s Office of Special Planning submitted a report in 1985 that warned of a bombing at the WTC of a similar kind to what they have envisioned, and also emphasized the vulnerability of the basement levels (see November 1985). However, no steps were taken to increase security at the WTC in response to that report. [Stewart, 2002, pp. 173-177] In February 1993, terrorists will attack the WTC in almost exactly the way that Hill predicts, by parking a van containing a 1,500-pound urea nitrate bomb in the basement and detonating it with a timer (see February 26, 1993). [Parachini, 2000, pp. 190-191 ]
Former Attorney General Edwin Meese is interviewed by the House Judiciary Committee about the Inslaw affair. He says that he cannot recall any discussions with former Justice Department official Lowell Jensen about office automation or case tracking at the department. He adds that if there were such a discussion, it would have been casual conversation. [US Congress, 9/10/1992] However, Jensen previously said he discussed the “whole Inslaw matter” with Meese (see June 19, 1987).
A Web graphic opposing the ‘New World Order.’ [Source: Human Symbiose (.org)]In a speech discussing the post-Cold War world, President Bush outlines his vision of a “New World Order.” Bush says: “We stand today at a unique and extraordinary moment. The crisis in the Persian Gulf, as grave as it is, also offers a rare opportunity to move toward an historic period of cooperation. Out of these troubled times, our fifth objective—a new world order—can emerge: a new era—freer from the threat of terror, stronger in the pursuit of justice, and more secure in the quest for peace.” The Southern Poverty Law Center will later write that many people, particularly white supremacists and separatists, take Bush’s phrase “as a slip of the tongue revealing secret plans to create a one-world government.” [Sweet Liberty, 9/11/1990; Southern Poverty Law Center, 6/2001] In 1995, Michigan gun dealer and right-wing activist Frank Kieltyka will describe the “New World Order” to a Buffalo News reporter. According to Kieltyka, the “New World Order” is backed by the US government and led by, among other organizations, the Trilateral Commission and the Council on Foreign Relations (CFR). “We’re moving towards the Communists,” Kieltyka will warn. The belief in this “New World Order” will be emphasized in coming years in the militia movements and by right-wing publications such as The Spotlight, an openly racist, anti-government newsletter. [Stickney, 1996, pp. 157-158]
Army intelligence officer Robert Rendon, a convicted drug dealer and admitted black-marketer (see July 28, 1983) who led a retaliatory smear campaign against whistleblower Tom Golden (see After July 1987 and August 1990), is still working a highly sensitive counterespionage post in a unit known as the Foreign Counterintelligence Activity. As recently as August 1990, Rendon was spreading false rumors within the counterintelligence unit about veteran officer Tom Golden, who exposed corruption within the ultra-clandestine Continuity of Government program (see July 1987), of which Rendon was once a part. “It is amazing to me that the man has the position he does,” says one Army intelligence officer familiar with Rendon’s background. [Philadelphia Inquirer, 12/16/1990; Knight Ridder, 12/18/1990]
The CIA says that it does not have the PROMIS database and search application (see Mid-1970s). The statement is made in response to a letter sent to CIA Director William Webster by the House Judiciary Committee on November 20 asking him to help them “by determining whether the CIA has the PROMIS software.” In response the CIA states, “We have checked with Agency components that track data processing procurement or that would be likely users of PROMIS, and we have been unable to find any indication that the [CIA] ever obtained PROMIS software.” However, information contradicting this will subsequently emerge. For example, a retired CIA official whose job it is to investigate the Inslaw allegations internally will tell Wired magazine that the Justice Department gave PROMIS to the CIA: “Well, the Congressional committees were after us to look into allegations that somehow the agency had been culpable of what would have been, in essence, taking advantage of, like stealing, the technology [PROMIS]. We looked into it and there was enough to it, the agency had been involved.” However, the official will say that when the CIA accepted PROMIS, it did not know that there was a serious dispute about the Justice Department’s ownership of the software. [Wired News, 3/1993]
Time magazine reports in 1994, “During the Gulf War, uniformed air-defense teams could be seen patrolling the top floor [of the White House] with automatic rifles or shoulder-mounted ground-to-air missiles.” [Time, 9/26/1994] While a battery of surface-to-air-missiles remains permanently on the roof of the White House, the rest of these defenses are apparently removed after the war is over. [Daily Telegraph, 9/16/2001] Yet even though counterterrorism officials later call the alerts in the summer of 2001 “the most urgent in decades,” similar defensive measures will apparently not be taken. [US Congress, 9/18/2002]
In 1991, there is a surge in the number of US soldiers adhering to Islam, due to a conversion program sponsored by the Saudi government (see March-September 1991). Islamic activist Abdurahman Alamoudi approaches the US military and suggests they create a program for Muslim chaplains, similar to a longstanding program for Christian chaplains. His proposal is accepted and in 1991 he creates the American Muslim Armed Forces and Veterans Affairs Council (AMAFVAC) with the stated purpose to “certify Muslim chaplains hired by the military.” In 1993, the Defense Department certifies it as one of two organizations to select and endorse Muslim chaplains. The other is the Graduate School of Islamic and Social Sciences (GSISS). [US Congress, Senate, Committee on the Judiciary, 10/14/2003; Wall Street Journal, 12/3/2003] That group is run by prominent Islamic scholar Taha Jabir Al-Alwani. Most of the roughly one dozen Muslim chaplains in the US military are educated there. In 2002, the US government searches the school and Al-Alwani’s home as part of a raid on the SAAR network (see March 20, 2002). He appears to also be named as an unindicted coconspirator in the Sami al-Arian trial. Counterterrorism expert Rita Katz says Al-Alwani is a “person who supports and funnels money to terrorist organizations,” but Al-Alwani denies all terrorism ties and has not been charged with any crime. [St. Petersburg Times, 3/27/2003] Most Muslim chaplains trained at GSISS then receive an official endorsement from Alamoudi’s AMAFVAC organization. US intelligence will learn in early 1994 that Alamoudi has ties to bin Laden (see Shortly After March 1994). [US Congress, Senate, Committee on the Judiciary, 10/14/2003] In 1996, counterterrorism expert Steven Emerson will warn in a Wall Street Journal editorial that Alamoudi openly supports Hamas, even after the US government officially designated it a terrorist organization (see March 13, 1996). [Wall Street Journal, 3/13/1996] But Alamoudi will work for the Defense Department until 1998 on an unpaid basis to nominate and to vet Muslim chaplain candidates. After that, he will give the task to others in his AMAFVAC organization. [US Congress, Senate, Committee on the Judiciary, 10/14/2003] Furthermore, Senator Charles Schumer (D-NY) will later allege the US the military allowed Muslim chaplains to travel to the Middle East on funds provided by the Muslim World League, which has been linked to al-Qaeda (see October 12, 2001). Senator Jon Kyl (R-AZ) will later comment, “It is remarkable that people who have known connections to terrorism are the only people to approve these chaplains.” [US News and World Report, 10/27/2003] In late 2003, Alamoudi will be arrested and later sentenced to 23 years in prison for terrorism-related crimes. The US military will announce around the same time that it is reviewing and overhauling its Muslim chaplain program. [US News and World Report, 10/27/2003]
A US appellate court refuses to find a number of military contractors liable in the death of Earl Patton Ryals, who died with 36 of his fellow crewmen in the Iraqi attack on the USS Stark (see May 17, 1987 and After). Ryals’s estate claims that he and his fellows died in part because of negligence on the part of the contractors who designed, manufactured, tested, and marketed the weapons system on board the Stark, including the Phalanx anti-missile system. In turning down the estate’s claim, the court cites the government’s “state secrets” privilege (see March 9, 1953), saying that the facts of the issue could not be resolved without examining classified Navy documents. And even without this reason, the court rules, Ryals’s estate cannot see the documents because the case presents “a political question” about military decision-making that is not subject to judicial review. [Zuckerbraun v. General Dynamics Corp., 6/13/1991; Siegel, 2008, pp. 197-198] A year later, a similar case will be dismissed on the grounds that a trial might conceivably reveal “state secrets” (see September 16, 1992).
Count Alexandre de Marenches, the former head of France’s secret services for 11 years (1970-1981), publishes his last book, The Fourth World War: Diplomacy and Espionage in the Age of Terrorism (co-authored with journalist David A. Andelman). In addition to many cloak-and-dagger stories, the book warns that “the Fourth World War has already begun,” waged by “small, highly deadly units of terrorists,” and that Americans will eventually have to deal with terrorism at home. [de Marenches and Andelman, 1992] One 1992 reviewer says, “These extreme views inadvertently cast some doubt on his judgment while running French intelligence.” [Foreign Affairs, 12/1/1992] However, after 9/11, the expression “World War Four” is taken up by neoconservatives. In 2006, Tony Corn will write in Policy Review, “Back in 1992, the former head of the French Intelligence Service Alexandre de Marenches had already raised the specter of a ‘Fourth World War.’ In the aftermath of 9/11, the concept was given a new currency by former CIA Director James Woolsey and others, both in the US and abroad. So long as it is clearly understood that ‘World War IV-as-Fourth-Generation Warfare’ will not be a copycat either of War World II or the Cold War, it is indeed no exaggeration to speak in terms of a fourth World War.” [Policy Review, 1/2006; Macleans, 7/25/2006]
Paul Wolfowitz, the neoconservative undersecretary of policy for Defense Secretary Dick Cheney, promotes the export of advanced AIM-9M air-to-air missiles to Israel. This is discovered by a lengthy investigation by the Bush administration into the export of classified weapons technology to China. The Joint Chiefs of Staff, aware that Israel has already been caught selling an earlier version of the AIM missile to China in violation of a written agreement between Israel and the US, intervenes to stop the missile sales. Wolfowitz retains his position at the Defense Department until he and most of his neoconservative colleagues are turned out of the federal government by the onset of the Clinton administration. [Source: Edit International (.com)]In a number of venues, including “The Seditionist” magazine and an Illinois publication called “The War Eagle: A Voice and Forum for Revolutionary Pan-Aryanism,” white supremacist Louis Beam calls for “leaderless resistance,” or cells of fighters who report to no one. Beam writes that the idea originated in the early 1960s as part of preparations for a Communist takeover of the United States; he has adapted it to the idea of resisting what he calls the threat of “federal tyranny” and the federal government’s “ever increasing persecution and oppression.” Beam writes that the usual “pyramidal” scheme of organization, “with the mass at the bottom and the leader at the top,” is “not only useless, but extremely dangerous for the participants when it is utilized in a resistance movement against state tyranny.… In the pyramid type of organization, an infiltrator can destroy anything which is beneath his level of infiltration and often those above him as well. If the traitor has infiltrated at the top, then the entire organization from the top down is compromised and may be traduced at will.” Beam recommends the independent “cell system” of organization, and cites two examples: the Revolutionary War-era “Sons of Liberty” and the more recent use of “cells” by Communist infiltrators in the US. Beam writes that if the cell system is adopted without the top layer of leadership—leaderless “phantom cells”—this can thwart government efforts to infiltrate and monitor the groups. Every cell must have the same fundamental ideology and agenda, Beam writes, and then can be trusted to operate independently, taking actions that further the cause of the larger group without top-down direction. He concludes: “America is quickly moving into a long dark night of police state tyranny, where the rights now accepted by most as being inalienable will disappear. Let the coming night be filled with a thousand points of resistance. Like the fog which forms when conditions are right and disappears when they are not, so must the resistance to tyranny be.” Beam’s idea will be used by many in the so-called “Patriot Movement.” The “Patriot Movement” is later defined by founder John Wallace and by the Southern Poverty Law Center (SPLC) as a loose confederation of anti-government organizations, groups, and individuals who believe that the US government is illegally infringing on citizens’ liberties. The “Patriot Movement” is largely comprised of right-wing, separatist, and white supremacist organizations, groups, and individuals. An unnamed US intelligence official tells businessman William Hamilton that there is a connection between the PROMIS database and search program and the Main Core database. Hamilton is a former NSA official who helped developed PROMIS, but is now involved in a series of disputes with the government over money he says it owes his company, Inslaw. Main Core is a database that is said to collect sensitive information, including about US persons. The specific type of connection is not certain. This is one of three times officials will tell Hamilton about the link (see 1995 and July 2001). [Salon, 7/23/2008]

The bombing levels the three-story building. Argentina, the US, and Israel will later accuse Hezbollah and its backer Iran, but provide little evidence. According to most media accounts and the US State Department’s annual report on terrorism, the bombing was the work of a Hezbollah suicide bomber who drove a truck into the building. [Los Angeles Times, 5/8/1992; Patterns of Global Terrorism, 4/30/1993; Fox News, 10/5/2007] However, a technical report ordered by Argentina’s Supreme Court will find that the bomb was placed inside the building: “Court official Guillermo Lopez said that the investigation had ascertained that the explosives had been located on the first floor of the diplomatic headquarters. ‘The engineers established, with 99 percent certainty, the exact location where the explosives were and the quantity that was used.’” That conclusion is angrily rejected by Israel. [NotiSur, 8/16/1996] The case remains unsolved. [Ha'aretz, 3/17/2008]
Terry Nichols, a white supremacist member of the so-called “Patriot Movement” (see March 24, 1988 - Late 1990 and February 1992), renounces his US citizenship via a “nonresident alien” declaration to the Evergreen, Michigan, Township Clerk. “[T]here is total corruption in the entire political system,” Nichols says; “the entire political system from the local government on up thru and including the President of the United States, George Bush.” He adds: “I no longer am a citizen of the corrupt political corporate state of Michigan and the United States of America.… I follow the common laws, not the Uniform Commercial Codes, Michigan Statutes, etc., that are all colorable laws.… I lawfully, squarely challenge the fraudulent usurping octopus of jurisdiction/authority that does not apply to me. It is therefore now mandatory for… the so-called IRS, for example, to prove its jurisdiction.” He calls himself “a nonresident alien, non-foreigner, stranger to the current state of the forum.” Many will later detect language similar to that used by the Posse Comitatus movement (see 1969). Nichols has already sent his bank a letter revoking his signature on a credit card application, in an attempt to avoid paying $14,000 in credit card debt (another source will say Nichols owes closer to $40,000), writing in part: “I came across some information and in researching it further I have found that your credit, money, and contracts are all based upon fraud, etc., as stated in my revocation document.” The bank wins a lawsuit to compel Nichols to pay his debt; Nichols attempts to pay the debt with a fraudulent “Certified Fractional Reserve Check,” a scheme somewhat similar to the fraudulent checks advocated by the Montana Freemen (see 1993-1994), which the bank refuses to accept. During the court proceedings, Nichols, ordinarily an unusually quiet and shy man, repeatedly defies judicial orders to, among other things, come to the front of the courtroom, and at one point tells the judge, “I’m… a layman, a natural person, a freedom of common-law citizen under threat and duress and to challenge the jurisdiction of this court.” Circuit Judge Donald A. Teeple will later recall: “He was hollering in a loud voice. I informed him that if he didn’t keep quiet, I’d send him to jail. Then he decided to come around the rail” and participate quietly in the hearing. [New York Times, 4/23/1995; New York Times, 5/28/1995; PBS Frontline, 1/22/1996; New York Times, 12/24/1997; Southern Poverty Law Center, 6/2001; Nicole Nichols, 2003; Nicole Nichols, 2003] Both Terry Nichols and his brother James (see December 22 or 23, 1988) routinely stamp their paper money with the words “Discharged Without Prejudice,” a phrase indicating they do not accept its validity. The money-stamping is popular among Posse Comitatus members (see 1969) as they claim money not backed by gold lacks credibility. They also refuse to buy license plates for their vehicles or register them. James Nichols will also renounce his citizenship sometime later [Nicole Nichols, 2003; Nicole Nichols, 2003] , telling local courthouse officials that he is “no longer one of your citizens or a resident of your de facto government.” In mid-1992, Nichols will spend several days in jail for refusing to recognize a court’s authority to make him pay child support; after those days in a cell, he will agree to the court’s mandate. [New York Times, 4/24/1995; Serrano, 1998, pp. 109] Nichols will later be convicted for his role in the Oklahoma City bombing (see 8:35 a.m. - 9:02 a.m. April 19, 1995 and December 23, 1997).
Ahmad Ajaj. [Source: FBI]Al-Qaeda operatives Ahmad Ajaj and Ramzi Yousef enter the US together. Ajaj is arrested at Kennedy Airport in New York City. Yousef is not arrested and will later mastermind the 1993 bombing of the World Trade Center. “The US government was pretty sure Ajaj was a terrorist from the moment he stepped foot on US soil,” because his “suitcases were stuffed with fake passports, fake IDs, and a cheat sheet on how to lie to US immigration inspectors,” plus “two handwritten notebooks filled with bomb recipes, six bomb-making manuals, four how-to videotapes concerning weaponry, and an advanced guide to surveillance training.” However, Ajaj is charged only with passport fraud and serves a six-month sentence. From prison, Ajaj frequently calls Yousef and others involved in the 1993 WTC bombing plot, but no one will translate the calls until long after the bombing. [Los Angeles Times, 10/14/2001] Ajaj will be released from prison three days after the WTC bombing, but is later rearrested and sentenced to more than 100 years in prison. [Los Angeles Times, 10/14/2001] One of the manuals seized from Ajaj will be horribly mistranslated for the trial. For instance, the title page is said to say “The Basic Rule,” published in Jordan in 1982, when in fact the title says “al-Qaeda” (which means “the base” in English), published in Afghanistan in 1989. Investigators will subsequently complain that a proper translation could have shown an early connection between al-Qaeda and the WTC bombing. [New York Times, 1/14/2001] An Israeli newsweekly will report that the Palestinian Ajaj may have been a mole for the Israeli Mossad. The Village Voice will suggest that Ajaj may have had “advance knowledge of the World Trade Center bombing, which he shared with Mossad, and that Mossad, for whatever reason, kept the secret to itself.” Ajaj is not just knowledgeable, but is involved in the planning of the bombing from his prison cell. A federal appeals court upholds the dismissal of a lawsuit filed on behalf of 23 Navy sailors killed in the attack on the USS Stark (see May 17, 1987 and After) against a number of defense contractors. A similar lawsuit on behalf of one of the sailors killed in the attack was dismissed a year before (see June 13, 1991). This time the plaintiffs file over 2,500 pages of unclassified documentary evidence supporting their claims that the contractors were negligent in their design and implementation of the weapons systems aboard the Stark. The appeals court finds that regardless of the amount of evidence entered, to allow the trial would be to potentially infringe on the US government’s “state secrets” privilege (see March 9, 1953). “[N]o amount of effort could safeguard the privileged information,” the court rules. The court adds that “classified and unclassified information cannot always be separated, and therefore courts must restrict access not only to classified material, but to “those pieces of evidence” that “press so closely upon highly sensitive material that they create a hgh risk of inadvertent or indirect disclosures.” [Siegel, 2008, pp. 198]
Eight agents from the Bureau of Alcohol, Tobacco and Firearms (BATF) take up surveillance on the Branch Davidian compound just outside of Waco, Texas, after compiling evidence of illegal gun caches and child abuse among the community (see November 1992 - January 1993). The agents assume undercover identities as students at Texas State Technical Institute and rent a ramshackle house directly across from the front driveway leading into the Davidian property. One of the agents pretends to be interested in the Davidians’ religious teachings in order to gain access to the compound itself. [House Committee on Government Reform and Oversight, 8/2/1996; House Committee on Government Reform and Oversight, 8/2/1996]
Weapons Observed - The agents who manage to gain access to the compound find a large cache of semi-automatic weapons, including AK-47’s, AR-15’s, M-16’s, 9-millimeter handguns, Israeli assault rifles, and others. [New York Times, 3/27/1993]
Undercover Identities Compromised - Many of the Davidians believe the men to be federal agents, correctly surmising that they are too old and too affluent to be college students. The 1995 House investigation of the Davidian debacle (see August 2, 1996) will determine that “a series of mistakes” by the agents alerts the Davidians to their true identities; a 1996 House committee report will find, “At least some of the breaches of security were so serious, and obvious, that they should have been recognized as such by [B]ATF, and become the basis for modifying the nature and timing of any subsequent action against [Davidian leader David] Koresh.” Koresh tells his next-door neighbor of his suspicions, and says he believes the “college students” to be federal agents. The agents are told by another neighbor that Koresh suspects them of being undercover agents. On one occasion, some Davidians visit the agents’ house with a six-pack of beer to welcome their new neighbors, but the agents refuse to let them in. One of the agents, Robert Rodriguez, will later testify that “all of [the undercover BATF agents], or myself, knew we were going to have problems. It was just too—too obvious.”
Agents Unprepared with Basic Intelligence - Moreover, the agents’ preparation was so poor that they do not even know what Koresh looks like; their single means of identifying him is an old driver’s license photograph. The House investigation will find that the “lack of such basic and critical intelligence clearly undermined the ability of the undercover operation to fulfill its mission.” [New York Times, 3/6/1993; House Committee on Government Reform and Oversight, 8/2/1996]
Surveillance Fails to Find Evidence of Criminal Activity - The surveillance, including film from cameras peering into the Davidian compound, produces no evidence of criminal activity. What surveillance material that is created—some 900 photographs and other materials—is largely ignored. [House Committee on Government Reform and Oversight, 8/2/1996]
'Grossly Incompetent' - In 1996, the House committee investigation will find that the BATF investigation is “grossly incompetent” (see August 2, 1996). [House Committee on Government Reform and Oversight, 8/2/1996]
The Bureau of Alcohol, Tobacco, and Firearms (BATF) asks the Army for assistance in raiding the Branch Davidian compound near Waco, Texas (see November 1992 - January 1993 and 5:00 A.M. - 9:30 A.M. February 28, 1993). The request is not acknowledged by federal or military officials for over six years. Army officials will note that such involvement is illegal unless the president personally makes the request; they say that no such request was ever considered. In 1999, the General Accounting Office (GAO) will find that military personnel were called to the scene after the BATF “cited possible drug-related activity” at the Davidian compound. The BATF makes the request through Operation Alliance, an agency that coordinates law enforcement requests for military help in fighting drugs. The BATF requests training by special forces troops, instruction in driving Bradley Fighting Vehicles (BFVs), and the loan of seven BFVs. Operation Alliance will forward the request to Fort Bliss, the home of Joint Task Force 6 (JTF-6), the military’s headquarters for domestic anti-drug efforts. JTF-6 officials are told that the requested assistance is “in direct support of interdiction activities along the Southwest border.” However, Major Mark Petree, the commander of the Army’s special forces, questions the legality of the request. His legal adviser, Major Phillip Lindley, writes a memo stating that the BATF request would make the military an active, illegal partner in a domestic police action. JTF-6 officers accuse Lindley of trying to undermine the mission, and Lindley refers the matter to Lieutenant Colonel Douglas Andrews, the deputy staff judge advocate. Andrews says that the military could probably evaluate the BATF plan of attack (see February 24-27, 1993), but cannot intervene to cancel or revise it. [House Committee on Government Reform and Oversight, 8/2/1996; Associated Press, 10/31/1999] In 1996, a Congressional investigation will find that the BATF deliberately misrepresented the Davidians as a drug cartel in order to receive military assistance and avoid reimbursing the military for that assistance (see August 2, 1996). White separatist Timothy McVeigh (see March 24, 1988 - Late 1990), already mulling over plans to bomb an Oklahoma City federal building (see 8:35 a.m. - 9:02 a.m. April 19, 1995), quits his job with an upstate New York security company (see November 1991 - Summer 1992), sells all of his belongings except what will fit into his car, and begins traveling around the US attending gun shows and militia events. Not all militia movements are characterized by the racist ideology that helps impel McVeigh, but many are, and many white hate groups are making common cause with militias. McVeigh ekes out enough money selling knives, fatigues, and copies of The Turner Diaries (see 1978) to continue his travels, and meets a number of like-minded people. One gun collector who knows McVeigh from the circuit will later tell investigators: “He carried that book all the time. He sold it at the shows. He’d have a few copies in the cargo pocket of his cammies. They were supposed to be $10, but he’d sell them for $5. It was like he was looking for converts.… He could make 10 friends at a show, just by his manner and demeanor. He’s polite, he doesn’t interrupt.” The gun collector, who refuses to give his name to a reporter, also recalls McVeigh living mostly in his car and carrying a “big pistol” with him at all times. An undercover detective will later recall McVeigh showing people at one 1993 gun show in Phoenix how to convert a flare gun into a rocket launcher, and giving out documents with the name and address of the FBI sniper who had shot the wife of white supremacist Randy Weaver at Ruby Ridge (see August 31, 1992). Psychology professor Gerald Post will later say, “Gun shows have become town hall meetings for racists and antigovernment radicals.” At McVeigh’s trial, prosecutors will say that McVeigh used the gun shows to “fence stolen weapons, make contacts to buy bomb materials, and hone his terrorist skills.” During his travels, McVeigh writes to his sister Jennifer, saying that the government is planning to disarm gun owners and incarcerate them in concentration camps. [New York Times, 7/5/1995; PBS Frontline, 1/22/1996; Douglas O. Linder, 2001] Author Brandon M. Stickney will later write: “Today, this part of McVeigh’s life would be difficult even for Tim to document, but it was during this odyssey of uncertainty that he became seriously involved in a dangerous world. Tim was now driven by a desire for ‘citizen action,’ or a movement by the people to alter the liberal thinking of politicians and officials in power.… [I]t is believed that during those lost days, he was frequently exposed to the growing ‘paramilitary’ underworld of Michigan and other states. Groups whose members were upset with taxes, political corruption, and incidents like Ruby Ridge spoke of organizing ‘militias.’” [Stickney, 1996, pp. 150]
Meets Fellow Anti-Government Figures at Gun Shows - Along the way, McVeigh meets Andreas Strassmeir, the head of security for the far-right white supremacist community at Elohim City, Oklahoma (see 1973 and After). He also meets gun dealer Roger Moore at a gun show; McVeigh’s partner Terry Nichols will later rob Moore (see November 5, 1994) as part of McVeigh and Nichols’s bomb plot. [New York Times, 7/5/1995; PBS Frontline, 1/22/1996; Douglas O. Linder, 2001; Nicole Nichols, 2003] Moore is an outspoken man who loudly boasts about his love of country and his hatred for the federal government. He frequently says he would be more than willing to take part in a violent assault against federal law enforcement officials, but, he says, his girlfriend, Karen Anderson, will not let him get involved in such activities. He will later tell a reporter: “I don’t give a sh_t. I’ll put on my flak vest, take a bunch of godd_mn guns in my van, and if I get in a firefight, so be it. I wanna run around and dig up a lot of stuff, but she will not let me go anywhere.” [Serrano, 1998, pp. 59]
Admires Davidian Attack on Federal Law Enforcement Officials - McVeigh has recently developed a crippling habit of gambling on football games, and has maxed out several credit cards, severely damaging his financial status, though by the end of 1992 he had paid off all but one $10,000 debt. According to his later recollections, he is depressed and frustrated by his inability to find someone to love. He spends some time in Florida, living with his sister and working for her husband as an electrician. He meets Moore while in Florida, and shares a table with him at one gun show. He finds Miami too loud and the people offensive, so he leaves shortly after his arrival. It is at this time that he first learns of the federal raid on the Branch Davidian compound outside Waco (see 5:00 A.M. - 9:30 A.M. February 28, 1993), and while watching news coverage of the event, tells his sister that the Davidians “must be doing something right, they are killing Feds.” [PBS Frontline, 1/22/1996]
BATF agents train for a raid. [Source: Time]The Bureau of Alcohol, Tobacco and Firearms (BATF, sometimes known as the ATF) begins preparing for a large-scale raid on the Waco, Texas, compound, Mt. Carmel, owned by the Branch Davidian sect. The BATF has evidence that the Davidians and their leader, David Koresh, own a large amount of possibly illegal weapons, are committing statutory rape and child abuse against the female children of the group, and are possibly beating the children as a means of discipline (see November 1992 - January 1993). The raid is approved by BATF Director Stephen Higgins, after a recommendation from Philip Chojnacki, the senior BATF agent in the Houston office. Undercover BATF agents who have infiltrated the Davidian community recommend that the assault take place on a Sunday morning, because during Sunday morning prayer services the men are separated from the women and children, and do not have easy access to the Davidians’ cache of weapons. [New York Times, 3/3/1993; Dick J. Reavis, 7/19/1995; PBS Frontline, 10/1995]
Significant Lack of Planning - Information compiled after the raid, in which the Davidians kill four BATF agents (see 5:00 A.M. - 9:30 A.M. February 28, 1993), is somewhat contradictory; a Treasury Department report issued after the April conflagration at the compound (see Late September - October 1993) will claim there is no written plan for the “dynamic entry” to be executed by BATF agents, and that the raid is code-named “Trojan Horse.” Agents who participate in the assault will later say the raid is code-named “Showtime.” [New York Times, 3/3/1993; Dick J. Reavis, 7/19/1995; PBS Frontline, 10/1995] According to the Treasury Department report, acting Special Agent in Charge Darrell Dyer, assigned as support coordinator for the operation, arrived in Waco from his Kansas City office on February 23, asked to see the documents for the plan of attack, and was told none had been drawn up. Dyer and agent William Krone draw up a plan on their own, though they have little knowledge about the work performed by the tactical planners. The two manage to generate a rough plan, but the plan remains on Krone’s desk and is never distributed or referred to during the actual raid. [New York Times, 10/1/1993]
Element of Surprise Key - According to later testimony before a House investigative committee (see August 2, 1996), the element of surprise is so integral to the raid that if it is lost, the raid is to be aborted. Ronald Noble, assistant secretary-designate of the treasury for law enforcement, will testify that on-site BATF commanders knew of the provision. Noble will say in 1995, and will be quoted in the 1996 House investigative report, “What was absolutely clear in Washington at Treasury and in Washington and ATF was that no raid should proceed once the element of surprise was lost.” However, Dan Hartnett, deputy director of the BATF for enforcement, will contradict Noble’s assertion, saying that while “secrecy and safety” were “discussed over and over again,” the provision that the raid should be called off if the Davidians were alerted to it beforehand was not in place; Hartnett will accuse Noble of trying to deflect blame away from the Treasury Department and onto the BATF. The report will conclude that no such provision was in place. The BATF commanders will order the raid to go forward even after learning that the Davidians know it is coming. The House report will conclude that the lack of such a provision was a critical failure of the plan. [House Committee on Government Reform and Oversight, 8/2/1996]
No Alternatives Considered - BATF agents will also later claim that the raid was necessary because Koresh never left the compound. However, evidence will show that at least three times between January 17 and February 24, Koresh did exit the compound, where agents could have easily apprehended him; among other examples, Koresh is a regular patron of the Chelsea Bar and Grill in Waco, and leaves the compound regularly to jog. According to the Treasury Department report and a 1996 report by the House investigative committee, other options are considered but rejected. The first is to avoid violence and merely serve the warrants by visiting the compound. This is rejected because of Koresh’s history of antipathy towards law enforcement and his propensity towards violence (see November 3, 1987 and After). A second option, arresting Koresh while he is away from the compound, is rejected because, according to subsequent testimony by Chojnacki, Koresh supposedly never leaves the site. A third option, a plan to besiege Mt. Carmel, is rejected because of the possibility that the Davidians might destroy the illegal weapons, commit mass suicide, or both. [Dean M. Warnings of Violent Response Ignored - The Congressional report will find, “The [B]ATF chose the dynamic entry raid, the most hazardous of the options, despite its recognition that a violent confrontation was predictable.” Before the raid, BATF agents discussed the idea of launching a raid with Joyce Sparks, a Texas Department of Protective and Regulatory Services (DPRS) caseworker who has spent a considerable amount of time with Koresh and the Davidians (see April 1992). Sparks is familiar with the Davidians’ apocalyptic religious beliefs, and warned the agents that to launch a raid on the compound would invite a violent response. “They will get their guns and kill you,” she told the agents. [House Committee on Government Reform and Oversight, 8/2/1996]
Plans, Execution Botched - The Congressional investigation will find that the BATF plan for attacking the Davidian compound was “significantly flawed… poorly conceived, utilized a high risk tactical approach when other tactics could have been successfully used… drafted and commanded by [B]ATF agents who were less qualified than other available agents, and used agents who were not sufficiently trained for the operation.” [House Committee on Government Reform and Oversight, 8/2/1996; House Committee on Government Reform and Oversight, 8/2/1996] Reflecting on the planning 10 years later, Robert White, a senior BATF agent wounded in the raid, will recall: “The people actually calling the shots, whether to go or not, did not have the tactical training necessary to make those kind of decisions. They had the authority to make those decisions simply because of their rank.” White will say that because of the botched raid, the agency will revise its tactical procedures: “Now, before any decision is made, a leader of one of the tactical teams, someone who has been trained specifically for that purpose, will make the call.” [Waco Tribune-Herald, 3/16/2003]
Top Treasury Officials Not Informed - The report also expresses surprise at BATF Director Higgins’s failure to appraise either Secretary of the Treasury Lloyd Bentsen or Deputy Secretary Roger Altman of the raid. The report will state, “Neither [Bentsen] nor his deputy knew anything about an imminent law enforcement raid—one of the largest ever conducted in US history—being managed by his department, which would endanger the lives of dozens of law enforcement agents, women, and children.” [House Committee on Government Reform and Oversight, 8/2/1996]

Bureau of Alcohol, Tobacco, and Firearms (BATF, sometimes abbreviated ATF) agent Davy Aguilera obtains a warrant, or affidavit as it is sometimes called in law enforcement terminology, to search the Branch Davidian compound, known to many as Mt. Carmel, just outside of Waco, Texas. Aguilera, a BATF agent out of Austin, Texas, secures the warrant from US Magistrate Judge Dennis Green in Waco. Aguilera says the evidence for the warrant comes from his own investigation, “as well as information furnished to me by other law enforcement officers and concerned citizens” (see March 5-9, 1992, June-July 1992, November 1992 - January 1993, December 7, 1992, January 11, 1993 and After, and January 22 - Early February, 1993). Aguilera’s warrant gives legal standing for the BATF’s upcoming raid on the Davidian compound (see 5:00 A.M. - 9:30 A.M. February 28, 1993). Aguilera writes, “I believe that Vernon Howell, aka David Koresh and/or his followers who reside at the compound known locally as the Mt. Carmel Center are unlawfully manufacturing and possessing machine guns and explosive devices.” [Bureau of Alcohol, Tobacco and Firearms, 2/25/1993] The legitimacy of the BATF affidavits and warrants will be disputed. After the events of the final assault (see April 19, 1993), a retired FBI agent will examine the original BATF affidavits and say that the agency lacked probable cause for them. In 1996, a Congressional investigation will find that the warrant is replete with “an incredible number of false statements” (see August 2, 1996); one example is its claim, based on witness statements, that the Davidians own a British Boys anti-tank .52 caliber rifle, when in fact they own a Barret light .50 firearm. Possession of the British Boys constitutes a felony, while ownership of the Barret is legal. The affidavit relies heavily on information provided by former Davidian Marc Breault (see February 27 - March 3, 1993); it does not note that Breault left the compound as an opponent of Koresh, a fact that might affect his motives in speaking against Koresh. Nor does the affidavit note that Breault is almost completely blind, but instead claims that he was a bodyguard who “participated in physical training and firearm shooting exercises conducted by Howell. He stood guard armed with a loaded weapon.” Aguilera repeatedly misrepresents and misstates the facts of weapons laws in the affidavit, and misstates the types of weapons parts that Koresh and the Davidians are known to have purchased. The investigation will find that while legitimate evidence exists that would constitute probable cause for a warrant, the BATF agents “responsible for preparing the affidavits knew or should have known that many of the statements were false.” [House Committee on Government Reform and Oversight, 8/2/1996; House Committee on Government Reform and Oversight, 8/2/1996]
Neil Herman. [Source: Paul Schneck Photography]The Al-Kifah Refugee Center is bin Laden’s largest fundraising group in the US and has offices in many cities (see 1986-1993 and 1985-1989). Counterterrorism expert Steven Emerson will later call it “al-Qaeda’s operational headquarters in the United States.” [Emerson, 2006, pp. 436] Nearly every figure involved in the 1993 WTC bombing has a connection to the Al-Kifah branch in Brooklyn, New York. [Newsweek, 3/29/1993] Bob Blitzer, a former FBI terrorism chief who heads the FBI’s first Islamic terrorism squad, is stunned to discover the number of militants connected to Al-Kifah who have left the US to fight for Muslim causes overseas. He will later remember thinking, “What the hell’s going on?” Neil Herman, head of the FBI’s WTC bombing investigation, will comment, “It was like a modern underground railroad.” But no effort is made to keep track of who has gone overseas to fight, even though many of the WTC bombers had gone overseas to fight then came back to use their training to plan an attack in the US. Furthermore, the Al-Kifah office in Brooklyn shuts itself down, but all the other branch offices remain open. US News and World Report will later note that the offices “were left largely intact [and] helped form the nucleus of bin Laden’s al-Qaeda network.” Herman will say, “They certainly continued on, but were somewhat fragmented.” Over time, the other branches generally go underground. Soon their functions are largely replaced by a network of Islamic charities. For instance, the functions of the Brooklyn branch, including its newsletter and website, are directly taken over by a new Boston-based charity called Care International (see April 1993-Mid-2003). Another charity is the Benevolence International Foundation (BIF), run by Enaam Arnaout, who is a veteran of the Al-Kifah Brooklyn office. [US News and World Report, 6/2/2002] The US will not freeze the assets of Al-Kifah until shortly after 9/11, long after all the US branches have dissolved (see September 24, 2001). There is evidence to suggest that the CIA had ties to Al-Kifah and blocked FBI investigations of it (see Late 1980s and After).
The day before the BATF (Bureau of Alcohol, Tobacco, and Firearms) raid on the Branch Davidian compound outside Waco is slated to happen (see 5:00 A.M. - 9:30 A.M. February 28, 1993), BATF public information officer Sharon Wheeler calls editors at the ABC and NBC affiliates in Dallas to alert them to the impending raid. Gary Nichols, assignment editor for the Dallas ABC news affiliate, will later recall, “Sharon said, ‘We have something big going down.’” [New York Times, 3/27/1993]
BATF agents wait to assault the Branch Davidian compound. [Source: LMPD Arcade]The Branch Davidians and their leader, David Koresh (see November 3, 1987 and After), are warned of an impending raid on their compound outside Waco, Texas, by agents of the Bureau of Alcohol, Tobacco and Firearms (BATF—see 5:00 A.M. - 9:30 A.M. February 28, 1993). For several days, BATF agents have come into Waco from all over Texas; the day before the raid, BATF official Sharon Wheeler alerted news outlets in Dallas that “something big” was in the offing (see February 27, 1993). The morning of the raid, medical personnel alert Waco-area press and television personnel that the “feds” are preparing a large-scale exercise of some sort; some reporters and producers see evidence of the preparations for themselves. A large number of news reporters begin scouting the area for more information. Jim Peeler, a cameraman for Waco’s KWTX-TV, knows the Davidians are to be involved in the raid; he finds himself on a rural road near Mt. Carmel, the Davidian compound, where he encounters US mailman David Jones. Peeler asks directions from Jones, who, unbeknownst to Peeler, is Koresh’s brother-in-law and a Davidian affiliate. Peeler will later say that Jones seems to be doing some sort of reconnaissance when they stop their cars for their chat. Peeler tells Jones he is looking for Mt. Carmel, and they briefly discuss the “Sinful Messiah” series on Koresh that has been running in the Waco Tribune-Herald (see February 27 - March 3, 1993). Both hear the National Guard helicopters beginning their patrol. Jones asks Peeler: “Are there helicopters out here? Something’s gonna happen out here today. There’s too much traffic on the road.” Jones tells Peeler he is going home to watch television and see what is going on. Instead, he races to the compound and alerts Koresh; Jones will join the Davidians in the compound, and perish in the blaze that kills Koresh and others 51 days later (see April 19, 1993). [Dean M. Kelley, 5/1995; Austin Chronicle, 6/23/2000] Seven years later, the media learns that Peeler had been alerted to the raid by local law enforcement official Cal Luedke (see June 23, 2000). Peeler will later admit to tipping off Jones, but will claim he knew nothing of Jones’s affiliation with Koresh or the Davidians. He will say that he is sent to drive down the road until he encounters a roadblock put up by the Texas Department of Public Safety, and film whatever may happen. He will say he gets lost trying to find the road leading to the compound. Lawyer Richard DeGuerin, who will represent Koresh in the following weeks, will give a different version of Peeler’s words to Jones. DeGuerin will say: “David Jones had been out to get a paper. On the way back he was driving his car and saw someone that looked lost. He saw a newsman. After being satisfied that David was a mailman, the newsman said, ‘Well, you better get out of here because there’s a National Guard helicopter over at [Texas State Technical Institute], and they’re going to have a big shootout with the religious nuts.’” Jones drives to Mt. Carmel and alerts Koresh and his father, Koresh’s top aide Perry Jones, to the impending raid. [Newsweek, 5/3/1993; Dallas Morning News, 8/28/1993; Time, 10/11/1993] Later allegations that the Davidians were tipped off by Peeler’s colleague, KWTX-TV reporter John McLemore, will be disproven. [Dallas Morning News, 8/28/1993] Lieutenant Gene Barber of the Waco Sheriff’s Department will later testify that local police believe another possible source of information for KWTX-TV was an “informant” at the local ambulance company. Barber will say that on several earlier occasions, when police had put the ambulance company on standby, a KWTX-TV camera crew was sent to the site of the police activity even though the police had not disclosed it to the station. A 1996 House investigation of the Davidian debacle (see August 2, 1996) will conclude that not only were the Davidians aware of the impending raid, but many of them quickly prepared to “ambush” the raiders. [House Committee on Government Reform and Oversight, 8/2/1996] After the raid, Virgil Teeter, the vice president of news for KWTX-TV, says he decided to send a camera crew to the Davidian compound only because of the “Sinful Messiah” articles on Saturday and Sunday morning. “We just thought it would be wise to be in the area,” he says. Teeter says no one from the station began videotaping until after the shooting started. “We didn’t go in before the agents,” he says. “We had no live coverage till long after the shooting started. There is no issue of criticizing us for our actions.” WFAA-TV in Dallas will broadcast some live footage from the raid and its aftermath, and that footage is broadcast nationally on CNN. BATF agents attempt to force entry through a second-floor window of the Branch Davidian compound. At least one of the agents depicited will be shot in the firefight. [Source: Asian Celebrities (.com)]The Bureau of Alcohol, Tobacco and Firearms (BATF) launches its long-planned raid on the Branch Davidian compound near Waco, Texas (see 5:00 A.M. - 9:30 A.M. February 28, 1993). About 9:30, the BATF forces arrive at Mt. Carmel, the location of the Davidian compound. Two National Guard helicopters, which had been scheduled to create a diversion in the rear of the compound so as to allow the cattle trucks carrying the BATF agents to arrive unseen, are late in arriving, and fail to carry out their mission. The raid commanders are out of radio range and unable to abort the raid or modify the deployment of agents. Moreover, as some agents will later tell the New York Times (see March 27, 1993), only squad leaders can communicate with their team members, so communications are difficult, and when a squad leader is shot—and one will be shot in the first few minutes of the raid—that leader’s squad can no longer receive or send information. BATF Agents Advance, Shots Fired - At least 70 agents wearing bulletproof vests, helmets, and army gear emblazened with “ATF Agent” in yellow and white letters, emerge from the trailers and race towards the buildings in groups. Davidian leader David Koresh opens the front door and shouts: “What do you want? There’s women and children in here!” (Some reports say Koresh is unarmed; others say he is dressed in black and carrying an AR-15 semiautomatic rifle.) The lead agent, Roger Ballesteros, brandishes a search warrant and shouts: “Police! Get down!” and Koresh closes the door. Moments later, BATF agents, including Ballesteros (see January-February 1994) and John Henry Williams, and Texas Ranger David Byrnes will report that the Davidians shoot first; Davidians will claim the opposite. One BATF agent will later report that a fellow agent actually shoots first, at a dog he feels is threatening him, but later that agent will retract the claim. A team of agents with a battering ram is slated to burst through the main doors. Two teams of BATF agents with ladders mount to the roof of the first floor and break into windows on the second floor, where they believe the weapons are stored. The ladder and battering ram teams all encounter heavy fire, and several agents are hit, including one on the roof who manages to hobble to a ladder and slide down. Davidians rain bullets from the upper windows onto the agents. One BATF team manages to force entry into the compound, but is unable to advance. Most of the agents are pinned down behind vehicles. The two sides exchange heavy gunfire. [New York Times, 3/27/1993; Newsweek, 5/3/1993; Dean M. Kelley, 5/1995; Dick J. Reavis, 7/19/1995; PBS Frontline, 10/1995; LMPD Arcade, 2009] A federal law from 1917 mandates that federal agents use what is called the “knock and announce” approach—in essence, a federal law enforcement agent must knock on a door and announce himself and his intentions before entering. Ballesteros and his fellow BATF agents do not follow this legal provision, though the law does have several exceptions that may apply in this instance. A later House investigation will find the BATF’s choice not to “knock and announce” reasonable under the circumstances. [House Committee on Government Reform and Oversight, 8/2/1996]
Helicopter Activity - Two of the three helicopters land after taking fire. [Newsweek, 3/15/1993] Philip Chojnacki, the agent in charge, rides in one of the helicopters; he is almost struck by a Davidian bullet in the first minutes of the raid. [New York Times, 3/27/1993] The House investigation will find that Chojnacki’s presence in the helicopter essentially takes him out of the communications loop with the raid commanders and team leaders before the beginning of the raid, and deprives him of any opportunity to learn that the Davidians are planning an ambush. [House Committee on Government Reform and Oversight, 8/2/1996] Catherine Mattison, a Davidian who will escape the April 1993 conflagration (see April 19, 1993), will say in 2003 that she saw gunfire from the helicopters. “They were shooting when they came in,” she will recall. “I went upstairs to my room and all of a sudden I could see three helicopters in V-formation firing. David’s rooms were in the back of the building and that’s where they were firing. I didn’t realize that for three months afterwards because of all the shock and commotion but they were trying to kill him right then.” [Guardian, 10/28/2003] Mattison’s allegations are unconfirmed; testimony from a number of agents will challenge her account, and videotape from the raid shows no gunfire from the helicopters. The helicopters are on loan from the National Guard, and are expressly forbidden to engage in any role save as observational. [House Committee on Government Reform and Oversight, 8/2/1996]
Machine-Gun Fire - Reflecting on the raid 10 years later, BATF agent Bill Buford will say: “But before I even got out of the trailer, I could hear machine guns, and I knew we didn’t have any.… I’m an old Vietnam vet, and I can tell you—the firing was intense.” Buford is wounded in the gun battle. “The one thing we had not planned for was to be pinned down by fire right out in front of the building,” Buford will add. “We did not anticipate we would come under such heavy fire, nor did we anticipate we would have such heavy casualties.” Buford will say that after the botched raid, the BATF will all but abandon such “insertion”-type assaults, and rely instead on surrounding a building and negotiating with the inhabitants. Failure to Follow Manual - Ballesteros will later testify that no particular agent was assigned to announce their identity and the purpose of the raid. “We basically all announced,” he will say. He will admit that according to the BATF manual, “[o]fficers are required to wait a reasonable period of time to permit the occupants to respond before forcing entry,” and the agents do not follow that mandate. He will testify that the agents expected resistance, but not gunfire, and had not planned for that contingency. BATF agent Kenneth King, one of the two “ladder” team members who attempt to force entry through the second-floor windows, will also testify that the agents did not plan for gunfire, and were unprepared for such a heavy level of resistance. Later testimony also shows that some of the damage suffered by the agents may have been from “friendly fire”; one BATF agent is wounded by what later proves to be a 9mm hydroshock bullet, the ordnance being used by the BATF assault teams. According to a recording of his call, Martin shouts: “There are 75 men around our building and they’re shooting at us! Tell ‘em there are children and women in here and to call it off!” Other similar phone calls are made to the 911 center and to the sheriff’s office. The sheriff attempts to reach the BATF commanders and put them in touch with Martin. [Dean M. Kelley, 5/1995] Audiotapes of the phone calls between Martin and McLennan County Sheriff’s Department official Larry Lynch, released months later (see June 2003 and After), show Lynch’s efforts to persuade Martin to have the Davidians stop firing on wounded agents. Lynch asks Martin to let four wounded BATF agents reach another agent shot six times during the battle; Martin suddenly says the others in the compound fear an all-out assault. “We’re worried that the National Guard will fly in here with choppers,” he says. “We’re gonna assume that any chopper that comes in is National Guard.” While Lynch works to calm Martin, a BATF agent on another line tells Lynch: “All of our guys are in the open right now. If they open up, we’re gonna lose 20 guys.” Lynch asks Martin if the authorities can help any wounded Davidians, only to be told: “Here’s the message. We don’t want any help from your country.… I can tell you now. They’re not gonna leave this property.… Nobody wants to leave.… Each man’s making his own decision.… Some of them are dying.” [Dallas Morning News, 8/7/1993]
A cease-fire ends a violent, bloody conflict between the Branch Davidians, a group of religious separatists in their Waco, Texas, compound, and agents from the Bureau of Tobacco, Alcohol and Firearms (BATF, sometimes abbreviated ATF), who launched a raid on the compound to serve search and arrest warrants on Davidian leader David Koresh (see 5:00 A.M. - 9:30 A.M. February 28, 1993 and 9:30 A.M. and After, February 28, 1993). The cease-fire goes into effect after about 90 minutes of the two sides exchanging gunfire. Four BATF agents are dead and 16 are wounded, some severely. The agents retreat to a safe distance, where they mill around aimlessly; the commanders have not given the agents a plan for retreat or failure. The Davidians also withdraw inside their compound. Five Davidians, including a woman nursing her baby, are dead, and several, including Koresh, are wounded; Koresh suffers gunshot wounds in the hand and the side. (Two of the Davidians may have been killed by their fellows after being gravely wounded by BATF fire.) Three Davidians attempting to get to the main building from a warehouse on the property are apprehended by BATF agents; one is killed, one is arrested, and one escapes. Media Contacts - During the raid, CNN receives calls from Davidian Steve Schneider. CNN producers verify that Schneider is indeed inside the compound, and set up an interview with Koresh for this evening (see 5:00 p.m. February 28, 1993 and After). [New York Times, 3/1/1993]
Negotiations and Implementation - The cease-fire takes some time to implement. Senior BATF agent James Cavanaugh succeeds in convincing Koresh and Schneider to agree to a cease-fire. Schneider has to walk through the main building to tell his people to stop firing; Cavanaugh has no direct radio link to his agents, and has to go through team leaders to tell them to stop firing. The cease-fire has been agreed upon for several minutes before the shooting finally concludes. As part of a 1996 House investigation of the Davidian debacle (see August 2, 1996), Cavanaugh will say: “I called the compound directly on the phone from the undercover house. I reached… Schneider. I told him I was an ATF agent and I wanted to talk to him about this situation. As should be expected, the activity inside the compound was very frantic, people were screaming and yelling, and there was still shooting going on both sides. Steve was very excited and very hostile. I wanted to negotiate a cease-fire, and he [Schneider] was agreeable. I am not going to be good on the time of how long it took, but it took a little while to negotiate that. He had to go throughout the compound, which is very large, telling everyone not to shoot. While he was doing this, there was still shooting going on both sides. I had to get on the command net frequency and tell the commanders on the ground there not to shoot, and they had to relay that to all 100 agents, who were around there, so it took a little time to arrange it. Once I returned to the rear command post I called back in on the telephone to the residence about 2:00 p.m. and I spoke with Steve and David Koresh about what was going on. We had long conversations about the warrant, and we also had a lot of conversations about Biblical passages and Mr. Koresh’s belief that he was the Lamb of God, who would open the Seven Seals. As you might assume, he was very hostile, very angry, and very upset.” [House Committee on Government Reform and Oversight, 8/2/1996] In the following days, Koresh will tell local reporters by phone that he is shot in the “gut” and his two-year-old daughter is dead from BATF gunfire. He will also leave a message on his mother’s answering machine in Chandler, Texas, which says in part: “Hello, Mama. It’s your boy.… They shot me and I’m dying, all right? But I’ll be back real soon, OK? I’ll see y’all in the skies.” [Newsweek, 3/15/1993] The body of the Davidian slain while trying to return to the compound, Michael Schroeder, will lie untouched in a gully for four days before authorities retrieve it; those authorities will wait 11 days before informing Schroeder’s parents of his death (see March 11, 1993).

FBI Takes Control - Within hours of the raid’s conclusion, the FBI will take control of the situation and besiege the compound (see 12:00 p.m. February 28, 1993).
Criticism of BATF Tactics - Soon after, the FBI publicly criticizes the BATF’s decision to storm the compound in a frontal assault. “It’s against our doctrine to do a frontal assault when women and children are present,” one FBI agent says. BATF spokeswoman Sharon Wheeler explains: “We were outgunned. They had bigger firearms than we did.” But former New York City Police Commissioner Benjamin Ward says of that explanation: “‘Outgunned’ is a euphemism for ‘outplanned,’ or ‘unplanned.’ They did it backwards. The accepted way is to talk first and shoot second.” Vic Feazell, a former district attorney for the area, says of Koresh and the Davidians, “They’re peaceful and nonaggressive unless they are attacked.” By going in, guns blazing, the BATF played right into the group’s apocalyptic vision, he says. “They would see this as a holy war provoked by an oppressive government.” [Newsweek, 3/15/1993]
Standoff Will End in Fiery Conflagration - Most of the Davidians, including Koresh, will die in a fiery conflagration after a 51-day standoff with FBI agents (see April 19, 1993). After the site is secured, Texas law enforcement officials will recover over 300 firearms from the compound, as well as numerous live grenades, grenade components, and hundreds of thousands of rounds of ammunition. [Source: PBS]The FBI dispatches agents to the Branch Davidian compound outside Waco, Texas, the scene of a bloody standoff this morning between the Davidian sect members and a large force of agents from the Bureau of Alcohol, Tobacco and Firearms (BATF), which resulted in the deaths of four BATF agents and six Davidians (see 5:00 A.M. - 9:30 A.M. February 28, 1993). By the afternoon, the FBI becomes the lead agency for resolving the standoff. [PBS Frontline, 10/1995] Jeffrey Jamar, head of the FBI’s San Antonio office, is named the on-site commander. The bureau quickly deploys its own agents, and local law enforcement officials, around the compound to ensure no one tries to escape. The deployment quickly becomes an all-out siege. [PBS Frontline, 10/1995] President Clinton was reportedly angered at reports of the botched raid. His chief of staff, Mack McLarty, demanded of a senior Justice Department official, “What the hell happened here?” The order to replace the BATF with the FBI came from Clinton. [Newsweek, 3/15/1993] FBI Hostage Rescue Team (HRT) personnel are in place by the afternoon, and hostage negotiators spend much of the afternoon talking on the telephone with Koresh. Some bring Bibles, later telling reporters: “This guy’s a Bible-citing machine. We have to speak his language.” As part of the negotiations to persuade Koresh to allow some of the sect members to leave safely, Koresh will be allowed to broadcast his religious teachings on a local radio station (see March 2, 1993) and to give an interview to a CNN reporter (see 5:00 p.m. February 28, 1993 and After). Texas Rangers attempt to begin their own investigation, but are barred by the FBI from continuing. Clinton closely follows the events as they progress. Marc Breault, a Branch Davidian who lived for years at the Mt. Carmel compound before rebelling against the leadership of David Koresh (see November 3, 1987 and After) in 1990 and leaving for Australia, is contacted by an FBI agent several hours after the failed raid on the Davidian compound (see 5:00 A.M. - 9:30 A.M. February 28, 1993). Breault has talked about what he considers the threat of Koresh and the Davidians to US law enforcement authorities and the Australian media, and was interviewed for a series of articles about Koresh in the Waco Tribune-Herald (see February 27 - March 3, 1993). As part of its planning for the raid, agents of the Bureau of Alcohol, Tobacco, and Firearms (BATF, sometimes abbreviated ATF) talked to Breault and other Mt. Carmel “defectors” to get a sense of the situation. Breault warned the agents not to get overly aggressive with the Davidians. “The ATF agents I spoke with were quite good,” he will later recall. “They said they wanted to get Vernon [Howell, Koresh’s birth name] on his own, to lure him away from Mt. Carmel and arrest him. Their other scenario was a raid on Mt. Carmel. I said if they were going to do a raid they had better have the element of surprise or they would end up with an armed confrontation.” Another “defector,” David Bunds, also speaks with BATF agents before the raid. Bunds will later recall: “I said, ‘Don’t go in there with your guns. It won’t work.’ And they said, ‘Oh, we’re not going to do that.’” Hours after the raid, an FBI agent calls Breault for his take on the siege. “It was pretty chaotic,” Breault will later recall. “I talked with an FBI negotiator for half an hour. He asked what I thought Koresh would do. I said I thought it would end in massive death, a mass suicide. I explained Vernon’s belief about the fifth seal of Revelations, which said there had to be a certain number of martyrs before the end could come.” [Conway and Siegelman, 1995, pp. 255] In 1999, Breault will tell a Daytona, Florida, newspaper a similar story. “They [the BATF agents he spoke with] were afraid, based on some of the things he had written, that if they tried to assault the compound, he would start a fire,” Breault will recall. “They were afraid if they sent people into the compound there would be explosions, there would be fires set. They had lots of Scriptures, all [of them] he had gone over with us many times.” Breault will claim to have told BATF agents that fire was very much a part of Davidian prophecy. “There’s a Scripture in Daniel 11 that talks about how the righteous will fall,” Breault will say. “Some are taken captive; some die by the sword; and some die by the flame. Two parts of that prophecy had already been fulfilled, according to their beliefs. That was the problem. The Davidians thought they were seeing prophecy fulfilled before their very eyes. Flames were the only thing left.” Breault will say of Koresh: “I think they decided Vernon didn’t believe any of this stuff. They thought he was a con man. They failed to take into account the level of his belief and that of his followers. They couldn’t believe there was anyone that dedicated to an apocalypse.” He will add that the primary responsibility for the events of the siege, and the final assault, lay with Koresh and the Davidians: “I think people should keep in mind that in his theology, the apocalypse was inseparable from fire. I’ve always believed Vernon started the fire at Mount Carmel or set up a situation where an assault would start a fire. It’s possible the FBI inadvertently—you might say negligently—set the fire. [Source: PBS]President Clinton gives his implicit endorsement for a negotiated solution to the standoff between federal agents and the Branch Davidian sect members near Waco (see 5:00 A.M. - 9:30 A.M. February 28, 1993 and 12:00 p.m. February 28, 1993). By 6:00 a.m., the FBI has assumed formal control of the situation. FBI agents set up a fully functioning command post by the afternoon, and FBI agents in armored vehicles surround the compound. FBI Special Agent in Charge Jeffrey Jamar, named site commander, arrives to take charge. Daniel Hartnett, the associate director of enforcement for the Bureau of Alcohol, Tobacco, and Firearms (BATF) also arrives. The Davidians allow 10 children to leave the compound, apparently as a result of intense hostage negotiations between the Davidians and the FBI’s Hostage Rescue Team (HRT) personnel, who have just arrived on-scene. Deputy Treasury Secretary Roger Altman goes to Waco and meets with BATF agent Bill Buford. Davidian leader David Koresh becomes agitated when he sees the vehicles moving in; he is further angered when he learns that the FBI has blocked all incoming and outgoing telephone calls except for communications between him and the negotiators. Koresh assures the negotiatiors that his Davidians are not contemplating mass suicide. FBI Director William Sessions advises Clinton that a “waiting strategy” to handle the situation is best, and Clinton agrees. Supplies and Surveillance - Starting today and for weeks to follow, FBI negotiators will provide the besieged Davidians with some requested items, including food and supplies for the children. In some of these provisions, FBI agents insert listening devices, which give the agents a limited amount of knowledge as to topics being discussed among the Davidians. [Dean M. Kelley, 5/1995]
Negotiations - The FBI chooses not to retain the services of BATF agent James Cavanaugh, who successfully negotiated the cease-fire between the BATF and the Davidians; Cavanaugh has already gained a measure of trust from Koresh and his aide Steve Schneider, and had successfully convinced the two to let some children leave the compound. The FBI does allow McLennan County Sheriff Jack Harwell to speak with the Davidians, as the Davidians know him and trust him to an extent. The FBI comes to consider Harwell a “natural” at low-key negotiations. However, within two days, it will prevent him from any further contact with the Davidians. The FBI never allows the Texas Rangers to speak with the Davidians, though the Davidians say they trust the Rangers to treat them fairly; Jamar refuses to speak to Rangers chief David Byrnes. Abdul Rahman Yasin. [Source: CBS News]A week after the WTC bombing, an Iraqi-American is questioned by the FBI and then allowed to leave the country, despite evidence tying him to the bombing. Abdul Rahman Yasin is a US citizen but spent most of his life in Iraq until 1992, when he returned to the US. Two of the major WTC bomb plotters, Ramzi Yousef and Mohammed Salameh, lived in the apartment directly above Yasin’s. Several days after Salameh is arrested, the FBI searches Yasin’s apartment. They find traces of bomb explosives on a scale, a tool box, and a shirt. In the trash, they find jeans with an acid hole burned in them, and torn pieces of a map showing the route to Yousef’s other apartment. Yasin is taken to an FBI office and interrogated by Neil Herman, head of the FBI’s WTC bombing investigation, and others. Yasin gives information about Salameh, Yousef, and other participants in the bomb plot. Agents observe a chemical burn on his right thigh, making them suspect that he was involved in mixing the chemicals used in the bombing. The next day, he drives FBI agents to the apartment where the bomb was made. Yet Yasin will later be interviewed and claims that the FBI never asked him if he was involved in the bomb plot. Later that evening, he flies to Iraq. Herman will later say, “There was not enough information to hold him and detain him. And the decision was made, and he was allowed to leave.” [Los Angeles Times, 10/12/2001] In 2002, Iraqi Deputy Prime Minister Tariq Aziz will recall, “I have to tell you that we fear[ed] that sending Yasin back to Iraq… was a sting operation [for the US to] tell people later on, look, this man who participated in that event now is in Iraq, etc., and use it as they are doing now, using many false pretexts, you see, to hurt Iraq in their own way.” [60 Minutes, 6/2/2002] Yasin will be indicted in August 1993 for his role in the WTC bombing and the US later puts a $2 million bounty on his head. In October 2001, that will be increased to $25 million. In 2002, Yasin will be interviewed by CBS News in Iraq and will confess to involvement in the WTC bombing but says he was not an Iraqi government agent. Iraqi authorities will tell CBS that Yasin is still imprisoned without charge and has been in prison since 1994, but this has not been independently confirmed. Some continue to point to Yasin as evidence that Iraq was behind the WTC bombing. [Los Angeles Times, 10/12/2001; 60 Minutes, 6/2/2002]

[Source: Life]A nine-year-old girl, Heather Jones, leaves the Branch Davidian compound near Waco, currently under siege by the FBI and other law enforcement authorities (see 5:00 A.M. - 9:30 A.M. February 28, 1993 and March 1, 1993). She has a note pinned to her jacket written by her mother; the note says that once the children have left the compound, the adults will die. FBI negotiators immediately contact Davidian leader David Koresh; both Koresh and his top aide, Steve Schneider, deny they are contemplating mass suicide. The FBI believes that the Davidian compound contains enough food to last the inhabitants a year. Profilers and experts, including some members of the Davidian sect not immured inside the compound, give conflicting opinions on whether Koresh will lead the group in a mass suicide (see March 5, 1993). [PBS Frontline, 10/1995] Federal agents tell reporters that in 1992 they received warnings that the Branch Davidian sect near Waco, Texas, was contemplating mass suicide. The warnings came from Australians formerly connected to the Waco group of the Davidians. An agent with the Bureau of Alcohol, Tobacco and Firearms (BATF), the agency that raided the compound, says the Australians warned that Koresh was discussing mass suicide with his fellow members. Another BATF official says the tip, included in a State Department cable, was not a major factor in the bureau’s decision to raid the compound. FBI officials confirm that Koresh has assured them he is not contemplating mass suicide. “He indicates there is no intent on his part to order a suicide, nor does he contemplate suicide,” says FBI agent Bob Ricks. New York State Senator Roy Goodman (R-Manhattan) presides over the hearings. His committee questions 26 witnesses in what journalists Wayne Barrett and Dan Collins will later call “a no-holds-barred probe of the City [of New York] and of the Port Authority.” [Newsday, 11/12/2001; Barrett and Collins, 2006, pp. 86]
Bombing Was a 'Dire Warning' - During the hearings, Goodman calls the WTC “an extremely inviting target” for terrorists, and says the recent bombing (see February 26, 1993) was a “tragic wake-up call” and “a dire warning of the future disasters which could occur with far greater loss of life if we fail to prepare” for terrorism “here at home.” [Albany Times Union, 10/2/2001; Barrett and Collins, 2006, pp. 86-87] He also refers to a number of Port Authority consultant and internal security reports, which predicted the kind of bombing that occurred at the WTC (see January 17, 1984, July 1985, November 1985, and (Mid-1986)), and criticizes Port Authority officials who appear for failing to follow the recommendations of these reports.
Detective Says He Fears a 'Further Disaster' - One Port Authority employee who appears, Detective Sergeant Peter Caram, warns about the continuing threat to the WTC. Caram is the only Port Authority employee with a top security clearance and who is assigned to the New York Joint Terrorism Task Force. He says he fears a “further disaster somewhere down the line” and, referring to the WTC, implores the Port Authority to “harden our target.” James Fox, the assistant director in charge of the FBI’s New York office, similarly warns, “We would be well advised to prepare for the worst and hope for [the] best.” And New York City Police Commissioner Raymond Kelly says New York should remain at “a heightened state of awareness and readiness for the foreseeable future.” [Barrett and Collins, 2006, pp. 87]
Official Recommends Practicing for a Plane Hitting the WTC - On the final day of the hearings, Guy Tozzoli, the director of the Port Authority’s World Trade Department, recalls a drill held in 1982, which simulated a plane crashing into the WTC (see November 7, 1982), and recommends that New York’s emergency response agencies train again for an aircraft hitting the Twin Towers (see (March 29, 1993)). Report Based on Hearings Is 'Largely Ignored' - The exact dates of the hearings are unclear. The hearings begin on March 22, according to Barrett and Collins. [Barrett and Collins, 2006, pp. 86] And according to Newsday, March 29 is the third and final day of the hearings. [Newsday, 11/12/2001] Goodman will issue a 34-page report in August this year based on the hearings. The report, titled “The World Trade Center Bombing: A Tragic Wake-Up Call,” will describe the WTC as “a singular potential terrorist target.” It will call for a special task force and for increased security in the parking facilities under public skyscrapers. But Goodman will say, shortly after 9/11, that his report’s recommendations “were largely ignored as time dulled the sensitivity of the public to terrorist threats.” [Albany Times Union, 10/2/2001; Newsday, 11/12/2001; Barrett and Collins, 2006, pp. 88]

[Source: Anu News (.com)]Many white separatists and right-wing militia members are aghast, appalled, and infuriated by the violent end to the Branch Davidian siege in Waco, Texas (see April 19, 1993). Two of those are future Oklahoma City bombers Terry Nichols and Timothy McVeigh (see 8:35 a.m. - 9:02 a.m. April 19, 1995); when McVeigh watches the flames devour the Davidian compound, he stands in Nichols’s living room and weeps. McVeigh has already visited the compound during the siege (see March 1993); in the following weeks, he revisits the scene, collecting pamphlets from the Davidians, taking photographs, and even taking samples of the charred wood left behind. McVeigh begins wearing, and selling at gun shows, caps that depict the BATF (Bureau of Alcohol, Tobacco and Firearms) logo with bullet holes in them (see August 26 - September 15, 1994). He sells flares that can be used as missiles. Moreover, he and Nichols soon begin practicing with explosives and agitating for violent assaults on government officials with local militia members (see October 12, 1993 - January 1994). McVeigh later tells interviewers: “I didn’t define the rules of engagement in this conflict. The rules, if not written down, are defined by the aggressor. It was brutal, no holds barred. Women and children were killed at Waco and Ruby Ridge (see August 31, 1992). You put back in [the government’s] faces exactly what they’re giving out.” McVeigh’s favorite magazine, Soldier of Fortune, later publishes articles calling the FBI and BATF “the Gestapo” and accusing the government of funneling illegal drugs into the country through the auspices of the DEA; McVeigh will read these articles, and other more overt anti-government publications that directly accuse the government of plotting to enact “new Wacos” throughout the country, with a new fervor. Another favorite is a videotape, “Waco: The Big Lie,” promoted by militia leader Linda Thompson (see April 3, 1993 and September 19, 1994), who accuses the government of deliberately plotting the deaths of everyone inside the Davidian compound and setting the compound afire by shooting flames at the building through a tank. McVeigh will later claim to have learned the “real truth” about the siege after meeting a former Davidian, Paul Fatta, on the gun show circuit (see Late 1992-Early 1993 and Late 1994). Nichols’s neighbor Phil Morawski will later recall of McVeigh: “He said he witnessed part of the siege at Waco and was very upset about it; the government overstepped its bounds. Waco is kind of like the battle cry for Tim and many others.” McVeigh’s friend Michael Fortier (see March 24, 1988 - Late 1990) will later recall discussing the Davidian debacle with McVeigh, saying, “We both concluded that the federal government had intentionally attacked those people and may not have intentionally started the fire, but they were certainly the cause of the fire and potentially murdered those people in Waco.” Fortier’s wife Lori will recall McVeigh’s position differently: according to her recollection, McVeigh believes that “the government murdered those people.” After the bombing, Dennis Mahon, the head of the Oklahoma cell of the White Aryan Resistance, will tell federal officials about McVeigh, whom he claims to have known under an alias: “I met Tim Tuttle, but I didn’t know he was alias Tim McVeigh. I met him at gun shows (see January 23, 1993 - Early 1994). He sold military stuff, knives, gun parts, camouflage uniforms.… And we talked about Waco. And I said: ‘What comes around goes around. If they keep doing this terrorism on our people, terrorism’s going to happen to them…’ He said: ‘Probably. Probably so.‘… Timothy McVeigh is my hero. Wish we had a thousand more like him. He took action.” Mahon will later be identified by one witness as the person driving the Ryder truck for McVeigh on the day of the Oklahoma City bombing (see April 15, 1995), though the identification is in doubt, and Mahon will not be charged for playing a part in the bombing. [Stickney, 1996, pp. 155, 159; PBS Frontline, 1/22/1996; Serrano, 1998, pp. 76-78; Nicole Nichols, 2003; CNN, 12/17/2007] McVeigh will send videotapes about the Davidian tragedy, such as “Waco: The Big Lie,” to his friends, including his former coworker Carl Lebron (see November 1991 - Summer 1992), his former Army comrade Albert Warnement (see January - March 1991 and After), and his neighbors Richard and Lynn Drzyzga (see October 1990). Lebron considers the videotapes “nonsense,” and the Drzyzgas become concerned that McVeigh may actually believe the “nutty” “paranoia” of the information in them. McVeigh will also write a letter to his childhood friend Steve Hodge, breaking off their friendship because Hodge is not sufficiently enraged by the Davidian tragedy (see July 14, 1994). [Serrano, 1998, pp. 78] McVeigh is not the only one preaching active retribution for Waco. James Nichols, Terry’s older brother (see December 22 or 23, 1988), says they are planning to kill law enforcement officials. Paul Izydorek, a family friend, will later tell a CNN reporter: “Evidently, James had told [Izydorek’s son] one or two times about how they were going to kill cops and judges and, you know, really clean house on all the local government. I didn’t take it serious but I guess maybe that’s what the heck they was really talking about, maybe they was a lot more serious, you know, than I realized.” [Stickney, 1996, pp. 156]

The “Blind Sheikh,” Sheikh Omar Abdul-Rahman, is arrested in Brooklyn after a long stand off. The “Landmarks” plot was rolled up on June 24, 1993, and many of Abdul-Rahman’s close associates were arrested on that day (see June 24, 1993). But Abdul-Rahman moved to the Abu Bakr mosque and stayed there. His presence in a mosque and the many supporters that gathered to surround it makes his arrest difficult. But after long negotiations, on July 3, 1993, he is arrested on immigration charges and taken to prison. [New York Times, 7/3/1993] He will later be charged with a role in the “Landmarks” plot and eventually sentenced to life in prison. [New York Times, 1/18/1996]

[Source: Bonfire's Blog (.com)]A jury acquits white separatist Randy Weaver and a fellow separatist of murdering a US marshal during the Ruby Ridge standoff (see August 31, 1992), a verdict the Southern Poverty Law Center will later call “a stinging rebuke to federal law enforcement.” Evidence will later emerge that shows the FBI changed its normal rules of engagement during the standoff and later lied about it. Kifah Wael Jayyousi. [Source: Robert A. Reeder]A Florida cell of Islamic radicals carries out fundraising, training, and recruitment to support the global jihad movement. The group is monitored by the FBI from the early 1990s, but no action is taken against it until after 9/11. The cell’s most prominent members are Adham Amin Hassoun, Mohammed Hesham Youssef, Kifah Wael Jayyousi, Kassem Daher, and Jose Padilla. Adnan Shukrijumah may also be involved (see (Spring 2001)).
Both Hassoun and Jayyousi are associates of “Blind Sheikh” Omar Abdul-Rahman and the FBI monitors telephone conversations between them and Abdul-Rahman from January 1993 to 1995, at least. After Abdul-Rahman is taken into police custody in July 1993, according to an FBI agent, Jayyousi calls Abdul-Rahman in jail to “update the sheikh with jihad news, many times reading accounts and statements issued directly by terrorist organizations.” [St. Petersburg Times, 11/23/2003; Lance, 2006, pp. 126-8; Associated Press, 4/8/2006; International Herald Tribune, 1/4/2007]
Funds are provided through bank accounts of Al-Gama’a al-Islamiyya (the Islamic Group), the Canadian Islamic Association, and Benevolence International Foundation (BIF), for which Hassoun files incorporation papers in Florida. The cell pays out thousands of dollars in checks, some of which are marked “Chechnya”, “Kosovo,” or “for tourism”.
They try to talk in code, but the code is unsophisticated; for example “tourism” apparently means “terrorism”. In addition, they are not very careful and in one conversation overheard by the FBI, which records tens of thousands of their conversations from the early 1990s, one plotter asks another if he has enough “soccer equipment” to “launch an attack on the enemy.” In another, the conspirators discuss a $3,500 purchase of “zucchini” in Lebanon.
Cell members are involved in jihad, through funding or direct participation, in Egypt, Somalia, Bosnia, Chechnya, Afghanistan, Lebanon, Libya, Kosovo, the former Soviet Republic of Georgia, and Azerbaijan.
They are involved with both bin Laden and Chechen leader Ibn Khattab; for example, in one conversation Youssef tells Hassoun that he would be traveling “there at Osama’s and… Khattab’s company.” [Indictment. United States v. Jose Padilla, 11/17/2005 ]
They publish the Islam Report, a radical magazine about jihad. [Associated Press, 4/8/2006]
It is unclear why the FBI monitors the cell for almost a decade before doing anything. However, some of their activities are focused on Bosnia, where the US is turning a blind eye, or even actively assisting Islamic militants fighting on the Bosnian side (see 1992-1995 and April 27, 1994). The cell is broken up in the months after 9/11, and Hassoun, Jayyousi, and Padilla are sent for trial, which begins in 2007. [International Herald Tribune, 1/4/2007]

A Florida couple affiliated with the so-called “Patriot Movement” (see February 1992) guns down an Opelika, Alabama, police sergeant investigating a disturbance involving the woman’s young son. The couple will later be convicted of capital murder. [Southern Poverty Law Center, 6/2001]
White supremacist and anti-government separatist Timothy McVeigh, having left the Army after being refused a position in Special Forces, moves in with his old Army friend Terry Nichols (see March 24, 1988 - Late 1990) and Nichols’s wife, a mail-order bride from the Phillippines. Enraged by the debacle in Waco (see April 19, 1993), McVeigh and Nichols begin experimenting with explosives on brother James Nichols’s farm in Decker, Michigan, meeting with members of the nascent Michigan Militia (see April 1994), and proposing to launch violent attacks on judges, lawyers, and police officers. McVeigh and Nichols find the militiamen too inactive for their taste, and, in part inspired by the novel The Turner Diaries (see 1978), form their own small “cell” (see February 1992), calling themselves the “Patriots.” [Nicole Nichols, 2003] Both McVeigh and Nichols will later be convicted of blowing up an Oklahoma City federal building (see 8:35 a.m. - 9:02 a.m. April 19, 1995).
By 1990, Arizona became one of the main centers in the US for radical Muslims, and it remains so through 9/11. A number of future al-Qaeda leaders live in Tucson, Arizona, in the early 1990s (see 1986). Around 1991, future 9/11 hijacker Hani Hanjour moved to Arizona for the first time (see October 3, 1991-February 1992) and he will spend much of the rest of the decade in the state. The FBI apparently remains largely oblivious of Hanjour, though one FBI informant claims that by 1998 they “knew everything about the guy.” [New York Times, 6/19/2002; Washington Post, 9/10/2002; 9/11 Commission, 7/24/2004, pp. 521] In 1994, the Phoenix FBI office uncovers startling evidence connecting Arizona to radical Muslim militants. According to FBI agent James Hauswirth, they are told that a group of “heavy duty associates” of al-Qaeda leader Sheikh Omar Abdul-Rahman have arrived in the area, fleeing New York in the wake of the 1993 World Trade Center bombing. They are in the area to train a recruit as a suicide bomber. The recruit apparently is an FBI informant. FBI agent Ken Williams, who will later author the July 2001 “Phoenix memo,” orders surveilance of the training. The informant is driven to a remote stretch of desert and instructed in how to use explosives. A device is thrown at a car, but it fails to explode. The FBI secretly videotapes the entire incident. One of the two men is later positively linked to Abdul-Rahman. But apparently the investigation into the people involved fails to make progress. Hauswirth later blames this on a lack of support from higher-ups in the Phoenix office, recalling, “The drug war was the big thing back then, and terrorism was way on the back burner.” Additionally, also in 1994, a key FBI informant will begin monitoring local radical militants (see October 1996). However, terrorism will remain a low priority for the Phoenix, Arizona, FBI office (see April 2000-June 2001). [Los Angeles Times, 5/26/2002; New York Times, 6/19/2002; Lance, 2003, pp. 209-210]

The Montana Militia is led by John Trochmann, a white supremacist and supporter of Ruby Ridge survivor Randy Weaver (see August 31, 1992). [Southern Poverty Law Center, 6/2001]
The Boston Herald reports that an internal CIA report has concluded that the agency is “partially culpable” for the 1993 World Trade Center bombing (see February 26, 1993) because it helped train and support some of the bombers. One source with knowledge of the report says, “It was determined that a significant amount of blowback appeared to have occurred.” A US intelligence source claims the CIA gave at least $1 billion to forces in Afghanistan connected to Gulbuddin Hekmatyar. More than a half-dozen of the WTC bombers belonged to this faction, and some of the CIA money paid for their training. The source says, “By giving these people the funding that we did, a situation was created in which it could be safely argued that we bombed the World Trade Center.” Those connected to the bombing who went to Afghanistan include Sheikh Omar Abdul-Rahman, Clement Rodney Hampton-el, Siddig Siddig Ali, Ahmed Ajaj, and Mahmud Abouhalima. [Boston Herald, 1/24/1994] Additionally, Ramzi Yousef trained in Afghanistan near the end of the Afghan war, and there are claims he was recruited by the CIA (see Late 1980s). “Intelligence sources say the CIA used the Al-Kifah Refugee Center in Brooklyn—founded to support the Afghani rebels fighting Soviet occupation—to funnel aid to Hekmatyar, setting the stage for terrorists here to acquire the money, guns and training needed to later attack the Trade Center. CIA support also made it easier for alleged terrorist leaders to enter the country.” [Boston Herald, 1/24/1994] It will later be alleged that the CIA repeatedly blocked investigations relating to Al-Kifah, which was al-Qaeda’s operational base in the US (see Late 1980s and After).
A California state official refuses to vacate an IRS lien against a number of “Patriots” who argue that they do not fall under state and federal laws because they consider themselves “common law” adherents (see February 1992 and April 2, 1992 and After). The “Patriot” members beat and stab the official, and sodomize him with a gun. According to the Southern Poverty Law Center, “The attack exemplifies the growing violence of common law adherents.” [Southern Poverty Law Center, 6/2001]

An anti-abortion activist addresses a meeting of the anti-government US Taxpayers Party, calling on churches to form their own militias. The Southern Poverty Law Center will note that the address shows “the increasing convergence of Patriot (see February 1992) and anti-abortion activists.” [Southern Poverty Law Center, 6/2001]
Carole Howe. [Source: Eye on Hate (.com)]Carole (or Carol) Howe, a former college student who became involved with a number of white supremacists and anti-government radicals at Elohim City, Oklahoma (see 1973 and After), allegedly gives federal agents repeated warnings about a bombing planned for Oklahoma City (see 8:35 a.m. - 9:02 a.m. April 19, 1995). Howe left Tulsa Metro Christian Academy after falling in with local “skinheads,” and became romantically involved with Dennis Mahon, a former Ku Klux Klan member, the leader of the White Aryan Resistance (WAR) organization, and the purveyor of Tulsa’s Dial-a-Racist telephone line. Mahon, 46, later says he became involved with Howe because she wrote him a letter in the spring of 1993 after calling his telephone line, claiming “she was 23, pure Aryan, considered beautiful, and wanted to fight for her race and culture. So, hey, I sent her some tapes.” Mahon will say that he considered Howe brilliantly intelligent and well-spoken, and wanted to make her a movement spokesperson: “I was going to get her on Oprah. Most of our women are not very intelligent. All they can say is ‘n_gger this’ and ‘n_gger that.’ She could have been our Aryan spokeswoman.” Mahon began taking her to Elohim City. The relationship had soured by the summer of 1994, and in August 1994, after filing a restraining order against Mahon, Howe was recruited as an informant for the Bureau of Alcohol, Tobacco, and Firearms (BATF). In a letter to her parents explaining her decision to work for the government, she says: “I don’t like America as she is today. But I don’t think she is past saving. And if there’s something I can do to help this country realize a glimmer of her potential greatness, then I must do it. These people intend to start a war here within the next few years. They have the power, means, and support to do it. This war would especially devastate America.” Between August 1994 and March 1995, Howe supplies the BATF with 38 audiotapes’ worth of surveillance. She tells her handler that Elohim City leader Robert Millar is spoiling for a new revolution, and repeatedly gives sermons preaching violence against the US government, particularly the BATF. He says that the group will expand its influence throughout the Midwest, and other militia groups will unite with the Elohim City forces to contend with the government. She is briefly deactivated after an apparent suicide attempt, but will be reactivated after the bombing, when she says the sketch of the “John Doe No. 2” suspect (see April 20, 1995) resembles one of the Elohom City residents, probably neo-Nazi Andreas Strassmeir. The day after the April 19, 1995 bombing, Howe will tell a reporter that she warned the BATF that Strassmeir and Michael Brescia (see 1992 - 1995) had “cased” the Murrah Building in Oklahoma City in preparation for the bombing (see November 1994). She will also claim to have told her handler, BATF agent Angela Finley, about the Elohim community’s preparations for a much larger assault, perhaps as a prelude to the long-anticipated “race war” they had so often predicted. Government sources will say Howe made no warnings until after the bombing, when she tells federal agents of Mahon’s and Strassmeir’s plans. After the bombing, her information will consist largely of reporting on the Elohim residents’ attempts to lock down their own alibis. Howe will say that she saw accused bomber Timothy McVeigh (see 8:35 a.m. - 9:02 a.m. April 19, 1995) at the compound, then withdraw that claim. Federal agents will consider her answers speculative and lacking in evidence, though reports by some BATF and FBI agents may contradict that assessment. Mahon will later say that Howe attempted to entrap others at the Elohim City compound into committing illegal acts, apparently alluding to his suspicion that she was an informant. In March 1995, the BATF releases Howe as an informant, saying she is erratic and unreliable, though some reports indicate that she may serve as an informant well into 1996. Following the Yemen Civil War, which Islamic militants help the north to win, the militants are allowed to settle in Yemen. Before the war, Osama bin Laden had provided several million dollars to Ali Mohsen al-Ahmar, a Yemeni general and a brother of Yemen’s President Ali Abdallah Saleh, to help settle Arab Afghan fighters in the country (see May 21-July 7, 1994). Yemeni Prime Minister Abd al-Karim al-Iryani will later say: “Yes, these jihadis have helped us during the secessionist war, and yes, we decided that they must be absorbed into the government system afterwards and not let loose to cause trouble.” This policy is devised by President Saleh, who becomes known for his “big tent” strategy of reaching out to Islamic militants. [New York Times, 11/26/2000] In 2000, Jane’s Intelligence Review will comment that “harboring terrorists has become something of a cottage industry in Yemen” and estimate the number of militants who fought in the Soviet-Afghan War present in the country may be as high as 2,000. Bin Laden, whose family is originally from Yemen, is also said to visit the county a number of times. The money he provides is used to set up small businesses, including safe houses and document forgery shops. Yemen becomes a base for al-Qaeda operations in Africa and counterterrorism expert Rohan Gunaratna will later write, “Only some 35 percent of Yemen is under the permanent influence and control of the government, so its state of lawlessness would have made it an ideal base for al-Qaeda.” [Jane's Intelligence Review, 7/1/1999; Gunaratna, 2003, pp. 186-7]
Two right-wing extremists, both members of the Minnesota Patriots Council, are arrested for making ricin, a deadly toxin. The two will later be convicted of attempting to poison federal agents. [Southern Poverty Law Center, 6/2001]
Linda Thompson, an attorney who styles herself as a “general” of the various US militias, calls for an armed march on Washington, DC. Other “Patriots” and anti-government organizations renounce her, labeling her call as foolhardy and suicidal. [Southern Poverty Law Center, 6/2001]
A number of “Patriot” and other anti-government, white supremacist, and separatist organizations hold a conference in Lakeland, Florida, called “Operation Freedom.” More than 1,500 people attend the conference, where they listen to speeches and share information about starting militias. [Southern Poverty Law Center, 6/2001]
Jennifer McVeigh, the sister of Oklahoma City bomber Timothy McVeigh (see 8:35 a.m. - 9:02 a.m. April 19, 1995), will later testify that during this time, her brother gives her a “wad” of cash and asks her to “launder” it for him. He claims the money comes from a bank robbery. She will also testify that her brother discusses plans to conduct political assassinations. Later investigations will show that by this time Timothy McVeigh may be involved with a self-described “terrorist group,” the Aryan Republican Army (see 1992 - 1995), which has staged numerous robberies and says its purpose is to conduct “terrorist acts against the United States.” [Nicole Nichols, 2003] McVeigh comes back to their Pendleton, New York, home in the days after their grandfather dies (see November 2-7, 1994), and stays for a month. He shows his sister a videotape about the Branch Davidian debacle (see April 19, 1993 and April 19, 1993 and After), and tells her he believes the FBI and the Bureau of Alcohol, Tobacco and Firearms (BATF) were responsible for the deaths at the Davidian compound. He also says he does not believe the government will ever hold anyone accountable for the deaths.
Letter to American Legion - McVeigh borrows his sister’s word processor and types up a “manifesto” of sorts, a letter written to the American Legion and addressed to “Constitutional Defenders.” The letter reads in part: “We members of the citizen’s militia do not bear our arms to overthrow the Constitution, but to overthrow those who PERVERT the Constitution and when they once again draw first blood (many believe the Waco incident (see April 19, 1993 and April 19, 1993 and After) was ‘first blood’). Many of our members are veterans who still hold true to their sworn oath to defend the Constitution against ALL enemies, foreign and DOMESTIC.” He quotes English philosopher John Locke on the right to slay the tyrant if the government leaders force the people into a state of war. He attacks the BATF as a “fascist federal group” that attacks and kills innocent civilians. Militia groups alone, he writes, can defend the American people “against power-hungry storm troopers” (see October 21 or 22, 1994). He cites the Branch Davidian tragedy, the Ruby Ridge incident (see August 31, 1992 and August 21-31, 1992), and the Gordon Kahl slaying (see March 13 - June 3, 1983) as examples of the government behaving as “fascist tyrants.” He says the US military is being used overseas to fight for democracy “while at home [it is] used to DESTROY it (in full violation of the Posse Comitatus Act), at places like Waco.” He concludes: “One last question that every American should ask themselves. Did not the British also keep track of the locations of munitions stored by the colonists, just as the ATF has admitted to doing? Why???… Does anyone even STUDY history anymore???”
'Now I'm in the Action Stage' - McVeigh’s sister, though in agreement with much of her brother’s beliefs, is alarmed by the letter, believing that her brother has gone far past where she is willing to go in her beliefs and his apparent willingness to act on those beliefs. McVeigh tells her: “I’m no longer in the propaganda stage. I’m no longer passing out papers. Now I’m in the action stage.”
Letter to BATF - McVeigh’s second letter, written to the BATF and labeled “ATF Read,” is even more alarming. It reads in part: “ATF, all you tyrannical motherf_ckers will swing in the wind one day for your treasonous actions against the Constitution and the United States. Remember the Nuremburg War Trials. But… but… but… I was only following orders.… Die, you spineless cowardice [sic] b_stards!” He prints the American Legion letter for mailing, but leaves the ATF letter in the computer, apparently for federal agents to find after he has launched his bombing attack. [New York Times, 5/6/1997; Serrano, 1998, pp. 114-115] Jennifer will write her own letter to her hometown newspaper warning of an impending government crackdown on its citizens’ liberties (see March 9, 1995), a letter which will echo many of her brother’s anti-government sentiments.
Terry Nichols, conspiring with Timothy McVeigh (see November 1991 - Summer 1992) to blow up a federal building in Oklahoma City (see September 13, 1994 and 8:35 a.m. - 9:02 a.m. April 19, 1995), calls his ex-wife Lana Padilla. Nichols is en route to his ex-wife’s home in Las Vegas; unbeknownst to Padilla, Nichols has just robbed a gun dealership (see November 5, 1994) and is preparing to leave much of the goods obtained from that robbery for her use if he fails to return from an imminent trip to the Philippines (see November 5, 1994 - Early January 1995). Padilla has sent Nichols a letter indicating her concerns about their son Joshua, 15. Instead of talking about Joshua, Padilla will later say, Nichols talks at length about the FBI raid on the Branch Davidian compound in Texas (see April 19, 1993 and April 19, 1993 and After) and of the possibility of civil unrest. Padilla will later describe their conversation as “very odd.” [New York Times, 11/20/1997]

Mohammed Loay Bayazid is arrested in Morgan Hills, California, together with Mohammed Jamal Khalifa (see December 16, 1994-May 1995), Osama bin Laden’s brother-in-law and a known terrorism financier, and Salem bin Laden, one of Osama’s brothers (see December 16, 1994). Bayazid was born in Syria but moved to the US with his parents as a teenager and became a US citizen. In the mid-1980s he went to fight in Afghanistan and befriended bin Laden. He was one of the original members of al-Qaeda and took the notes during the group’s founding meeting in 1988 (see August 11-20, 1988). Bayazid moved with bin Laden to Sudan in the early 1990s and has been called bin Laden’s main business adviser there. In 1993, it is believed he was involved in an al-Qaeda effort to purchase nuclear material. By 1994, Bayazid moved back to the US and became the president of the Chicago-based Benevolence International Foundation (BIF), a charity suspected of links to al-Qaeda. [Kansas City Star, 9/9/2006] The driver’s license he shows for identification when arrests gives the Chicago office of BIF as his residence. [USA v. Benevolence International Foundation and Enaam M. Arnaout, 4/29/2002, pp. 16-17 ] But surprisingly given Bayazid’s history, he is released not long after his arrest in California. Lorenzo Vidino, an expert on Islamic militants, will later investigate Bayazid but is never able to determine when he was released, why, or where he went after that. [Kansas City Star, 9/9/2006] There is evidence he stays in the US until April 1998, and then moves to Turkey. Bayazid will eventually reappear in Susan, where he will be interviewed by the FBI shortly after 9/11 (see November 2001). He apparently still operates several businesses there. He denies ever having any connection to terrorism. [Chicago Sun-Times, 5/1/2002; Kansas City Star, 9/9/2006]
